Forest damage due to illegal logging and logging is known as illegal logging. Legal protection of the rights of indigenous and tribal peoples to the negative impacts of illegal logging based on the concept of national law and customary law can be done by protecting the interests of indigenous peoples, particularly through legislation, namely Article 67 Article (1) (2) and (3) of the Law Law No. 41 of 1999 concerning Forestry. The need for legal protection for indigenous peoples is vulnerable to violations or neglect of their human rights. The state has the responsibility to promote, protect and uphold human rights against its citizens.

The article reveals the role of the judiciary in the context of ensuring the protection of human rights and freedoms in terms of practical approach. It was found that ensuring the protection of human rights and freedoms in Ukraine is regulated by the Constitution of Ukraine, the Law of Ukraine «On the Commissioner for Human Rights of the Verkhovna Rada of Ukraine» and the Law of Ukraine «On Citizens' Appeals». It is established that in Ukraine judicial protection is enshrined in the Constitution of Ukraine, in particular in Article 55, according to which the rights and freedoms of man and citizen in particular are protected by the court. It is proved that the functioning of the constitutional mechanism for the protection of human rights and freedoms can occur only if the state actively participates in ensuring such rights and freedoms. It is determined that an important component of subjective human rights is the right to judicial protection, which should be realized not only in the direct dimension, but also through the activities of state bodies or bodies or organizations authorized by the state. It is established that the concept of «protection» from the standpoint of the legal aspect is interpreted as a legal obligation of the state in the face of bodies, organizations or officials authorized by it, and as the ability of a person to exercise personal subjective right. It was clarified that the concept of «protection of human rights and freedoms» should be interpreted as a set of measures of organizational and legal nature to ensure legal protection or remove obstacles that arise in the context of the exercise of subjective rights and rights to restore such rights, if they were violated with the application of measures on this basis in the form of punishment of the offenders. It is proposed under the mechanism of protection of human and civil rights and freedoms, in particular, to define a holistic, legally enshrined and at the same time dynamic system, which includes subjects, objects, methods and means of protection of human and civil rights and freedoms. to neutralize illegal obstacles, as well as to prevent the emergence of new obstacles. It is proved that the mechanism of protection of human and civil rights and freedoms in particular should consist of institutional and functional systems. It is noted that the prospects for further research in this area are to determine the requirements for the incompatibility of the position of a judge with other activities in a comparative constitutional and legal aspect.

As the law states, Indonesia  provide the protection of the rights for of all people without the discrimination. By the basis of the mandate of the Preamble to the Constitution of 1945 that "a just and civilized humanity," the Indonesian state guarantees of a society that is fair. Political rights granted by the country with regard to discrimination is legal protection by the state against women's political rights. By participating in the convention and recognized in the form of Law Number 7 Year of 1984 on Ratification of the Convention on the Elimination of All Forms of Discrimination Against Women, an attempt by the state to remove the problems in realizing the equality of women and men. Therefore  the  problem  that  can  formulated are: 1) how the legal protection of women's political rights in Indonesia? 2) how the implementation of Law Number 7 Year of 1984 on Ratification of the Convention on the Eliminationof All Forms of Discrimination Against Women Related Political Rights of Women?. The purpose of this study was to examine the legal protection by the state against the ful fillment of women's political rights in Indonesia and the implementation of protection of women's political rights pursuant of Law Number7 Year of 1984. This research is a normative law. The technique used in this research is to use the concept approach and statutory approach to reviewing the legislations and legal literatures. Rights protection as a form of justice for each person more specifically regulated in Law about Human Rights. Protection of the rights granted to women by the state including the protection of the political field regulated in some provisions of other legislation. By removing discrimination against women in it’s implementation still look at the culture and customs which is certainly not easy to do and the state is obliged to realize the objectives of the convention

Penelitian ini mengkaji dua persoalan pokok. Pertama, relevansi Hukum Pidana Adat sebagai kontribusi dalam pembaharuan Hukum Pidana di Indoneisa. Kedua, penerapan hukum dalam penyelesaian tindak pidana berdasarkan Hukum Pidana Adat di Suku Tengger. Hasil penelitian ini menunjukkan bahwa kontribusi Hukum Pidana Adat, berupa penyelesaian perkara di luar pengadilan atau mediasi penal yang dilakukan masyarakat atau masyarakat adat secara turun temurun, sudah relevan dengan pembaharuan Hukum Pidana di Indonesia. Praktik semacam ini selaras dengan nilai dan cita-cita Bangsa Indonesia, sesuai dengan sila keempat Pancasila sebagai dasar negara. Selain itu selaras dengan ide keseimbangan Hukum Pidana, teori sifat melawan hukum, pemenuhan kewajiban adat serta perluasan asas legalitas. Masyarakat Adat Suku Tengger menggunakan mediasi penal sebagai alternatif pertama dalam menyelesaikan perselisihan atau tindak  pidana yang terjadi pada daerah mereka, kemudian menyerahkan kepada pihak yang berwajib ketika mediasi penal tidak mencapai kesepakatan yang adil. <br /><br /><br /><em>This study examines two key issues. First, the relevance of Criminal Customary Law as a contribution to the renewal of Criminal Law at Indoneisa. Second, application of the law in the resolution of a criminal offense under the Criminal Customary Law in Tengger tribe. These results indicate that the contribution of Criminal Customary Law, in the form of settling disputes out of court or penal mediation conducted community or indigenous peoples from generation to generation, it is relevant to the Criminal Law reform in Indonesia. Such practices are aligned with the values and ideals of the Indonesian nation, according to the fourth principle of Pancasila as the state. Moreover tune with the idea of the balance of the Criminal Law, the theory of nature against the law, customary obligations fulfillment and expansion of the principle of legality. Indigenous Peoples Tengger tribe using penal mediation as the first alternative in resolving disputes or criminal acts that occur in their area, and then handed over to the authorities when the penal mediation does not reach a fair deal.</em>

Penelitian ini bertujuan untuk mendeskripsikan eksitensi hukum cambuk (mihita la ua uatto) dalam masyarakat adat Iha-Ulupia dikaji dalam prespektif Hak Asasi Manusia (HAM). Penelitian ini menggunakan deskriptif kualitatif yang bertujuan untuk mengetahui pelaksanaan hukum cambuk dan pandangan Hak Asasi Manusia terhadap pelaksanaan hukum cambuk. Teknik pengambilan data primer dilakukan melalui observasi, wawancara, dan dokumentasi terhadap sejumlah informan yang dianggap terlibat secara langsung dalam proses pelaksanaan hukum cambuk (mihitta la ua uatto). Hasil penelitian ini menunjukan bahwa eksitensi hukum cambuk (mihita la ua uatto) dalam masyarakat adat Iha-Ulupia di kaji dalam prespektif Hak Asasi Manusia (HAM) di negeri Iha-Ulupia Kecamatan Huamual, Kabupaten Seram Bagian Barat terlaksana dengan baik. Hukum cabuk yang diterapkan di negeri Iha-Ulupia masih bersumber pada salah satu sumber hukum yang masih berlaku di Indonesia yaitu hukum adat, hukum cambuk yang diterapkan di negeri iha-ulupia secara substansi tidak melanggar hukum positif dalam hal ini UU HAM karena memiliki landasan pada pasal 18 b ayat (2) UUD 1945.   This study aims to describe the existence of the Caning Law (Mihia La Ua Uatto) in the Iha-Ulupia Indigenous Peoples Study in the Perspective of Human Rights (HAM). Asai Man against the implementation of the caning law. The primary data collection technique was carried out through observation, interviews, and documentation of a number of informants who were considered to be directly involved in the process of implementing the caning law (mihitta la ua uatto). The results of this study indicate that the existence of the law of whips (Mihita La Ua Uatto) in the Tha Ulupia Indigenous Peoples is studied in the perspective of human rights (HAM) in Iha-Ulupia Country, Huamual District, West Seram Regency. Iha-ulupia country is still based on one of the legal sources that are still valid in Indonesia, namely customary law, the caning law applied in Iha-ulupia country substantially does not violate positive law in this case the Human Rights Law because it has a basis in article 18 b paragraph (2) 1945 Constitution.

The rights of prisoners have been explicitly regulated in Act No.12 of 1995 on Corrections. The law therein outlines 13 (thirteen) rights reserved for a prisoner while in a Penitentiary. The right to get a wage or premium for the work done is a right that is often neglected in practice in the correctional institution located in our country. This happens because of the stigma of the people who still tend to assume that a prisoner is a party that deserves to be treated arbitrarily because of the crime he has committed. It is this kind of thinking that ultimately also affects officials or prison officers who end up treating incendiary people like humans who are unfit to accept the rights that have been provided by the state. Many inmates are employed in penitentiaries who are not paid for by their employers. If this continues to be done then the purpose of punishment will actually violate human rights inherent in the Prisoners as human beings. However, prisoners must also be protected by their rights as human beings.

Legal protection is very effort to shelther the human dignity and recognize of human rights in the legal field. A country has the responsibility to socialize new regulations to its society so that they will be aware of the law and also of their rights protected by the state. If society’s legal awareness is growing well, then legal protection in this country will run properly. The development of law enforcement is the beginning of the Police Force. It offers a very interesting history in the development of humanity. Despite the progress that goes slowly, the efforrt is gradually continued in line with the development of human civilization. Thus the ask of the Police is to perforn law enforcement, and the authority of its duty is restricted under the law. In reality, the Police offers in Indonesia are not Legal subjects who never made mistake; hence the author deems that the legal rights and obligations of these officers should be similar as the community at large.

An information system is absolutely necessary in making logical decisions so that the policies developed are in accordance with the applicable law. This article discusses political dynasties from state constitutional law and human rights, whether constitutional or unconstitutional. This article uses a normative research method, which examines the law, the state constitution, and the Constitutional Court decisions related to political dynasties in the implementation of general elections. Political dynasties are a familiar thing in organizing general elections; political dynasties certainly reap the pros and cons. Still, as a legal state, Indonesia must also provide legal certainty regarding how the law views political dynasties. Basically, in this study, based on the rule of law and the state constitution, political dynasties are not unconstitutional; political dynasties do not violate the state constitution; with the prohibition on political dynasties, it is an unconstitutional act and violates human rights. The provisions of the Law on Human Rights prohibit the existence of political dynasties that do not prioritize human rights values, which are regulated in the Law on Human Rights; provide legal protection for every citizen has the right to vote and be elected in general elections. And stated firmly that political dynasties are prohibited, because they are not in line with the constitution and also the values of human rights.

Local wisdom of Indigenous Peoples Migou Pa ‘Tulangbawang Lampung, contains a few anomalies. First, a person who violates customary law will be sanctioned in accordance with the level of the rank of cultures. If he is on the level of indigenous higher, the sanctions given to him will be doubled from legal sanctions must be received by people of customary middle class. In accordance, if he comes from the lowest class, he will get legal sanctions only half of the second level. Second, the natures of anomalies were found on the punishment for adultery to be discharged into the jungle. As adultery is considered an act of animal, the adultery are to be gathered with the animals in the forest. Nowadays, this kind of action could be considered not humane or could also be considered a violation of Human Rights (HAM). All this, according to the author, is intended that people of high rank could be more cautious, more aware of, and even obeying the law. In addition, according to the author, the fact that adultery should be thrown into the jungle is intended to provide a deterrent effect. Third, in the case of violation of the law which should eventually be fined, all members of his clique will be liable to pay a fine. It is intended that the family relatives of the click constantly remind each other that the violation of the law could be fatal. Kearifan lokal Adat Masyarakat Migou Pa’ Tulangbawang Lampung, mengandung beberapa hal anomaly yakni, pertama seseorang yang melakukan pelanggaran hukum adat akan dikenai sanksi sesuai dengan level pangkat adatnya, jika sesorang itu dari level adat yang tinggi maka sanksi hukuman yang diberikan kepadanya akan dua kali lipat dari sanksi hukum yang harus diterima oleh orang yang pangkat adatnya klas  menengah, sebaliknya jika sipelaku itu berasal dari kelas terendah maka sanksi hukumnya hanya separuh dari sanksi hukum orang level kedua. Kedua sifat anomaly itu terdapat pada hukuman bagi pelaku zina yang harus dibuang ke rimba, hanya karena perbuatan zina itu telah dianggap sebagai perbuatan binatang, maka para pelaku zina itu harus dikumpulkan dengan hewan–hewan di hutan, untuk zaman sekarang tindakan semacam ini bisa dianggap tidak manusiawi atau juga bisa dianggap pelanggaran Hak Asasi Manusia (HAM). Semua ini menurut penulis dimaksudkan agar orang–orang berpangkat tinggi itu bisa lebih hati–hati, lebih sadar bahkan taat hukum, kemudian pelaku zina harus dibuang ke rimba raya menurut penulis hal ini dimaksudkan untuk memberi efek jera. Ketiga jika terjadi pelanggaran hukum yang akhirnya harus dikenai sanksi denda maka segenap anggota kliknya yang menanggung kewajiban membayar denda itu, dimaksudkan agar sanak family yang satu klik itu senantiasa saling mengingatkan bahwa pelanggaran hukum itu bisa berakibat fatal.

Abstract:A draft law must be able to answer and solve the main problem of the society so that with the existence of the law the community gets legal protection from the state. However, the draft of Cipta Kerja Law makes an endless controversy. In fact, the draft was allegedly containing some problems since its appearance. Therefore, academic research (Assesment Report) is needed so that the rules in the draft have basic scientific arguments that can be justified. Unfortunately, the draft does not conduct an assesment report to know whether the society need the law and urgent.Keywords: Legal Protection, Controversy and Assesment Report Abstrak:Sebuah rancangan undang-undang harus dapat menjawab dan menyentuh pokok permasalahan masyarakat sehingga dengan adanya undang-undang tersebut masyarakat mendapatkan sebuah perlindungan hukum dari negara. Namun, dalam RUU Cipta Kerja ini justru berakibat pada kontroversi yang tiada hentinya. Bahkan, disinyalir RUU ini mengandung kecacatan sejak awal pembentukannya. Oleh karena itu, dibutuhkan penelitian akademis sehingga aturan-aturan yang ada dalam RUU ini mempunyai basis argumentasi ilmiah yang dapat dipertanggungjawabkan yang salah satunya adalah dengan membuat Laporan Kelayakan. Sayangnya RUU ini belum melakukan laporan kelayakan apakah RUU ini dibutuhkan dan penting di masyarakat.Katakunci: Perlindungan Hukum, Kontroversi dan Laporan Kelayakan
