AbstractIn accordance to the Republic of Indonesia Law of National Education System which isknown as “Sisdiknas”(Sistem Pendidikan Nasional) Law Number 20, Year 2001, thenational education system in Indonesia should guarantee the universities managementefficiency. Besides other factor of universities’ capability to implement the autonomy ofuniversities organizational management; either in academic, personal, financial fields or inother functional areas regulated by each university. Following the government regulationLaw Number 99 Year 2001 concerning the Education National Standard, normatively infact that law is challenging the universities organizational management locally, nationallyand globally and today this become the object of study of the organizational communication.Our contemporary understanding actually has accepted that leadership is basicallyinfluence the daily interpersonal communication in the life of organization even itdetermines the achievement of organization’s objectives. The Republic of Indonesias State Constitution of 1945 adopted a basic policy that obliges the government to run one national education system. It would seem it was the belief of the Founding Fathers when they drafted the constitution that education would be the strategic vehicle for ensuring that the newly independent Indonesian nation would be modern, democratic, prosperous, and with a concept of social justice based on the state philosophy of Pancasila. In implementing the basic policy, a series of education laws (1950, 1954, 1989 and 2003) have been promulgated that were to produce an educated citizenry who would be intelligent, healthy, moral, democratic, and responsible. This policy, and the goals and principles of education formulated in the constitution and in subsequent education laws, is in line with a paradigm followed by many nations that have made education an effective means of supporting their growth and development. Education is seen by some economists and political scientists to have a strategic role in improving the quality of life for Indonesian citizens. However, there has been no serious political determination on the part of the elites who control government and parliament to support the implementation of an education system that accords with the hopes and ambition of the Founding Fathers. The funding necessary for education has not been set aside in national budgets despite the constitutional and legislative requirements and expectations that this be done. The funding for education in Indonesia, compared with other developing nations, is low. The goals and principals adopted in the constitution and education laws have not been seriously and consistently implemented.

Abstract: National Education System, explains that education is a conscious and planned effort to create an atmosphere of learning and learning process so that learners actively develop their potential to have state power, self-control, personality of intelligence, noble character, as well as skills needed him, society, nation and country. Legal provisions for the protection of the rights of street children are legal provisions both at the level of laws, provincial and district / municipal regulations governing the protection, survival value, development, maintenance, welfare, education, physical health, moral social and mental spiritual. Legal provisions on the education of children should have a harmonious regulation both at the level of regulations issued by the government, provincial and municipal governments and districts that contain provisions both in terms of responsibility, to the involvement of the community in managing education based on the basic ideals of the Republic Indonesia

Studies on religious education teacher’s competences in Aceh could not be separated from studies on state’s intervention toward education. State hegemony occurs in the form of regulation formalization which regulates efforts for improving qualification and competence of teachers. The research showed that the presence of Act No. 14, 2005 and the Government Regulation No. 74, 2008 had been used as legal reference to encourage the improvement of Aceh religious education teachers’ qualification and competence. This is a qualitative study in which triangulation in data collection was used. The data was then collected through documentations, observations, and deep interviews. This work emphasizes that improving teachers’ competences in Islamic education system in Aceh was in accordance to and did not contradict with national education system and moreover strengthen the content of Act No. 14, 1005 and Government Regulation No. 74, 2008. Qualification and competence of religious education teachers in Aceh underwent improvement better than previous term. However, teachers experienced that socialization process and implementation of regulation has yet to receive upmost attention. The study also suggests that religious education teachers’ qualifications and competences will significantly contribute to the development of religious education quality, thus Islamic education transforms intently in national and state relations order.

This study aims to determine the values of Tauhid Education in the National Education System and the relevance of the National Education System Law No. 20 of 2003 in strengthening the values of Tauhid Education. This research method uses a type of library research or literature study (library research). Using two data sources, namely: 1). The primary data is law No. 20 of 2003 concerning the National Education System. 2). Secondary data is literature related to this research. The results of the study were obtained: 1) the values of Tauhid education contained in Chapter II Article 3 read: "National Education aims to develop the potential of students to become human beings who believe and fear God the Almighty". Chapter V Article 12 paragraph 1 point A reads: "Every student in each education unit has the right: get religious education in accordance with the religion he adheres to and is taught by educators who are of the same religion". Chapter X Article 36 paragraph 3 point A reads: "The curriculum is prepared in accordance with the level of education within the framework of the Unitary State of the Republic of Indonesia by taking into account: Increased faith and piety". 2) Relevance of the Law on National Education System No. 20 of 2003 in strengthening the values of Tauhid education that the main purpose is: "Faithful and devoted to the Almighty God". Then the right of the first student is to get religious education in accordance with a religion that is followed and taught by religious educators. And the curriculum is arranged in accordance with the level of education within the framework of the Unitary State of the Republic of Indonesia with the first increase, namely faith and piety.

In the contents of the Republic of Indonesia Constitution no. 20 of 2003 concerning National Education System is the realization of an education system as a strong and authoritative social institution to empower all Indonesians to develop into quality maneuvers that are capable and proactive in responding to the challenges of an ever-changing era. However, along with the rapid development of the times, with the emergence of various kinds of problems, especially in the field of education, which makes the goals of education contained in the law tend to be difficult to realize. So, to facilitate the development of educational goals with the aim of advancing the quality of education in Indonesia, there are three things that must be done, namely : 1) developing the quality of human resources, 2) building a Strong Educational Foundation and Clear Vision, 3) developing a noble moral based curriculum.Dalam undang-undang RI No. 20 tahun 2003 tentang Sisdiknas adalah terwujudnya sistem pendidikan sebagai pranata sosial yang kuat dan berwibawa untuk memberdayakan semua warga Indonesia berkembang menjadi manusia yang berkualitas sehingga mampu dan proaktif  menjawab tantangan zaman yang selalu berubah. Akan tetapi, seiring dengan cepatnya perkembangan zaman, dengan munculnya berbagai macam permasalahan terutama dalam bidang pendidikan, yang membuat tujuan dari pendidikan yang tertuang dalam undang-undang tersebut cenderung sulit terwujudkan. Maka, untuk memudahkan pengembangan tujuan pendidikan dengan maksud memajukan kualitas pendidikan di Indonesia, ada tiga hal yang mesti dilakukan yaitu; 1) mengembangkan kualitas sumber daya manusia, 2) Membangun landasan pendidikan yang kuat dan visi yang jelas, 3) mengembangkan kurikulum berbasis akhlak mulia.

Education is considered to have a very important role in promoting the civilization of a nation. Good quality education can encourage the creation of a quality society, creative and productive until finally able to achieve welfare. Through this national education system, the government should be able to ensure equal distribution of educational opportunities, as well as the relevance and efficiency of education management to face challenges in line with the changing demands of local, national and global life. The budget allocation system for education in Indonesia is heavily influenced by government policies. Education financing depends on the management of educational institutions, but budget allocations used must conform to national financing standards. Education in Indonesia, implemented in accordance with educational policies that regulate the national education system, as well as the allocation of 20% education funding obtained from the state budget and APBD.

This article aims to analyse the Indonesian State’s laws regarding models of religious education, by evaluating Law No. 20/2003, concerning the national system of education and other related laws. Two questions are highlighted: What type of religious education is favoured by Indonesian state? Does the preference for a certain type of religious education reflect a specific vision of the state-religion relationship? Our data consisted of two sources: the State’s law on national education system, Law No. 20/2003, and the minutes of the Indonesian parliament meeting approving the law. We found that Law No. 20/2003 expresses the preference of the government for a mono-religious model. Indonesia is categoreized as having preferred treatment for some religions or support for a particular religious tradition. This categorisation is confirmed by the results of our research findings indicated by the preferential treatment delivered by the State, and the State’s legislation and regulations on religion.[Tulisan ini menganalisis legislasi negara terhadap pendidikan agama dengan cara mengevaluasi UU No. 20/2003 tentang Sistem Pendidikan Nasional beserta perundang-undangan terkait lainnya. Dua pertanyaan berusaha untuk dijawab dalam tulisan ini, yaitu: Model pendidikan agama yang bagaimana yang menjadi preferensi negara? Apakah preferensi tersebut merefleksikan visi negara terhadap model relasi negara-agama tertentu? Tulisan ini merujuk kepada dua data utama, yaitu: UU No. 20/2003 tentang Sistem Pendidikan Nasional serta Risalah Rapat Paripurna ke-35 DPR RI tahun 2003 yang mengesahkan UU No. 20/2003. Penelitian ini menemukan bahwa UU Sistem Pendidikan Nasional merefleksikan preferensi negara terhadap model pendidikan agama mono-relijius. Model pendidikan mono-religius ini merefleksikan preferensi negara terhadap model relasi negara-agama preferensial; negara mengakui lebih dari satu agama resmi dan memberi dukungan kepada institusi-institusinya, yang direfleksikan melalui legislasi dan peraturan terkait agama.]

<p>Abstract<br />Government has the legal responsibilities in the implementation of national education system to carry out the mandate set out in Section 31 of the Constitution of the Republic of Indonesia 1945 related to the intellectual life of the nation. This is confirmed and applied by The Indonesian Government Regulation 47/2008 regarding compulsory education and Indonesian Government Regulations 48/2008 related to the funding education of elementary school (SD) to high school (SMP) free made by the government through the School Operational Assistance (BOS) to make the education system based on the national human values and justice according to Pancasila ad realize the human rights set out in the Constitution Indonesian 1945 Article28 c paragraph(1) and Article 28d paragraph (3) stated that every citizen has the right to obtain equal opportunities in government. The free primary education can not be realized in a fair and equitable for the presence of education autonomy, every area is not the same policies and management education in many schools that are not transparent even still many schools to collect funds for the reason given by the government budget for operational costs is not enough.In addition, the9-year basic education which should be free up to secondary education (high school) born by either the state of infrastructure, teachers’ salaries, electricity, telephone, computer, books, stationery without distinguishing between public and private schools.<br /><em>Keywords: national education, justice, humanity,Indonesian contitution 1945</em></p><p>Abstrak<br />Pemerintah memiliki tanggung jawab hukum dalam implementasi sistem pendidikan nasional sebagai amanah (mandat) dari Pasal 31 Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 yakni hak mendapatkan pendidikan yang layak. Mandat tersebut diturunkan dalam Peraturan Pemerintah Nomor 47 Tahun 2008 tentang wajib belajar dan Peraturan Pemerintah Nomor 48/2008 tentang Pendanaan Pendidikan dari Sekolah Dasar ( SD ) hingga Sekolah Menengah ( SMP ) yang gratis ditanggung oleh pemerintah melalui Bantuan Operasional Sekolah ( BOS ) dalam rangka untuk menciptakan sistem pendidikan berdasarkan pada nilai-nilai kemanusiaan nasional dan keadilan dalam Pancasila, serta dalam rangka penegakan Hak Asasi Manusia berdasar Pasal 28C ayat (1) dan Pasal 28D ayat (3) dimana setiap warga negara memiliki kesempatan yang sama dalam pemerintahan. Pendidikan dasar gratis tidak dapat dicapai secara adil dan merata karena setiap daerah miliki kebijakan dan manajemen pendidikan yang berbeda, adanya ketidaktransparanan sekolah dalam mengelola dana, dan faktor alasan ketidakcukupan dana yang diberikan oleh pemerintah kepada sekolah. Pendidikan Dasar 9 (sembilan tahun) seharusnya gratis sampai pada Pendidikan Menengah Pertama (SMP) baik dalam hal infrastruktur pendidikan, honor guru, biaya listrik, telepon, pengadaan komputer, buku-buku tanpa ada pembedaan sekolah publik dan sekolah swasta.<br /><em>Kata kunci: Pendidikan Nasional, Keadilan, Kemanusiaan, UUD 1945</em></p>

<p><span>The legal status of polytechnic has been fundamentally changed from time to time. After the Law of National Education System Number 20/2003 and the Law of Higher Education Number 12/2012 came into effect, the polytechnic has been granted a new legal status that offers more diverse programs at various levels. Since then, polytechnic could conduct vocational diploma programs and degree programs in applied sciences from graduate to postgraduate. This legal status raises legal problems whether polytechnic is a higher education institution in vocational or applied sciences. Best education practices in some countries classify applied sciences higher education as academic education, not vocational education. This doctrinal research paper then will examine this legal problem using statute, historical and comparative approach, in the light of the Development Legal Theory. This study shows that the legal status of polytechnic is heavily dependent on government policy. In the absence of a clear and firm ground policy of vocational education, the legal status of the polytechnic has been interpreted differently from time to time. The government ought to reset the vocational education policy and then reform the law of the national education system. Therefore, the legal status of the polytechnic will be more sustainable and have better legal certainty accordingly. Regarding the recent development of higher education, it will be better if the government constitutes polytechnic as a higher education institution in applied sciences.</span></p>

Abstract., Indonesia is a country that is conducting educational development as mandated by the 1945 Constitution. In the course of the Law of the Republic of Indonesia Number 20 of 2003 on National Education System defines education as a conscious and planned effort to create an atmosphere of learning and learning process so that learners actively developing his potential to have spiritual spiritual strength, self-control, personality, intelligence, noble character, as well as the skills he needs, society, nation and state. In response, Islamic Education needs to get serious attention, especially among the intellectuals and thinkers of Islamic education in Indonesia. Various efforts are needed to restore Islamic education to its glory. To restore Islamic education to the glory, certainly not as easy as putting water on a cauldron. But there needs to be seriousness in reaching these ideals, including the seriousness in management and leadership of a reliable Islamic education institutions. Menyikapi hal tersebut, Pendidikan Islam perlu mendapat perhatian yang serius, terutama kalangan cendekiawan dan pemikir pendidikan Islam di Indonesia. Diperlukan ragam upaya untuk mengembalikan pendidikan Islam kepada kejayaannya. Untuk mengembalikan pendidikan Islam kepada kejayaan tersebut, tentu tidak semudah menaruh air di atas kuali. Namun perlu ada keseriusan dalam menggapai cita-cita tersebut, diantaranya keseriusan dalam manajemen dan kepemimpinan lembaga pendidikan Islam yang handal. Dalam makalah ini penulis akan mencoba memfokuskan pembahasan pada problematika pendidikan Islam abad 21 serta solusi-solusi yang dapat ditawarkan dalam menanggapi problematika pendidikan Islam tersebutKata Kunci:Problematika Pendidikan, Pendidikan Islam.
