The formulation of the problem and the purpose of this study is to describe and analyze the diversion urgency in handling juvenile criminal cases, and to describe and analyze Perma No. 4 of 2014 on Diversion in criminal matters menyelesaian children through restorative justice approach. This research method using normative legal research methods dengn type of research is descriptive analytical.� Based on the analysis result No. 4 of 2014 can be presented the following results, that Perma No. 4 of 2014 is needed in handling juvenile criminal cases. This is because during this time the condition of children who are in the coaching institutions, detention and permayarakatan far worse than a face appeared positive aspects of child development. Mixing children with adults in penitentiary have negative effects and its own psychological burden for the child, because he considered himself the same as adults with Perma No. 4 of 2014.Keywords: Diversion, Child Criminal Justice System, Restorative Justice

The purpose of this research to determine and analyze the extent to which restorative justice is implemented in the settlement of juvenile criminal cases at the Tanjung Karang High Court and to determine the inhibiting factors for law enforcers to implement restorative justice in resolving juvenile criminal cases at the Tanjung Karang High Court. This research is an empirical juridical legal research. Based on the research results, the application of restorative justice at the Tanjung Karang High Court has been carried out although it is not optimal. The application of restorative justice to children in conflict with the law in resolving child criminal cases at the Tanjung Karang High Court is still experiencing obstacles. These obstacles include the limping of the substance of Law No. 11 of 2012 concerning the Juvenile Criminal Justice System, the short duration of case handling, and the minimum budget.

The method of community organization can be used to implement restorative justice within the community. This study aimed at understanding whether members from seven communities in Malaysia would assume responsibility for restorative justice initiatives, accept various elements of restorative justice, and welcome offenders back into the community. The findings are mixed. Some community members believed that the community setting may offer resources for offender rehabilitation that the criminal justice system does not have; others raised concerns over various limitations such that communities may not be equipped to deal with criminal cases.

ABSTRAKPenanganan perkara tindak pidana korupsi menganut sistem pemidanaan minimum bagi pelaku yang diputus bersalah oleh pengadilan. Istilah ketentuan pidana minimum khusus secara normatif diatur dalam Pasal 2 ayat (1) Undang-Undang Nomor 31 Tahun 1999, sebagaimana telah diubah menjadi Undang-Undang Nomor 20 Tahun 2001 tentang Pemberantasan Tindak Pidana Korupsi. Pada tataran praktiknya terdapat fenomena adanya putusan pengadilan yang menerobos sistem pemidanaan minimum yang dianut tersebut. Salah satu contoh putusan pengadilan yang ditelaah dalam tulisan ini adalah Putusan Nomor 2399 K/PID.SUS/2010. Permasalahan yang timbul adalah apa saja yang menjadi landasan infra petita hakim dalam menjatuhkan putusan yang menerobos ketentuan pemidanaan minimum dalam perkara tindak pidana korupsi tersebut. Metode dalam penelitian ini menggunakan metode penelitian hukum normatif dengan menggunakan pendekatan undang-undang. Penulis berkesimpulan bahwa putusan pengadilan tindak pidana korupsi yang menerobos ketentuan pemidanaan minimum dalam Undang-Undang Pemberantasan Tindak Pidana Korupsi pada dasarnya diperbolehkan. Sepanjang putusan hakim yang infra petita tersebut memiliki esensi ratio legis yang kuat dan dapat dipertanggungjawabkan, atas dasar alasan pertimbangan nilai keadilan dan pertimbangan judex factie sebagaimana pada perkara a quo.Kata kunci: putusan, korupsi, pemidanaan minimum. ABSTRACT In the handling of a corruption case, mandatory minimum penalty is adopted in the criminal justice system for the offender who was found guilty by the court. The term ‘mandatory minimum penalty’ is normatively regulated in Article 2 paragraph (1) of Law Number 31 of 1999, as amended to Law Number 20 of 2001 concerning Corruption Eradication. In practice there is a phenomenon of a court decision breaching the adopted mandatory minimum penalty. One example of a court decision analyzed hereon is the Decision Number 2399 K/PID.SUS/2010. The arising problem is what the consideration of the judge is for infra petita in imposing decision which breached the mandatory minimum penalty provision in that corruption case. This research uses normative legal research method with legislation approach. It can be concluded that it is basically permissible in the corruption court’s decision to breach the minimum penalty provisions as stipulated in the Corruption Eradication Law. Provided that the judge’s decision of infra petita, is based on strong legislation ratio and can be accounted for, on the basis of justice value and judex factie considerations as in the a quo case. The best treatment for children who should be lived, with the best interests for the sustainability of human life. In handling criminal cases, the restorative justice approach provides different views and approaches to studying and dealing with a criminal act for the handling of restorative justice, that criminal acts are essentially from the viewpoint of criminal law in general, namely attacks on individuals and society as well as community relations. In restorative justice, it can also be found that the features of the formulation of justice are related to rights, judged by results. This meaning has brought a paradigm shift in understanding the concept of providing justice that is in the criminal justice system, it’s said that because in the concept of the criminal justice system in general, justice is considered to have been achieved, the value of the perpetrator can be sanctioned by the state and the victim doesn’t have a place in the settlement process, meanwhile. In the concept of a framework of restorative justice, perpetrators of criminal acts, victims and the whole community are involved in resolving criminal acts directly and focusing on recovery suffered by victims, while the state functions as a facilitator in the process of resolving criminal acts.

The objectives of this research thatin order to properly analyze the basic ideas contained in restorative justice , to dowith children in conflict with the law and to analyze policy formulation set forth in the Law. 112012 on the Criminal Justice System Kids for restorative justice to children inconflict with the law . While this type of research used in scientific journals this isthe kind of normative legal research , because it is based on the assessment thatthere is a conflict between the norms of Law. 11 of 2012 on the Criminal JusticeSystem Children with the norms contained in the draft - Criminal Code ( CriminalCode ) . In this case the unlawful act committed by the child who has not reached theage of 18 (eighteen years ) diversion efforts which have the purpose for the creationof a balance between the interests of focus and attention to the perpetrator and thevictim also impact the completion of the criminal case that happens in thecommunity to ensure and protecting children and their rights in order to live , grow,develop and participate optimally in accordance with the dignity of humanity , aswell as protection from violence and discrimination .

ABSTRAKDalam sistem peradilan pidana penanganan suatu kasus dimulai sejak kasus itu muncul, kemudian ditangani oleh polisi, hingga proses akhir dari penegakan hukum terletak pada putusan hakim. Putusan hakim dapat berupa menjatuhkan hukuman ataupun membebaskan seorang terdakwa. Dalam putusan hakim akan terlihat kemampuan hakim dalam mengonstruksi kasus sejak dakwaan dibacakan hingga pledoi diucapkan. Semua konstruksi hakim tersebut akan tergambar dalam pertimbangan-pertimbangan. Dalam pertimbangan tersebut akan terlihat apakah suatu putusan tersebut melanggar kode etik atau tidak. Apa yang terlihat dalam dua putusan hakim yang dikeluarkan oleh Pengadilan Negeri Tobelo, mencerminkan adanya persoalan ketika seorang terdakwa dua kali dihukum oleh majelis hakim yang sama untuk perbuatan yang sama pula. Hal inilah yang kemudian menjadi rumusan masalah, apakah putusan tersebut melanggar Kode Etik dan Pedoman Perilaku Hakim atau tidak? Dengan menggunakan metode penelitian hukum normatif yang memfokuskan kajian pada data sekunder, maka akan terlihat bagaimana sesungguhnya dua putusan tersebut. Hasil dari penelitian ini menunjukkan telah terjadi pelanggaran Kode Etik dan Pedoman Perilaku Hakim yang dilakukan oleh majelis hakim.Kata kunci: kode etik dan pedoman perilaku hakim; sistem peradilan pidana; profesionalisme.  ABSTRACT In the criminal justice system, the handling of a case starts since the claim arises, then is handled by the police, until the final process of law enforcement, which lies in the judge's decision. Judges' decisions can be in the form of sentencing or acquitting a defendant. The ability of a judge to construct a case will appear in the decision from the time the indictment is read until the plea is pronounced. In these considerations, it will be seen whether the judge's decision violates the code of ethics or not. Two judges' decisions issued by the Tobelo District Court reflect the problem in which a defendant was twice sentenced by the same panel of judges for violating the same law. This is what then becomes the formula of the problem, whether the decision violates the Code of Ethics and Code of Conduct of Judges or not. By using normative legal research method focusing on secondary data construing, it will expose the fact of these two decisions. The results of this analysis indicate that there are violations of the Code of Ethics and Code of Conduct of Judges been committed by the panel of judges examining the case. Keywords: code of ethics and code of conduct of judges; criminal justice system; professionalism.

Penyelesaian perkara pidana melalui lembaga peradilan sering tidak menjamin rasa keadilan di antara korban dan pelaku. Oleh karenanya diperlukan penyelesaian melalui restorative justice untuk mewujudkan keseimbangan antara korban dan pelaku. Selain itu agar penanganan perkara pidana dapat berjalan secara fleksibel dan tidak bersifat kaku. Penelitian ini menjawab permasalahan sejauh mana restorative justice dapat diterapkan dalam sistem peradilan pidana di Indonesia untuk mencapai keadilan dan bagaimana mewujudkan keseimbangan antara pelaku dan korban tindak pidana guna menuju cara berhukum yang fleksibel. Penelitian ini termasuk dalam penelitian hukum empiris yang bersifat deskriptif dengan menggunakan pendekatan kasus dan perundang-undangan. Berdasarkan hasil penelitian disimpulkan bahwa restorative justice di Indonesia sejauh ini dapat diterapkan dalam penyelesaian perkara pidana untuk mencapai keadilan. Selain itu restorative justice terbukti mampu mewujudkan keseimbangan antara pelaku dan korban tindak pidana. Oleh karena itu direkomendasikan agar aparat penegak hukum mempunyai standar operasional untuk menggunakan restorative justice pada setiap penanganan perkara pidana.<p>The completion of criminal cases often does not give the sense of justice between the victims and perpetrators. Based on that, citizens need a resolution in justice through restorative justice to create balance between the victims and perpetrators. Moreover, through the restorative justice, the vision is to have resolution of criminal case that can run flexible and is not rigid. This research answers the question of the application’s effect of the restorative justice can be done in the criminal justice system in Indonesia in creating justice and the question of the process to make balance justice between the victims and perpetrators in order to reach flexible ways in law. This research is included in the descriptive empirical law research by using case approach and the legislation. Based on the research’s result, the writer can conclude that the restorative justice in Indonesia nowadays can be applied in the criminal case solution to reach the justice.</p>

The concept of diversity and restorative Justice is a criminal cases settlement form that provide children protection by promoting the best interest of the child principle. To protect children from the formal process of criminal justice system, the legal and humanitarian experts conceptualize the act of removing child who has allegedly committed a criminal offense from the general criminal justice process by providing an alternative punishment that is considered better for children. The concept of diversion is created based on the fact that the criminal justice process for children as the perpetrators through the conventional criminal justice system causes more harm than good. Restorative Justice is a fair resolving criminal cases system with by emphasizing recovery in its original state. This article will discuss about the shifting of children criminal responsibility from conservative criminal penalties to child friendly criminal penalties with the concept of diversity and restorative justice.

Restorative justice or more precisely keadilan restoratif in the Indonesian context is based on the principle of building joint participation between perpetrators, victims, and community groups in resolving a criminal act. The problem has been that in the formulation of the laws and government regulations diversion (diversi) is carried out if a criminal act is committed by a child who is punishable by imprisonment under seven years other than that if criminal acts that were committed by a child is not a repetition of criminal acts (recidive). A research using a normative legal research method found that through legal findings or rechtsvinding (penemuan hukum), judges can formulate criminal law policies through their decisions based on mens rea. Tt is a must for judges to settle criminal cases with a child of 12-years-old age perpetrator and/or the delinguent actor is a recidive via diversion. The provisions of Indonesian criminal procedure law dicates that judges are also obliged to seek diversion towards the settlement of all criminal cases whose actions were committed by children, both those with a criminal penalty over seven years and/or recidive or those who does not included in the two categories.

The purpose of this article is to formulate the concept of restorative justice which balanced to protect between child offenders and the victims through the diversion (Victim-offender oriented). This goal will be realized through normative research (legal research) based on Restorative Justice concept.  In Law Number 11 of 2012 concerning the Child Criminal Justice System the process (SPPA Law), its prioritizes the Diversion Process (Settlement outside the court) carried out through a Restorative Justice approach. Article 5 paragraph (2) of the SPPA Law states Restorative Justice is the settlement of criminal cases by involving perpetrators, victims, families of perpetrators /victims, and other related parties to jointly to find a fair solution by emphasizing recovery and not based on revenge. Empirical conditions show that balanced legal protection between criminal offenders and victims has not implemented. Evaluation of Law Number 11 of 2012 is needed to formulating the Integrated Child Criminal Court.
