Ignacy Czerwiński’s legal competences in the light of the opinions of professionals: Przewodnik testatora in Antoni Rosbierski’s commentsIn this article I present the opinions of Antoni Rosbierski 1764–1815, a jurist educated in Vienna, who worked in the area of the Kingdom of Galicia and Lodomeria inter alia as a councillor of court for the aristocracy in Lvov, on the subject of one of the first books of Ignacy Czerwiński 1749–1836, an active lawyer and, later, the author of Okolica Za-dniestrska 1811 which is considered to be the first ethnographic monograph. In Annales Jurisprudentiae pro Regnis Galiciae et Lodomeriae Rosbierski published in Latin a review of Czerwiński’s Przewodnik testatora [A testator’s guide], published in 1818 in Lvov. Until now, it has not been a subject of further studies. Both publications can be considered important sources for the evolution of positive laws in 19th-century Galicia that provide insight into the law culture of that time, which is an important element of the intangible cultural heritage of any society. For this reason, the publication is worth reminding of. Przewodnik testatora may be interesting not only to jurist specialists but also to those researchers of Polish culture who are interested in the problem of the relation between law and custom. It was one of many attempts at giving an answer to the question of how to counteract denationalization in the face of the sudden loss of sovereignty and extensive surveillance systems.

Why did the subject of law play a central role in sociology as it emerged? And why is this no longer the case today? This study explains this transformation of the sociological interest in law by means of a genealogical investigation into the mutual references between the jurisprudence of private law and sociology: the way in which, from a legal perspective starting in the 19th century, law has been addressed as a social phenomenon in the face of concrete problems is reflected in the early sociologies of Émile Durkheim, Ferdinand Tönnies and Max Weber. This has led to a mutual demarcation, which places law and sociology in a problematic relationship to each other for the future.

Abstract This paper explores Namahage of Akita Prefecture as it assumes three different instantiations: 1) enactment as a private ritual within individual households on New Year’s Eve; 2) performance as a public festival at a shrine in mid-February; and 3) celebration as an “element” inscribed on UNESCO’s Representative List of the Intangible Cultural Heritage of Humanity. I argue that in the first instance, Namahage is part of a vernacular religious “structure of feeling” in which religious elements are inseparable from community life; in the second instantiation, religion is more explicit and codified; and in the third iteration, religion is only vaguely articulated. Tracing the “same” tradition through different forms provides insight into the changing needs of communities and into the dynamics of change itself. With this in mind, I propose a model called hrönirism through which to broadly conceptualize notions of change and difference within traditions such as matsuri.

<p align="justify">Este trabajo de investigación analiza las competencias que corresponden a la Administración estatal, autonómica y local en materia de protección y fomento del patrimonio histórico y cultural, prestando especial atención a las competencias municipales; para posteriormente centrarnos en el estudio de los instrumentos de protección del patrimonio histórico andaluz, el Catálogo General y el Inventario de Bienes Reconocidos, en los que aquellas competencias se proyectan. Así, nuestro objeto de estudio son los bienes que los integran, el procedimiento de inscripción y el régimen jurídico aplicable a los titulares o poseedores de los bienes inscritos. Y todo ello, analizando no solo la Ley de Patrimonio Histórico Andaluz de 2007, sino también, la normativa estatal relacionada y la jurisprudencia referente al tema.</p> <p align="justify"><b>This work of investigation analyses the competitions that correspond to the state Administration, regional and local in matter of protection and promotion of the historical and cultural heritage, loaning special attention to the municipal competitions; for later centre us in the study of the instruments of protection of the historical heritage of Andalusia, the General Catalogue and the Inventory of Recognized Goods, in which those competitions are projected . Like this, our object of study is the goods that integrate them, the procedure of registration and the applicable juridical diet to the headlines or possessors of the goods inscribed. And all this, analyzing, not only the Law of Andalusia Historical Heritage of 2007, but also the state rule related and the jurisprudence concerning the subject.</b></p>

O reconhecimento da capoeira como Patrimônio Cultural Imaterial da Humanidade pela UNESCO contribui para a valorização e a visibilização dessa prática de resistência negra brasileira a ná­vel mundial, mas também implica certas ressignificações em face das possá­veis essencializações. Portanto, consideramos necessário um olhar filosófico sobre a capoeira, dando ênfase aos saberes ancestrais e á  sua articulação no contexto da desigualdade sociorracial. O caminho percorrido neste artigo engendra aportes teóricos multidisciplinares, juntando conceitos que dialogam entre a filosofia da diferença de Foucault, Deleuze e Guattari e as perspectivas e reflexões sociogeográficas. Defendemos a ideia de que o mestre de capoeira representa um filósofo diaspórico que cria um espaço de possibilidades para coletividades marginalizadas e fortalece uma pedagogia da (re)existência negra. Entretanto, a capoeira se inscreve num campo diná¢mico, afetado por diferentes interesses econômicos, polá­ticos e morais, com os quais o mestre precisa articular agenciamentos que salvaguardem os mais perceptá­veis traços filosóficos da capoeira.Palavras-chave: Mestre de Capoeira. Desigualdade.  THE MASTER OF CAPOEIRA: strengthening philosophies and practices of black (re)existence in the face of socioracial inequalitiesAbstract:  Since capoeira has been recognized as Intangible Cultural Heritage of Humanity by the UNESCO, this Brazilian practice of black resistance has been increasingly valorized and visibilized at a global level. But this also implies certain resignifications in the face of possible essentializations. Therefore, we consider it necessary to provide a philosophical perspective on capoeira, emphasizing ancestral knowledge and its articulation in the context of socioracial inequality. In this article, we use a multidisciplinary approach, establishing a dialogue between the philosophy of difference of Foucault, Deleuze and Guattari, and socio-geographical perspectives and reflections. We defend the idea that the ”˜mestre”™ (master) of capoeira represents a diasporic philosopher who creates a space of possibilities for marginalized collectivities and promotes pedagogics of black (re)existence. Meanwhile, capoeira is part of a dynamic field affected by different economic, political and moral interests, with which the 'mestre' needs to articulate entanglements that safeguard the most perceptible philosophical traits of capoeira.Keywords:  Mestre of capoeira. The present study examines the three perceptual factors (cultural, economic, and social) that affect residents’ attitude towards transformation in the search for sustainability. Macao’s Drunken Dragon Festival, China’s intangible cultural heritage, was used as the case. Self-administered surveys were conducted on 378 resident festival participants in 2015 and 692 residents (both participants and non-participants) in 2017. The results show that regardless of previous experiences of participating in the festival, those who perceive more strongly about its cultural values tend to have positive attitudes towards its transformation, which may involve a loss of objective authenticity. Those who perceive more strongly that the festival is exclusive and does not embrace diverse participants are more likely to support its transformation. However, such a perception does not lead to their belief that diverse groups of people should be incorporated into the festival. Only among the non-participants from the sample collected in 2017, the perception that this festival provides economic benefit is associated with positive attitudes towards transforming and incorporating diverse groups of participants. This study provides insight into understanding the residents’ common and differentiated attitudes with regards to how much transformation is necessary to ensure sustainability of a local traditional cultural festival.

This paper presents a close encounter between the literary works of Franz Kafka and a core topic in organizational theories of power, namely the participation of subjects in their own subjectification. In discussing ‘In the Cathedral’, the penultimate chapter of The Trial by Franz Kafka, the paper develops three central aspects of Kafka’s text: reflexivity as a form of entanglement with power, self-slander complementing formal involvement, and humour as a form of freedom. These aspects are mirrored against the example of performance evaluation to complement and enrich the theoretical debate about subjectification more generally. The paper and its contributions serve as a corrective to approaches that overemphasize either the possibilities of resistance, for example through reflexivity, or the impotence of the subject in the face of power.

The paper provides an insight into the destabilisation of the subject and the emergence of the posthuman condition in the novel Night Work (Die Arbeit der Nacht, 2006) by Austrian writer Thomas Glavinic. The first part briefly discusses previous analyses of the novel and the definitions of posthumanism as an umbrella term for a heterogeneous theory dedicated to the questions of what follows after the re-consideration of the humanist ideals and after decentring the human. The posthuman is interpreted as non-fixed, in the state of constant reconstruction as opposed to the humanist subject’s fixedness and integrity. The analysis examines the ‘uncanny’ setting of the novel and the power of survival in the face of death, which becomes the protagonist’s point of demise and divergence from consciousness and rationality. The urban environment devoid of all organic life replaces the Other applied traditionally to other humans. The Sleeper as the nightly doppelgänger and the filming of the environment further add to the transgression of the boundaries between material and immaterial, the living and the non-living, the real and the dreamlike/artificial, and ultimately determine the protagonist’s posthuman existence in the state of ‘becoming’ rather than ‘being’.

The religious festivities are integrated into the extensive inventory of the intangible cultural heritage of Mexico. The continuity of their practice stimulates social cohesion, collective identity, peace and ecological awareness. Such manifestations are susceptible to patrimonialization due to their symbolic ex‑ pression and their economic potential in the face of the tourism model, they respond to the imperatives of late capitalism that tends to commodify and homogenize cultural diversity. We study the religious festivities of localities of Bahía de Banderas, in particular that of Nuestra Señora de la Paz in Bucerías and that of Nuestra Señora del Rosario de Tintoque in Valle de Banderas, in order to understand the dominant trends in the processes of patrimonialization. The objective is to contribute to the knowledge of the patrimonial wealth of the coastal towns that have been subject to tourism and with it, develop the methodological instruments to fill out the information sheets of the inventory of festivities in the region.

This article discusses the Omahu affair, a prominent legal drama that took place in the late 19th century involving prominent Māori leaders from the Hawke’s Bay region. The case was the subject of numerous Native Land Court hearings, decisions of the ordinary courts, and ultimately a Privy Council decision in London. This article considers how tensions within the Māori community could drive cases in the Native Land Court, and explores the interconnections between that Court and the ordinary courts. It seeks to promote a more sophisticated view of the Court's role, particularly in the context of inter-Māori disputes, as well as of the complexities of legal and political affairs in 19th century New Zealand. The article also raises some questions relating to the role of elites in the Māori community, and the interconnections between Māori and European elites in 19th century New Zealand.
