Democracy and Scandal: A Research Agenda

Abstract In a recent edition of this journal, Scott Brenton (2012) announced a refreshing perspective on the relationship between political scandal and liberal democratic institutions: though scandals are often thought anathema to democratic politics, a cause of public distraction or a sign of institutional degradation, their effect may actually be to reinforce and rejuvenate the polity. We consolidate and then challenge this perspective. We begin by reconstructing Brenton’s observations on scandal as a process model which we term the “scandal reform cycle”. We then suggest a raft of challenges to the model to reveal the complexity of scandals and their uncertain institutional effects. Our larger ambition is to articulate the relationship between scandal and democracy not as a simple question but rather as an ambitious and timely research agenda.

Abstract In my original article “Scandals as a Positive Feature of Liberal Democratic Politics: A Durkheimian perspective” (2012b), I argued that scandals are actually a positive feature of liberal democratic politics, and rather than representing a threat to political stability serve an important function. Scandals provide a “safety valve” for the expression of negativity towards political actors while reinforcing collective values and ultimately strengthening the system, consistent with Durkheim’s ideas. The response to this article certainly contains some thought-provoking examples, but they do not contradict my argument that scandal can only occur in liberal democracies due to the necessity of freedom of speech, an open and aggressive media and strong political competition.

This essay takes its bearings from an epistolary dialogue between Arthur de Gobineau and Alexis de Tocqueville about the contours of modern politics. Their dispute illuminates in a remarkable way the theological-political problem that suffuses the emergence of modern politics and, as a consequence, provides a helpful frame of reference for understanding several contemporary controversies bearing on the relationship between religion and liberal democratic politics. Moreover, their correspondence casts new light on the underpinnings of Tocqueville's thought. The frankness of this exchange together with the relentless character of Gobineau's arguments, provoke in Tocqueville an articulation of the larger context within which he understands modern politics and, in so doing, reveals an important, though largely neglected, intellectual framework that informs much of his published work.

The rule of law requires political office holders to exercise their powers in accordance with the law. Most societies, however, rely not only on the moral obligation to obey the law but also require office holders to take a religious oath or solemn affirmation. The divine witness to the oath of office stands in as a guarantor of the political order but also looms above it. As such, the oath represents a paradox. It guarantees the performance of official duties while also subjecting them to external judgement. The oath thus encompasses the large question of the relationship between religious conviction, personal fidelity, moral principle, and political power. It suggests that law and religion are as much intertwined as separated in today’s politics. By tracing the oath of office as a sacrament of power, much light can be shed on the relationship between law and religion in today’s liberal-democratic politics.

The article explores the political effects of popular consultations as a means of direct democracy in struggles over mining. Building on concepts from participatory and materialist democracy theory, it shows the transformative potentials of processes of direct democracy towards democratization and emancipation under, and beyond, capitalist and liberal democratic conditions. Empirically the analysis is based on a case study on the protests against the La Colosa gold mining project in Colombia. The analysis reveals that although processes of direct democracy in conflicts over mining cannot transform existing class inequalities and social power relations fundamentally, they can nevertheless alter elements thereof. These are for example the relationship between local and national governments, changes of the political agenda of mining and the opening of new spaces for political participation, where previously there were none. It is here where it’s emancipatory potential can be found.

Pragmatism and its consequences are central issues in American politics today, yet scholars rarely examine in detail the relationship between pragmatism and politics. This book systematically explores the subject and makes a strong case for adopting a pragmatist approach to democratic politics—and for giving priority to democracy in the process of selecting and reforming political institutions. What is the primary value of democracy? When should we make decisions democratically and when should we rely on markets? And when should we accept the decisions of unelected officials, such as judges or bureaucrats? This book explores how a commitment to pragmatism should affect our answers to such important questions. It concludes that democracy is a good way of determining how these kinds of decisions should be made—even if what the democratic process determines is that not all decisions should be made democratically. So, for example, the democratically elected U.S. Congress may legitimately remove monetary policy from democratic decision-making by putting it under the control of the Federal Reserve. This book argues that pragmatism offers an original and compelling justification of democracy in terms of the unique contributions democratic institutions can make to processes of institutional choice. This focus highlights the important role that democracy plays, not in achieving consensus or commonality, but rather in addressing conflicts. Indeed, the book suggest that democratic politics is perhaps best seen less as a way of reaching consensus or agreement than as a way of structuring the terms of persistent disagreement.

Since the very beginning, Confucianism has been troubled by a serious gap between its political ideals and the reality of societal circumstances. Contemporary Confucians must develop a viable method of governance that can retain the spirit of the Confucian ideal while tackling problems arising from nonideal modern situations. The best way to meet this challenge, this book argues, is to adopt liberal democratic institutions that are shaped by the Confucian conception of the good rather than the liberal conception of the right. The book examines and reconstructs both Confucian political thought and liberal democratic institutions, blending them to form a new Confucian political philosophy. The book decouples liberal democratic institutions from their popular liberal philosophical foundations in fundamental moral rights, such as popular sovereignty, political equality, and individual sovereignty. Instead, it grounds them on Confucian principles and redefines their roles and functions, thus mixing Confucianism with liberal democratic institutions in a way that strengthens both. The book then explores the implications of this new yet traditional political philosophy for fundamental issues in modern politics, including authority, democracy, human rights, civil liberties, and social justice. The book critically reconfigures the Confucian political philosophy of the classical period for the contemporary era.

Allegedly neutral institutions were shown to be implicitly biased toward the priorities, experiences, or interests of the dominant groups in the society. Criticism of difference-blind rules and claims for justice to minority groups defined the relationship between government and opposition in many contexts. Arguments for special rights to protect minorities, women, or ethnocultural groups gained legitimacy (Young 1990, Jones 1990, Phillips 1991, Taylor 1994, Kymlicka 1995, Kymlicka and Norman 2000).

Abstract This article reviews three books that offer thought-provoking insights on a central political science question, namely the relationship between capitalism and democracy in the twenty-first century. First, ‘Democracy and Prosperity’ by Iversen and Soskice posits a symbiotic relationship between capitalism and democracy. Advanced capital thrives on nationally rooted institutions, hence it needs democratic politics. A majority of voters ask for pro-advanced-capital reforms, hence democratic politics needs advanced capital. Second, ‘Capitalism, Alone’ by Milanovic depicts a troubled coexistence between capitalism and democracy. The former's tendency to concentrate economic and political power in the hands of the few is the main reason why democratic politics is under pressure. Third, ‘The Age of Surveillance Capitalism’ by Zuboff suggests a negative relationship between digital capitalism and democracy. Surveillance capitalism increasingly acts as a control means of individuals' behaviour, which undermines democracy at its roots. The last section brings the three contributions together. It maintains that a mutually beneficial coexistence between capitalism and democracy currently faces both internal (from within) and external (from without) challenges. In line with Milanovic and Zuboff, it argues that the concentration of economic and political power in the hands of the few is the most apparent from-within challenge. Drawing on Milanovic, it contends that rise of China as a global power combining capitalism with non-democracy challenges the relationship between capitalism and democracy from without. Finally, it contends that the environmental question and the pandemic represent two windows of opportunity for democracy to recover lost ground and re-establish a more balanced relationship with capitalism.

This paper subjects to critical analysis four common arguments in the sociopolitical theory literature supporting the cultural nationalist thesis that liberal democracy is viable only against the background of a single national public culture: the arguments that (1) social integration in a liberal democracy requires shared norms and beliefs (Schnapper); (2) the levels of trust that democratic politics requires can be attained only among conationals (Miller); (3) democratic deliberation requires communicational transparency, possible in turn only within a shared national public culture (Miller, Barry); and (4) the economic viability of specifically industrialized liberal democracies requires a single national culture (Gellner). I argue that all four arguments fail: At best, a shared cultural nation may reduce some of the costs liberal democratic societies must incur; at worst, cultural nationalist policies ironically undermine social integration. The failure of these cultural nationalist arguments clears the way for a normative theory of liberal democracy in multinational and postnational contexts.

What kinds of issues does the global crisis of climate change present to aesthetics, and how will they challenge the field to respond? This paper argues that a new research agenda is needed for aesthetics with respect to global climate change (GCC) and outlines a set of foundational issues which are especially pressing: (1) attention to environments that have been neglected by philosophers, for example, the cryosphere and aerosphere; (2) negative aesthetics of environment, in order to grasp aesthetic experiences, meanings, and dis/values in light of the catastrophic effects of GCC; (3) bringing intergenerational thinking into aesthetics through concepts of temporality and ‘future aesthetics’ (4) understanding the relationship between aesthetic and ethical values as they arise in regard to GCC.
