The amendment of the 1945 Constitution sets that governors, regents, and local mayors are democratic in their election, originally selected by the legislative assembly and latterly sifted into direct election from the people. Based on the regulation No. 22 of 2007, it states that the election of local leader and co-leader is characterized as the part of general election regime, and thus it brings impact on local election, which should run directly as well. This article examines the arising problems on local election after the amendment of the 1945 Constitution, which reveals various problematic factors in the implementation of direct election for local head has been officially established. Indonesia has run local election many times in different eras, including in Dutch colonialism, Japan colonialism, and post-independence era. In post-independence era, Indonesia also has various political climates and traditions and including Old Order, New Order, and reformation era. The alteration of this general election system aims to provide fair democracy for all people to vote for their local leaders. The implementation, however, encounters several factors and problems derived from the level of participation up to the readiness of local election committee.

Frasa ” dipilih secara demokratis ” dalam Pasal 18 ayat (4) Undang-Undang Dasar 1945 selalu ditafsirkan bahwa pemilihan kepala daerah harus dilakukan secara langsung oleh rakyat. Untuk memahami tafsiran sesungguhnya, tulisan ini akan membahas mengenai tafsiran ketentuan tersebut terhadap mekanisme pemilihan kepala daerah, disamping itu akan dibahas pula dinamika pemilihan kepala daerah (termasuk di daerah istimewa) di Indonesia dari masa ke masa, dan perbandingan sistem pemilihan kepala daerah di negara lainnya. Melalui penelitian yuridis normatif, diketahui bahwa secara konstitusional makna frasa tersebut dapat diartikan dalam bentuk pemilihan langsung dan pemilihan oleh Dewan Perwakilan Rakyat Daerah. Terhadap mekanisme pemilihan kepala daerah di Negara lain pada dasarnya juga pernah diterapkan di Indonesia. Akan tetapi, berdasarkan kisruh yang terjadi beberapa lalu terkait pemilihan kepala daerah di Indonesia melalui pemilihan Dewan Perwakilan Rakyat Daerah memunculkan isyarat bahwa rakyat lebih puas dengan pemilihan langsung. Sebaliknya di daerah istimewa Yogyakarta, rakyat lebih puas untuk tetap menetapkan turunan Sultan yang menjadi pemimpin mereka. Dengan demikian, alangkah baiknya pemerintah memperhatikan aspirasi rakyat sebelum mengubah mekanisme pemilihan kepala daerah untuk meminimalisir terjadinya kisruh.<p>The phrase ”shall be elected democratically” in Article 18 paragraph (4) of the 1945 Constitution of Indonesia is always interpreted that regional leaders shall be elected directly by the people. According to that, this paper will discuss the provisions interpretation about election system for regional leaders, the dynamic system in the local election for regional leaders (including in special regions) in Indonesia, and comparison with other countries. Through normative juridical research, the constitutional meaning of the phrase can be interpreted both as direct election and election by the Local Council. The local election for regional leaders in other countries basically has been applied in Indonesia. However, based on the protest that occurred related to the election by the Local Council gave us a sign that people prefer direct election. Unlike in Yogyakarta, as a special region in Indonesia, the Yogya’s people prefer to be led by Sultan’s descendant. Thus, in the future, government should understand people’s will before changing the election system for regional leaders to minimize conflicts.</p>

Map of political Islam in Indonesia is always colored by the government political map. From the pre-independence era, the post-independence (old order), the new order and the reform era. Islamic education is still in a position that is generally not in favor of the empowerment of the people. Education is a tool for which the government used it to escort people and people to the desired political objectives, theoretically it is not wrong if the government wants the product graduate of educational institutions contribute to development. But at the same time the government should also give freedom to the world of education to determine its direction with permanent gets assistance, support, and facilitation from the government.

Abstract Electoral system is one of the factors that affect the development of democracy and political state. It is need to get the attention of people who want improvement democracy. The electoral system, especially in implementation of house of representative election, it becomes a study that need attention given during the general election of house of representative (DPR) members eleven times from some period of democracy is different, it cannot fully realize the elections are truly ideal for the development of democracy and resulted in the representatives of the people and reflecting the aspirations properly represent the people's interests. Post-fall of the New Order regime, the action of Islamic radicalism spreads out fast in Indonesia. Unluckily, actors and the perpetrators are mostly Muslimand claiming graduated from Islamic educational institutions. Radical Islamic movements nowadays are worrying the people and threaten the life of the nation that contains the values of pluralism, tolerance, and acculturative, including in religion. According to way of life on Indonesian, Pancasila, and the 1945 Constitution and the Republic of Indonesia which is the basics of nation and state are also threatened. even their movement tends to do with violence. Proven by the presence of several violent incidents that resulted in deaths were not counted. (National Agency for Counter of Terrorism, 28/8/2002). Therefore, Indonesia  (and even the world) needs strategies to prevent the anti-radicalism and terrorism. Learning the last fact, education that be designed by conforming new model of learning for Moslem Teacher is absolutely needed. The approach to the handle the Islamic radicalism must always be strived, One of models is through character education. Education is partly done by reconstructing the Islamic Religious Education (PAI) that is taught in educational institutions. Reconstruction of PAI should be able to produce learners that possess attitude of tolerant, moderate and inclusive. In short, there is a tendency of systematic efforts made by certain religious groups to teach the doctrine of religious hardliners among students of Elementary School (SD), that often reborn radicalization. Here, the writer will show how Moslem teacher can take anti-radicalims learing by some new models that can be implemented, namely the de-radicalization preventive, de-radicalization preservative against moderate Islam, and  curative deradicalised.

“Kekristenan dan Nasionalisme di Indonesia” membahas mengenai sejarah kekristenan di Indonesia yang diasumsikan sebagai agama yang pro terhadap penjajah dari Barat namun asumsi itu tidak benar sebagai bukti ada banyak tokoh Kristen yang ikut memperjuangkan kemerdekaan Indonesia dengan didasarkan semangat nasionalisme. Kemudian pasca-kolonial Belanda kekristenan ingin menampilkan wajah baru yang sungguh-sungguh keindonesiaan dengan lahirnya organisasi DGI/PGI. Namun seiring waktu ketika berakhirnya era orde baru dan memasuki era reformasi, kekristenan dan masyarakat lainnya di Indonesia menghadapi arus gelombang yang mengatas-namakan agama yang pergerakannya cukup masif dibandingkan di era orde lama diantaranya: kelompok Islam fundamentalis yang ingin menjadikan NKRI bersyariat Islam, adanya gerakan politik transnasional HTI yang ingin menghidupkan kembali kejayaan Islam pada abad ke-6 dan faham Wahabisme yang sarat dengan kekerasan. Persoalan lainnya ialah adanya kemiskinan yang terstruktur akibat dari krisis moneter yang melanda di Indonesia tahun 1997. Abstract: Christianity and Nationalism in Indonesia” discuss the history of Christianity in Indonesia, which is assumed to be a religion that is pro to Western colonialism. Still, this assumption is incorrect as evidence that many Christian figures fought for Indonesian independence based on the spirit of nationalism. Then post-colonial of Dutch, Christianity wanted to be presented a truly Indonesian face with the birth of the DGI / PGI organization. But over time when the end of the new order and entering the era of reform, Christianity and the other societies in Indonesia faced challenges in the name of religion whose movements were quite massive compared to the old order including fundamentalist Islamic groups who wanted to make the Republic of Syariat Muslim Indonesia, a transnational HTI political movement that wanted to revive the glory of Islam in the 6th century and the ideology of Wahhabism which is loaded with violence. Another problem is the existence of structured poverty due to the monetary crisis that hit Indonesia in 1997. Through this problem, every religion in Indonesia must converge on the basis of the same concerns.

Abstract: This article discusses the individual candidate in the general election of regional head in political jurisprudence perspective. Before the Mahkamah Konstitusi’s decision No. 5/PUU-V/2007 pointed out, the individual candidate could have enter the two political institutions; first, in the 2004 general election, the individual candidate competed to get into the institution of the Regional Representative Council of the Republic of Indonesia; second, Undang-Undang No. 11 tahun 2006 regarding with the Government of Aceh where the individual candidate could compete with the candidates promoted by the national political party in electing the regional head in all over Aceh. The decision of Mahkamah Konstitusi No. 5/PUU-V/ means that the local head election held in various regions can include the individual independent candidate. In political jurisprudence perspective, mechanism of the individual candidacy in the election has already in accordance with the concept of maslahah al-‘ammah ie. hifdz al-ummah.  In this case, any of the individual independent candidates who nominate themselves as the regional head cannot be discriminated and they deserve the right to nominate to be in line with the Mahkamah Konstitusi’s decision.Keywords: Candidate, individual, local election, jurisprudence, siyasah

Abstract; this paper highlights democracy in the history of the constitution of the Republic of Indonesia. In the history of the nation, from independence to now, there are three kinds of democracy that once applied in the constitutional life of Indonesia, namely the liberal democracy, the guided democracy, and the Pancasila democracy. The liberal democracy leads to a failure of the Constituent establishing Undang-Undang Dasar 1945 as a replacement of Undang-Undang Dasar Sementara 1950. The Guided Democracy is under the reign of the old order and the Pancasila democracy is under the rule of the new order. Although the initial concept for the period intended as an implementation of the fourth principle of Pancasila, but the power was ultimately centralized on the hand of President. A failure of the old and the new order to uphold the values of democracy cause a reformation. Pancasila is the basis of our country and the nation's view of life, which is extracted from the noble values of the nation's culture. However, along with the development of time, the practice and implementation of the Pancasila practice are always adjusted to the regime's will in power. In the Old Order era, Pancasila was used as an ideological tool; during the New Order, Pancasila was carried out purely and consistently but followed the regime's will in power at that time. In the Reformation Age, the implementation of Pancasila, which was expected to be following the original, even began to be abandoned because the people were more faced with a free lifestyle with liberal understanding. This article will try to highlight the position of Pancasila during the New Order regime when President Suharto was in power and compare it with the work of Pancasila Post-reformation starting from the fall of the New Order until now and looking at the challenges that will be faced in the future.
