Environmental problems are enormous around the world and threaten the global environment. In most cases, these problems are caused by rapid growth of population and poverty. Climate change and sustainable development are inter-linked and are priority issues in the development continuum. Any adverse impact on the environment and biodiversity can cause the restriction of resources and limit available options. Concerted efforts of all the states can bring positive result to address the effects of climate change. Compliance with the treaty provision and sharing of resources and actions among the states can ensure proper utilization of resources and sustainable development.

This chapter looks at the relationship between the World Trade Organization (WTO) and international trade in terms of international environmental law. Twenty-five years after the WTO system came into operation it appears that neither trade law nor environmental law have trumped each other. Rather, there has been a process of accommodation which is still ongoing. The chapter ends by making some conclusions on the arguments presented in this book and the issues currently being faced. The current policy of encouraging free trade cannot always be made environmentally friendly and this will always be the case. The problem becomes clear if we consider climate change. Free trade and globalisation by nature exacerbates the difficulties of regulating environmental issues. In addition, one of the key problems with sustainable development as a concept is that there has been too much emphasis on development, and not nearly enough on sustainability, then a policy of promoting free trade is part of that problem.

The growing body of international environmental law has not been successful in addressing the ecological challenges affecting our planet according to the Global Environment Outlook-6. We are not making enough progress to address environmental problems in such a manner that we can achieve the sustainable development goals by 2030 or achieve some degree of sustainable development by 2050. This chapter reviews the latest science on environmental issues and draws five lessons: First, incremental hard law is unable to pre-empt tomorrow’s problems, let alone address yesterday’s challenges. Second, international environmental law needs to make a quantum jump in terms of understanding of the issues and identification of appropriate tools—and this requires the legal community to engage more proactively with scholars from other disciplines. Third, international environmental law must address the drivers of environmental destruction. Fourth, it needs to engage more proactively with the growing pollution caused by the rich and the growing vulnerability of the poor to the impacts. Finally, principles of environmental justice may need to be incorporated in a possible Global Constitution if we are to live peacefully within a world of resource limits.

International environmental law encompasses the legal norms and processes that address transboundary, regional, or global environmental issues. International environmental concerns generally result from human impacts on the natural environment, such as pollution or resource use related to production or consumption processes. Environmental problems pose at least five distinctive challenges for international law. First, because they typically result from private activities (Nonstate Actors) rather than from government action, international environmental law must either engage these actors directly or, as has been the predominant approach to date, prompt states to regulate private actors under their jurisdictions. Second, because international environmental problems, or scientific understanding of them, tend to evolve rapidly and sometimes unexpectedly, international environmental law often operates under conditions of uncertainty and must be adaptable to changing needs or knowledge. Third, international environmental law must deal with multiple interconnections. International environmental problems, by definition, not only transcend jurisdictional boundaries, but they also implicate social, political, and economic processes, as has come to be expressed through the concept of sustainable development (Sustainable Development). Moreover, because many international environmental problems are intertwined with one another, action or inaction on one issue implicates one or more other issues. Fourth, many international environmental issues, and virtually all global environmental concerns, require cooperation between industrialized and developing countries (History and Evolution), raising complex and highly charged questions of equity and capacity (Common but Differentiated Responsibilities). Finally, international environmental problems frequently require not only the balancing of potentially competing contemporary interests and priorities, but also have significant implications for future generations of humanity (Intergenerational Equity). The evolution of international environmental law has been shaped by these closely intertwined challenges (History and Evolution). Customary or soft law principles (Key Principles) have emerged that reflect the various dimensions sketched above. Perhaps in recognition of the fact that environmental problem-solving requires cooperation rather than confrontation, the primary role of these principles has been to help frame the negotiation and operation of international environmental agreements (Multilateral Environmental Agreements) and the activities of international institutions (International Environmental Institutions). Indeed, the bulk of international environmental lawmaking, implementation, and compliance control (Compliance Mechanisms) occurs today under the auspices of the hundreds of environmental agreements that are now in existence. International courts and tribunals (Courts and Tribunals) have played only a relatively small role in the application of customary or treaty law to environmental issues in the course of dispute settlement. Similarly, the law of state responsibility has found only limited application in the environmental context and states have preferred to negotiate civil liability regimes to address specific risks, such as those posed by oil pollution or nuclear energy production (Responsibility and Liability). This article focuses on the major structural elements and key characteristics of international environmental law rather than on developments in the various substantive issue areas.

This chapter investigates the interaction between individuals and states in the face of climate change. It looks into the points of intersection between climate change and human rights regimes by examining the extent to which the climate change regime has recognized and addressed the human rights dimensions of climate change. Indeed, climate change is but one of many global environmental issues and where the climate change regime is part of the corpus of international environmental law, it looks into the extent to which the debate on a right to environment can be used in the context of climate change. International environmental law includes instruments that embrace the human dimensions of environmental issues as reflected, for instance, in the definition of sustainable development adopted in the Johannesburg Declaration on Sustainable Development at the Johannesburg World Conference on Environment and Development.

This chapter focuses on the connection between the international legal framework governing the conservation of natural resources and human rights law. The objective is to examine the potential synergies between international environmental law and human rights when it comes to the protection of natural resources. To do so, it concentrates on three main areas of potential convergence. It first focuses on the pollution of natural resources and analyses how human rights law offers a potential platform to seek remedies for the victims of pollution. It next concentrates on the conservation of natural resources, particularly on the interconnection between protected areas, biodiversity, and human rights law. Finally, it examines the relationship between climate change and human rights law, focusing on the role that human rights law can play in the development of the current climate change adaptation and mitigation frameworks.

This chapter looks at whether and how international organizations and criminal law can help us deal effectively with transnational environmental crimes and, more broadly, with environmental insecurity and injustice. It explores the question of whether the climate change justice agenda can benefit from the expanded pursuit of transnational environmental crime. The chapter asks whether international environmental law, refurbished, act as a mitigating factor in climate change. It concludes that while current international legal instruments can help spur additional action, by themselves, they will prove inadequate. Consequently, one idea proposed is a new international environmental court to deter all forms of ecocide.

Abstract This workshop is dedicated on SDGs in the focus of environmental and health issues, as very important and actual topic. One of the characteristics of today's societies is the significant availability of modern technologies. Over 5 billion (about 67%) people have a cellphone today. More than 4.5 billion people worldwide use the Internet, close to 60% of the total population. At the same time, one third of the people in the world does not have access to safe drinking water and half of the population does not have access to safe sanitation. The WHO at UN warns of severe inequalities in access to water and hygiene. Air, essential to life, is a leading risk due to ubiquitous pollution and contributes to the global disease burden (7 million deaths per year). Air pollution is a consequence of traffic and industry, but also of demographic trends and other human activities. Food availability reflects global inequality, famine eradication being one of the SDGs. The WHO warns of the urgency. As technology progresses, social inequality grows, the gap widens, and the environment continues to suffer. Furthermore, the social environment in societies is “ruffled” and does not appear to be beneficial toward well-being. New inequalities are emerging in the availability of technology, climate change, education. The achievement reports on the Sustainable Development Goals (SDGs), also point out to the need of reviewing individual indicators. According to the Sustainable Development Agenda, one of the goals is to reduce inequalities, and environmental health is faced by several specific goals. The Global Burden of Disease is the most comprehensive effort to date to measure epidemiological levels and trends worldwide. It is the product of a global research collaborative and quantifies the impact of hundreds of diseases, injuries, and risk factors in countries around the world. This workshop will also discuss Urban Health as a Complex System in the light of SDGs. Climate Change, Public Health impacts and the role of the new digital technologies is also important topic which is contributing to SDG3, improving health, to SDG4, allowing to provide distance health education at relatively low cost and to SDG 13, by reducing the CO2 footprint. Community Engagement can both empower vulnerable populations (so reducing inequalities) and identify the prior environmental issues to be addressed. The aim was to search for public health programs using Community Engagement tools in healthy environment building towards achievement of SDGs. Key messages Health professionals are involved in the overall process of transformation necessary to achieve the SDGs. Health professionals should be proactive and contribute to the transformation leading to better health for the environment, and thus for the human population.

Growing environmental problems and increasing requirements of green jobs force universities around the world not only to transform their curricula but also to enrich existing ones with contents related to the promotion of sustainable development. This paper aims to show the importance of measuring and monitoring the share of green contents in all university activities, as only in that way it is possible to monitor trends and give realistic assessments of their effect and importance. The paper presents a comparative analysis of different types of methodologies for assessing sustainable activities at universities as well as research conducted at the University of Novi Sad in Serbia and its comparison with the University of Gothenburg (Sweden). This research aims to point out the importance of increasing competitiveness in higher education through assessment of green content in a curriculum and its promotion. In this way, through eco-labeling methodology, it would be easier to identify those contents that, in a certain share, contribute to the promotion of sustainable development. Furthermore, this methodology can easily be extended across the country and the region, which would bring positive effects to all stakeholders in higher education.
