The development of Corruption Crimes has a widespread adverse impact on the lives of Indonesian people life. To stop this, it is needed to be taken a variety of extraordinary efforts including by implementing capital punishment for perpetrators, especially related to criminal acts of corruption that concern to many people that occur when the country is in danger. Even so, not all people agree with the application of capital punishment because it is considered to be conflict with Human Rights, the Constitution of the Republic Indonesia and Pancasila. To analyze these legal issues, various efforts can be taken such as seeing the meaning of the nature of human rights in the perspective of national and international law, interpreting legal norms using appropriate interpretation methods and seeing the existence of capital punishment in the perspective of religious law and customary law. Writing in this study uses a normative juridical approach with the type of data in the form of secondary data which comes from primary legal material and secondary legal material. The writing is done descriptively.

The Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia recently issued Ministerial Regulation of ATR No. 18 of 2019 concerning Procedures for Administration of Customary Land Community Units of Customary Law. However, the reality is that until now there are still ulayat lands of customary law community units whose management, control and use are based on local customary law provisions and are recognized by the members of the customary law community unit concerned. The research uses normative research, namely normative juridical research, namely research based on applicable laws and legal norms and has binding power to answer the legal issues faced. The results obtained are that the characteristics of customary rights of customary law communities, that customary rights to land are controlled by customary law communities, namely people who live in groups, hereditary based on ties of origin/ancestor or similarity of residence, have the same culture, live in a certain area, have customary property that is jointly owned, have customary institutions containing sanctions, as long as they are still alive according to developments and do not conflict with national law.Keywords: Existence; Customary Rights; Minister of Agrarian Regulation.Menteri Agraria Dan Tata Ruang/Kepala Badan Pertanahan Nasional Republik Indonesia baru-baru ini menerbitkan Permen ATR No. 18 Tahun 2019 Tentang Tata Cara Penatausahaan Tanah Ulayat Kesatuan Masyarakat Hukum Adat. Penelitian dengan menggunakan penelitian normatif, yaitu penelitian yuridis normatif, yaitu penelitian didasarkan peraturan perundang-undangan atau norma-norma hukum yang berlaku dan mempunyai kekuatan mengikat guna manjawab isu hukum yang dihadapi. Diperoleh hasil bahwa Karakteristik hak ulayat masyarakat hukum adat, bahwa hak ulayat atas tanah tersebut dikuasai oleh masyarakat hukum adat, yakni masyarakat yang hidup berkelompok, turun menurun berdasarkan ikatan asal usul/leluhur atau kesamaan tempat tinggal, berbudaya sama, hidup dalam satu wilayah tertentu, memiliki harta benda adat milik bersama, mempunyai pranata adat mengandung sanksi, sepanjang masih hidup sesuai perkembangan dan tidak bertentangan dengan hukum nasional.Kata Kunci: Eksistensi; Hak Ulayat; Peraturan Menteri Agraria.

This study aims to determine the arrangement of customary traditions based on Indonesian law and to understand the guarantee of Human Rights in the Manak Salah Tradition in Bali. The method used in research related to human rights assurance in the Manak Salah Tradition in Bali uses normative juridical legal research, using a statutory approach or a statute approach to analyze legal issues in this study. Sources of legal materials in this study consist of primary, secondary, and tertiary legal materials. The results of this study found that human rights guarantee in the Manak Salah Tradition in Bali basically have to be uniform. This is because a tradition will be very difficult to erase, this is because customary law is recognized in the 1945 Constitution of the Republic of Indonesia Article 18B paragraph (2) even though customary law cannot conflict with national law. So that in order to guarantee human rights from the wrong tradition, special arrangements are needed in the form of proper housing facilities, visited by other village krama, provision of MCK facilities, assisted with readiness by all village manners as a whole so as to help ease the burden on the family who is subject to sanctions, help ease the family. Penelitian ini bertujuan untuk mengetahui pengaturan tradisi adat berdasarkan Hukum Indonesia serta memahami jaminan Hak Asasi Manusia (HAM) dalam Tradisi Manak Salah di Bali. Metode yang digunakan dalam penelitian terkait jaminan HAM dalam Tradisi Manak Salah di Bali ini mempergunakan jenis penelitian hukum yuridis normatif, dengan menggunakan pendekatan perundang-undangan atau statute approach dan pendekatan konseptual atau conceptual approach untuk menganalisis isu hukum dalam penelitian ini. Hasil dari studi ini menemukan jika jaminan HAM dalam Tradisi Manak Salah di Bali pada dasarnya harus dilakukan penyeragaman. Hal ini dikarenakan suatu tradisi akan sangat sulit untuk dihapuskan, hal ini dikarenakan hukum adat diakui dalam UUD NRI 1945 Pasal 18B ayat (2)  meskipun hukum adat tidak boleh berlawanan dengan hukum positif Indonesia. Sehingga untuk menjamin HAM dari tradisi manak salah diperlukan pengaturan secara khusus berupa fasilitas perumahan yang layak, dikunjungi oleh krama desa yang lain, penyediaan fasilitas MCK, dibantu kesiapannya oleh seluruh krama desa secara keseluruhan sehingga membantu meringankan beban pihak keluarga yang terkena sanksi, membantu meringankan keluarga.

This paper aims to examine the suitability between national law and international law in the regulation of natural resource use. In this paper used the normative juridical method, with primary data contains laws relating directly to international law, while secondary data in the form of journals or library references. The result obtained that Adjustment of the national legal system into a global legal system, it makes positive law becomes harmonious and uniform (harmony of law) and the adjustment of certain legal norms into a unity of global norm which later can be used as a means of dispute resolution. Harmonious and uniform can be achieved if global harmony of decisions are the same. The legal arrangements of the archipelago countries as reflected in the three points raised by the archipelago supporters which reflect the principles of the regime on waters of the archipelago as practiced by Indonesia and the Philippines. In these circumstances the only effort that can be made to unite the opinions in order to get a clear pattern is the consultation with various groups, both between themselves and between groups.

The existence of a conflict that occurs in a country makes the citizens of the country feel uncomfortable with their country so that some of them decide to run for protection. The flight has an influence on the State of Australia because it is one of the countries that are the destination countries for Asylum Seekers and so on. This then made the State of Australia make a policy in terms of maintaining sovereignty and fighting human rights crimes such as trafficking and people smuggling. The policy is Operation Sovereign Borders which turns out to experience a conflict harvest because it is not in accordance with the requirements of international law. The ratification of this policy aims at how to handle protection seekers in accordance with the requirements of International Law and law enforcement in the event of a violation based on the Operation Sovereign Borders policy. Writing KTI uses the normative juridical method. The specifications used are descriptive-analytic. Then the data used is secondary data. In its implementation, Operation Sovereign Borders is still inappropriate so that it violates the sovereignty of the Republic of Indonesia and violates the ethics of neighboring countries (good neighborliness), besides that it also violates the principles of international law contained in the 1952 Convention and instruments of International Human Rights (non-refoulement principle)

U.N. Secretary General Kofi Annan recently observed that "state sovereignty, in its most basic sense, is being redefined ... by the forces of globalisation and international cooperation." The article deals with the question of how much this is an accurate observation in the context of humanitarian intervention. Within the theories of classical international law, the principle of nonintervention involves the prohibition to intervene in the internal affairs of a sovereign State. Even though there have always existed exemptions to this principle, there was never an exemption of humanitarian intervention mentioned, neither in the UN Charter or any other international legal instrument, nor in the customary law. In the article the possibility of new international legal norms evolving in this field is discussed, to justify intervention in the name of protecting fundamental human rights that are today one of the leading concepts of international legal order, tightly connected to the protection of international peace and security in a highly interdependent international community. To clarify the concept, some basic elements and dimensions of humanitarian intervention are outlined, together with some possible features of the future development of the humanitarian intervention concept. The aim of the article is to discover, what is, both in the legal sense and in practice, the relationship between the sovereignty of states and their responsibility to fulfil their obligations under the international law, including the obligation to respect and protect human life and dignity, as well as other fundamental human rights.

In the last six decades, one of the most striking developments in international law is the emergence of a massive body of legal norms and procedures aimed at protecting human rights. In many countries, though, there is little relationship between international law and the actual protection of human rights on the ground. This book takes a fresh look at why it's been so hard for international law to have much impact in parts of the world where human rights are most at risk. The book argues that more progress is possible if human rights promoters work strategically with the group of states that have dedicated resources to human rights protection. These human rights “stewards” can focus their resources on places where the tangible benefits to human rights are greatest. Success will require setting priorities as well as engaging local stakeholders such as nongovernmental organizations and national human rights institutions. To date, promoters of international human rights law have relied too heavily on setting universal goals and procedures and not enough on assessing what actually works and setting priorities. This book illustrates how, with a different strategy, human rights stewards can make international law more effective and also safeguard human rights for more of the world population.

Since introduced with Universal Declaration at 1948 by United Nations Organization, human rights  has becoming a main instrument in international law and national laws. In Indonesia, regulations  concerning human rights has been legalized by Act Number 39 Year 1999. Study is needed to  explosure the extend of the rules of human rights that has determined in Indonesia Laws. This  journal analyze Indonesia Nationality Law based on universal instrument of human rights by  descriptive analysis research. Its found that Act Number 12 Year 2006 concerning Nationality of the  Republic of Indonesia has accommodate universal instrument of human rights.

Tulisan ini ingin menjawab dua isu utama mengenai hubungan hukum internasional dan pengujian undang-undang oleh Mahkamah Konstitusi RI (MKRI). Isu pertama adalah legitimasi penggunaan hukum internasional sebagai alat interpretasi dalam pengujian undang-undang, sedangkan isu kedua adalah urgensi penguasaan hukum internasional oleh hakim MKRI. Tulisan ini merupakan penelitian hukum yang menggunakan pendekatan konseptual dan pendekatan historis dalam menjelaskan perkembangan pengujian undang-undang di Indonesia sekaligus menemukan legitimasi penggunaan hukum internasional oleh MK RI. Kesimpulan dari tulisan ini menegaskan bahwa hukum internasional memiliki sumbangsih yang penting dalam perannya sebagai alat interpretasi dalam proses pengujian undang-undang oleh Mahkamah Konstitusi, khususnya terkait hak asasi manusia. Justifikasi keabsahan praktik penggunaan hukum internasional tersebut ditarik dari tradisi ketatanegaraan yang secara implisit dikehendaki UUD NRI Tahun 1945. Manfaat positif yang diberikan hukum internasional nyatanya harus disertai juga dengan penguasaan hukum internasional oleh hakim MK RI supaya hukum internasional dapat digunakan secara tepat. Pembahasan dalam tulisan ini dibagi ke dalam empat sub bahasan inti yakni, pengujian undang-undang, penggunaan hukum internasional sebagai the interpretative tool dalam pengujian undang-undang oleh MK, legitimasi penggunaan hukum internasional sebagai the interpretative tool dalam pengujian undang-undang, pentingnya penguasaan hukum internasional oleh hakim MK.This article intentionally answers two principal issues regarding the relationship between international law and judicial review by the Constitutional Court of the Republic of Indonesia. The first issue is the legitimacy of international use as an interpretative tool in judicial review. The second issue talks about the necessity of urgent international law mastery by the Constitutional Court’s judges. This legal research utilizes both a conceptual approach and a historical approach to explain the development of judicial review in Indonesia, and to find legitimacy of international law by the Constitutional Court. The analysis in this article affirms that international law positively contributes as an interpretative tool in judicial review by the Constitutional Court, particularly pertaining to human rights. A justification of a legitimate international law use is withdrawn from constitutional tradition which is implicitly desired by the Indonesian Constitution (UUD NRI 1945). Since international law has provided better insights into norms, a mastery of international law should be encouraged. There are four main discussions in this article: judicial review, application of international law in judicial review process, legitimacy of international law application in judicial review, and the importance of international law mastering by Constitutional Court judges.

<em>In order to offer a transformative discourse Abdullah Ahmad An-Na'im build a method he called with the evolution of Shari'ah (abrogated). According to him the method can respond to contemporary issues at this time. Because he assumed that abrogating is one of the principal methods and has a wide and high complexity in theology and fiqh (jurisprudence) of Islam. He tries to deconstruct abrogated method and also some methods of ijtihad that had been considered settled by the classical scholar. Abdullah Ahmad An-Na'im radically have done repeated studies against the epistimologi Islamic law as well as the mereformulasi return and customize it with the standard of human rights as well as international law as a benchmark. The method developed by Abdullah Ahmad An-Na'im, he stated three important things that need to be done to realize the abrogating. Text, values of humanity, and logic. He also overestimated human rights, so that a text (paragraph) may be enforced in accordance with human rights. In order to answer the legal issues of contemporary Islam.   </em>

The principle of legal certainty applied to the principle of extra ordinary crime is contrary to the respect for humanity as the most fundamental human rights principle and the principle of legality is associated with positive law and international conventions. The results of this study are intended to seek or find arguments for the certainty of the execution of the death penalty for the community, family, convicts and the state, so that the research on death penalty decisions in narcotics cases that occurred from 2014 to 2018. This research method is included in normative juridical law research. The conclusion is, sentencing with the threat of the death penalty can still be applied in Indonesia in narcotics crime cases is appropriate. Therefore, the death penalty, of course, state law does not conflict with religious law/teachings, in other words, the death penalty does not conflict with the first precepts because the first principle of Pancasila is Belief in One God, which means based on the beliefs/religions of each person who in carrying out/believes His religion is also guaranteed in the 1945 Constitution of the Republic of Indonesia, which is contained in Article 28 E paragraph (1) and paragraph (2) and Article 29 paragraph (2).
