Implementation of the principle of restorative justice on the crime of persecution is still many pros and cons. For the investigator is not easy to settle the criminal act of persecution with the principle of restorative justice because there must be agreement between the victim's family and the perpetrator. Research method in writing this thesis is Library Research and Field Research. Implementation of the principle of restorative justice in the process of investigation of children as perpetrators of criminal acts of persecution, investigators have opinions that are different from the Law of the Criminal Justice System of Children. Implementation of the principle of restorative justice in the settlement of criminal acts of mistreatment committed by a child is performed after the process of conversion if the diversion fails and without the existence of a third warning letter and the determination of the court. The obstacles faced by the Dairi Regional Police are that there is no meeting point between the perpetrators and the victims and their families, the families of the victims object to the perpetrators and expect the perpetrators to be punished severely, the victims and perpetrators do not want to make peace through diversion.

Criminal liability is a necessary condition to impose a crime against a person who commits a crime, including a crime committed by a child which results in a fire. The problems that will be discussed in this study are related to how the criminal liability of children that causes fires and how the juvenile justice system is organized in Indonesia. The purpose of this study is to determine the criminal liability of children who cause fires and to determine the implementation of the juvenile justice system in Indonesia. The data collection technique in this research is using the library research method. While the analysis technique carried out on the legal materials that have been collected by the author will be done deductively. The results of this study indicate that if the child who commits the crime that resulted in the fire is 12 years old, then the child can be burdened with criminal liability. Furthermore, the implementation of the juvenile criminal justice system in Indonesia starts from the investigation stage to the guidance stage after serving a crime.

Restorative justice challenges the traditional outcomes and processes of the criminal justice system. While as a unified theory of punishment restorative justice is notably problematic, elements of it have been incorporated within sentencing regimes around the world. Responding to increasing incarceration rates and disproportionate Aboriginal incarceration rates and in articulating the fundamental purpose and principles of sentencing, Parliament included principles of restorative justice, thanks in part to a belief in its particular application to Aboriginal offenders. The Canadian approach to restorative justice is focused entirely on securing non-custodial outcomes. However, other principles of sentencing, Canadian appellate jurisprudence, further legislative amendment, and the growth of penal populism demonstrate that the Canadian sentencing regime, taken as a whole, precludes this very goal. The author demonstrates that the statutory adoption of restorative justice through the Criminal Code has not had its intended effect: Aboriginal offenders are just as likely to face a term in custody as they were prior to the 1996 amendments. That said, there remains a role for restorative justice. The author argues for a shift to restorative processes. This shift would allow for a continued commitment to restorative justice while alleviating the obstacles associated with an outcome-centered approach. Importantly, it reflects the recognition that the Aboriginal offender can benefit from actively participating in the determination of how best to address his offending. Finally, this approach recognizes that there is a disconnect between the criminal justice system and traditional Aboriginal justice, and reflects factors shown to increase voluntary compliance with the law.La justice réparatrice met en question les résultats et les processus traditionnels du système de justice pénale. Quoique en tant que théorie unifiée de châtiment, la justice réparatrice est notamment problématique, certains de ses éléments ont été incorporés aux systèmes de détermination des peines partout au monde. En réaction aux taux croissants d’incarcération et des taux disproportionnés d’incarcération d’autochtones et en énonçant le but fondamental et les principes de la détermination des peines, le Parlement a inclus des principes de justice réparatrice, en partie à cause de la croyance en son application particulière aux contrevenants autochtones. L’approche canadienne à la justice réparatrice porte entièrement sur l’obtention de résultats sans privation de liberté. Toutefois, d’autres principes de détermination des peines, la jurisprudence des cours d’appel, de nouveaux amendements législatifs et la croissance du sentiment populaire par rapport aux peines démontrent que le système canadien de détermination des peines, dans son ensemble, empêche justement l’atteinte de cet objectif. L’auteur fait voir que l’adoption statutaire de la justice réparatrice dans le Code criminel n’a pas eu l’effet voulu : les contrevenants autochtones ont les mêmes chances de se voir imposer une période de détention qu’ils avaient avant les amendements de 1996. Cela dit, un rôle demeure pour la justice réparatrice. L’auteur argumente en faveur d’un virage vers les processus réparateurs. Ce virage permettrait de maintenir l’engagement envers la justice réparatrice tout en allégeant les obstacles associés à l’approche centrée sur les résultats. Il importe de noter que cela reflète la reconnaissance que le contrevenant autochtone peut bénéficier de participer activement à la détermination de la meilleure façon de traiter de son infraction. Finalement, cette approche reconnaît la discordance entre le système de justice pénale et la justice autochtone traditionnelle, et reflète des facteurs qui ont manifestement augmenté le respect volontaire de la loi.

The formulation of the problem and the purpose of this study is to describe and analyze the diversion urgency in handling juvenile criminal cases, and to describe and analyze Perma No. 4 of 2014 on Diversion in criminal matters menyelesaian children through restorative justice approach. This research method using normative legal research methods dengn type of research is descriptive analytical.� Based on the analysis result No. 4 of 2014 can be presented the following results, that Perma No. 4 of 2014 is needed in handling juvenile criminal cases. This is because during this time the condition of children who are in the coaching institutions, detention and permayarakatan far worse than a face appeared positive aspects of child development. Mixing children with adults in penitentiary have negative effects and its own psychological burden for the child, because he considered himself the same as adults with Perma No. 4 of 2014.Keywords: Diversion, Child Criminal Justice System, Restorative Justice

ABSTRAKPrinsip keadilan restoratif dalam peraturan perundang-undangan hukum pidana yang berlaku di Indonesia hanya diatur dalam Undang-Undang Sistem Peradilan Pidana Anak (SPPA) yang diaplikasikan dalam bentuk diversi, namun diversi tersebut hanya ditujukan bagi pelaku tindak pidana anak bukan untuk pelaku dewasa, peraturan perundang-perundangan pidana Indonesia belum mengatur prinsip keadilan restoratif bagi pelaku dewasa. Dalam praktik penegakan hukum, penerapan prinsip keadilan restoratif bagi pelaku dewasa sebagian telah dilaksanakan melalui diskresi, namun secara teoritis dan pratik pelaksanaan diskresi masih bermasalah karena belum memenuhi tiga nilai dasar hukum yaitu keadilan, kepastian dan kemanfaatan, dan diskresi juga bisa menimbulkan permasalahan ketidakadilan, karena adanya perbedaan perlakuan dalam proses penegakan hukum, sehingga asas “equality before the law” tidak dilaksanakan. Tujuan penelitian adalah untuk mengetahui bagaimana pelaksanaan prinsip keadilan restoratif dalam peraturan perundang-undangan pidana yang berlaku di Indonesia dan bagaimana penerapan diversi bagi pelaku dewasa dalam rangka mewujudkan keadilan restoratif. Jenis penelitian yaitu penelitian hukum normatif atau penelitian hukum kepustakaan, untuk mencari dan menemukan data yang dibutuhkan untuk menjawab permasalahan. Hasil penelitian diketahui bahwa peraturan perundang-undangan hukum pidana Indonesia belum mengatur tentang prinsip keadilan restoratif bagi pelaku dewasa, prinsip keadilan restoratif diterapkan baru sebatas untuk pelaku anak yang diaplikasikan dalam bentuk diversi. Secara teoritis, historis, normatif dan praktik prosedural, diversi juga dapat diterapkan untuk menyelesaikan perkara tindak pidana yang dilakukan oleh orang dewasa, namun perlu adanya perubahan dan penyesuaian terutama dalam hal tujuan pelaksanaan, kwalifikasi jenis tindak pidana dan mekanisme atau prosedur pelaksanaannya.Kata kunci: kebijakan hukum pidana; anak; dewasa; diversi; keadilan restoratif.AbstractThe principle of restorative justice in criminal law regulations in force in Indonesia is only regulated in the Law on the Criminal Justice System for Children (SPPA) which is applied in the form of diversion, however the diversion is only intended for child offenders not for adult offenders, Indonesian criminal laws and regulations do not regulate the principle of restorative justice for adult offenders. In law enforcement practices, the application of the principle of restorative justice for adult offenders has been partially implemented through discretion, but theoretically and practically the implementation of discretion is still problematic because it does not meet the three basic legal values, namely justice, certainty and benefit, and discretion can also cause problems of injustice, due to differences in treatment in the law enforcement process, so the principle of "equality before the law" is not implemented. The research goal is to find out how the implementation of the principles of restorative justice in criminal legislation in Indonesia, and how the application of diversion for adult offenders in order to realize restorative justice. This type of research is normative research or library research, to search and find the data needed to answer the problem. The results of the study note that Indonesian criminal law regulations do not regulate the principles of restorative justice for adult offenders, the principle of restorative justice is applied only to the child offenders which is applied in the form of diversion. Theoretically, historically, normatively and procedural practice, diversion can also be applied to resolve cases by adult offenders, but there needs to be changes and adjustments especially in terms of implementation objectives, qualification of the type of crime and the mechanism or procedure for its implementation.Keywords: criminal law policy; children; adults; diversion; restorative justice.

Currently in Indonesia Islamic Bank has gained a place and interested in the community, causing many emerging Syari'ah Bank and Financial Institutions of the syari'ah, and products in Islamic banks are widely used is murabahah financing. The formulation of the problem in this research are: (1). How is the implementation of the sale and purchase through murabahah financing between Bank Muamalat Harkat with customers. (2). Is trading system murabahah financing between Bank Muamalat Harkat and customers have been according to the principles of Syari’ah. (3). How murabahah financing efforts to resolve the breach between the customer and Muamalat Harkat. This research method is empirical legal research, this study was conducted in Bank Muamalat Harkat based data collection through field research such as interviews, observation and description as well as information from respondents through library research. The results of this research are: before an agreement Bank to assess carefully the prospective customer in the form of a comprehensive analysis and is divided into several stages, such as the assessment using the principle of 5C Character (Character of the debitor), Chapacity (Capability Candidate Debitor) , Capital (Capital candidate Debitor), Collateral (Collateral candidate Debitor) and Condition of economy (economic condition of the prospective Borrower). Trading system murabahah financing between Bank Muamalat Harkat with the customer has not fully based on the principles of the Syari'ah. Murabahah financing efforts to resolve the defaults can be solved by R3 is Restrukturing (Arrangement Back), Reconditioning (Terms Back) and Rescheduling (rescheduling), sales collateral and auction execution.

In the 21st century, the concept of restorative justice has become widespread in criminal proceedings. The introduction of special compromise procedures into the criminal process allows for the restoration of the rights of the victim and reduces the level of repression in the criminal justice system. The traditional system of punishment is considered ineffective, not conducive to the purpose of compensating for harm caused by the crime. Restorative justice enables the accused to compensate for the harm caused by the crime and is oriented not towards their social isolation, but towards further positive socialization. The introduction of the ideas of restorative justice into the Russian criminal process requires the introduction of special conciliation procedures. The purpose of the article is to reveal promising directions for introducing special conciliation procedures into the Russian criminal process. The use of the formal legal method provided an analysis of the norms of criminal procedure legislation and the practice of its application. Comparative legal analysis revealed common features in the development of models of restorative justice in modern states. Conclusions. The introduction of conciliation procedures into the Russian criminal process is in line with the concept of its humanization and reduction of the level of criminal repression. The consolidation of the mediator»s procedural status and the mediation procedure in the criminal procedure legislation will make it possible to put into practice the elements of restorative justice.

This article examines the incorporation of restorative principles and practices within reforms of Northern Ireland’s youth justice system, adopted following the peace process. It considers whether restorative justice principles can be successfully incorporated into criminal justice reform as part of a process of transitional justice. The article argues that restorative justice principles, when brought within criminal justice, can contribute to the broader process of transitional justice and peace building, particularly in societies where the police and criminal justice system have been entwined in the conflict. In these contexts restorative justice within criminal justice can help civil society to take a stake in the administration and delivery of criminal justice, it can help break down hostility and animosity towards criminal justice and contribute to the development of social justice and civic agency, so enabling civil society to move forward in a transitional environment.

Increased recognition of the need for victims of crime to be integrated into the criminal justice system and to receive adequate reparation has led, in a number of jurisdictions, to legislative measures to encourage the greater use of compensation orders. The Sentencing Act 1997 (Tas) (which came into force on 1 August 1998) went further and made compensation orders compulsory for property damage or loss resulting from certain crimes. This article shows that this measure has failed victims and argues that they have been used in the service of other ends. Mandatory compensation orders are a token gesture repackaged as restorative justice to gain public support for the administration of the criminal justice system.Ways in which compensation orders could be made more effective and the possibilities of accommodating restorative compensation into a conventional criminal justice system are explored.
