ABSTRACT  The members of INA and PIR don’t give right to vote and be elected in general elections because there is worried about right to vote and be elected will be bringing on not neutral in general election, with the result that general elections principle is direct, general, secret, honest, and fair will not be achieved if right to vote and be elected is given. Although that worried still be able to debate in theoretical. It is becaused if right to vote and be elected for members of INA and PIR are given, so will not influence the vote result majority in general elections. The concept  to give right to vote and be elected  for members INA and PIR in general elections need to be implemented, because in the first general elections in 1955 the members of INA and PIR follow to vote and be elected in general election, and than there was not problem happen in thats time. Because of that  be alternative thought bargained  in this thesis; The concept  of  legal protection  for members INA and PIR in political freedom is looked from human right protection principle is given  freedom for members INA and PIR  to vote the candidates house representatives, house representative region, house representative people, President and Vice President with free without any pressures from the institution INA and PIR. And than  for the members INA and PIR propose their self as candidates the members House Representative, House Representative Region, House Representative People, President and Vice President permitted to be candidate as form of political freedom to every people Keyword: legal equality, political freedom, general election.

Abstrak Implikasi putusan mahkamah konstitusi terkait penggunaan KTP dan paspor dalam pemilihan presiden dan wakil presiden dalam kerangka menjamin hak memilih dalam pemilihan umum. Terkait dengan ini maka memunculkan permasalahan terkait implikasinya. Bagaimana implikasi baik secara langsung maupun tidak langsung putusan Mahkamah Konstitusi terkait penggunaan KTP dan Paspor dalam pemilihan umum. Mahkamah Konstitusi sebagai lembaga pelaksana kekuasaan kehakiman yang salah satu kewenangannya adalah menguji Undang-Undang terhadap UUD Negara Republik Indonesia Tahun 1945 dalam rangka mewujudkan negara demokrasi yang berdasarkan hukum sebagaimana termaktub dalam Pasal 1 UUD Negara Republik Indonesia Tahun 1945. Hasilnya adalah implikasi langsung yang terdiri dari penerapan KTP dan Paspor sebagai ganti DPT, Memunculkan putusan yang bersifat self executing, mengesampingkan Peraturan Pemerintah Pengganti Undang-undang, mengesampingkan keputusan dan peraturan KPU terkait aturan baru akibat putusan MK dan Implikasi tidak langsung yang terdiri dari Mengurangi terjadinya perselisihan hasil Pemilihan Umum Presiden, KPU bekerja ekstra. Tujuan ke depan penelitian ini adalah untuk mengetahui dan memberikan sumbangsih dalam dunia akademik terutama terkait tentang penjaminan hak asasi manusia terutama hak memilih dalam pemilihan presiden dan wakil presiden. Penelitian ini menggunakan metode kajian peraturan perundang-undangan yang sesuai dengan metode ilmu hukum. Kata Kunci: Putusan Mahkamah Konstitusi, Pemilu, Kartu Tanda Penduduk Abstract The implications of the constitutional court's decision regarding the use of resident identity cards and passports in the election of president and vice president in the framework of guaranteeing the right to vote in general elections. Related to this, problems arise regarding their implications. What are the implications of either directly or indirectly the decision of the Constitutional Court regarding the use of Identity Cards and Passports in general elections. The Constitutional Court as the executing agency of judicial power whose authority is to examine the Law against the State Constitution of the Republic of Indonesia of 1945 in order to realize a democratic state based on law as stipulated in Article 1 of the Constitution of the Republic of Indonesia of 1945. The result is implications directly consisting of the application of Identity Cards and Passports in lieu of the Permanent Voters List, Raising decisions that are self-executing, overriding Government Regulations Substituting the Law, overriding the decisions and regulations of the General Election Commission regarding new rules due to the Constitutional Court ruling and indirect implications consisting of Reducing the disputes over the results of the Presidential General Election, the Election Commission works extra. The future goal of this research is to know and contribute in the academic world, especially related to guaranteeing human rights, especially the right to vote in the presidential and vice presidential elections. ABSTRACTUU no. 7/2017 concerning General Elections, is the legal protection for the implementation of the 2019 General Election using the system presidential threshold. The problem is, this is seen as castration of individual rights where power is in the hands of the people. Equal treatment before the law and politics in the context of nominating the President and Vice President is limited to parties that are part of and meet the threshold in the 2014 general election. This research found that the implementation of the system Presidential Threshold in Indonesia was an embodiment of the people's sovereignty itself. Where the individual directly determines the leader, and in making the requirements to become a leader, and the DPR is a representation of the people. This eliminates concerns in the community when the system will be ratified Presidential Threshold in Law Number 7 of 2017 concerning Elections so that the people's sovereignty in the threshold system is by siyasah syar’iyyah where ahlul halli wa al-‘aqdi can determine candidate leaders and Bai’ah is a form of the general election in determining the leader.Keywords: People’s Sovereignty, Presidential Threshold, Siyasah al-Syar’iyyah.\ABSTRAKUU No. 7 /2017 tentang Pemilihan Umum dasar hukum dilaksanakannya Pilkada Umum Tahun 2019 dengan menggunakan system presidential threshold. Riset ini menjumpai bahwa pelaksanaan sistem Presidential Threshold di Indonesia merupakan perwujudan dari kedaulatan rakyat itu sendiri. Di mana individu secara langsung menentukan pemimpin, dan dalam pembuatan persyaratan untuk menjadi pemimpin, yang mana DPR adalah representasi dari rakyat. Hal ini menghapuskan kekhawatiran di masyarakat ketika akan disahkannya sistem Presidential Threshold dalam Undang-Undang Nomor 7 Tahun 2017 tentang Pemilu, sehingga kedaulatan rakyat dalam sistem ambang batas sudah sesuai dengan siyasah syar’iyyah dimana ahlul halli wa al-‘aqdi memiliki kapasitas untuk menentukan calon permimpin dan Bai’ah adalah bentuk dari pemilihan umum dalam menentukan pemimpin.Kata Kunci: Kedaulatan Rakyat, Presidential Threshold, Siyasah Syar’iyyah.

The aim of this paper is to analyze the regulation of general election of President and vice President in Indonesia. The method used is the normative juridical, with the history approach. Based on  results that the Election of President and Vice President in Indonesia changes from time to time, from the period 1945-1950 President and Vice President elected by PPKI by acclamation. The period 1950-1959 elected by agreement between the state of RIS and RI. After the 1959 period until now, the President and Vice President were elected by the people through general elections.

The General Election was held in 2019 with the KPU as the organizer on April 17, 2019. Among the tasks of the KPU was the dissemination of General Elections to remote areas throughout Indonesia. Remote areas are the main concern of the KPU in an effort to increase election participation in 2019, because remote areas are one of the biggest contributors to the Golput number in the 2014 elections. One of the remote areas with very low participation rates is Tegal Rejo Village, Gedang Sari District, Gunung Kidul Regency. This village is located in a hilly area which is one of the disaster prone areas. Tegal Rejo village has not received socialization from the Gunung Kidul Regency KPU and many villagers are still not informed about the 2019 Presidential Election. From the problems that occur, the author finds a solution to the problem by making an "Infographic Design as a Media Supporting the Socialization of KPU to Remote Areas". As for this design contains information on Election 2019, such as the introduction of candidates in the form of profiles of each prospective president and vice president, procedures for voting, time and place of execution until the conditions become a Permanent Voters List (DPT). And the media created will be given to the KPU to be the material for dissemination to remote areas in Indonesia.

This study raises the legal issue against the enactment of Law No. 7 of 2017 on General Elections in Indonesia. The law has violated the constitutional rights of new political parties of the simultaneous general election participants that began in 2017. The injustice is seen in article 222 which requires the provision of presidential threshold for political parties nominating the president and vice-presidential pairs based on the results of general elections in 2014. If this provision is applied, automatically the new political parties of the simultaneous general election participants in Indonesia do not have the opportunity to nominate a couple of presidents and vice presidents. Based on the Constitution of the 1945 Constitution, the president and vice president are nominated by a political party or a coalition of political parties participating in the general election. Considering the constitution applicable in Indonesia should every political party participating in the general election have equal rights and opportunity in carrying the candidate of president and vice president to be elected by the people in a democracy.

ABSTRAKSelama ini pemilu presiden dan pemilu legislatif dilakukan secara terpisah atau tidak serentak. Pemilu legislatif selalu dilakukan sebelum pemilu presiden dan wakil presiden. Pemilihan umum yang dilakukan secara terpisah dianggap lebih banyak dampak negatifnya serta tidak sesuai dengan UUD NRI 1945. Metode yang digunakan dalam penelitian ini adalah deskriptif analitis dengan pendekatan peraturan perundangundangan. Rumusan masalahnya adalah bagaimanakah pertimbangan hakim konstitusi dalam memutus Putusan Nomor 14/PUU-XI/2013 sehingga terjadi perbedaan dengan putusan sebelumnya Nomor 51-52-59/PUUVI/ 2008 terkait dengan pelaksanaan pemilu serentak. Hasil penelitian menunjukkan pertimbangan hakim konstitusi dalam memutus Putusan Nomor 14/PUUXI/ 2013 tentang pengujian Undang-Undang Nomor 42 Tahun 2008 tentang Pemilihan Umum Presiden dan Wakil Presiden terjadi inkonsistensi. Putusan Nomor 14/ PUU-XI/2013 memutuskan bahwa pemilu presiden dan wakil presiden harus dilaksanakan secara bersamaan dengan pemilu anggota DPR, DPR, dan DPRD. Sedangkan dalam putusan sebelumnya yaitu Putusan Nomor 51-52-59/PUU-VI/2008 pada pengujian pasal dan undang-undang yang sama (Pasal 3 ayat (5) Undang- Undang Nomor 42 Tahun 2008), Mahkamah Konstitusi memutuskan bahwa pemilu presiden dan wakil presiden yang dilaksanakan setelah pemilu anggota DPR, DPD, dan DPRD (tidak serentak) adalah tidak bertentangan dengan UUD NRI 1945 (konstitusional). Terjadinya pertentangan putusan ini antara lain disebabkan oleh perbedaan pilihan penafsiran konstitusi.Kata kunci: inkonsistensi, mahkamah konstitusi, pemilu serentak. ABSTRACTDuring this time, the presidential and legislative elections are conducted separately or not simultaneously. The Legislative Elections are always carried out prior to the General Elections of the President and Vice President. The general election is conducted separately as considerably having more negative impacts and inconsistency with the 1945 Constitution. This analysis uses descriptive analysis method with the pertinent laws and regulations approach. The formulation of the issue is what the Constitutional Court Justices took into consideration in its Decision Number 14/PUU-XI/2013 leading to differences to that of its previous Decision Number 51- 52-59/PUU-VI/2008 concerning the implementation of simultaneous elections. The analysis results show inconsistencies in the consideration of the Constitutional Court Justices in ruling the case through the Decision Number 14/PUU-X/2013 on the judicial review of Law Number 42 of 2008 concerning the General Elections of the President and Vice President. The Constitutional Court Decision Number 14/PUU-X/2013 decided that the General Election of the President and Vice President should be implemented simultaneously with the Legislative Election for the Member of the House of Representatives, the Regional Representatives Council, and the Regional House of Representatives. As for the previous decision, the Constitutional Court Decision Number 51-52-59/PUU-VI/2008 on the judicial review of the same article and law (Article 3 (5) of Law Number 42 of 2008), the Constitutional Court decided that the elections of the President and Vice President conducted after the Legislative Election for the Member of the House of Representatives, the Regional Representatives Council, and the Regional House of Representatives (not simultaneously) is not contradictory to the 1945 Constitution. The contradiction of these decisions is partly due to the variety of interpretation on the constitution.Keywords: inconsistency, the constitutional court, simultaneous elections.

Salah satu penyebab kurangnya angka partisipasi pemilih adalah diantaranya sedikitnya pengetahuan dan informasi masyarakat tentang Pemilu di daerah-daerah terpencil Indonesia. Salah satu daerah terpencil yang tingkat partisipasinya sangat rendah adalah Desa Tegal Rejo Kecamatan Gedang Sari, Kabupaten Gunung Kidul. Desa ini terletak di daerah perbukitan yang menjadi salah satu daerah rawan bencana. Desa Tegal Rejo belum mendapat sosialisasi dari KPU Kabupaten Gunung Kidul dan masyarakat desa masih banyak yang tidak mendapat informasi mengenai Pemilihan Presiden 2019. </em><em>Dari permasalahan yang terjadi, penulis menemukan usulan pemecahan masalah yaitu dengan membuat sebuah “Perancangan Infografik sebagai Media Pendukung Sosialisasi KPU ke Daerah Terpencil”. Adapun pada perancangan ini berisikan tentang Informasi Pemilu 2019, seperti pengenalan calon berupa profil setiap calon peresiden dan wakil presiden, tata cara mencoblos, waktu dan tempat pelaksanaan hingga syarat-syarat menjadi Daftar Pemilih Tetap (DPT). In the 1945 Constitution of the Republic Indonesia, there is an order to further regulate in the Law such as the general election that has been enacted Law No. 7/ 2017 on General Election. In its Law, the results of the general election is merely a dispute over the result of the general election regarding the determination of the vote which may affect the election participants’ seats and the President and Vice President election results. The objective of this paper is to find out the legal consequences of the provisions of the law which reduce the authority of state institutions that have been regulated in the 1945 Constitution. The approach of this research is status approach that will be used by examining the laws and regulations relating to the problem. The provisions of the Law on General Elections can be said to have reduced the authority of the Constitutional Court granted the Constitution. There should be strong grounds for an amendment to this provision it can be done immediately by the House of Representatives and the President. Testing by the Constitutional Court may be done but it is better through changes by the House of Representatives and the President.

Political parties are the only institution that has the right to propose candi- dates for president and vice president as stipulated in Article 6A paragraph 2 of the 1945 Constitution so that they will have power and legitimacy as heads of state and heads of government. These constitutional rights are not owned by any democratic institution other than political parties. However, in the process of holding the general election, it does not always go as expected, as stated in the KPU’s laws and regulations. There were irregulari- ties committed by candidates and by political parties in the form of Money Politics.According to the political dowry event is in the general election area based on the legal principle of Lex specialis derogat legimitation generaly which states that the law is specific (lex specialis) overrides the general law (lex generalis) the Money Politic event is resolved by an institution, namely Bawaslu (General Election Supervisory Board).Besides the Article 6A paragraph 2 of the 1945, there is also Law Number 10 of 2016 concerning the Second Amendment of Law No. 1 in 2015 concerning the stipulation of Perppu (the governmental regulation of low amandement) Number 1 in 2014 according to the governor’s election, regents and mayors, especially in Article 47, Article 187A,Article 187B, Article 187C and Article 187D which regulates general elections. But in reality there are many irregularities in the implementation of the Constitution and etc.Events in the form of political dowry still occured which is evidenced by the infor- mation given by several witnesses and as the victim and perpetrator of the political dowry. Surprisingly, the General Election Supervisory Board (Bawaslu) as an election watchdog institution mandated by the Act to enforce the prevailing regulations is very difficult to carry out its duties, reminding that Bawaslu has weaknesses in handling the alleged polit- ical dowry. The weakness of Bawaslu is that they do not have the power to take witnesses or people who will be questioned.The author argues that there is a need for a legal protection in the form of a law that provides better opportunities to Bawaslu so that the position of Bawaslu as an election supervisory bord can be much stronger.

This paper aims to examine the presidential threshold in relation to the simultaneous general elections 2019. After the decision of the Constitutional Court Number 14/PUU-XI/ 2013 which mandates the general election simultaneously raises the pros and cons of setting the presidential threshold. In the constitutional perspective, using or not using the presidential threshold is not contrary to the constitution, because the presidential threshold is an open legal policy of the legislator. The legislators need to rethink the provisions of the presidential threshold especially in relation to the simultaneous elections, taking into account the advantages and disadvantages of applying or abolishing the presidential threshold, in order for the purpose of strengthening the presidential system to be achieved. The existence of simultaneous general elections has substantially eliminated the provisions of the presidential threshold, so the threshold requirement to nominate the President and Vice President becomes irrelevant. However, if the legislators demand presidential threshold, the middle path that can be selected is to apply the presidential threshold by using the legislative election 2014 with a record of institutionalizing the coalition.
