The new urban agenda and human rights cities: Interconnections between the global and the local

As the level of governance closest to the city dwellers, local authorities have been called to play a protagonist role as implementers of global standards on human rights and sustainable development. The New Urban Agenda, a political declaration signed by all UN Member States, sets a human rights-based approach to policy-making and service delivery as a path towards inclusive and sustainable urban development. Remarkably, the document acknowledges that local authorities are responsible for protecting, respecting, fulfilling, and promoting the human rights of the inhabitants. However, gaps between the aspiring language of international commitments and their concrete impact on the ground have limited its potential to transform people’s lives. Nevertheless, all over the world human rights cities have pro-actively set the implementation of human rights as a core task in the municipality. By establishing practical links and synergies between human rights cities and the NUA, this paper suggests ways of filling implementation gaps, drawing a promising scenario for the realisation of both global and local agendas.

Upaya untuk membawa nilai-nilai Hak Asasi Manusia (HAM) ke tingkat lokal sudah mencuat sejak 1990-an, melalui berbagai konsep, salah satunya human rights in the city. Konsep tersebut menantang pendekatan HAM yang selama ini hanya terpusat pada negara, sehingga membuka ruang bagi ide bahwa implementasi nilai-nilai HAM harus ditangani oleh berbagai tingkatan pemerintahan, bukan lagi terbatas pada pemerintah pusat. Dalam konteks Indonesia, upaya melokalkan nilai-nilai HAM telah dilakukan melalui berbagai kebijakan hak asasi manusia. Kebijakan tersebut antara lain penghargaan kabupaten/kota peduli HAM yang diselenggarakan oleh Kementerian Hukum dan Hak Asasi Manusia, dan proyek Kota HAM Bandung. Kajian ini menggunakan pendekatan kualitatif yang berbasis pada studi kasus, analisis dilakukan dengan menerapkan konsep pendekatan hak asasi manusia (human rights-based approach) dalam kebijakan hak asasi manusia. Dalam perspektif pelokalan hak asasi manusia, kebijakan HAM di Kota Bandung menunjukkan beberapa indikasi. Pertama, kebijakan Deklarasi HAM Bandung sebagai suatu kebijakan berbasis hak asasi manusia yang bersifat bottom-up masih belum mampu mendukung upaya pelokalan HAM di kota Bandung. Kedua, kebijakan Penghargaan Kabupaten/Kota Peduli HAM sebagai suatu kebijakan yang bersifat top-down, meskipun mendapatkan respons positif dari pemerintah kota dan instansi vertikal sebagai bagian dari pelaksana kebijakan, tidak mendapatkan legitimasi yang cukup dari masyarakat kota Bandung.

ResumoOs avanços em torno do Direito à Cidade no Brasil, mesmo após o advento da Nova Agenda Urbana, resultante da conferência Habitat III, se encontram ameaçados por propostas legislativas que visam retirar o condicionamento do direito de propriedade ao cumprimento da função social. Analisou-se, primeiramente, a consolidação do direito à cidade enquanto norteador a política urbana nacional, a partir da Constituição Federal de 1988, bem como a ameaça de esvaziamento de seu conteúdo, cristalizada na Proposta de Emenda Constitucional nº 80/2019. Utilizou-se o método de abordagem dedutivo, utilizando técnica de pesquisa bibliográfica, legislativa e procedimento monográfico, centrando-se na premissa da incompatibilidade da proposta em análise com o conteúdo constitucional referente à política urbana. Concluiu-se que a proposta tem grande carga de retrocesso ao desenvolvimento da política urbana, além de incompatibilidade constitucional pelo esvaziamento da função social da propriedade, bem como se encontra em oposição aos objetivos dispostos na Nova Agenda Urbana, compromisso internacional para o desenvolvimento urbano sustentável da qual o Brasil é parte.Palavras-Chave: Direito à cidade; Espaço local; Função social da propriedade; Nova Agenda Urbana; Política fundiária. AbstractThe advances in the Right to the City in Brazil, even after the advent of the New Urban Agenda, resulting from the Habitat III conference, are threatened by legislative proposals that aim at removing the conditioning of property rights to fulfill social functions. Firstly, it was analized the consolidation of the right to the city as a guideline for national urban policy, starting with the Federal Constitution of 1988, was analyzed, as well as the threat of emptying its content, crystallized in the Proposed Constitutional Amendment nº 80/2019. The deductive approach method was used, using bibliographic and legislative research technique and monographic procedure, focusing on the premise of the incompatibility of the proposal under analysis with the constitutional content referring to urban policy. It was concluded that the proposal has a major setback for the development of urban policy, in addition to constitutional incompatibility due to the emptying of the social function of property, as well as being in opposition to the objectives set out in the New Urban Agenda, an international commitment to sustainable urban development of which Brazil is a part.Keywords: Social function of property; Land policy; Local space; New Urban Agenda; Right to the city.

Based on the concept of a livable and global age-friendly city, pavements are a public facility that the city should provide to the people. Appropriate pavements will be beneficial for the people, particularly for good quality of life for the elderly to move around in the city. This study explored the behaviour of the elderly in the use of pavements and the problems confronted. The study also evaluated the value of the pavement walking area as it reflected the benefits of pavements to the elderly by applying the Contingent Valuation Method (CVM). During March-May 2017, data were collected using interviews with 601 elderly living in Bangkok. The study indicated that the main problem for senior citizens regarding their use of pavements was from being disturbed by motorbikes riding on the pavements. The average value of pavement for the elderly was about THB 160 (USD 5.30) per person per year. Thus, the benefits of pavements to the elderly in Bangkok was approximately THB 158 million (USD 5.2 million) per year. Thus, policy makers should make proper budget allocations for elderly-friendly pavement management and seriously address the problems confronting the elderly in using pavements, to maximize the usefulness of pavements not only for the elderly but also for the public and to support a sustainable urban development.

AbstractThe paper analyzes the transformation of identity politics of Kharkiv local authorities after the Euromaidan, or Revolution of Dignity, the annexation of Crimea, and the War in Donbass. Being the second largest city in Ukraine and becoming the frontline city in 2014, Kharkiv is an interesting case for research on how former pro-Russian local elites treat new policies of the central government in Kyiv, on whether earlier they tried to mobilize their electorate or to provoke political opponents with using soviet symbols, soviet memory, and copying Russian initiatives in the sphere of identity.To answer the research question of this article, an analysis of Kharkiv city and oblast programs and strategies and of communal media were made. Decommunisation, as one of the most important identity projects of Ukrainian central authorities after 2014, was analyzed through publications in Kharkiv’s city-owned media as well as reports from other scholars. Some conclusions are made from the analysis of these documents: Kharkiv development strategy until 2020, Complex program of cultural development in Kharkiv in 2011–2016 (and the same for 2017–2021), The regional program of military and patriotic training and participation of people in measures of defense work in 2015–2017, Program of supporting civil society in 2016–2020 in Kharkiv region and the city mayor’s orders about the celebration of Victory Day (9 May), the Day of the National Flag (23 August), the Day of the City (23 August) and Independence Day (24 August) in 2010–2015.

Rapidly changing framework conditions for city development such as globalization, demographic trends, deindustrialization, technological developments or the increasing urbanization as well as the economic, social and political changes are profound and change our urban life. This leads, that the cities of tomorrow will differ essentially from today´s city principles. Therefore innovative, strategically wise and quick action becomes a criterion for success. Here, more than ever, local conditions and requirements must be taken into account as well as global framework conditions. The responsible parties have to set the course so that the “City” remains competitive and sustainable in the future. Therefore, innovation processes and sustainable strategies for dealing with the diverse and complex agendas of a city in dialogue with those who are responsible for it must be initiated and management systems established so that new things can develop continuously and systematically. This work illustrates how the boundaries created to manage and market future liveable and sustainable city destinations are the root of the practical and academic problems that trouble city management these days.  This paper aims to develop the new integrated Smart Urban Profiling and Management model, which presents a new integrated approach for city marketing as an instrument of sustainable urban development. In this way, comprehensive research was conducted to evaluate if the holistic city marketing concept that integrates elements of smart city strategies and adaptive management is a more suitable instrument and integrative process than conventional city marketing in order to improve the sustainable urban development. Therefore, in this work, the designed “Smart Urban Profiling and Management model” for city management introduces an alternative and holistic perspective that allows transcending past boundaries and thus getting closer to the real complexities of managing city development in dynamic systems. The results offer the opportunity to recognize the city and consequently allow to developing successful strategies and implementation measures. This study targets to contribute to this endeavor in order to produce new impulses and incitements in the city management field and shall provide a fresh impetus for a new understanding of city marketing as the initiator of development processes, mobilization and moderator in concerning communication and participation processes. This paper is written from a perspective addressing those responsible for the city- management, city- & urban marketing and development.
