Along with the process of transition into information society, fundamental changes in the field of public administration have come to the fore. This new concept of understanding emerges from the viewpoint of the New Public Administration which stems from the standpoint of the individual state with comparison to the classical public administration. The change in the position given to the individual by the concept of public administration led to the change in public institutions at the same time. In this model, called the New Public Management, public institutions have been managed in accordance with the provisions of the social state, on the one hand have been managed similar to private enterprises in terms of performance. It has been a reflection of this change on Administrative Law such as on public administration and public institutions. Today there is not enough study on the new public administration which is evaluated in terms of administrative law. For this reason, in this study, administrative law is included in the comparison of the new public management model and the classical public administration approaches. In this study, a literature is reviewed and related resources were searched and conceptual analysis of New Public Management in the theoretical sense was made and a compared with the public administration approaches. According to the results of the study, the model of new public management is the most useful model for the information society and the globalized public sphere. On the other hand, the administrative law which is developed on the basis of classical public administration approach cannot give effective and satisfactory answers to the emerging new public administration and management structure. For this reason, it is suggested that the new public management should be reshaped in accordance with the dynamically evolving and publicly structured interest. ÖzetBilgi toplumuna geçiş süreci ile birlikte, kamu yönetimi alanında da köklü değişiklikler meydana gelmiştir. Ortaya çıkan bu yeni anlayışın adı Yeni Kamu Yönetimi anlayışı olup, klasik kamu yönetimi anlayışına göre bireyi devletten önceleyen bir bakış açısına sahiptir. Kamu yönetimi anlayışının bireye verdiği konumun zaman içinde değişmesi, aynı zamanda kamu kurumlarının da değişikliğini elzem kılmıştır. Yeni Kamu İşletmeciliği adı verilen modelde, kamu kurumları bir yandan sosyal devlet anlayışına uygun yönetilirken, diğer yandan performans açısından özel işletmelere benzer bir yönetime sahip olmuştur. İdare hukukunda da, kamu yönetiminde ve kamu kurumlarında meydana gelen bu değişimin yansımaları kaçınılmazdır. Günümüzde yeni kamu işletmeciliğinin idare hukuku açısından değerlendirildiği yeterince çalışma bulunmamaktadır. Bu nedenle bu araştırmada idare hukukunda yeni kamu işletmeciliği modeli ve klasik kamu yönetimi yaklaşımlarının kıyaslanmasına yer verilmiştir. Bu çalışmada literatür tarama modelinden yararlanılmış ve ilgili kaynaklar taranarak teorik anlamda Yeni Kamu İşletmeciliği’nin kavramsal analizi yapılmış, yeni kamu işletmeciliği ile kamu yönetimi yaklaşımları arasında bir karşılaştırma gerçekleştirilmiştir. Çalışmanın sonuçlarına göre yeni kamu işletmeciliği modeli, bilgi toplumu ve küresel kamuya en uygun olan modeldir. Öte yandan klasik kamu yönetimi yaklaşımına dayalı olarak geliştirilen idare hukuku, ortaya çıkan bu yeni kamu yönetimi ve işletmeciliği yapısına yeterince etkili ve tatmin edici cevaplar verememektedir. Bu nedenle yeni kamu işletmeciliğinin dinamik sürekli gelişen ve kamuya göre şekillenen, kamu yararına ön plana alan yapısına uygun olarak yeniden şekillenmesi gerektiği ileri sürülmektedir.

This article examines China’s government reforms over the past 40 years from an instrumental–structural and a cultural–value perspective with the aim of exploring the supposed shift from New Public Management (NPM) to post-NPM. It finds that some aspects of the Old Public Administration (OPA) have been combined with NPM and post-NPM features in a layering process, resulting in new hybrid organizational forms and value orientations. In particular, the analysis shows that China’s post-NPM-oriented reforms have focused on positive coordination in the sense of super-ministries and networks on the one hand and value-based governance with a service orientation on the other hand.

Purpose. The aim of the article is consideration of the conceptual foundations of the use of public management tools in modern conditions from the standpoint of strengthening the institutional capacity of government institutions to perform functional activities. Methodology of research. The following general scientific methods are used in the research process: system, structural analysis, grouping ‒ in the study of structural elements of public administration and public management; historical analysis ‒ when considering the scientific foundations of public management; comparative analysis of scientific schools, concepts and models of public management ‒ when choosing basic scientific concepts for the use of levers of public management. Findings. The essential determinants of public management are analysed, the objective necessity of its use in modern practice of public administration is verified. It is substantiated that the effectiveness of state transformations depends on the innovation and modernization of public administration tools. The need to study the best practices and models of public management is established in order to create a conceptual model of new public management for public institutions of the national economy. Originality. The major contradictions in the system of public management and the mechanisms of their solution are systematized. Conceptual approaches to the use of public management in the activities of public institutions as an effective functional innovative tool of public administration are substantiated. Practical value. The results of the study can be the basis for further research on improving approaches to public administration and to create an effective organizational and functional mechanism of public management. AbstractObjective: The implementation of mechanisms stimulating marketization of the public sector is an elementary assumption of a modern public management system. The main goals of these processes are to increase efficiency, reduce bureaucracy, create a platform for cooperation between public and private entities, and extend decentralization. The set of rules practiced in modern local governments increasingly resembles a private enterprise managed by efficient managers. The traditional approach, which was only the administration process itself, is being replaced by a focus on economy, efficiency, quality, and effectiveness.Methodology: The material was created based on the qualitative method in the form of secondary analysis of literature data. At the same time, it provides the theoretical background for conducted empirical research on changing the management system in public administration. The effect of further research explorations will be another material presented in the form of a research reportValue Added: The New Public Management (NPM) concept is based on changing the orientation of management of public organizations consisting in ceasing to apply the approach focusing only on procedures and rules of conduct related to expenditure, and implementing rules based on the analysis of the results related to expenditure incurred, adopting strategic orientation and introducing market mechanism for the process of providing public services (Zalewski, 2006, p. 74). The purpose of the article is to describe the New Public Management model, the implementation of which helps public institutions to respond to challenges posed by external and internal stakeholders.Findings: The article presents the thesis that changes in public administration require the transformation of a management system characterized by entrepreneurship, the use of different business-oriented strategies for implementing effective actions.Recommendations: The idea of New Public Management is to replace the bureaucratic administrative management model and to introduce a managerial model, i.e. the application in the public sector of the principles and solutions of management systems known and used in the business sector (Alford & Huges, 2008, pp. 130–148). This is caused by the increase in citizens’ expectations regarding the increase in the quality of service provision, while at the same time unwilling to raise taxes. To achieve this goal, NPM has introduced certain assumptions to help in effective management (Templatka, n.d.).

Šiems tikslams pasiekti gana detaliai nagrinėjama Konstitucinio Teismo suformuluota konstitucinės valstybės tarnybos sampratos jurisprudencija. Vienas iš pagrindinių straipsnio tikslų – konstituciškai įvertinti 2010 metais Vyriausybės parengtą Valstybės tarnybos tobulinimo koncepciją ir įstatymų leidėjui pateikti su jos įgy­vendinimu susijusius konkrečius pasiūlymus. Lithuanian system of public administration and civil service is analysed in the article, using constitu­tional law as a tool of its legal evaluation. Some characters of two main models of public administration (the one of Max Weber and so called “New public management”) are presented and juxtaposed in or­der to understand the existing Lithuanian model. Analysis of jurisprudence of Lithuanian Constitutional Court concerning the Lithuanian civil service plays major role in assessing the constitutionality of Lithu­anian civil service improvement guidelines, developed and announced by the Lithuanian government in the beginning of 2010.

During the past ten years most cantonal forest services have undergone re-organisations. Lucerne's cantonal forest administration initiated a fundamentally new way of providing forestry services by differentiating between sovereign tasks and management tasks. By examining the individual steps of the process we demonstrate how starting with the mandate,goals were developed and implemented over several years. Product managers assumed responsibility for products, as defined in the New Public Management Project, on a cantonal-wide basis. Work within a matrix organisation has led to significant changes. Territorial responsibilities are increasingly assumed by district foresters, who have modern infrastructures at their disposal in the new forestry centres. The re-organisation has led to forest districts being re-drawn and to a reduction in the number of forest regions. To provide greater efficiency,state forest management has been consolidated into a single management unit. The new forest reserve plan removes almost half of the state forest from regular forest management,resulting in a reduction in the volume of work and in the work force. We show how effective the differentiation of sovereignty tasks and management tasks has been in coping with the effects of hurricane Lothar.

Abstract Recently, scholars have claimed that public management theory has too much ignored law. Consequently, the under-legalized conception of public management has produced a flawed understanding of public management theory as well as public management practices, threatening public institutions’ legitimacy. In this article, we argue that law never left public management theory. Rather, the link between government and law has been redefined twice. We refer to the assumptions that constitute this link as the law-government nexus. This nexus changed from lawfulness in a public administration paradigm, to legal instrumentalism in a (new) public management paradigm, and to a networked concept in the public governance (PG) paradigm. In order to prevent a faulty over-legalized conception of public management, bringing the law back in should be built on lessons from the past. This article elaborates on three strategies to reconnect law and public management. We map the strengths and weaknesses of each law-government nexus and illustrate these with the case of the Dutch tax agency. In our strategies that aim to reconceptualize the current law-government nexus, we incorporate the benefits of each paradigm for public management theory. The revised law-governance nexus enables the PG paradigm to correspond to contemporary issues without encountering old pathologies.

In keeping with the New Public Management dispensation, state corporations in Kenya have taken up strategic planning with a view to effect reforms for improved service delivery. New Public Management particularly advances a customer-centric approach to public administration for improved service delivery, with the public, who are the recipients of public service, as key stakeholders in public administration. Despite this, service delivery in the Agribusiness sub-sector in the country is riddled with inadequacies highlighted by among other complaints, unpaid produce supplies, dwindling finances, slumped agricultural extension services and low produce prices. Against this backdrop, the study set out to establish the effect of strategic planning on service delivery and assess how stakeholder involvement influences the relationship between strategic planning and service delivery among agribusiness state corporations in Kenya. Grounded on the New Public Management and Stakeholder theories, the study adopted the positivism paradigm and the descriptive cross-sectional research design. Targeting 73 state corporations pertinent to agribusiness in the country, primary data was collected by use of a structured questionnaire with institutional heads as the units of observation. Both descriptive and inferential statistics were then employed in data analysis. It was established that strategic planning has a significant positive influence on service delivery. Stakeholder involvement was however found to not have a significant moderating effect on the relationship between strategic planning and service delivery. This was attributed to the technocratic approach in the formulation of the strategic plans among state corporations and the numerically limited nature of most stakeholders in state corporations represented in the boards of directors. Following a significant direct effect of stakeholder involvement on service delivery among Agribusiness state corporations in the country, state corporations are implored to involve stakeholders in strategic planning and observe meaningful participation, communication and dispute resolution in the engagement.

Purpose The purpose of this paper is to reflect various pathways for public sector accounting and accountability research in a post-new public management (NPM) context. Design/methodology/approach The paper first discusses the relationship between NPM and public sector accounting research. It then explores the possible stimuli that inter-disciplinary accounting scholars may derive from recent public administration studies, public policy and societal trends, highlighting possible ways to extend public sector accounting research and strengthen dialogue with other disciplines. Findings NPM may have represented a golden age, but also a “golden cage,” for the development of public sector accounting research. The paper reflects possible ways out of this golden cage, discussing future avenues for public sector accounting research. In doing so, it highlights the opportunities offered by re-considering the “public” side of accounting research and shifting the attention from the public sector, seen as a context for public sector accounting research, to publicness, as a concept central to such research. Originality/value The paper calls for stronger engagement with contemporary developments in public administration and policy. This could be achieved by looking at how public sector accounting accounts for, but also impacts on, issues of wider societal relevance, such as co-production and hybridization of public services, austerity, crises and wicked problems, the creation and maintenance of public value and democratic participation.
