The reform to improve the system of admitting guilt and accepting punishment for leniency is one of the important measures to “promote the reform of the jury-centered litigation system”, which is parallel to the substantial reform of court hearings. After pilot reform, it was finally confirmed by legislation. From the perspective of legislative norms, the leniency system of confession to a crime and acceptance of punishment includes basic principles, applicable standards for confession and acceptance of punishment, procedural norms and a system for the protection of rights. From the analysis of its nature, it is a diversion mechanism of criminal procedure, rather than a plea-bargaining system, which mainly implements the statutory penalty and is supplemented by the application of discretion and also embodies voluntary confession and other Chinese characteristics. The reform to the leniency system of admitting to a crime and accepting punishment contributed to the development of the conceptual and theoretical system of the leniency system and formed a series of theoretical systems for pleading guilty with Chinese characteristics: the generation of the penalty theory of postcrime behavior, a balance of justice and efficiency of the program from a simple theory, and the development of the effective defense system in China. It is particularly noteworthy that the system of admitting guilt and accepting punishment for leniency in China is a sentencing negotiation system rather than a conviction negotiation system.

In Malaysia, the plea-bargaining process was formalized in 2010 with the amendment to the Criminal Procedure Code 1976, which was intended to reduce the number of criminal cases that could be resolved at the pre-trial stage. However, the law in action does not appear to be in line with the law in the statute book. Hence, this paper aims at examining the reality of the plea-bargaining process and the extent of the applications in Malaysia. In the context of numerous measures taken to increase the efficiency of criminal proceedings, a special place belongs to the simplified forms of criminal cases proceedings. Inspired by the desire for saving time, costs and labour and avoiding formalities which seem unnecessary in routine cases, the simplified procedural forms are proposed to traditional criminal proceedings. In this context, the systematic reform of criminal procedural legislation has been executed, both at the level of Bosnia and Herzegovina and in its entities and the Brcko District BiH which has opened a completely new approach to criminal proceedings, in which the emphasis is not only on enhancing the protection of basic human rights and freedom but also the efficiency of the proceedings. The range of simplified and shortened procedures, the new criminal proceedings legislation in the Republic of Srpska is known through the following forms: witness immunity (Article 149 of the Law on the Criminal Procedure of the Republic of Srpska), plea of guilty (Article 244 of the Law on the Criminal Procedure of the Republic of Srpska), plea bargaining (Article 246 of the Law on the Criminal Procedure of the Republic of Srpska), procedure for issuing penal order (Article 358 of the Law on the Criminal Procedure of the Republic of Srpska). In this paper it will be discussed about practical application of the institutes from the aspect of the efficiency of criminal proceedings of the Republic of Srpska. The basic method that will be used in the theoretical part of the paper is a dogmatic and normative method, while in the second part of the paper the statistical method will be used.

ABSTRACTRevolutionary struggle in order to compete for the independence of Indonesia has been a source of inspiration Indonesian artists, including Bambang Soelarto who wrote drama Domba-domba Re- volusi (DDR). DDR studied drama is quite interesting because it tries to criticize the freedom fight- ers. This study aims to: first to know the theme and the problem plays DDR; second to determine the relationship of the socio - historical struggle in 1948 with the sociological elements of drama DDR themes and issues. This study uses sociological theory of art. The basic principles of the sociology of art is the fact that the creation of works of art influenced by the historical social conditions where the work was created. Research using content analysis of Krippendorf, the methods used to examine the symbolic phenomena with the aim to explore and express the observed phenomenon which is the content, meaning, and an essential element of the literary work. Based results of this research is that Bambang Soelarto as the author tries to capture di?erence between fighters during the struggle for the political aspirations for 1948 are expressed in a work of drama. Historical events inspired the creation of drama DDR. Soelarto want to respond to the political aspirations of the di?erence between historical figures and wanted to provide an assessment and outlook through DDR.Keywords: themes, drama, sociology of art, social historical ABSTRAKRevolusi perjuangan dalam rangka memperebutkan kemerdekaan Indonesia telah men- jadi sumber inspirasi para seniman Indonesia, termasuk Bambang Soelarto yang menulis drama Domba-domba Revolusi (DDR). Penelitian ini bertujuan untuk: pertama, mengeta- hui tema dan permasalah drama DDR; kedua, mengetahui hubungan kondisi sosio-histo- ris perjuangan pada tahun 1948 dengan unsur-unsur sosiologis terimplisir pada unsur tema dan masalah drama DDR. Penelitian ini menggunakan teori sosiologi seni. Prinsip dasar dari sosiologi seni adalah adanya fakta bahwa penciptaan karya seni dipengaruhi oleh kon- disi sosial historis tempat karya itu diciptakan. Penelitian ini menggunakan metode con- tent analysis dari Krippendorf, yakni metode yang dipergunakan untuk meneliti fenome- na-fenomena simbolik dengan tujuan untuk menggali dan mengungkapkan fenomena yang teramati yang merupakan isi, makna, dan unsur esensial karya sastra. Berdasarkan hasil penelitian dapat diketahui bahwa Bambang Soelarto sebagai penulis mencoba un- tuk menangkap perbedaan antara pejuang aspirasi politik selama perjuangan tahun 1948 untuk diekspresikan dalam sebuah karya drama. Peristiwa sejarah mengilhami penciptaan drama DDR. Soelarto ingin menanggapi aspirasi politik perbedaan antara tokoh-tokoh se- jarah dan ingin memberikan penilaian dan pandangan pandangannnya melalui DDR.Kata kunci: tema, drama, sosiologi seni, sosial historis

The maximum duration of the detention in custody and house arrest measures in criminal cases is researched. A number of issues have been considered regarding the calculation of the term and its initial and final moments, including the hypotheses related to the returning of the case to the prosecutor by the court, the taking of the measures against an accused party detained on different grounds, as well as in view of a modification of the legal qualification of the indictment, establishing a different maximum duration under Art. 63, para. 4 of the Criminal Procedure Code. An emphasis has been placed on the disputable aspect of the duration of the period in regard to underage accused parties. A necessity to introduce a maximum period of detention in custody and house arrest,including also the court phase of the trial, has been acknowledged.

Создание геймифицированных образовательных ресурсов позволяет повысить мотивацию студентов к обучению, индивидуализировать образовательные маршруты, обеспечить вариативность содержания образования, учесть ограничения в здоровье. Цель настоящей статьи состоит в описании принципов разработки цифровых мультимедийных игр для сферы профессионального образования с учетом командного взаимодействия представителей различных профессиональных групп. В результате исследования выделены основные принципы разработки цифровых мультимедийных игр, предполагающие использование звуковых, анимационных и других эффектов при проведении корпоративных сеансов и выполнении творческих заданий. Практическая значимость заключается в возможности использования описанных принципов для дальнейшей разработки геймифицированных ресурсов. The creation of gamified resources makes it possible to increase the students’ motivation with the content of activities, to individualize educational routes, to ensure the variability of the content of education, to take into account health restrictions. The aim of this article is to describe the principles of developing digital multimedia games for vocational education, taking into account the team interaction of representatives of various professional groups. As a result of the study the basic principles of the development of digital multimedia games are highlighted, involving the use of sound, animation and other effects for corporate sessions and for doing creative tasks. The practical significance lies in the possibility of using the described principles for further development of gamified resources.

The article deals with problematic issues associated with the use of the results of an operational experiment as evidence. It is proposed to refuse to conduct an operational experiment on the initiative of operational units and allow it to be conducted exclusively within the framework of considering a report on a crime, on the basis of an order from an investigator of the Investigative Committee in accordance with Article 144 of the Criminal Procedure Code of the Russian Federation.

The article deals with the historical aspect of the requirements to the indictment in the Russian legal proceedings in the 19th century, analyzes the points of view of leading scientists in modern realities, draws Parallels of continuity and determines the patterns in the development of the criminal process. The article also analyzes the current state of the return of criminal cases by courts at the regional level on the grounds of violations of criminal procedure legislation in the preparation of indictments.

The investigative action is a request for information about the connections between subscribers and / or subscriber devices, provided for by Article 186.1 of the Code of Criminal Procedure of the Russian Federation, it is in demand in connection with the development of telecommunication systems and has been successfully applied in almost all categories of criminal cases. The author has analyzed the requirements for such a criminal procedure decision as the decision of the investigator (interrogator) to initiate before the court a motion to obtain information about connections between subscribers and (or) subscriber devices. Errors made by investigators (interrogators) in the preparation of this decision are indicated. The article discusses the procedure for obtaining a permission to conduct this investigative action, reveals the shortcomings of the legal regulation of obtaining information about connections between subscribers and (or) subscriber devices.

The article deals with the peculiarities of the activity of courts in making judicial decisions in the context of a pandemic. First of all, we are talking about the wider use of digital and information technologies in criminal proceedings, which have previously been repeatedly recommended by forensic science for implementation in judicial practice. Some recommendations of criminalistics are currently accepted by the Presidium of the Supreme Court of the Russian Federation in its Decision dated April 08, 2020 № 821 and Review on certain issues of judicial practice related to the application of legislation and measures to counteract the spread of a new coronavirus infection (COVID-19) in the territory of the Russian Federation № 2, which provided appropriate explanations for their use in practice. In particular, we are talking about the possibility of using video conferencing systems for certain categories of criminal cases and materials that are considered urgent, although this is not provided for in criminal procedure legislation. It is concluded that it is necessary to change the current criminal procedure legislation, bring it into line with the Constitution of the Russian Federation, federal constitutional laws, federal laws and subordinate regulatory legal acts, including orders of the Judicial Department under the Supreme Court of the Russian Federation.
