Providing the Missing Link: Law after Latour’s Passage

A decisive philosophical intervention pitched at the level of law’s ontology, Gutwirth’s ‘Providing the Missing Link’ renders the difference between law as an institution or a body of norms and law as a mode of existence or value a crucial point of passage for any future philosophy of law. The first, Gutwirth argues, isn’t really law at all, but a political and organisational phenomenon easily confused with other norms and normative systems, from the rules of sporting groups or trade associations to ethical codes. The second is a far narrower concept keyed to the production of novel solutions under a particular kind of constraint and has nothing to do with the establishment of standards to be followed. Gutwirth’s finely tuned theorisation of law, which resonates with the work of Isabelle Stengers and Gilles Deleuze, sounds a laudable alarum designed to compel legal theorists to disencumber law of the formidable demands of the Rechtsstaat, while holding firmly to the evasive thread of legal enunciation. For Gutwirth, statements in the key of [LAW] require, as an absolute condition, the ‘anticipat[ion of] how and what a judge or court would decide’, and we are all jurists engaged in the practice of law, or at the least, we ‘speak legally’ and not merely ‘about law’, insofar as we projectively reason on the basis of that anticipation. The passage of law depends on this anticipatory structure, from which Gutwirth derives the signal operations of law (qualification, hesitation, imputation and so on), which work in essentially the same way as they did for the Romans. Law alone, he concludes – even after it has been unburdened of the political, economic, moral and other duties recklessly imposed on it – remains ‘the rightful and ultimate provider of stability and security’, as the loops of its unique temporality ensure that a resolution to any controversy can indeed be fashioned, even where every other mode fails.

Between the affirmative and the negative, the compositional and the oppositional, we need to rethink the difference between difference and contradiction. In this regard, the concept of ‘diplomacy’, as developed by Isabelle Stengers, is of particular significance. Whereas many adherents of an affirmative ontology of difference reduce contradiction to a caveat – ‘of course, antagonism is inevitable, but …’ – diplomacy makes contradiction its fundamental concern. This article explicates the significance of such a conception, via close readings of Stengers’ work in relation to that of Gilles Deleuze, and Gottfried Wilhelm Leibniz. However, it also develops diplomacy in new directions, particularly relating the diplomatic ‘fold’ to the sovereign ‘cut’. The fold of coexistence, then, is achieved through diplomacy as a ‘labour of difference’, against ‘facile pluralism’, which takes worldly cohabitation as given. A diplomatic political ontology is neither bellicose nor pacific; rather, it dramatizes the possibility of peace from within a coercive historical reality.

The issue of the loss of antiquities is one of the important geopolitical issues that began to take high-level local, regional and international attention as well as highlighting the most important geopolitical repercussions that resulted from the theft of Iraqi antiquities at the political, economic and social level. The aim of the study is to demonstrate the importance of antiquities as a tourism, economic and historical resource for the state, as well as highlighting the strengths and weaknesses in managing the file of theft. And the loss of antiquities, as well as trying to find out which countries were recovering artifacts from. The problem of antiquities is a complex problem with deep roots that cannot be treated easily, as there are many proposals and solutions in order to treat the theft and loss of antiquities, but most of these solutions are patchwork solutions on paper only and have not been applied on the ground, and there are many Arab and international experiences to manage The file of effects, but most of these experiences cannot be applied to Iraq due to the difference in the geographical characteristics of each country from Iraq, and the success of the experience of a particular country does not necessarily mean success in another country due to the different geographical, political, economic and social data for each country

South Beirut has recently become a vibrant leisure destination with a plethora of cafés and restaurants that cater to the young, fashionable, and pious. What effects have these establishments had on the moral norms, spatial practices, and urban experiences of this Lebanese community? From the diverse voices of young Shi'i Muslims searching for places to hang out, to the Hezbollah officials who want this media-savvy generation to be more politically involved, to the religious leaders worried that Lebanese youth are losing their moral compasses, this book provides a sophisticated and original look at leisure in the Lebanese capital. What makes a café morally appropriate? How do people negotiate morality in relation to different places? And under what circumstances might a pious Muslim go to a café that serves alcohol? This book highlights tensions and complexities exacerbated by the presence of multiple religious authorities, a fraught sectarian political context, class mobility, and a generation that takes religion for granted but wants to have fun. The book elucidates the political, economic, religious, and social changes that have taken place since 2000, and examines leisure's influence on Lebanese sociopolitical and urban situations. Asserting that morality and geography cannot be fully understood in isolation from one another, the book offers a colorful new understanding of the most powerful community in Lebanon today.

 Abstract Generally speaking, media is extensively used as the means to disseminate news and information pertaining to business, social, political and religious concerns. A portion of the time and space of media has now become an important device to generate economic and social activities that include advertising, marketing, recreation and entertainment. The Government regards them as an essential form of relaying news and information to its citizens and at the same time utilizes them as a powerful public relations’ mechanism. The effects of media are many and diverse, which can either be short or long term depending on the news and information. The effects of media can be found on various fronts, ranging from the political, economic and social, to even religious spheres. Some of the negative effects arising from the media are cultural and social influences, crimes and violence, sexual obscenities and pornography as well as liberalistic and extreme ideologies. This paper sheds light on these issues and draws principles from Islam to overcome them. Islam as revealed to humanity contains the necessary guidelines to nurture and mould the personality of individuals and shape them into good servants. Abstrak Secara umum, media secara meluas digunakan sebagai sarana untuk menyebarkan berita dan maklumat yang berkaitan dengan perniagaan, kemasyarakatan, pertimbangan politik dan agama. Sebahagian dari ruang dan masa media kini telah menjadi peranti penting untuk menghasilkan kegiatan ekonomi dan sosial yang meliputi pengiklanan, pemasaran, rekreasi dan hiburan. Pengaruh media sangat banyak dan pelbagai, samada berbentuk jangka pendek atau panjang bergantung kepada berita dan maklumat yang brekenaan. Kesan dari media boleh didapati mempengaruhi pelbagai aspek, bermula dari bidang politik, ekonomi, sosial bahkan juga agama. Beberapa kesan negatif yang timbul dari media ialah pengaruhnya terhadap budaya dan sosial, jenayah dan keganasan, kelucahan seksual dan pornografi serta ideologi yang liberal dan ekstrim. Kertas ini menyoroti isu-isu ini dan cuba mengambil prinsip-prinsip dari ajaran Islam untuk mengatasinya. Tujuan Islam itu sendiri diturunkan kepada umat manusia ialah untuk menjadi pedoman yang diperlukan untuk membina dan membentuk keperibadian individu dan menjadikan manusia hamba yang taat kepada Tuhannya. The development of modern civilization attests to its decisive role in the progressive development of institutions. They identified the difference between Western civilization and the rest of the world. Confirmation of the institutional advantages of the West was its early industrialization. The genesis and formation of institutionalism in its ideological and conceptualmethodological orientation occurs as a process alternative to neoclassic in the context of world heterodoxia, which quickly spread in social science. Highlighting institutional education as a separate area of sociocultural activity is determined by the factor of differentiation of institutional theory as a whole. A feature of institutional education is its orientation toward the individual and his/her transformation into a personality. The content of institutional education is revealed through the analysis of the institution, which includes a set of established customs, traditions, ways of thinking, behavioral stereotypes of individuals and social groups. The dynamics of socio-political, economic transformations in Ukraine requires a review of the foundations of national education and determination of the prospects for its development in the 21st century in the context of institutionalism.

Review of the monograph indicated in the subtitle V.T. Ryazanov. The reviewer is critical of the position of the author of the book, believing that it is possible and even necessary (to increase the effectiveness of General economic theory and bring it closer to practice) substantial (and not just formal-conventional) synthesis of the Marxist system of political economy with its non-Marxist systems. The article emphasizes the difference between the subject and the method of the classical, including Marxist, school of political economy with its characteristic objective perception of the subject from the neoclassical school with its reduction of objective reality to subjective assessments; this excludes their meaningful synthesis as part of a single «modern political economy». V.T. Ryazanov’s interpretation of commodity production in the economic system of «Capital» of K. Marx as a purely mental abstraction, in fact — a fiction, myth is also counter-argued. On the issue of identification of the discipline «national economy», the reviewer, unlike the author of the book, takes the position that it is a concrete economic science that does not have a political economic status.

This book chronicles the history of education policymaking in India. The focus of the book is on the period from 1964 when the landmark Kothari Commission was constituted; however, to put the policy developments in this period into perspective major developments since the Indian Education Commission (1882) have been touched upon. The distinctiveness of the book lies in the rare insights which come from the author’s experience of making policy at the state, national and international levels; it is also the first book on the making of Indian education policy which brings to bear on the narrative comparative and historical perspectives it, which pays attention to the process and politics of policymaking and the larger setting –the political and policy environment- in which policies were made at different points of time, which attempts to subject regulation of education to a systematic analyses the way regulation of utilities or business or environment had been, and integrates judicial policymaking with the making and implementation of education policies. In fact for the period subsequent to 1979, there have been articles- may be a book or two- on some aspects of these developments individually; however, there is no comprehensive narrative that covers developments as a whole and places them against the backdrop of national and global political, economic, and educational developments.

This chapter explores the international and interdisciplinary backdrop of Lincoln Kirstein’s efforts to form an American ballet in the early 1930s. The political, economic, and cultural conditions of the Depression reinvigorated the search for an “American” culture. In this context, new openings for a modernist theory of ballet were created as intellectuals and artists from a wide range of disciplines endeavored to define the role of the arts in protecting against the dangerous effects of mass culture. Chapter 1 sheds new light on well-known critical debates in dance history between Kirstein and John Martin over whether ballet, with its European roots, could truly become “American” in contrast to modern dance. Was American dance going to be conceived in nationalist or transnationalist terms? That was the deeper conflict that underlay the ballet vs. modern dance debates of the early 1930s.

This essay explores the theory of intersectionality in the study of youths’ lives and social inequality in the Global South. It begins with an overview of the concept of intersectionality and its wide applications in social sciences, followed by a proposal for regrounding the concept in the political economic systems in particular contexts (without assuming the universality of capitalist social relations in Northern societies), rather than positional identities. These systems lay material foundations, shaping the multiple forms of deprivation and precarity in which Southern youth are embedded. A case study of rural migrant youths’ ‘mobility trap’ in urban China is used to illustrate how layers of social institutions and structures in the country’s transition to a mixed economy intersect to influence migrant youths’ aspirations and life chances. The essay concludes with ruminations on the theoretical and social implications of the political-economy-grounded intersectionality approach for youth studies.
