The subject of the research within the framework of the article is the criminal procedure institute for the detention of a person on suspicion of committing a crime. The legal nature of this institution is analyzed, and comments are given on the normative legal acts and judicial practice regulating the issues of detention. The theoretical basis of the research is based on the publications of the last two decades on this problem, in particular, reflecting the discussion of the process scientists S. A. Shafer, S. B. Rossinsky and A. A. Tarasov, the subject of which was the issue of the legal nature of a suspect detention in a criminal case. In the paper, the authors ask the following questions: What is the detention of a person on suspicion of committing a crime in accordance with the legislation of the Russian Federation? From what moment does the detained person acquire the status of a suspect? Is it possible to detain a person before initiating a criminal case? The study concludes that a person acquires the actual status of a suspect from the moment of direct detention, that is, before documenting this status and, as a result, before initiating a criminal case. Amendments to the articles of the Criminal Procedure Code of the Russian Federation are proposed, and the authors` versions of the definitions of the concepts «detention of a suspect», «the moment of actual detention» and «pre-trial proceedings» are given.

ABSTRAK Praperadilan yang diatur dalam KUHAP menjamin perlindungan HAM dan aparat penegak hukum dalam menjalankan tugas dan kewenangannya secara konsekwen. Lembaga praperadilan telah menciptakan mekanisme kontrol sebagai lembaga yang berwenang melakukan pengawasan terhadap kinerja aparat penegak hukum dalam menjalankan tugasnya guna tercipta proses peradilan pidana yang baik. Terkait dengan penegakan hukum dan pemberantasan korupsi, Komisi Pemberantasan Korupsi merupakan lembaga yang diamanatkan oleh undang-undang dengan wewenangnya untuk menetapkan status tersangka guna proses penyelidikan dan penyidikan tindak pidana korupsi. Penelitian ini bertujuan untuk mengetahui akibat dari perluasan objek praperadilan atas penetapan status tersangka terhadap KUHAP dan mengetahui akibat dari perluasan objek praperadilan terhadap penetapan status tersangka tindak pidana korupsi oleh KPK. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian yuridis normatif melalui pendekatan konseptual, pendekatan peraturan perundang-undangan dan pendekatan kasus. Sebelumnya, sah atau tidaknya penetapan status tersangka oleh KPK bukan merupakan objek praperadilan, namun melalui Putusan Mahkamah Konstitusi Nomor 21/PUU-XII/2014 praperadilan telah berwenang memeriksa sah atau tidaknya penetapan status tersangka. Hal ini menjadi sebuah pembaharuan dalam Hukum Acara Pidana di Indonesia. ABSTRACT Pretrial regulated in the Criminal Procedure Code guarantees the protection of human rights and law enforcement officers in carrying out their duties and authorities consistently. The pretrial institution has created a control mechanism as an institution authorized to supervise the performance of law enforcement officers in carrying out their duties in order to create a good criminal justice process.This study aims to determine the effects of the expansion of pretrial objects over the determination of the status of suspects against the Criminal Procedure Code and to determine the consequences of expanding pretrial objects to determine the status of suspected criminal acts of corruption by the KPK. The research method used in writing this thesis is a normative juridical research method through the conceptual approach, the statutory approach and the case approach. Previously, the KPK was not a pretrial object or not, but through the Constitutional Court Decision Number 21 / PUU-XII / 2014 the pretrial had the authority to examine whether or not the status of the suspect was determined. This has become a renewal in the Indonesian Criminal Procedure Code.

The article compares the Criminal Procedural Codes provisions of the Russian Federation and the Federal Republic of Germany that regulate conducting a search as an investigative act. It also provides and compares the definitions of the concept “search” and “dwelling” given in Russian and German criminal procedural legislation. The reasons for conducting the search in general and the search of dwelling are considered, similarities and differences are revealed in relation to the status of the subject who is under the search. The author characterizes the search of dwelling and gives a comparative analysis of this investigative action as well as the notion of “urgent cases” in both countries. The authors also proposed some brief recommendations for improving the norms of the Russian Federation Criminal Procedure Code.

The development of information technology and correspondence resulted in a shift in the format of print media to digital media, so that this growth was followed by the continuation of the development of a new criminal class that rode digital media in criminal acts of terrorism. This study aims to determine the regulations for the use of website evidence and the position of using website evidence in handling terrorism crimes in case number 140 / Pid.Sus / 2018 / PN.Jkt.Sel. This research uses a normative legal exploration method whose data comes from the determination related to the use of website evidence in Article 184 of the Criminal Code. The results of the research show that the determination of the exploitation of website evidence, which when based on Article 184 of the Criminal Procedure Code, means that electronic material is not classified as an abash instructional device classification, but if it is based on statutory regulations in a special crime, the electronic evidence media has resistance as a valid evidence, this can be seen in the provisions of Article 5 paragraph (1) of the ITE Law which are reaffirmed in the provisions of Article 44 of the ITE Law. Utilization of electronic evidence in the process of evidence in court is sourced from website evidence in law enforcement for criminal acts of terrorism in the Case Number 140 / Pid.Sus / 2018 / PN.Jkt.Sel scandal. Criminal Procedure, especially Article 184 of the Criminal Procedure Code, but has a judicial guideline that the judge cannot refuse to explore and decide the matters brought against him, provided that the law is unclear or non-existent, then the judges' rules should expose the meaning of continued and continuous law in the consortium, up to the provisions as contained in the ITE Law which regulates electronic instruction instruments as valid instruction devices.

The article deals with the problematic issues of pre-trial investigation of criminal offenses, under investigation by the units of the National Police of Ukraine, have not been studied in the scientific literature. The author of the article points out the problems of the legal status of a head of an inquest body, the author's definition of this term is given and proposed changes to the current criminal procedural legislation, which should eliminate legal gaps. Considered the inconsistencies of the current criminal procedural legislation in terms of regulating the order of attachment for seizure of the property during the pre-trial investigation of criminal offenses. Analyzed judicial practice on this issue and proposed changes to legislation according to the needs of practice. The drawbacks are noted in establishing the terms of pre-trial investigation of criminal offenses, which are caused by the need to conduct psychiatric and other forensic examinations, it is proposed to provide in the Criminal Procedure Code of Ukraine for an inquiry period of 2 months from the moment a person is informed of suspicion. The author's specified legal inconsistencies in the issue of regulating the conduct of a search during an inquiry, it is indicated that there is a need to standardize Articles 234–236 of the Criminal Procedure Code. Due to fact that the activities of the inquest bodies of the National Police of Ukraine are noticeably inefficient, it is proposed to introduce a shortened inquiry procedure in order to implement the principle of economy in the criminal process and saving resources used during the pre-trial investigation.The current procedural form of criminal investigation in Ukraine provides for the need to conduct a full range of investigative and procedural actions in a short time, even for obvious criminal offenses, when the suspect unequivocally pleads guilty and compensates for the damage, which has negative consequences. The introduction of an abbreviated procedure for inquiry is possible only for a clearly defined range of criminal offenses, the legislation must approve guarantees to ensure the rights of suspects from law enforcement abuses and the criteria under which an abbreviated form of inquiry is impossible. The study of the possibility of implementing an abbreviated order of inquiry is of practical importance and is an important area for further study.

В представленной статье рассмотрен ряд вопросов совершенствования регламентации процессуальных полномочий органов и учреждений уголовно-исполнительной системы Российской Федерации. Высказаны предложения по модернизации ряда норм, устанавливающих статус органов и учреждений уголовно-исполнительной системы и их должностных лиц как органов дознания. Рассмотрен круг проблем, связанных с более четким процессуальным регулированием механизма исполнения меры пресечения в виде домашнего ареста. Даны предложения по внесению изменения в уголовно-процессуальное законодательство, которые должны содействовать более эффективной реализации полномочий по контролю за арестованными со стороны уголовно-исполнительных инспекций. Сформулировано предложение по устранению терминологической неточности, допущенной в ст. 397 Уголовно-процессуального кодекса Российской Федерации. The article deals with a number of issues of improving the regulation of procedural powers of bodies and institutions of the penal system of the Russian Federation. In particular the proposals for the modernization of a number of rules establishing the status of the bodies and institutions of penal system, and their officials, as criminal investigation bodies. In addition, the range of problems associated with a more precise procedural regulation of the mechanism of execution of preventive measures in the form of house arrest. In this regard, proposals were made to amend the criminal procedure legislation, which should contribute to a more effective implementation of the powers to control arrested persons by the penal inspections. In conclusion, a proposal to eliminate the terminological inaccuracy in article 397 of the Criminal procedure code of the Russian Federation is formulated.

Article is devoted to search of author's determination of the criminal procedure status of the head of investigative body. Determination of the status is given in it is general legal sense, types of legal statuses, such as the general (constitutional), special (patrimonial), individual, the status of the foreigner and branch legal statuses are allocated. The discussion about a ratio of legal status and a legal status on the basis of which conclusions the author has divided concepts of legal and procedural status per se is given. Are carried to number of elements of legal status of the head of investigative body: the rights and duties provided by the Code of Criminal Procedure of the Russian Federation and specified departmental standard legal by acts of the Ministry of Internal Affairs of the Russian Federation, SK of Russia and FSB of Russia; the criminal liability regulated by the Criminal Code of the Russian Federation and the disciplinary responsibility provided by subordinate regulations for non-execution or inadequate execution of the procedural powers; procedural and administrative accountability of activity of the head of investigative body to the head of higher investigative body. Elements of the criminal procedure status of the designated participant of criminal trial, according to the author, are the rights and duties provided by the Code of Criminal Procedure of the Russian Federation; the accountability of activity of the head of investigative body to the head of higher investigative body regulated by the Code of Criminal Procedure of the Russian Federation. The author has also mentioned a discussion about existence of criminal procedure responsibility of participants of criminal legal proceedings. In article the maintenance of each of elements of the status and justification of reference of each of them to this or that type of the status is opened. Proceeding from the considered structure, the concept of the criminal procedure status of the head of investigative body as the position of the head of the investigative body including his procedural laws, duties and accountability to the head of higher investigative body regulated only by the Code of Criminal Procedure of the Russian Federation is formulated.

AbstractIn the context of carrying out the task of eradicating illicit abuse and illicit trafficking of Narcotics and Narcotics Precursors, the investigator has the authority to conduct urine tests on a person suspected of being an abuser, as stipulated in Article 75 letter l of Law Number 35 Year 2009 concerning Narcotics. The urine sample that has been taken will then be tested based on the development of science and technology in the narcotics testing laboratory which is then poured in the minutes of the test results. The minutes of the test results are valid evidence as determined by Article 184 of the Criminal Procedure Code. Someone who has a positive urine test result can be arrested and named as a suspect of narcotics abuse based on sufficient preliminary evidence. Suspects of abuse of Narcotics can be convicted in accordance with Article 127 paragraph (1) of the Narcotics Act. Thus the legal issues in this study is the Urine Test Results Are Used as the Basis for Assigning a Person to Be a Narcotics Abuse and Classification of Urine Test Results as Evidence As a Provision for Article 184 of the Criminal Procedure Code.Keywords: Urine Test; Preliminary Evidence; Determination of Suspect; Valid Evidence.AbstrakDalam rangka melaksanakan tugas pemberantasan penyalahgunaan dan peredaran gelap Narkotika dan Prekursor Narkotika penyidik berwenang melakukan tes urine terhadap seseorang yang diduga sebagai penyalah guna, sebagaimana diatur pada Pasal 75 huruf l Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika. Sampel urine yang telah diambil selanjutnya akan diuji berdasarkan perkembangan ilmu pengetahuan dan teknologi di laboratorium uji narkotika yang kemudian dituangkan dalam berita acara hasil pengujian. Berita acara hasil pengujian merupakan alat bukti yang sah sebagaimana ditentukan Pasal 184 KUHAP. Terhadap seseorang yang hasil tes urinenya positif dapat ditangkap dan ditetapkan sebagai tersangka penyalahgunaan Narkotika berdasarkan bukti permulaan yang cukup. Tersangka penyalahgunaan Narkotika dapat dipidana sebagaimana ketentuan Pasal 127 ayat (1) Undang-Undang Narkotika. Dengan demikian rumusan masalah dalam penelitian ini adalah Hasil Tes Urine Dijadikan Dasar Untuk Menetapkan Seseorang Sebagai Tersangka Penyalahguna Narkotika dan Klasifikasi Hasil Tes Urine Sebagai Alat Bukti Sebagaimana Ketentuan Pasal 184 KUHAP. Reorganization towards a restorative criminal justice scheme in India was undertaken based on an amendment made to the Criminal Procedure Code (CrPC) of 1973 in 2008. The said amendments were conceded by the Government of India in order to advance the country’s antiquated criminal laws. However, the main problem was keeping the definition of victim stagnant when, in fact, changes relating to victim and, further, reorganizing obsolete laws which have connection with the laws relating to compensation to victims continue. Unfortunately, another difficulty was that the existing laws on determination of victim compensation leave it to the sole discretion of authorities provided under the CrPC. This article highlights that the provisions in the CrPC after the new changes are more general in their attitude of addressing predicament of victims. Yet the irregularity with which the sections are appealed by the judiciary in an effort to accomplish victim fairness and lessen the griefs of the victim would reduce these laws as futile and be the dwindling theme of victim compensation laws in India. Moreover, this article emphasises that some minor developments which occurred in the field of compensation to victims have no doubt reduced an accused-oriented approach, but at the same time there were still numerous lacunae left in this field. Last but not the least, the article focuses on the interface between victim compensation laws and evaluation of victim compensation–amended laws.
