Digital technologies enable us to visualize dance in new ways and to capture recordings of dance which may be preserved and handed down to future generations. In this way, dance starts to become part of our intangible cultural heritage. But capturing dance also raises questions of authorship and ownership of copyright in both the dance and the recording of the dance. Challenges arising at the intersections between the legal frameworks of intangible cultural heritage and copyright have surfaced in an EU-funded project, Europeana Space. This contribution describes the E-Space project and the place of dance within it, and it introduces work being done at the Centre for Dance Research at Coventry University on dance and examines the intersections between copyright law and the international legal frameworks applicable to safeguarding intangible cultural heritage.

Nowadays, cultural heritage is more than ever linked to the present. It links us to our cultural past through the conscious act of preserving and bequeathing to future generations, turning society into its custodian. The appreciation of cultural heritage happens not only because of its communicative power, but also because of its economic power, through sustainable development and the promotion of creative industries. This paper presents SILKNOW, an EU-H2002 funded project and its application to cultural heritage, as well as to creative industries and design innovation. To this end, it presents the use of image recognition tools applied to cultural heritage, through the interoperability of data in the open-access registers of silk museums and its presentation, analysis and creative process carried out by the design students of EASD Valencia as a case study, in the branches of jewellery and fashion project, inspired by the heritage of silk.

By preserving and providing accessibility to cultural heritage, archives and museums have a crucial role in civil society. "Culture" is not a static concept; ideally, the practices of contemporary archives and museums should adapt to meet the changed expectations and cultural values of society. However, the limited permitted exceptions for archives in the Copyright Act 1994 are an obstacle to archives and museums attaining this goal. For example, the provisions are drafted from a traditional, analogue perspective, albeit with more recent minor changes in an attempt to acknowledge digital technologies. Furthermore, the permitted exceptions are confined to not-for-profit and state archives– a somewhat contentious limit in the 21st century when the Internet promises the means for cultural democracy. Museums are not mentioned at all. In addition, there is no legislative process permitting uses of orphan copyright works. This article explains how the permitted exceptions for archives could be amended in the upcoming review of the Copyright Act to better acknowledge and support cultural heritage institutions. It examines recent amendments in the Copyright, Designs and Patents Act 1988 (UK) and suggests that while some of these amendments would be useful for New Zealand to emulate, additional changes should also be considered.

Abstract Traditional Cultural Expressions (TCE) is all the intangible cultural heritage, developed by local communities, collectively or individually in a non-systemic manner and that are inserted in the cultural and spiritual traditions of the communities. The catagories of TK and TCE ... “expressions of folklore in the form of  tekstual fonetic or verbal, music, dances, theater, fine art, ritual ceremony”. The legal framework of TCE in Indonesia that can be implemented as contained in the 1945 Constitution of the Republic of Indonesia (Fourth Amendment) Article 32 (1), Article 38 and 39 on Copyright Law Number 28 Year 2014 on Copyright, Law Number 5 Year 2017 on Futherance Culture, Presidential Regulation No.78 Year 2007 on the Convention on Protection of Intangible Cultural Heritage), Permendikbud N0.106 of 2013 on Intangible Cultural Heritage of Indonesia. Further provisions by the state are required to immediately ratify the Traditional Knowledge Bill and EBT into a separate law in Indonesia  Defensive protection TCEin Blora community is urgent to be protected as a whole so as not to be abused by others. The process of recording, stipulating, proposing to the Indonesian Conservation Heritage Agency on ICH Unesco's list is the final process of digital documentation in the database of intangible cultural heritage as official data of the state which has a positive impact on the welfare of its supporting community. This research indicates that there are only 16 cultural works for the community in Blora Regency that have been designated as Indonesian Culture Heritage / Intangible Cultural Heritage in accordance with UNESCO Convention Year 2003. While there are still many cultural works that need to be prioritized for immediate recording for next year. Kategori warisan budaya tak benda meliputi tradisi lisan, seni pertunjukkan, praktek-praktek sosial, ritual, perayaan-perayaan, pengetahuan dan praktek mengenai alam dan semesta atau pengetahuan dan ketrampilan untuk menghasilkan kerajinan tradisional. Kerangka hukum EBT di Indonesia  yang dapat diimplementasikn sebagaimana terdapat  dalam UUD RI Tahun 1945 (Amandemen ke empat) Pasal 32(1), Pasal 38 dan 39 tentang Undang-undang Hak Cipta Nomor 28 Tahun 2014 tentang Hak Cipta, Undang-Undang Nomor 5 Tahun 2017 tentang Undang- Undang Pemajuan Kebudayaan yang lahir dalam rangka melindungi, memanfaatkan dan mengembangkan kebudayaan Indonesia, Perpres RI No.78 Tahun 2007 tentang Konvensi Perlindungan Warisan Budaya Takbenda), Permendikbud N0.106 Tahun 2013 tentang Warisan Budaya Takbenda Indonesia. Diperlukan ketentuan lebih lanjut oleh negara untuk segera mengesahkan RUU Pengetahuan Tradisional dan EBT menjadi Undang-Undang tersendiri di Indonesia.Perlindungan defensif EBT di masyarakat Kabupaten Blora sangat mendesak untuk dilindungi secara keseluruhan agar tidak disalahgunakan oleh pihak lain. Proses pencatatan, penetapan,  pengusulanke Badan Warisan Budaya Takbenda Indonesia dalam  daftar ICH Unesco merupakanproses akhir dokumentasi secara digital dalam database warisan budaya takbenda  sebagai data resmi negara yang memberikan dampak positif bagi kesejahteraan masyarakat pendukungnya.Penelitian ini menunjukkan bahwa baru ada 16 karya budaya bagi masyarakat di Kabupaten  Blora yang telah ditetapkan sebagai Warisan Budaya Tak Benda Indonesia/Intangible Cultural Heritagesesuai Konvensi UNESCO Tahun 2003.Sementara masih banyak karya-karya budaya yang perlu diprioritaskan untuk segera dilakukan pencatatan untuk tahun-tahun mendatang.(Barong, motif batik dll). Kata Kunci: Perlindungan Defensif, Ekspresi Budaya Tradisional (EBT), Penyalahgunaan,  Dokumen Digital.

AbstractThis article explores the interplay between climate change and cultural heritage, in particular the intangible aspects of cultural heritage, in international legal frameworks, either existing or under development. The prime focus of the current climate change regime of the United Nations Framework Convention on Climate Change (UNFCCC) is the reduction of greenhouse gas emissions, leaving certain aspects of cultural heritage rather on the sidelines of debate and policy. However, where climate change combines with generally weak law and policy for culture and traditions, countries vulnerable to climate change may face significant cultural loss in the years to come.In its inventory of present and contemplated legal protection options, this article draws particular attention to policymaking directed at shaping a “rights-based” system in the form of sui generis rights, to complement any existing intellectual property-based protection. If adequately motivated, indigenous people have a key role to play not only in observing change, but also in developing adaptive models to cope.

Copyright law is the primary means by which society preserves and protects valued cultural heritage. There is a clear correlation between that which is protected and that which is valued by society for the continued enjoyment of future generations. However, this truth becomes troubling when it is considered that modern copyright continues to espouse antiquated ideals of acceptable cultural production, to the exclusion of the cultural property of many historically marginalized people groups. This article takes a critical look at copyright law to deconstruct the ways in which historical values and assumptions continue to color the modern protection of cultural creation, thereby confining cultural expression and barring protection to the cultural work of the marginalized.

This article considers the relationship between Intangible Cultural Heritage (ICH) and the market in the backdrop of the reorientation of UNESCO’s priorities regarding sustainable development. Based on ethnographic observations of the meetings of the governing bodies of the Convention for the safeguarding of intangible cultural heritage, this work analyses the controversies generated by “risks of over-commercialization” of ICH among actors with normative agency for designing “good” heritage governance. While the need to reconcile market and heritage is officially acknowledged, the inclusion of a particular commercial practice on the UNESCO ICH lists is qualified by many actors as “traumatic”. The debate spurred within the governing bodies of the Convention by the drafting of these documents sheds light on the controversial perception of the relationship between the market and ICH. In considering the idea of “commercialization without over-commercialization” suggested by actors to resolve the tension between heritage and market, this work highlights a constitutive ambiguity of the Convention. Based on the ideas of “misappropriation” and “decontextualization”, this concept is part of the logic of intellectual property. The Convention, however, was explicitly designed within an alternative paradigm emphasizing cultural dynamisms and shared belonging. While heritage entrepreneurs on the ground shift from one regime to the other making a pragmatic and strategic use of legal frameworks based on fundamentally different logics, this inconsistency generates normative conundrums among the actors involved with the official bodies of the Convention, torn between a proprietary and a heritage regime and their different moral economies. In the framework of the Convention, the principle of “commercialization without over-commercialization” embodies therefore a fragile compromise reflecting the tension between different regimes regulating traditional culture.

AbstractConservation of cultural heritage is nowadays a very important aspect of our lives. Thanks to such legacy we gain knowledge about our ancestors, methods of production and ways of their life. The rapid development of 3D technology allows for more and more faithful reflection of this area of life. The rich cultural heritage, both tangible and intangible, can be preserved for future generations due to the use of advanced 3d technologies. They provide the means of documenting, recovering and presenting items of cultural heritage. Not only buildings or monuments are taken into account. An important aspect of our culture is intangible cultural heritage (ICH), including acting, crafting or storytelling, passed down from generation to generation. Due to the rapid development of civilisation and the migration of people, this type of culture is often forgotten. That is why the preservation of ICH is an important element of today world. The main aim of this study, on the basis of the gathered papers, is to identify: (1) the general state of use of 3D digital technologies in ICH; (2) the topics and themes discussed; (3) the technologies used in the study; (4) locations of research centres conducting such studies; and (5) the types of research carried out. The methodology consists of the following main steps: defining study questions, searching query development, selection of publications in Scopus, Web of Knowledge and IEEE Xplore, finally the study execution and the analysis of the obtained results. The results show that for ICH the most often used technologies are: 3D visualisation, 3D modelling, Augmented Reality, Virtual Reality and motion capture systems.

The heritage of any place is required to be conserved, documented, and protected to the extent possible for the benefit of future generations to retain its culture, pride, and traditions. Advancements in information, communication, and digital technologies have considerably extended supports in identifying, preserving, and managing cultural heritage items. The use of web-based applications and digital tools plays a significant role in preserving and sharing cultural assets. This chapter proposes the importance of building a comprehensive cultural heritage information system for preserving and conserving the cultural heritages pertaining to one of the UNESCO's world listed cultural heritages in India named Agra Fort. The researcher highlights the opportunities and the need for conserving the knowledge content of the heritage items associated with Agra Fort.

The importance of preserving intangible cultural heritage (ICH) for sustainable development has been widely acknowledged by the international society. Various forms of cooperation have taken place to prevent deterioration and destruction due to its inherent characteristic of ‘intangibleness’. Public engagement, however, has largely been excluded from the system in spite of its significance in safeguarding ICH by inducing people to be trained as successors. In this respect, this paper discusses and emphasises the necessity of public engagement in safeguarding ICH. To this end, it suggests the use of digital technologies to create museum content to encourage public involvement with and learning about ICH. Focusing on ICH in Korea, digital exhibitions on Jultagi and Daemokjang utilising virtual reality technology are proposed. The ultimate aim of this article is to contribute to the sustainability of world ICH for humanity through digital exhibitions.

The focus of this text is the masquerade tradition in central-west Bulgaria and activities related to its safeguarding and promotion. The essence of the survakar games in the Pernik Region is described, as well as its significance in traditional culture and its contemporary manifestations. The games with masks in the region are performed on the Surva feast day (14 January; also St. Basil’s Day according to the Julian calendar). The text notes the importance of the custom in the local community’s traditional culture. The main characters in the survakar groups, which are typical of both the past and the present, are presented, as are some new phenomena related to the feast. The tendencies in the context of the dynamics and events of the twentieth century are outlined, thanks to which the masquerade tradition has maintained its vitality until the present day. Some processes that have threatened the vitality of these masquerade games in the past are considered. Various local activities related to the safeguarding of the tradition are presented. The role of the community is important for the transmission of cultural practice to future generations, as is the role of local cultural institutions and organizations in preserving the tradition. Some ways of popularizing the local heritage and the joint work of the main actors engaged in safeguarding the region’s intangible cultural heritage today are emphasized.
