The implementation of the Noken election system in several areas in Papua Province is still debatable whether this system violates the democracy principle or not. Noken shows the symbol of power and wisdom when the election and induction of traditional (adat) leader that describe their own democracy election system. Noken has been used as an instrument to replace the ballot box since 1971 until the last Indonesia presidential direct election 2019, especially in highland areas, which are difficult to access. This Noken election system has been legally supported by several decisions of Constitutional Court in 2009. By cultivating the theory of recognition, this chapter aims to study the significance of Noken traditional election system as a form government recognition to Papuan even though this system is not applied in all Papua regions. Furthermore, this chapter attempts to analyze the potential of Noken election system as an alternative solution to reduce the Papua prolonged conflict by guaranteeing the political participation of the adat community.

Frasa ” dipilih secara demokratis ” dalam Pasal 18 ayat (4) Undang-Undang Dasar 1945 selalu ditafsirkan bahwa pemilihan kepala daerah harus dilakukan secara langsung oleh rakyat. Untuk memahami tafsiran sesungguhnya, tulisan ini akan membahas mengenai tafsiran ketentuan tersebut terhadap mekanisme pemilihan kepala daerah, disamping itu akan dibahas pula dinamika pemilihan kepala daerah (termasuk di daerah istimewa) di Indonesia dari masa ke masa, dan perbandingan sistem pemilihan kepala daerah di negara lainnya. Melalui penelitian yuridis normatif, diketahui bahwa secara konstitusional makna frasa tersebut dapat diartikan dalam bentuk pemilihan langsung dan pemilihan oleh Dewan Perwakilan Rakyat Daerah. Terhadap mekanisme pemilihan kepala daerah di Negara lain pada dasarnya juga pernah diterapkan di Indonesia. Akan tetapi, berdasarkan kisruh yang terjadi beberapa lalu terkait pemilihan kepala daerah di Indonesia melalui pemilihan Dewan Perwakilan Rakyat Daerah memunculkan isyarat bahwa rakyat lebih puas dengan pemilihan langsung. Sebaliknya di daerah istimewa Yogyakarta, rakyat lebih puas untuk tetap menetapkan turunan Sultan yang menjadi pemimpin mereka. Dengan demikian, alangkah baiknya pemerintah memperhatikan aspirasi rakyat sebelum mengubah mekanisme pemilihan kepala daerah untuk meminimalisir terjadinya kisruh.<p>The phrase ”shall be elected democratically” in Article 18 paragraph (4) of the 1945 Constitution of Indonesia is always interpreted that regional leaders shall be elected directly by the people. According to that, this paper will discuss the provisions interpretation about election system for regional leaders, the dynamic system in the local election for regional leaders (including in special regions) in Indonesia, and comparison with other countries. Through normative juridical research, the constitutional meaning of the phrase can be interpreted both as direct election and election by the Local Council. The local election for regional leaders in other countries basically has been applied in Indonesia. However, based on the protest that occurred related to the election by the Local Council gave us a sign that people prefer direct election. Unlike in Yogyakarta, as a special region in Indonesia, the Yogya’s people prefer to be led by Sultan’s descendant. Thus, in the future, government should understand people’s will before changing the election system for regional leaders to minimize conflicts.</p>

The amendment of the 1945 Constitution sets that governors, regents, and local mayors are democratic in their election, originally selected by the legislative assembly and latterly sifted into direct election from the people. Based on the regulation No. 22 of 2007, it states that the election of local leader and co-leader is characterized as the part of general election regime, and thus it brings impact on local election, which should run directly as well. This article examines the arising problems on local election after the amendment of the 1945 Constitution, which reveals various problematic factors in the implementation of direct election for local head has been officially established. Indonesia has run local election many times in different eras, including in Dutch colonialism, Japan colonialism, and post-independence era. In post-independence era, Indonesia also has various political climates and traditions and including Old Order, New Order, and reformation era. The alteration of this general election system aims to provide fair democracy for all people to vote for their local leaders. The implementation, however, encounters several factors and problems derived from the level of participation up to the readiness of local election committee.

AbstractDemocracy substance is “raison de etre” on regulating direct election system and it’s position about implementation principle of the state by law. Based on evaluating in 2005 until 2014, conducted alteration for implementation system, who reflected alteration policy purpose about election supervisor institute. An aim of this research is (a) to explain the direction of reinforcement supervisor election institute policies based on Law Number 1 of 2015 attached its alteration, and (b) the impact of reinforcement concerning institutional capacity. This research used juridical normativism method, through statue approach, conceptual and institutional in an integrative manner. Data resources used a secondary material with qualitative analysis technique.These research conclude the direction policies about reinforcement has been formed by enforcement duties, authority, obligation, character and function head for transformation as control institution. An impact about institution capacity is forming mechanism not including for enforcement capacity orientation, asymmetry on implementation administrative function, procedure, and finances ordering, rather regulation quality from Bawaslu with the result obstruction concerning the effectiveness of institutionally implementation function. Suggestion is (a) upgrading typology of Election Supervisor Board Province and alteration characteristic Election Supervisor Kabupaten/Kota become permanent institution or increasing quality, quantity and qualification human resources, (b) correction regulating about procedure and duty on pieces as integrative, also (c) completing regulation about observatory implementation function based on norm and rule pursuant to election ordinance. Keywords: Institusional Reinforcement, Election Supervisor and Local Election AbstrakSubstansi demokrasi merupakan raison de etre Pilkada secara langsung dan menegaskan kedudukannya atas implementasi prinsip negara hukum. Berdasarkan evaluasi tahun 2005 s.d 2014, dilakukan perubahan sistem penyelenggaraan yang merefleksikan perubahan arah kebijakan terhadap kelembagaan pengawas Pemilu. Tujuan penelitian ini (a) menjelaskan arah kebijakan penguatan kelembagaan pengawas Pemilu berdasarkan Undang-Undang Nomor 1 Tahun 2015 beserta peraturan perundangan perubahannya, dan (b) dampak penguatan terhadap kapasitas lembaga. Penelitian ini menggunakan metode yuridis normatif, melalui pendekatan undang-undang, konseptual dan kelembagaan secara integratif, menggunakan sumber data sukunder dengan teknik analisis kualitatif. Disimpulkan penguatan kelembagaan diwujudkan melalui penguatan tugas, kewenangan, kewajiban, peran dan fungsi kelembagaan yang mengarah transformasi fungsi sebagai institusi kontrol. Dampak terhadap kapasitas lembaga diantaranya mekanisme pembentukan belum berorientasi penguatan kapasitas, kesenjangan penatalaksanaan fungsi administrasi, tata kerja dan penatausahaan keuangan, serta lemahnya kualitas Peraturan-Peraturan Bawaslu yang menghambat efektifitas fungsi kelembagaan. Disampaikan saran (a) peningkatan tipelogi Bawaslu Provinsi dan perubahan kelembagaan ditingkat Kabupaten/Kota menjadi bersifat tetap dan/atau peningkatan kualitas, kuantitas dan kualifikasi SDM (b) pembenahan regulasi tata kerja dan uraian tugas secara integratif, serta (c) penyempurnaan regulasi pengawasan Pemilu berdasarkan norma dan kaidah peraturan perundang-undangan. Kata Kunci: Penguatan Kelembagaan, Pengawas Pemilu dan Pilkada

Abstract This research takes the case of Public Nomination and Direct Election, currently being rolled out in the People's Republic of China, to explain the function of elections in China. We believe that the goal of implementing this election system is to increase the governing ability of the Chinese Communist Party, thus sustaining the survival of the party-state system.

Institutionalist theory argues that fairly permanent economic structures and policy-making arrangements create “institutions” which shape future policy-making and economic performance to a considerable extent (March and Olsen 1989; North 1990; Riker 1982). This perspective suggests that it might be valuable to look for the political institutions that evolved during Taiwan’s development which could have inhibited the country’s adaptability after the mid-1990s. From this perspective, Taiwan’s current institutional imbroglio results from a combination of a complex and somewhat indeterminate constitutional system, a long-time election system that contained some perverse incentives, and its long era of authoritarian rule. This paper, hence, seeks to provide an “institutionalist” explanation for the polarization and gridlock in Taiwan’s politics in the early 21st century.
