This chapter examines copyright issues from copying and distributing information from the internet. It considers the discussion focuses on how the internet has challenged the application and development of copyright law, considering web-copyright concerns such as linking, caching, and aggregating, citing Google Inc. v Copiepresse SCRL. It spends considerable time discussing the operation of the temporary eproduction right though key cases Infopaq International, and Public Relations Consultants Association v Newspaper Licensing Agency. The analysis then moves on to examine the communication to the public right created by the Copyright and Related Rights in the Information Society Directive, examining the application of the right through key cases such as Nils Svensson v Retriever Sverige, GS Media v Sanoma Media, and Stichting Brein v Ziggo BV.

The development and diffusion of inexpensive, reliable and easy to use public Internet access means that large portions of the U.S. and global populations now regularly communicate with one another. Will the increasing penetration of the Internet into the social and political lives of people facilitate Thomas Jefferson's vision of a world “founded on the primacy of individual liberty and a commitment to pluralism, diversity, and Community”? While many people believe that the answer to this question is “yes”, such affirmations often rest on adducing cases not theoretically linked to one another. In contrast, the present paper provides a broadly philosophical, conceptual analysis of how use of the Internet can lead to forms of “social tyranny” in which one or more elements of a community impose their own beliefs and interests on others in that community. For instance, dependence on Internet access and use for social action or pertinent information about social activities may lead to marginalization and exclusion for people whose Internet access or use is limited. Furthermore, the connectedness or mode of connectedness of groups or organizations may give them an unfair advantage disseminating and advocating the messages they deliver to members of the communities in which they exist. The conclusion is not that we should adopt attitudes and policies that are antithetical to the use of the Internet. Rather, using ideas from Dewey and Habermas, amongst others, the conclusion is that it is important to reflect broadly and critically on how use of the Internet can transform the character of the public domain and the deliberations about governance that occur within that domain.

The internet and social media expand public space has been much associated with public space and digital networks in many studies, where Habermas's public space theory and the theory of the Castells network society have been much debated about its relevance to the techno-social development. Both Habermas and Castells tend to see the public space of the Internet as a contestation space where corporate and state forces work in various ways to control and dominate it. This study emphasizes more on the creativity of citizens forming community networks through the use of the Internet and social media and conducting autonomous conversations in the public space. Netnographic studies of the dynamics of the discourse of public space in the social movement networked Indonesia Berkebun show that the Internet and social media become creative means for citizens to package global discourse locally to voice their demands. This study concludes that the concepts and theories of public space, network society are relevant as tools for analyzing public space and Internet networks and social media. The potential of the Internet network and social media as autonomous communication spaces depends on the design and purpose and the utilization of available features. Conversations - conversations that are restricted to the agenda of the 3E program help communities focus on discourse and shape the character of a rational Indonesian gardening space. This community from the beginning realized the potential of the Internet and social media to form networks and public spaces. But like gardening, public space requires commitment, such as caring for the garden from pest attacks, weeds, giving it fertilizer so the plants grow as expected.

Media critics of the war in Afghanistan and Prince Harry’s participation in it hoped that his imagined kidnapping by the Taliban portrayed in the British TV mockumentary The Taking of Prince Harry (2010) would prevent his return to Afghanistan. Prince Harry’s first deployment to Afghanistan in 2007-2008 was conducted under a media blackout to protect him from potential Taliban threats. He returned home after news of his service leaked out on the internet. However, his second deployment to Afghanistan after the mockumentary aired was radically different. The British media was now given almost unlimited access to Captain Wales in terms of interviews, television coverage, and video postings on YouTube. Prince Harry’s second 20 weeks serving in Afghanistan from 2012 to 2013 became an effective reality TV show and viral internet sensation, culminating in the propaganda documentary exercise of Prince Harry: Frontline Afghanistan (2013) that the British government and military hoped would erase the public relations disaster associated with his first deployment that prompted the making of The Taking of Prince Harry. But the successful packaging of Prince Harry proved difficult in the Internet Age. In fact, the perceived unfair treatment of Harry by the media prompted such a strong reaction in him that it can be seen as instrumental in the current attempts by Harry and Meghan to establish new identities separate from the monarchy through a newly refashioned celebrity.
