<p><em>Article 66 paragraph (1) Act Number 2 of 2014 essentially regulates the consent of the Notary Honorary Council in the criminal justice process. The provisions in the a quo article have been still being applied and become a positive law in Indonesia. One of the criminal justice process in the notarial field relates to the criminal act of revelation of secrets as regulated in Article number 322 paragraph (1) of the Criminal Code. The consent given by the Notary Honorary Council as outlined above can certainly be viewed in the context of criminal law.</em></p><p><em><em>The research is a normative legal research using secondary data of both primary legal materials and secondary legal materials. The data collecting technique used is documentary study with written materials as the data collection tool to be analyzed qualitatively using content analysis.</em></em></p><p><em><em>The research result showed that in the context of criminal law, basically a notary who provides a copy of the deed and/or documents attached to the minuta deed or notarial protocol in the notarial archives for the purpose of the investigator, the public prosecutor or the judge has committed a criminal act of revelation of secrets as stipulated in Article number 322 paragraph (1) of the Criminal Code. However, the notary is not necessarily criminally liable considering the consent of the Notary Honorary Council as the grounds of impunity.</em></em></p><p><em><br /></em></p><p><em><strong><em>Keywords</em></strong><em>: Notary Honorary Council consent, grounds of impunity, criminal act of revelation of secrets.</em></em></p>

Fraudulent criminal acts that have been regulated in the Criminal Code (KUHP) with various modes, one of which is fraud by shamans with a multiplied money mode has made law enforcers increasingly have to rack their brains to be able to prove it. This study aims to examine and analyze law enforcement by the judge in decision No.61 / Pid.B / 2019 / PN.Blora with consideration of the criminal elements. The research method used is a sociological juridical approach. The specifications of the study were conducted using descriptive analytical methods. The data used for this study are primary and secondary data. The data consists of primary data and secondary data using field research methods, interviews, and literature studies. Based on the research it was concluded that the case ruling number 61 / Pid.B / 2019 / PN Bla with a fraud case with shamanism practices in the mode of duplicating the judge's money considering that the Defendants have been indicted by the Public Prosecutor with alternative indictments, so the Panel of Judges paid attention to the facts The aforementioned law decides on the first alternative indictment as regulated in Article 378 of the Criminal Code Jo Article 55 paragraph (1) of the 1st Criminal Code by considering the elements of that article.Keywords: Criminal Law Enforcement; Fraud; Multiple Money.

Imposition of the death penalty by the judge in the criminal justice process Indonesia still remains a debate among groups that agread with the group that oppose it. But in some laws for special crimes such as terrorism, corruption, narcotics, psychotropic substances, and a human rights capital punishment is still regulated, as well as of the criminal code and the concept of the criminal code by 2015 capital punishment is still based. The  existence of the group that did not agree with the conception and application of this dying, argued that human life bussiness, my God, not the man to lift the perspective of the scientific criminal law that a death penalty still exists in all criminal acts by perpetrators of crimes with widespread impact as well as detrimental to the wider community the research for criminal santions was important to examine the existence of the norms of law as a basic for corrector by maximum capital punishment in Indonesia. Penjatuhan pidana mati oleh hakim dalam proses peradilan pidana Indonesia masih tetap menjadi perdebatan antara kelompok yang setuju dengan kelompok yang menentangnya. Namun dalam beberapa undang-undang tindak pidana khusus seperti terorisme, korupsi, narkotika, psikotropika dan peradilan hak asasi manusia pidana mati masih diatur, begitu juga KUHP dan konsep KUHP tahun 2015 pidana mati masih tetap dicanangkan. Adanya kelompok yang tidak setuju dengan konsepsi dan aplikasi pidana  mati ini berdalih bahwa nyawa manusia menjadi urusan Tuhan, bukan menjadi kewenangan manusia untuk mencabutnya. Perspektif keilmuan hukum pidana bahwa pidana mati masih eksis untuk diberlakukan sepanjang tindak pidana yang dilakukan pelaku menyangkut kejahatan luar biasa dengan dampak luas serta merugikan masyarakat luas. Penelitian terhadap sanksi pidana mati penting dilakukan guna meneliti keberadaan norma hukum sebagai dasar pembenar dijatuhkannya pidana mati ini di Indonesia.

The rise of promiscuity and free sex is the reason for a large number of abortion perpetrators in Indonesia. In the enactment of the law stipulated in the Criminal Code (KUHP) regarding abortion, it is very clear that abortion is prohibited as well as from the perspective of Islamic law it is forbidden to abort the fetus unless there is a medical reason that an abortion must be performed. However, in the opinion of Madzhab, there is still a classification of permissibility before the blowing of the spirit and the scholars agree that it is haram to abort the fetus after blowing the spirit. The research approach used in this study is the Normative Juridical Research Method, namely the approach method used in this study is the normative juridical approach or doctrinal legal research, which is legal research that uses secondary data sources. The results of the research conducted by the author are to provide insight to readers so that they better understand the meaning of abortion and also the punishment of the perpetrators of the crime of abortion both in terms of positive law and Islamic criminal law. In finding the comparison of the punishment between positive law and Islamic criminal law lies in the age limit of the fetus that is in the content of the sanction based on Islamic criminal law, the punishment is to pay ghurrah or diyat Kamilah Dari before the blowing of the spirit or after the blowing of the spirit.

The formulation of the problem in this study are: How is the principle position Rechterlijk Pardon in the criminal system in Indonesia, how the principles are applied Rechterlijk Pardon in a criminal ruling Decision Number 241 / Pid.B / 2019 / PN.Mjl andHow the development / concept of the Rechterlijk Pardon principle in the renewal of the Indonesian criminal law that will come related to the draft criminal law on the monodualistic principle?This study uses a sociological juridical approach, with descriptive analytical research specifications. The data used in this study are secondary data obtained through library research and primary data obtained through field research which are then analyzed qualitatively using legal theory, the forgiveness agency theory, criminal justice system theory, and progressive legal theory. Based on the results of that study The position of the Rechterlijk Pardon Principle in the Criminal System in Indonesia is forgiveness is a form of forgiveness / deliverance from mistakes made. As a form of forgiveness, then with forgiveness, someone who is guilty is not sentenced or does not need to feel the punishment. Provisions such as this basically exist in conditional criminal conduct (voorwaardelijke veroordeling) regulated in Article 14a-14f of the Criminal Code. Conditional penalties are also referred to by part of the community with the term criminal trial or there is also termed as conditional punishment. Application of the Rechterlijk Pardon Principle in Criminal Verdicts Number 241 / Pid.B / 2019 / PN.Mjl it is applied later to act as the final safety valve in the criminal justice system if a case is not filtered at the prosecution and preliminary hearing judge stage. Development / Concept of the Rechterlijk Pardon Principle in the Future Renewal of Indonesian Criminal Laws Associated with the Draft Criminal Laws on the Monodualistic Principle are Forgiveness institution, is an important element to answer problems that cannot be accommodated with only 3 (three) types of decisions (free, loose, criminal funds).Keywords : Institutions; Forgiveness; Rechterlijk Pardon; Considerations; Judges; Decisions.

Myths in the modern era are things that are considered like truth. It arises through the process of hegemony and dialectical domination by the authority in history. So, myth is a phenomenon of common sense without criticism. The state's presence in the criminal justice process as a grand narrative identified with the interests of victims and society, in general, is common sense without criticism. This study aims to reveal whether the myth of modernity is a representation of victims in the Criminal Justice System. This study uses a normative juridical method based on secondary data with several models of approaches, including conceptual approaches, philosophical approaches, and critical approaches. The result of this research shows the phenomenon of objectification and reification of the people as victims in the Criminal Justice System in Indonesia. Mitos dalam era modern merupakan hal-hal yang diandaikan begitu saja sebagai suatu kebenaran. Hal tersebut tampil melalui proses hegemoni dan dominasi dalam dialektika otoritas dalam sejarah. Sehingga, mitos merupakan suatu fenomena common sense tanpa kritik. Kehadiran negara dalam proses peradilan pidana sebagai narasi tunggal (grand narrative) yang diidentikan dengan kepentingan korban dan masyarakat secara umum, merupakan common sense tanpa kritik. Penelitian ini ditujukan untuk membongkar apakah mitos modernitas tersebut merupakan representasi korban dalam Sistem Peradilan Pidana. Penelitian ini menggunakan metode yuridis normatif yang berbasis kepada data sekunder dengan beberapa model pendekatan, antara lain pendekatan konseptual, pendekatan filsafat, dan pendekatan kritis. Hasil penelitian ini menunjukkan adanya fenomena objektivikasi dan reifikasi terhadap masyarakat sebagai korban dalam Sistem Peradilan Pidana di Indonesia.

Abstract: The Judge’s ruling in the legal decition of the Lamongan District Court No. 164/Pid.B/2013/PN.LMG on the crime of persecution that causes the death of the victim is regarded true since it has been fulfilled all elements as required by Article 351 Paragraph (3) of Criminal Code as indicted by the public prosecutor. In deciding this case, the judge also considered the testimony of witnesses, the information from the defendant, the facts revealed at the hearing as well as the things that burdensome and relieve the defendant. Therefore, the defendant shall be sentenced for 5 months in prison and does not have to go through due to the imposed conditional sentence. In Islamic criminal law, the case is equated with a semi-deliberate murder and sanctioned by diyât and kafârat in the form of ta’zîr. In this case, the defendant can not be punished because of his self-defense. So that the defendant is free from a criminal liability in Islam.Keywords: Persecution, victim died, Islamic law. Abstrak: Putusan hukum hakim Nomor: 164/Pid.B/2013/PN.LMG tentang tindak pidana penganiayaan yang mengakibatkan korban meninggal dunia berdasarkan telah terpenuhinya semua unsur-unsur dari pasal 351 ayat (3) KUHP seperti yang didakwakan oleh jaksa penuntut umum. Dalam memutuskan perkara ini hakim juga mempertimbangkan keterangan saksi, keterangan terdakwa, fakta-fakta yang terungkap di persidangan, serta hal yang memberatkan dan meringankan terdakwa. Oleh karena itu, terdakwa dipidana dengan 5 bulan penjara dan tidak perlu menjalaninya dikarenakan dikenakan hukuman bersyarat. Dalam fiqh jinâyah, perkara ini disamakan dengan pembunuhan semi sengaja. Untuk sanksinya yaitu membayar diyat dan kafârat, sedangkan untuk hukuman penggantinya berupa hukuman ta’zîr. Dalam kasus ini, para terdakwa meskipun telah melakukan perbuatan tersebut, namun tidak bisa dikenakan hukuman tersebut, karena adanya unsur pembelaan diri, sehingga terbebas dari pertanggungjawaban pidana dalam Islam.Kata Kunci: Penganiayaan,  meninggal dunia, Hukum Islam.

Every person legal problems with the status as a suspect, accused and convicted person is obliged to secure the protection and legal aid. Legal aid is a right for everyone, especially for those who are punished more than five years is mandatory for legal counsel. Various guarantee protection for legal support in any judicial process is not regulated in the criminal code, Act No. 18 of 2003 regarding advocates, law No. 16 of 2011 on legal aid and law No. 12 of 1996 on corretional services. Began to suspect the examination process stages can have legal counsel or advocate o the court proceedings even to convict the accused. Legal assistance in the Indonesia judiccial process has been set broadly, in the sense that all stages of the judicial process of seeking justice is guaranteed by law without exception, the prisoners declared in the form of sponsorhip such as the availability of legal remedies extensivelly and every level of the judicial process, means remission, leave nearing relase, conditional release, resocialization, assimilation and others. Indonesia criminal justice process is carried out in an integrated manner by law enforcment in the context of a fair process in order to realize the prupose of law is fair, useful and achieving legal certainty for all seekers of justice based on the “system” that has adopted the “Integrated criminal justice system”. Setiap orang tersangkut masalah hukum dengan status sebagai tersangka, terdakwa dan terpidana adalah wajib mendapat perlindungan dan bantuan hukum. Bantuan hukum merupakan hak bagi setiap orang, apalagi bagi mereka yang diancam pidana lebih dari lima tahun adalah wajib untuk didampingi penasehat hukum. Berbagai ketentuan jaminan perlindungan akan bantuan hukum dalam setiap proses peradilan telah diatur dalam KUHAP, UU NO. 18 Tahun 2003 tentang Advokat, UU No. 16 Tahun 2011 tentang Bantuan Hukum serta    UU No.12 Tahun 1995 tentang Pemasyarakatan. Mulai tahapan proses pemeriksaan tersangka oleh pihak penyidik (kepolisian) seseorang tersangka telah dapat didampingi kuasa hukum atau advokat, hingga ke proses persidangan bahkan sampai terdakwa menjadi narapidana. Bantuan hukum dalam proses peradilan Indonesia telah diatur secara luas dalam arti semua tahapan proses peradilan para pencari keadilan dijamin oleh Undang-Undang tanpa kecuali, bagi terpidana dicanangkan berupa penyantunan seperti tersedianya upaya hukum secara luas dan disetiap jenjang proses peradilan, sarana remisi, cuti menjelang bebas, pelepasan bersyarat, resosialisasi, asimilasi dan lain-lain. Peradilan pidana Indonesia dalam prosesnya dilakukan secara terpadu oleh penegak hukum dalam rangka proses yang adil guna terwujudnya tujuan hukum yang berkeadilan, bermanfaat dan terciptanya kepastian hukum bagi semua pencari keadilan berdasarkan “sistem” yang telah dianut yakni “sistem peradilan pidana terpadu”

In the Indonesian criminal justice system, every public prosecutor possesses the authority to cease criminal prosecution in the name of public interest. In contrast, in the Netherland, only the Attorney General (Procureur Generaal) at the Supreme Court has this authority.  This article discusses this authority to cease of terminate criminal prosecution in the name of public interest.  To do this a comparative approach is used in which the ruling of this authority to terminate criminal prosecution as found in the Draft of the Indonesian Criminal Code will be compared against the same regulation and policy used in the Netherlands.  A doctrinal and comparative law approach will be used. One recommendation resulting from this research is the need to re-evaluate the existing procedure and requirement of terminating criminal prosecution in the public interest in the Indonesian context and the introduction of Rechter-Commissaris into the criminal justice system.

The role of the victim within the public criminal justice process has traditionally been one of supporting public prosecution. Without the victim's cooperation, police and prosecutors would neither be informed about the occurrence of crimes, nor be able to bring sufficient evidence to secure convictions or extra-judicial settlements. In Germany, for instance, about 90% of all prosecutions are initiated by private complaint.Compared to what the victim gives the state, the state traditionally gives little to the victim. While the victim's procedural position has been strengthened in Germany in recent decades, namely by the expansion of the right to join the prosecution as a collateral complainant, procedural participation alone has not been sufficient to satisfy the victim's need to be made whole. Victimological research indicates that the victim has a profound interest in compensation of damages. However, since according to our traditional understanding, the victim's claims and the State's claims against the offender are inherently different in nature, they ought to be governed by different types of principles and proceedings. Doctrinally, the criminal courts settle the State's conflict with the offender, while the victim's conflict with the offender is a matter for the civil law and the civil courts. Therefore, the legal consequences of crime, it is believed, reflect primarily the needs of the general public and not the “private” interests of the victim (whether defined as to receive: compensation; reparation; satisfaction; vindication).
