In Act No. 23 of 2014 on Regional Government, where there mention of the obligatory functions and affairs of choice, where one obligatory This is an investment, then in Government Regulation No. 38 Year 2007 on the dealings between the central government, provincial government and district / city government, a local government authority is in the field of investment, government Bandung, capital investment is obligatory and one local government authority is placed in the structure organization Bappeda Bandung is in the Investment Sector, is of course contrary to the Law No. 23 Year 2014 and Government Regulation No. 38 of 2007. This paper provides the organizational structure of institu-tional investment in the city of Bandung.Dalam Undang-Undang Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah dise-butkan mengenai urusan wajib dan urusan pilihan, dimana salah satu urusan wajib ini adalah pena-naman modal, kemudian dalam Peraturan Pemerintah Nomor 38 Tahun 2007 tentang Pembagian urusan antara pemerintah pusat, pemerintah provinsi, dan pemerintah kabupaten/kota, salah satu kewenangan pemerintah daerah adalah dalam bidang penanaman modal, di pemerintahan Kota Bandung, penanaman modal yang merupakan urusan wajib dan salah satu kewenangan pemerintah daerah ditempatkan dalam struktur organisasi Bappeda Kota Bandung yaitu pada Bidang Pena-naman Modal, ini tentu saja berseberangan dengan UU No. 32 Tahun 2004/UU No. 23 Tahun 2014 dan Peraturan Pemerintah No. 38 Tahun 2007. Artikel ini berisi tentang struktur organisasi kelem-bagaan penanaman modal di Kota Bandung.

Abstract Amendments to the laws on local government undnagan impact on local government authority in running the affairs of government. For 10 years Indonesian running the regional autonomy system using Law No. 32 of 2004 on local government, and amendments thereto, for the moment the law declared invalid by the enactment of Law No. 23 Year 2014 on Regional Government, the State Gazette of the Republic of Indonesia Year 2014 No. 244, on October 2, 2014. in the Act governing the affairs of government that must be done by the central government, provincial government and local government district / city. Some affairs are regulated in more detail in the Government Regulation No. 18 Year 2016 concerning the Region, which regulates the scope of authority in dealing with government affairs. PP No. 1/2016 outlining the areas that must be held in an area with indicator, scale of values that can be found local work load. Environmental Management itself in Law number 23/2014 and Government Regulation No. 1/2016 is a category / classified in the Mandatory government affairs unrelated to basic services.Keywords: Local authorities, Environment, government affairs

In the Indonesian national government system is recognized the existence of local government, the region consists of provincial, district and municipal areas. The Provincial Region is headed by a Governor, a Regency area headed by a Regent and a City area headed by a Mayor. Based on Law Number 23 Year 2014 on Regional Government placed the Governor in 2 (two) functions, namely; As Head of Region and As Deputy of Central Government in Region. The governor as the representative of the central government in the regions gained the delegation of authority from the government to carry out central government affairs in the regions. As a representative of the central government in the region the governor carries out the absolute affairs and implements the concurrent governmental affairs which are the authority of the central government and conducts the guidance and supervision of the districts / municipalities in carrying out the concurrent affairs which are the authority of the district / city government. In the implementation of central government affairs in the region it is necessary to have central government representatives in the regions and vertical institutions. Prior to the issuance of Law Number 23 Year 2014 in relation to the Governor as the representative of the central government in the regions is regulated in Law Number 32 Year 2004 regarding regional government and followed up by Government Regulation No. 7 of 2008 on Deconcentration and Co-Administration. In Act No. 23 of 2014 on Regional Government it is stated that the representative of central government in the regions is only given to the Governor, while the Regent / Mayor does not get the authority as a representative of the central government in the region. In carrying out the guidance and supervision on the implementation of government affairs which is the authority of the district / city and the task of assistance by the district / city, the President is assisted by the Governor as the representative of the central government.

The research objective was to determine the authority of local governments in forest protection based on Law Number 32 of 2004 and Law Number 23 of 2014 concerning Regional Government and to see the implications of the transfer of personnel, facilities and infrastructure, and documents on the protection of the Tagafura Protected Forest Area. , Tidore Islands City. This research used interview and document study methods. The data collected were analyzed qualitatively and descriptively. The research was conducted at the Tidore Islands City Government, the North Maluku Provincial Forestry Service Office and the Kalaodi Urban Village Office. This study found that: (1) the authority of the government based on Law Number 32 of 2004 lies in the regency or city, while in Law Number 23/2014, this authority is transferred to the provincial government; (2) The transfer of personnel, transfer of facilities and infrastructure as well as documents on efforts to protect the Tagafura Protected Forest Area did not proceed properly.

Nowadays, The Institutional of environmental in regional experinced many changes, its cause of stipulated of Law No. 23 of 2014 on Local Government and Government Act No. 18 of 2016 on Local Government Organization. Rule about central government authority and local government authority on environment aspect that ruled by Act No. 32 of 2009 on Protection and Management of Environment must be adjusted with Act No. 23 of 2014 on Local Government and Government Act No. 18 of 2016 on Local Government Organization. This research analyze about institutional harmonization on statute approaches. It is expected that this research give a knowledge of affairs which central government authority, province government authority, and district/regency government authority clearly especially on environment aspect. The minister of environment and forestry in order to implementing coordinative function, should be obliged to synchronize working program of environment institution between local and central government for making integrated environment management (policy) approaches.

Penyelenggaraan kewenangan pemerintah daerah telah bergeser ke arah prinsip ultra vires doctrine yang nampak pada perumusan kewenangan pemerintah daerah menjadi urusan pemerintah daerah, dan pembagian kewenangan pemerintah pusat dan daerah mengedepankan prinsip yang kongkuren.Kondisi ini ditandai dengan penyelenggaraan urusan pendidikan yang terbagi antara pemerintah kabupaten/kota dengan pemerintah provinsi, dimana untuk pendidikan dasar diselenggarakan oleh pemerintah kabupaten/kota sedang pendidikan menengah dikelola oleh pemerintah provinsi. Penelitian ini dilakukan dengan pendekatan motode kualitatif melalui observasi dan kajian pustaka.  Hasil dari penelitian ini menunjukkan penyelenggaraan urusan pendidikan menengah yang dialihkan kepada pemerintah provinsi akan menimbulkan sejumlah kecenderungan baru dalam pengelolaannya baik pada pemerintah daerah maupun pada pemerintah provinsi. Pertama, bahwa kebijakan – kebijakan yang selama ini dikeluarkan oleh pemerintah daerah terkait bidang pendidikan tidak seluruhnya akan diakomodir oleh pemerintah provinsi. Kedua, kecenderungan pada meningkatnya alokasi anggaran pada pemerintah provinsi sebagai ekses pengalihan kewenangan tersebut. Ketiga, proses evaluasi, pengawasan dan pengendalian penyelenggaraan pendidikan menengah oleh pemerintah provinsi yang akan semakin berat dilihat dari sisi letak geografis wilayah, dan keempat kekhawatiran akan kurang terakomodirnya muatan kearifan lokal dalam penerapan kurikulum, dimana sebelumnya setiap kabupaten/kota tentunya memiliki karakteristik budaya yang berbeda sebagai bentuk kearifan lokal yang dapat menjadi penguat dalam penyusunan kurikulum pendidikan. Key Words : Penyelenggaraan Urusan Pemerintahan, Pendidikan Menengah   Abstract Implementation of local government authority has shifted towards the principle of ultra vires doctrine which appears on the formulation of local government authority to the affairs of local government, and the division of central and local government authority put forward the principle of kongkuren. This condition is characterized by the implementation of educational affairs divided between district / municipal governments and provincial governments, where basic education is administered by district / municipal governments while high school is managed by the provincial government. This research was conducted with qualitative motive approach through observation and literature review. The results of this study indicate that the implementation of secondary education affairs transferred to the provincial government will lead to new trends in the management of both local government and provincial governments. First, that the policies that have been issued by local governments related to the education sector will not be entirely accommodated by the provincial government. Second, the tendency to increase budget allocation to the provincial government as an excess of the transfer of authority. Third, the process of evaluation, supervision and control of the implementation of high school by the provincial government will be more severe in terms of geographical location of the region, and the four concerns will be less accommodated local wisdom content in the application of the curriculum, where previously each district government / different as a form of local wisdom that can be a reinforcement in the preparation of educational curriculum. Local regulations are local regulations that are established by local specificities recognized by the Constitution of the Republic of Indonesia-1945 as part of their decentralization. Local regulations can not contradict the legislation of higher order not to cause a result of the cancellation. This cancellation is the authority of the central government in relation to the unitary state. Supervision by the central government there are two models of preventive supervision and oversight repesif. Cancellation regulatory oversight repesif area is conducted on local government. Cancellation Provincial Regulation made by the President and the Minister of the Interior gave rise to a dualism. For it will be discussed on How cancellation arrangements are made with the Provincial Regulations and Regulations Presidential Decree of the Minister of the Interior? 2. What is the legal effect of the cancellation of Provincial Regulation by Presidential Decree and the Regulation of the Minister of the Interior? The issues discussed using normative research by using the approach of legislation, the legal concept analysis approach, in order to obtain answers that dualism cancellation provincial regulations stipulated in several laws including Law No. 32 Year 2004 on Regional Government, Law No. 28 year 2009 on Local Taxes and levies, Government Regulation No. 79 Year 2005 on Guidelines Direction and Control of Local Government, Minister of the Interior No. 1 Year 2014 on the Establishment of the Regional law Products stating that the authority of the cancellation of regulations made by the President of the instrument while the Presidential Decree cancellation made by the Minister of the Interior was limited to cancellation Draft Regional Regulation on stage during the evaluation of preventive supervision and legal consequences caused by the dualism cancellation of local regulations are different between cancellation made by the President and minister of Interior. Cancellation is cancellation of its President in the field of executive interim final cancellation made by the Minister of the Interior if the local government to enforce the local regulations canceled Interior Minister will ask the cancellation to the President.

Through access to regional autonomy, the desire of various regions to formulate Islamic law into their laws and regulations in order to fulfill rights and obligations and respond to various problems of society becomes more open. Therefore, the purpose of this research is to reveal how the function of Sharia Regional Regulations in the implementation and fulfillment of basic service duties of local government, especially from the aspects of education and socio-culture in Gorontalo Province. This type of research includes normative legal research supported by empirical data, which examines comprehensively and analytically the primary and secondary legal materials, using statute approach and case approach. The result of the research indicates that the existence of these regional regulations is one of the provisions ensured in Law no. 23 of 2014 on Local Government and Government Regulation Number 38 of 2007 on the Division of Government Affairs, between the Provincial Government and Regency/Municipal Government. The regional regulations drafted and compiled by the Gorontalo provincial government actually assure harmony of life, security, and order. As it is in the field of one's religious education. The existence of the Regional Regulation of Reading and Writing Al-Qur'an in Gorontalo is able to embody the desire of students to develop their education to higher level, as a condition for entering the next school level. Meanwhile, from the socio-cultural aspect, the existence of Regional Regulations on the Prohibition of Gambling, Prostitution, and Liquor, helps the government create order and tranquility in people's lives, maximize regional potential and development, especially with regard to local wisdom. Therefore, the Regional Government requires to implement and maximize the provisions of sharia regional regulations in order to support development, especially those related to basic services in various aspects, in order to maximize the regional potential and local wisdom.

This research aims to find out the problems and solutions that can be done to overcome the problem of the protection of batik copyright law in the city of Cilegon based on law number 28 of 2014 concerning copyright.The formulation of the problem and the purpose of this paper is to see how the existence of batik in the city of Cilegon, businesses and any obstacles faced by the Cilegon city government in providing legal protection for the batik. in addition, the purpose of this study is to provide knowledge that the importance of other legal instruments that are technical. The intended legal device can be in the form of a Regional Government Regulation that regulates the protection of traditional batik art creations including folklore. The research method used is the empirical juridical approach method, where the procedure begins by examining secondary data first, then proceed with examining primary data in the field. The specifications of this study are analytical descriptive. Sources and types of data, consisting of primary data and secondary data. <p>Abstract<br />The authority to issue Mining Business Licenses based on Law Number 4 of 2009 concerning  Mineral and Coal Mining is owned by the Central Government, Provincial Government and Regency/City Government. Meanwhile, based on Law Number 9 of 2015 concerning the Second Amendment to Law Number 23 of 2014 concerning Regional Government the authority to issue  Mining Business Permits is owned by the Central Government and the Provincial Government. This article objective to discuss the implications of the regulation of mining business licenses that are not synchronized and efforts to synchronize the regulation of Mining Business Permits. This article is a descriptive analytical legal research. This research was carried out by the law approach. The data used are secondary data, namely the statutory provisions, the Regulation of the Minister of Energy and Mineral Resources, and the mining law literature with the technique of collecting study documents or library materials. So that the implications of these asynchronous arrangements can be resolved and the creation of an ideal Mining Business Permit arrangement.<br />Keywords: Synchronization; Implications; Mining Business Licenses; Investment.</p><p>Abstrak<br />Kewenangan penerbitan Izin Usaha Pertambangan berdasarkan Undang-Undang Nomor 4 Tahun  2009 tentang Pertambangan Mineral dan Batubara dimiliki oleh Pemerintah Pusat, Pemerintah  Provinsi, dan Pemerintah Kabupaten/Kota. Sedangkan berdasarkan Undang-Undang Nomor  9 Tahun 2015 tentang Perubahan Kedua Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah kewenangan penerbitan Izin Usaha Pertambangan dimiliki oleh Pemerintah Pusat dan Pemerintah Provinsi. Artikel ini bertujuan untuk membahas mengenai implikasi pengaturan Izin Usaha Pertambangan yang tidak sinkron dan upaya sinkronisasi pengaturan Izin Usaha Pertambangan. Artikel ini merupakan penelitian hukum doktrinal yang bersifat deskriptif analitis. Penelitian ini dilakukan dengan pendekatan undang-undang. Data yang digunakan merupakan data sekunder yaitu ketentuan perundang-undangan, Peraturan Menteri Energi dan  Sumber Daya Mineral, dan literatur hukum pertambangan dengan teknik pengumpulan data studi dokumen atau bahan pustaka. Sehingga implikasi dari pengaturan yang tidak sinkron tersebut dapat diselesaikan dan terciptanya pengaturan Izin Usaha Pertambangan yang ideal.<br />Kata Kunci: Sinkronisasi; Implikasi; Izin Usaha Pertambangan; Investasi.</p>

Decentralization is a policy for regions to maximize the functions of a regional government authority. Proportional and optimal power in mobilizing every resource in the area will make the region have independence in developing the part. The method used is a literature study; besides, the authors also use media such as newspapers, magazines, bulletins, and other sources relating to the discussion as reference material in reviewing the debate, analysis using descriptive-analytic methods. Decentralization implemented in the city of Makassar has made a very positive contribution to the people of Makassar, because, with devolution, the Makassar city government can plan its development independently for the sake of a sustainable city. The implementation of decentralization in the town of Makassar has implications for the progress of regional development; this can see in the physical event in the city and the level of economic growth.
