This chapter sheds light on the relationship between the composition of the bench and the sociological legitimacy of the judicial branch of the World Trade Organization (WTO). Two identity characteristics are consistently part of the criticism of the WTO’s bench: the lack of female adjudicators as well as individuals with academic experience. Overall, however, the identity of the bench does not appear to matter greatly for how WTO Members evaluate its exercise of authority. We suggest that the role of the WTO’s Legal Affairs Division and the Appellate Body Secretariat in streamlining outcomes and procedures may best explain this, as it helps prevent such diversity from manifesting in dispute rulings. Alternatively, it tells us that judicial diversity matters more for the bench’s normative legitimacy—and for scholars—than it does for governments.

AbstractThe two central issues in China's accession to the World Trade Organization (WTO) were its economic size and the large role the state had played in economic decisions – the treatment of State-Owned Enterprises (SOEs) as central to addressing the latter point. While the Protocol of Accession imposed obligations on China that went beyond what was required of other WTO members, it has not been effective at resolving concerns about Chinese SOEs. This demonstrates, in part, the limitations in using the WTO as a vehicle to promote economic reform.

Under the conditions of accession to the World Trade Organization (WTO) there is a particularly urgent problem of the provision of basic food products. One of the most important foods is potato. Potato is one of the few products for which the period of the reforms, there had been no sharp decline in production due to shortfalls in potato and other agricultural organizations almost full compensation due to its households producing potatoes for their own needs and remaining completely abandoned by the state. The main problem of the production and sales of potatoes is still a lack of state involvement in the formation and development of the potato market. The integration processes in the modern world, caused by the dynamic globalization, which covers all sectors of the world economies, including the agri-food sector, which provides the world's population with food, are considered. The peculiarities of unification of national agri-food markets into a single world market and adaptation of domestic state policy of agricultural regulation in accordance with the principles defined by the World Trade Organization and the general direction of the common agricultural policy of the European Union are described. The peculiarity of the agri-food sector of Ukraine, which consists in the degree of development of domestic agriculture and ways of implementing the regulatory policy of the state in this area, is described. A study of the integration processes of the Ukrainian agri-food market and the imperfection of mechanisms for regulating the activities of agri-food enterprises by the state, which necessitates the adaptation of integration processes to international requirements. The advantages and disadvantages of enterprises entering the international market after Ukraine's accession to the World Trade Organization are considered. The impact of the biodiversity strategy until 2030, adopted by the European Commission, on the activities of domestic agri-food enterprises, the competitiveness of their products on the international market and stimulating the production of environmentally friendly products has been studied. The main Ukrainian exporters of agricultural products on the European agricultural market and the rating of the main demanded goods are studied. It is analyzed that the agri-food market of Ukraine functions in the conditions of strengthening of internal and external integration processes. The internal integration processes characterized by the vertical integration of Ukrainian agri-food enterprises, which contributes to the significant development of the agri-food sector, are considered. It is proved that the private form of land ownership is dominant in this market, the monopoly position is occupied by domestic agricultural holdings, which intensifies imperfect competition in the market.

The aim of this paper is to verify empirically whether the Specific Trade Concerns (STCs) regarding Technical Barriers to Trade (TBTs) notifications by WTO members can serve as an early warning system for past and future disputes (DS) covering allegedly trade restricting TBTs. WTO members, in order to increase transparency of trade policies, have made efforts to compile data on notified TBTs. For several years the WTO provides a TBT dataset, used in our paper, which covers the STCs raised by its members (“reverse” notifications). From 1995-2011, there have been 45 requests for consultation under the Dispute Settlement (DS) Body of the World Trade Organization (WTO) in order to identify possible violations of the technical barriers to trade (TBT) agreement. This paper attempts to find the linkages between DS cases citing the TBT agreement and the STC data regarding TBTs. The DS Body’s decisions regarding possible violations of the TBT agreement are discussed in detail. Afterwards, we analyze, descriptively and econometrically, the relationship between notified STCs and DS consultations regarding TBTs.
