scholarly journals APPROACHES TO DEFINING THE ESSENCE OF DIGITAL STRATEGIC PARTNERSHIP

In modern conditions of a transformational economy, the processes of forming partnerships are especially relevant, based on the construction of the concept of digital strategic partnership, which opens up new competitive opportunities in the search for rational behavior of economic microsystems. The article identifies three main stages of globalization and the place of digitalization of all processes of social life. The studied features of the development of digital strategic partnerships made it possible to highlight the prerequisites for creating digital strategic partnerships and the main factors influencing their development: economic, political, social, technical and cultural factors. The controversy of scientific views on the definition of the essence of the concept of "stra-tegic partnership" is considered, two main approaches to the definition of the essence of the concept of "strategic partnership" are highlighted – according to the goals of creation and levels of economic relations. According to the goal of creating strategic partnerships, it identifies such classification features as: partnership as an agreement, partnership as a model of competition, partnership as a relational model, partnership as an international alliance of enterprises. According to the levels of economic de-velopment, strategic partnerships are distinguished at the macro level, at the meso level and at the micro level. The author pres-ents the definition of the term "Digital Strategic Partnership" as a set of parties (enterprises) to achieve a certain strategic goal, in particular to increase efficiency, which implies the creation of a common system of values and processes based on the use of resources. and partner competencies based on a single digital platform for business organizations. The basic concepts that reveal the essence of digital strategic partnership are revealed – cooperation, agreement, interaction, integration, partnership, strategy. In the new digital economy, digital strategic partnerships enable businesses to gain new competency benefits by gaining a single, open information network of access to partner resources, including markets, technology, capital, and human resources.Keywords: globalization, partnership, strategic partnership, digital strategic partnership. У статті визначено три основні етапи глобалізації і місце цифровізації всіх процесів суспільного життя. Сформовано передумови створення цифрових стратегічних партнерств і чинники впливу на їх розвиток. Розглянуто полеміку наукових поглядів щодо визначення сутності поняття «стратегічне партнерство», виділено підходи до визначення сутності поняття «стратегічне партнерство» за метою створення партнерства: як угода, як конкурентна модель, як реляційна модель, як міжнародний альянс підприємств і за рівнями економічного розвитку: на макрорівні, мезорівні і мікрорівні. The public interest right as a ground for restriction of the ownership right is studied in this article. The notion of sustainable development, widely discussed in recent years at the international level, considers the thesis of balanced regulation of economic relations as one of the main principles of state policy. The balanced regulation of economic relations is impossible without clear definition of the areas of private and public interests in law, as well as without development of the common approaches to the notion, content, criteria, and principles of restriction of the ownership rights. The purpose of this study is to analyze public interest as a groundfor restriction of the ownership right. This scientific work is based on the dialectical method, in which each legal phenomenon is considered in development, in constant movement, and the contradictions of different levels within the framework of the common system are recognized as the internal impulses of development. The principle of systematic analysis of the limits of implementation and restrictions of private and public ownership rights is actively applied. The study proposes to expand the subject composition in legal relations on restriction of the ownership rights and to introduce a new subject of law (the ʽfuture generationsʽ), the interests of which may become the limit of the implementation of the ownership right; the authors' definition of the ʽinterest of the societyʽ is given, the conclusion is madethat the restrictions of the ownership rights are independent legal relationships, arising from the legal facts, based on the law. The proposal is substantiated that in the system of fundamental human rights and freedoms it is necessary to single out the right to property as the basic right of an individual (person), different from the ownership right. The right to property is a potential, yet unrealized opportunity for everyone to possess any property. The conclusions and proposals made in the study will make it possible to ensure the balance of the property interests of the owners and the society.

The aim of this article is to review the strategic partnership of the European Union-Japan in the context of the changing global order, exploring economic, normative and security dimensions. This leads to wider reflections allowing us to theorize international relations with regards to the concept of strategic partnerships. The research question concentrates on what the foundations of the strategic partnership between the European Union and Japan are, and how it answers the challenges in the three above indicated fields. The hypothesis is formulated from the perspective of strategic partnership theory. Methodologically, the work is based on the analysis of primary and secondary sources, as well as on qualitative methods implemented in the form of semi-structured interviews. The key findings reveal that the changing global order and international environment have pushed both partners to create a strategic partnership that has spilled over from economic relations to the normative, political and finally security fields.

The research is aimed at the growing dependence of the national economy on external influences. The article raises the issue of creating a geoeconomic strategy for the development of the State as a full-fledged subject of world economic processes in order to increase multilateral cooperation and more sufficient participation in international and regional integration projects. In this regard, it becomes clear the need to carefully examine the features of conducting and managing international business, analyze foreign economic relations. International business can be defined as the commercial interaction of firms of different forms of ownership or their divisions located in different countries, the main purpose of which is to make a profit, taking advantage of international commercial operations. The development of international business and foreign economic activity of Ukraine with Asian countries are considered. The nature and prospects of development of foreign trade cooperation between Ukraine and several Asian countries are researched, its strategic priorities are substantiated and the place of the countries of the region in the geoeconomic strategy of the State is determined. At the present stage, economic relations between Ukraine and the countries of East Asia are being implemented through rather limited forms of cooperation that require greater diversification, symmetry and structural equilibrium. It is concluded that in the system of Ukraine's foreign economic priorities, cooperation with the countries of East Asia creates opportunities for diversification of foreign policy, intensification of cooperation with the definition of common goals and objectives of bilateral economic development. A strategic condition for further deepening of cooperation is mutual recognition at the official level of strategic partnership as an important element, which provides for the signing of additional bilateral agreements on additional conditions and principles of cooperation.

The call for paper clearly builds on the WOA 2019’s theme, acknowledging that organization theory and practice are progressively challenged and enriched by conflicting expectations expressed by a plethora of stakeholders whose answers have often to be found by the embracement of academic multidisciplinarity – i.e. the borrowing of constructs and models from other fields. In this fluid reality, organizations tend to be more problematic to design while extremely meaningful as privileged points of observations of phenomena. In this vein, they result as “convenient microcosms” where scholars and managers can observe the emergence of the unexpected, the craft of the new, the unfolding of novel practices and meanings. Anchoring the idea of organization (and organizing) to the Chester Barnard’s intuition of “fabrics of social life”, identity and pluralism are therefore put to the test as reality challenges what we know. As the WOA 2019 theme statement recalls: “Technology is reshaping the meaning of division of work and coordination, and even the borders of what is human in and around organizations, anticipating the emergence of robots and machine-based agents. Global socio-demographic processes are leading to massive migration processes and changes in the focus of economic processes. Societal values are changing the habits and patterns of consumption and the use of resources. Many other challenges are waiting for us to consider them in our theorizing and researching”. Moving from the philosophical roots of the ego consciousness, studies on pluralism and organizational identity have variously addressed what is believed to be foundational, valid, central and meaningful by organizational members, however the organizational boundaries would have been defined. Such studies have spanned from the questioning of the individual fit (via her/his self) with the organizational values and culture, to value-based and cognitive-enacted links glueing entire dispersed communities, passing though teams and more traditional forms of organizing (associations, companies, etc.). In this heterogeneous and magmatic manifestation of the “real”, individuals and organizations of various kind, nature and size struggle with the definition of their identities (sensegiving), the result of the individual and collective creation of meaning (respectively, perceptions/projections vs. sensemaking/sensebreaking), the processes through which they try to survive juggling with different affordances of pluralism and identity. With this call for paper we want to address all these issues by soliciting the submission of papers that, grounded in rigorous studies, embrace in a novel way the challenge to reflect on the “who, what and how” organizations can deal with pluralism and identity, yet attempting to thrive while exposed to fluid and uncertain environments. The article is devoted to the problem of strategic partnership in business through theoretical and practical focus. Theoretical and methodological analysis of the essential definition of the concepts of "strategic partnership" and "strategic alliance" in the works of foreign and domestic scientists. The author's definition of the concept of strategic partnership, which, unlike existing ones, is presented as one of the most flexible organizational forms of integration of businesses (enterprises), which is endowed with a number of essential distinguishing features business structures with strategic perspectives and goals. The principles of integration aspirations of business structures, which are based on the multifactorial nature of integration processes, which is reduced to the use of the benefits of integration through interconnectedness, interdependence and mutual benefit, are highlighted. The main goals of the strategic partnership are highlighted, the key ones being: avoidance of sanctions, tax liability, quotas; impact on the nature of competition in the industry; access to new markets through the partner's sales network; reduction of costs and risks of research and development; use of highly qualified research and engineering potential of contractors; maintaining the independence of the organization, etc. The most common types of strategic partnerships are considered, including strategic marketing, strategic supply chain partnerships, strategic integration partnerships, strategic technology partnerships, and strategic financial partnerships. Substantiated advantages (business incentives). The risk factors that must be taken into account before signing the agreement, both organizational and legal, and personal in relation to potential counterparties. The necessity of forming a partnership agreement and the list of basic conditions to be described in the partnership agreement are substantiated. A number of basic rules (principles) have been established, which are the key to an honest and fruitful strategic partnership in business. Expert assessment of practitioners on the decisive role of strategic partnership in effective business activities is given. The direction of further research is outlined, which can be reduced to the study of business cooperation strategies and features of their implementation in domestic enterprises.

Particular attention is paid to the definition of social progress and global problems of mankind.

Some aspects of the economic and legal status of a consulting engineer are analyzed, taking into account the specifics of national legislation. Some problems of the legal status of the consulting engineer and the forms of his economic activity are revealed. The introduction of such an entity as a consulting engineer in the modern conditions of construction development is of particular importance due to the need to improve the quality of construction work, the development of competition in this area and the need to change approaches to economic activity in this area. It is established that the concept of consulting engineer is defined in some special regulations, in particular, regulating activities in the field of road construction, but the economic and legal aspects of his business remain unresolved. This significantly affects the effectiveness of the introduction of the institute of consulting engineers in the field of management. The problem of lack of clear definition of the form of conducting economic activity by the specified participant of economic relations is revealed. The necessity of adopting a special normative legal act, namely the Law of Ukraine "On the activities of consulting engineers", in which to regulate general issues of their legal status, features of the organization of its activities, responsibilities, etc is proved. The author's definition of the concept of consulting engineer is proposed, taking into account the need to establish the organizational and legal form of his business, which will ensure proper regulation of relations between him and other participants in construction relations, including contractors and customers. The solution of some problems of the economic and legal status of the consulting engineer under the legislation of Ukraine is offered. The expediency of conducting the activity of a consulting engineer as a self-employed person, or carrying out its activity by creating a legal entity (association of consulting engineers) is substantiated. In addition, in our opinion, an entity that carries out engineering activities and has concluded employment contracts with duly accredited consulting engineers has the right to provide the services of a consulting engineer.

The purpose of this article is to address current issues of doctrinal and legal security of economic security of the state with the actualisation of issues concerning the relationship between the concepts of “economic security” and “economic sovereignty” in their relationship and mutual understanding. The authors pay attention to the analysis of existing in the national legal doctrines of individual countries scientific approaches to the definition of “economic sovereignty”, clarify its main features, analyse the scientific approaches of domestic and foreign researchers to define the concept of “economic security” and on this basis own vision of the instrumental content of these definitions. It is argued that the concept of “economic sovereignty” is primary in relation to the concept of “economic security”. The article examines the national systems (models) of economic security of the state, including, in particular, American, Japanese, Chinese, models of institutional entities (in particular, the EU), models typical of countries with economies in transition. The authors found that Ukraine is characterised by a system (model) of economic security of countries with economies in transition, which is fragmented and inconsistent in its construction, which ultimately affects the state of economic security of the state as a whole. It was found that the main goal of Ukraine at this stage of its development in the context of building a national model of economic security is to create an effective system of means to overcome or minimise existing or potential threats, especially in the context of globalisation of trade and economic relations. The paper emphasises the need to borrow positive foreign experience of legal support of relations for the creation and implementation of national systems of economic security of the state to gradually transform Ukraine into an important participant in the processes of international economic security
