In the framework of Democratic Policing Reforms, since 1979 the United Nations has actually adopted what is called the Code of Conduct for Law Enforcement Officials. This Code of Conduct includes the idea that the police should represent and be accountable to the entire community. Within the Indonesian case, it is recognized that there is a red thread between supervision and accountability of police performance, particularly law enforcement. However, more than a decade since police reform began in Indonesia, the demands of the wider community for accountability in carrying out police duties, particularly law enforcement in discretionary cases, have continued to echo. In order to make the supervision more effective, it is necessary to examine how supervision of law enforcement by the National Police is carried out. This article is written as a comparative literature study in the realm of legal philosophy. The results reveal that Law enforcement by the National Police, especially with regard to discretionary cases, turns out to require police accountability both inside and outside, both individually and organizationally. In this situation, supervision was carried out in the form of supervision of the implementation of law enforcement by the National Police. In this case, accountability can be said to be a kind of ‘soul mate’ from supervision.

After a significant period of violent conflict in the Western Balkans, countries in the region, specifically Albania, Bosnia-Herzegovina, Croatia, Macedonia, Serbia-Montenegro, and the United Nations (UN) protectorate of Kosovo, have embarked on a process of democratic reform. Part of the democratization effort involves reforming the police force. One important, yet not often studied, aspect of police reform is the appropriate use of force with firearms. This study explores the process of police reform in the Western Balkan region to assess the implementation of the UN Basic Principles on the Use of Force and Firearms by Law Enforcement Officials. Ultimately, this study offers a view of law enforcement activities in an attempt to assess how well these countries are incorporating international standards on the use of force with firearms into their national police practices. In so doing, this research enriches our understanding of weapons issues within the context of security sector, and specifically police reform.

Poor regulation quality contributes negatively to the regulation and law enforcement in the life of the state. The indicator of the poor quality of regulation includes, among others, the large number of regulations requested for judicial review and effectiveness of the implementation of regulations. There are several regulatory issues in Indonesia today, including the existence of multiple interpretations; potential conflict; overlap, principle mismatch, weak implementation effectiveness, not harmonious/out of sync; inconsistent; create unnecessary burdens, both on the target group and the affected groups. Base on these regulatory conditions, regulatory reform is very important and urgent. Given this very basic regulatory issue, it is necessary to make improvements in the regulatory field from upstream to downstream which leads to quality, orderly and simple regulations known as regulatory reform. The purpose of the study is to examine regulatory reform in order to support Indonesia's national development. research is done by doing literature research, or commonly known as the literature study. The Study shows that in order for a regulation to be good, it must fulfill several principles, namely: good norm, good process, and good drafting. Regulatory reform implementation is carried out through a) simplification of existing regulations; b) reconceptualization of the procedures for establishing regulations; c) institutional restructuring of regulation formation; and d) strengthening/empowering human resources with integrity. Good quality of democratic political dimension and progressive legal quality are needed to improve the quality of regulation

The writing of this scientific paper examines the lack of legal awareness of the community about sexual violence. This scientific work arose because the author saw that there were still many cases of sexual violence even though there were rules governing the acts of sexual violence. And this scientific work aims to tell the public what factors influence the act of sexual violence still arise and what efforts can be made by the community and law enforcement officials such as the police for this problem and is expected to eliminate the emergence of new sexual violence. The study sample was victims of sexual violence or sexual harassment in the Jakarta Bara police station. Data collection is carried out by interviewing 15 West Jakarta District Police Polres. And also conduct literature studies by looking for sources related to sexual violence. The results of this study suggest that the factors that often underlie the occurrence of sexual violence is a love factor where if the victim refuses to serve the perpetrators things will arise that are undesirable and there are false facts from the recognition of the average perpetrator who was interrogated by the police

Penelitian ini bertujuan untuk mengetahui Pelaksanaan Fungsi Balai Pemasyarakatan (BAPAS) Makassar Dalam Perlindungan Hak Asasi Manusia Pada Sistem Pidana Anak dan Kendala Balai Pemasyarakatan dalam Perlindungan Hak Asasi Manusia Pada Sistem Peradilan Anak. Penelitian merupakan penelitian normatif. Metode Pengumpulan Data melalui wawancara dan dokumentasi. Teknis Analisis data ini merupakan analisis kualitatif. Hasil penelitian menunjukkan bahwa Balai Pemasyarakatan kelas I Makassar sebagai salah satu penegak hukum khususnya dalam pembimbingan terhadap anak nakal menjalankan perannya tersebut melalui tiga tahap, yaitu tahap Pra ajudikasi, tahap ajudikasi dan tahap Post ajudikasi. Faktor kendala yang dihadapi dalam pelaksanaan Fungsi Balai Pemasyarakatan (BAPAS) antara lain kelemahan aturan hukum yang berlaku terhadap tindak pidana anak, kurangnya koordinasi diantara sesama aparat penegak hukum, rendahnya kualitas sumber daya manusia di BAPAS, and kurang Sarana dan Prasarana yang memadai. Mengakibatkan pelaksaan Fungsi Balai Pemasyarakatan (BAPAS) kurang optimal, dan alokasi anggaran dana yang sangat minim. This study aims to determine the implementation of the function of Makassar Correctional Center (BAPAS) in the Protection of Human Rights in the Criminal Justice System of Children and the Obstacles of the Correctional Center in the Protection of Human Rights in the Justice System of Children. This research is normative research. Data collection methods were through interviews and documentation. Technical analysis of the data is a qualitative analysis. The results showed that Correctional Center Class I Makassar as one of the law enforcers, especially in guiding delinquents carried out their roles in three stages, which are the Pre-adjudication stage, the adjudication stage and the Post-adjudication stage. Obstacles faced in the implementation of the function of Correctional Center (BAPAS) are weaknesses in the rule of law that applies to the crimes of children, lack of coordination among law enforcement officials, low quality of human resources at BAPAS, and lack of adequate facilities and infrastructure. As a result, the implementation of the function of Correctional Center (BAPAS) is not optimal, and the budget allocation for funds is very minimal.

<p>Abstract<br />This article  discusses the ideal setting reconsideration after the Constitutional Court decision No. 34/PUU-XII/2013. This research is legal (judicial) normative, namely by reviewing library materials (literature study). Therefore, the data used in this research is secondary data, which includes the primary legal materials, secondary, and tertiary. The results of this study showed that realizing an ideal regulatory application for review should be conducted, first, the MA should retract SEMA 7 2014 it is necessary to avoid confusion law enforcement officials and people seeking justice so as to interfere with the judicial system. If want to make additional rules to facilitate the course of justice, the MA should be poured in the form of PERMA. Second, by accelerating the process of PK and execution. Thirdly, provision PK in the future submission must be adapted to the Constitutional Court decision No. 34/PUU-X/2013. That way the material truth and justice will actually be realized.</p><p>Keywords: Judicial Review; Justice; Rule of Law; Supreme Court Decisions.</p><p>Abstrak<br />Artikel ini meneliti tentang pengaturan ideal peninjauan kembali pasca putusan Mahkamah Konstitusi No. 34/PUU-XII/2013.Penelitian ini merupakan penelitian hukum (yuridis) normatif, yaitu dengan mengkaji bahan-bahan pustaka (studi kepustakaan). Karena itu, data yang digunakan dalam penelitian ini adalah data skunder, yang mencakup bahan hukum primer, skunder, dan tersier. Hasil Penelitian ini menunjukan bahwa, demi menwujudkan suatu peraturan yang ideal permohonan peninjauan kembali maka perlu dilakukan, pertama, MA harus menarik kembali SEMA No.7 Tahun 2014 hal ini ini diperlukan agar tidak terjadi kebingungan aparat penegak hukum dan masyarakat pencari keadilan sehingga dapat mengganggu sistem peradilan. Kedua, dengan mempercepat proses PK dan eksekusinya. Ketiga, ketentuan pengajuan PK kedepanya harus disesuaikan dengan putusan MK No. 34/PUU-XI/2013. Abstract Numerous empirical studies have documented policing behavior and response to public opinion, social norms, changing laws, neighborhood context and a litany of other subject areas. What is missing from this literature is a general theoretical framework that explains the conflicting goals of properly applying the law and responding to social norms and the consequences of the law. We build a theoretical framework where law enforcement officials care about both reputation and performance. Outside evaluations assess the quality of the decision making of the officers, but can be influenced by strategic challenging of the sanctioning by the suspected violators. We first establish that reputational concerns can distort law enforcement, encouraging either over-enforcement or under-enforcement of the law, depending on the prior beliefs of violations and the observed signal. Introducing strategic challenging by the violator eliminates over-enforcement and allows for an even larger reduction in application of the law by less-skilled officers. Connections to empirical findings of distortions in law enforcement, along with an extension to deterrence are highlighted.
