Water rights transfers are allowed in México under the National Waters Law (LAN) promulgated in 1992. However, water transfers to date have not been widely used and those that have occurred have done so in small quantities and mainly at the level of the irrigation district (ID). We evaluate water policy in México as it relates to transfers and propose alternatives to current policy along the lines of Howe et al. (Water Resources 22(4), 439–445, 1986). Howe et al. proposed guidelines for water markets that comply with efficiency and equity. This guideline is the basis for implementing the approach proposed in this paper. Even though this research targets the Conchos basin, which is the most important tributary to the Rio Grande/Rio Bravo system, the analysis contains experiences and examples of water rights transfers of other Mexican regions. The paper focuses on two main aspects: first, a summarized and structured effort characterizing water resources policy in México in terms of involved institutions, legal aspects, stakeholder roles, etc; second, a series of proposals and recommendations oriented to improving the performance of this policy.

Market instruments have been often proposed with the aim of improving the efficient allocation of use rights over natural resources. This article analyzes the potential of market mechanisms in the field of water resources and focuses attention on the experience of Chile, one of the few cases in which water markets have been implemented on a wide scale. Abstract Establishing and perfecting the water rights system is an important way to alleviate the shortage of water resources and realize the optimal allocation of water resources. Agriculture is an important user of water in various water-consumption industries, the confirmation of water rights in irrigation districts to farmers is the inevitable requirement for implementing fine irrigation in agricultural production. In this paper, a double-level water rights allocation model of national canals – farmer households in irrigation district is established. It takes into account the current water consumption of the canal system, the future water-saving potential and the constraint of total amount control at the canal level. It takes into account the asymmetric information of farmer households’ population and irrigation area at the farmer household level. Furthermore, the Gini coefficient method is used to construct the water rights allocation model among farmer households based on the principle of fairness. Finally, Wulanbuhe Irrigation Area in the Hetao Irrigation Area of Inner Mongolia is taken as an example. The results show that the allocated water rights of the national canals in the irrigation district are less than the current because of water-saving measures and water rights of farmer household get compensation or cut respectively. The research has fully tapped the water-saving potential of irrigation districts, refined the distribution of water rights of farmers and can provide a scientific basis for the development of water rights allocation in irrigation districts and water rights transactions between farmers.

Various sectors of stakeholders (urban, agricultural, policymakers, etc.) are frequently engaged in participatory research projects aimed at improving water resources’ sustainability. However, a process for comprehensive and integrative identification, classification, and engagement of all types of water stakeholders for a region or river basin, especially in a transboundary context, is missing for water resources research projects. Our objective was to develop a systematic approach to identifying and classifying water stakeholders, and engage them in a discussion of water futures, as a foundation for a participatory modeling research project to address the wicked water resource problems of the Middle Rio Grande basin on the U.S./Mexico border. This part of the Rio Grande basin can be characterized as having limited and dwindling supplies of water, increasing demands for water from multiple sectors, and a segmented governance system spanning two U.S. states and two countries. These challenges are being exacerbated by climate change; a transitioning agriculture to more water demanding, high value crops; urbanization; and growing demand for environmental services. Moving forward, a core question for this region is how can water be managed so that the three competing sectors—agricultural, urban, and environmental—can realize a sustainable future in this challenged water system? We identified the major water-using sectors who represent competing demands as including agricultural, municipal, self-supplied industrial users, environmental, and a sector we labeled “social justice”, comprised of individuals who lack access to potable water, or who represent groups who advocate for access to water. We included stakeholders from both the U.S. and Mexico, which is seldom done, who share transboundary water resources in the region. We hosted a series of stakeholder dialogues and obtained results that identified and described their vision for the future of water; challenges to be overcome; and important research questions that could be addressed using participatory modeling approaches. Four broad themes common to multiple sectors emerged: (1) quantity, drought, and scarcity; (2) quality/salinization; (3) urbanization; and (4) conservation and sustainability. Each sector expressed distinctive views regarding the future of water. Agricultural stakeholders, in particular, had strong feelings of ownership of water rights as part of land ownership and a concomitant sense of threat to those water rights emanating from dwindling supplies and competing demands. The contribution of this work is a methodology for identifying, classifying, and engaging all types of stakeholders in the context of a research project, enabling us to compare and contrast views of different types of stakeholders. Heretofore, this has been accomplished in “bits and pieces”, but never comprehensively and holistically.

AbstractMarkets for managing natural resources have existed for many decades and have gradually made their way into the mix of discourses on water policy. However, there are not many established water markets functioning worldwide and little understanding about how and why water markets emerge as allocating institutions. In order to understand the dynamics of the evolution of water markets, the experiences of selected cases with relatively mature water market systems were analyzed, namely: the Murray–Darling Basin in Australia; the Colorado-Big Thompson Project and the transfers between the Palo Verde and Metropolitan Water Districts in the USA; and Spain. We found that formal markets emerged in water scarcity situations where water rights already existed and were sometimes exchanged informally. Water markets have not always moved to reduce transaction costs, as some of those costs were necessary to achieve societal goals beyond economic efficiency. There is a significant difference between the idea of water markets as proposed by economic theory and actual practice in the water sector. As institutions, markets are humanly devised rules embedded in a social and political context and do not always lead to efficient or effective solutions for the management of resources.

Southern Africa faces acute water scarcity challenges due to drought recurrence, degradation of surface water resources, and the increasing demand of water from agriculture, which has to meet the growing food demands of an increasing population. These stressors require innovative solutions that ensure the sustainability of water resources, without which the consequences could be dire for a region exposed to a host of vulnerabilities, including climate change. This review outlines the role of water markets in water management in times of water scarcity, highlighting the drivers of water markets in southern Africa, such as water scarcity, transboundary nature of water resources, and their uneven distribution. The review further discusses the role of water markets in climate change adaptation. Related institutional and legal frameworks as well as water allocation mechanisms are explored, aiming at improving water markets governance. The impact of adaptation to new water regimes in the face of scarcity are assessed by considering characteristics of current markets as related to future opportunities. In a diverse region such as southern Africa with unevenly distributed water resources, advancing the concept of water markets could play an important role in mitigating water scarcity challenges and promoting regional integration through coordinated transboundary water transfers. The emergence of water markets in the region is influenced by the continued depletion of water resources, which is resulting in the adoption of innovative water marketing strategies, such as inter-farm sharing or farm joint venture systems and inter-basin and intra-basin water transfers. As the concept is new in the region, it still has challenges that include general market inefficiencies, high transaction costs, market information asymmetries, imperfect competition, and weak or absent robust institutional frameworks that can facilitate market development.

The present irrigation-water policy of South Africa is based on the Water Act (Act 54 of 1956) as amended, and in this paper the most important legal aspects relating to irrigation are briefly highlighted. The basis of allocation of irrigation water is covered and the concepts of private water and public water are explained. The paper then deals with the powers vested in the state as far as control over public water is concerned, and its application. The water rights of properties riparian to public streams are discussed and water apportionment within and outside Government-controlled areas is briefly highlighted with reference to the concepts of normal and surplus flow.

Water governance and management are important challenges for the River Indus Basin in Pakistan. Water governance refers to social, political and economic factors that influence water management. The water scarcity and water security are a major concern for the state to control its water resources. The study aims to give Sindh water policy by exploring the challenges to Indus Basin in managing water resources and to identify opportunities Indus Basin can look to improve water management. Interviews were conducted from water experts and analysts having 5 years’ experience or more in the water sector of Pakistan through a semi-structured self-developed questionnaire using purposive sampling technique and transcripts were analyzed using thematic content analysis. The findings show that increasing population, climatic change and rising demand of water are major challenges Indus is facing and Indus with time is getting water-scarce therefore need strong institutions, civil society and legislatures to ensure equitable distribution of water and maintain the ecosystem. The study emphasizes that water governance and management are necessary for sustainable use of water. Pakistan, the water stress country needs to address ‘governance’ at a wider scale to solve problems in the Indus Basin for the livelihood of people. The research will benefit the state, water experts, institutions as well as civil society to promote efficient use of water in Indus Basin.
