Effective provision of justice remains essential for preventing wartime grievances into feuds and mass conflict in strengthening the state and improving accountability. It can lead to quick and cheaper resolution of disputes. This research focuses on evaluating the informal system of governance and justice delivery system in Swat, Khyber Pakhtunkhwa province of Pakistan. It evaluated the institutions of justice delivery (both formal and informal) in terms of structure, functions, and efficiency. The study reveals that informal mechanisms of dispute resolution is still preferred at large, despite the availability of formal institutions for this purpose. Majority of the respondents showed distrust on the formal institutions of justice delivery and dispute resolution across the sample population. This mistrust has been related to the ineffectiveness in terms of lengthy process of handling disputes of various types and the involved financial cost. Shariah and custom remained the preferred type of law to be adopted as compared to state law/statute for dispute resolution. The study concludes that state institutions of justice delivery and dispute resolution should work in collaboration with the informal institutions for effective provision of dispute resolution and justice delivery. A mixed method approach of depth interviews focus group and household survey is employed for collecting primary data.

AbstractThe author conducted this research with the background of the implementation of Mediation in Kuningan Religious Court in Kuningan. The purposes of writing this paper are to know how the Implementation on Divorce Settlement in Kuningan Religious Court and to know the factors that affect the success of mediation in the Kuningan Religious Court. The method used in this research is with empirical juridical approach using primary data and secondary data and data collection techniques are interviews, observation and literature study. The results of this research are the mediation arrangements set out in the Supreme Court Regulation (PERMA ) Number 1 Year 2016 about Mediation Procedures in Courts and more specifically stipulated in the Decree of the Chief Justice Number 108 / KMA / AK / VI / 2016 on Mediation Governance at the Court. Mediation is the means of dispute resolution through the negotiation process to obtain agreement of the Parties with the assistance of the Mediator. Mediator is a Judge or any other party who has a Mediator Certificate as a neutral party assisting Parties in the negotiation process to see possible dispute resolution without resorting to the disconnection or enforcement of a settlement. Its implementation has been regulated in Law Number 1 Year 1974 about concerning Marriage, Compilation of Islamic Law, and Supreme Court RegulationNumber 1 of 2016 concerning Mediation Procedure in Court. The conclusion of this thesis writing is Mediation which should be one of the alternative process of dispute settlement which can give greater access to justice to the parties in finding satisfactory dispute settlement and to fulfill the sense of justice, and become one of the effective instrument to overcome the problem of case buildup especially for the case Divorce, in the end has not been effectively implemented.Keywords: Mediation, Divorce, Marriage.�AbstrakPenulis melakukan penelitian ini dengan latar belakang yaitu bagaimana pelaksanaan Mediasi pada Pengadilan Agama Kuningan. Tujuan penulisan ini untuk mengetahui bagaimana Pelaksanaan pada Penyelesaian Perceraian di Pengadilan Agama Kuningan dan untuk mengetahui bagaimana faktor-faktor yang memepengaruhi keberhasilan mediasi di Pengadilan Agama Kuningan. Metode yang digunakan dalam penelitian ini adalah dengan pendekatan yuridis empiris dengan menggunakan data primer dan data sekunder serta alat pengumpulan data yang digunakan melalui wawancara, observasi dan studi pustaka. Hasil penelitian ini adalah pengaturan mediasi diatur dalam Peraturan Mahkamah Agung (PERMA) Nomor 1 Tahun 2016 tentang Prosedur Mediasi di Pengadilan dan lebih spesifik diatur dalam Keputusan Ketua Mahkamah Agung Nomor : 108/KMA/AK/VI/2016 tentang Tata Kelola Mediasi di Pengadilan. Mediasi adalah cara penyelesaian sengketa melalui proses perundingan untuk memperoleh kesepakatan Para Pihak dengan dibantu oleh Mediator. Mediator adalah Hakim atau pihak lain yang memiliki Sertifikat Mediator sebagai pihak netral yang membantu Para Pihak dalam proses perundingan guna mencari berbagai kemungkinan penyelesaian sengketa tanpa menggunakan cara memutus atau memaksakan sebuah penyelesaian. Pelaksanaannya telah di atur dalam Undang-Undang Nomor 1 Tahun 1974 tentang Perkwinan, Kompilasi Hukum Islam, dan Peraturan Mahkamah Agung Nomor 1 Tahun 2016 tentang Prosedur Mediasi di Pengadilan. Kesimpulan dari penulisan skripsi ini adalah Mediasi yang seharusnya menjadi salah satu alternatif proses penyelesaian sengketa yang dapat memberikan akses keadilan yang lebbesar kepada para pihak dalam menemukan penyelesaian sengketa yang memuaskan dan mmemenuhi rasa keadilan, serta menjadi salah satu instrumen efektif mengatasi masalah penumpukan perkara khususnya untuk perkara perceraian, pada akhirnya belum efektif dilaksanakan.Kata Kunci : Mediasi, Perceraian, Perdata

<p>Penanggulangan perkara pidana yang terjadi di tengah masyarakat dapat diselesaikan dengan dua metode, yaitu penal dan non penal. Penyelesaian secara non penal salah satunya merupakan Mediasi Penal. Mediasi penal sendiri lahir dari budaya yang ada di dalam masyarakat sehingga kandungan nilai-nilainya sesuai dengan karakteristik Bangsa Indonesia. Namun penerapan mediasi penal ini belum memiliki landasan yuridis yang kuat sehingga perlu diteliti lebih lanjut apa model mediasi yang digunakan serta bagaimana peran aparat penegak hukum. Dalam artikel ini akan dipaparkan proses penyelesaian perkara pidana melalui mediasi penal di tingkat penyidikan dan peran aparat penegak hukum dalam proses mediasi penal. Data pendukung artikel ini menggunakan hasil penelitian dengan jenis kualitatif dan metode pendekatan yuridis sosiologis yang mendasarkan pada data primer dan data sekunder. Pada dasarnya, mediasi penal telah familiar dilaksanakan ditingkat kepolisian didasarkan pada Surat Kapolri No Pol: B/3022/XII/2009/SDEOPS tanggal 14 Desember 2009 tentang Penanganan Kasus Melalui <em>Alternatif Dispute Resolution</em> dengan bentuk mediasi penal yang digunakan adalah <em>victim offender mediation</em>. Model VOM ini dianggap paling layak untuk diterapkan karena mempertemukan antara kedua belah pihak sehingga mengakomodir kepentingan para pihak demi terwujudnya keadilan restoratif.</p><p>Overcoming criminal cases that occur in the middle of society can be solved by two methods, namely reasoning and non-punishment. Non-reasoning settlement is one of them is Penal Mediation. The reasoning mediation itself is born from the culture that exists in society so that the content of its values is in accordance with the characteristics of the Indonesian Nation. However, the application of this reasoning mediation does not yet have a strong juridical basis so it needs to be investigated further what the mediation model is used and how the role of law enforcement officers is. In this article will be presented the process of solving criminal cases through reasoning mediation at the level of investigation and the role of law enforcement officers in the process of judicial mediation. Supporting data for this article uses the results of research with qualitative types and sociological juridical approaches that base on primary data and secondary data. Basically, the reasoning mediation is familiar is carried out at the police level based on National Police Chief No Pol: B / 3022 / XII / 2009 / SDEOPS dated December 14, 2009 concerning Case Handling through Dispute Resolution Alternatives with the form of reasoning mediation that is victim offender mediation. This VOM model is considered the most feasible to implement because it brings together the two parties so that it accommodates the interests of the parties in order to realize restorative justice.</p>

The implementation of court in Indonesia has not fulfilled as expected because any parties involving in court has a lack of capacity, consistency, and integrity to provide legal service seriously. Some people assume that court services are not still optimal. To settle the problems, the Supreme Court just has officially issued Regulation No. 1 of 2019 regarding the Administration of Cases and Legal Proceedings in Courts via Electronic Means on 8 August 2019. This regulation is believed as an appropriate solution to face those problems. To elaborate more, this study illustrates a judicial reform in Indonesia, e-court, and access to justice, the conception of e-court including the performance of e-court and its drawbacks and challenges in the digital era. The research method uses normative research by approaching legal review and literature study. The technique of primary data collection applies Supreme Court regulation while means of secondary data are collected from concept or theory as set out under bibliography. Judicial reform in Indonesia is indicated by issuing new regulation regarding e-Court and e-Litigation, the implementation e-Court itself has been attributed to 32 courts consisting of general religious, and state administrative courts. Through e-Court, access to justice more transparent and accessible. Besides, justice seekers have no worries regarding distance issues as of e-Court may allow them to fight in court without face to face. Parties have no doubt relating to the acceleration of court to settle any dispute in Indonesia.

AbstractUnderstanding the selves, situations and actions of Africans can never be comprehended outside kinship. Local and foreign worldviews are first pigeonholed into culture and defined within kinship realities in Nigeria and Africa. There have been studies on kinship in Africa. However, the findings from such studies portrayed the immutability of African kinship. Thus, as an important contribution to the on-going engagement of kinship in the twenty-first century as an interface between the contemporary Diaspora, this article engaged kinship within international migration. This is a major behavioural and socio-economic force in Nigeria. Methodological triangulation was adopted as part of the research design and primary data were collected through in-depth interviews (IDIs), and life histories of international migrants were documented and focus group discussions (FGDs) were held with kin of returnees. The article found and concluded that while returnees continued to appreciate local kinship infrastructures, the infrastructures were liable to reconstruction primarily determined by dominant support situations in the traditional African kinship networks.

Landslides affect at least 15% of the land area of India, exceeding 0.49 million km2. Taking the case of landslide affected communities in the state of Kerala in India, this paper demonstrates that the focus has seldom been placed on assessing and reducing vulnerability. From the perspective of political economy, this paper argues that vulnerability reduction has to be the main priority of any disaster risk reduction programme. This paper also demonstrates that the interactions between ecological and social systems are usually complex and non-linear in nature. In contrast, interventions to tackle landslide risks have followed a linear course, assuming that one hazard event acts independently of another. The key findings of the study show that lack of access to political power, decision making, and resources, insecure livelihoods,environmental degradation, and ine#ectiveness of the state approach to disaster risk reduction are some of the major factors that lead to increasing vulnerability. Qualitative in nature, the primary data were collected through in-depth interviews with people from different groups such as farmers affected by the landslides and secondary floods, men and women living in the temporary shelter, government representatives involved in relief activities, health authorities, and elected representatives.

The paper provides findings about how packaging of healthy foods is perceived by consumers. The primary data were collected by eye-tracking using the SMI RED 250. This investigation analyzed 12 healthy products and it was completed by 50 respondents. This method was supplemented with in-depth interviews with the same respondents who participated in the eye-tracking research. A questionnaire survey (n = 261) was also a part of the research. Based on these two methods, real and declared consumer behavior can be recognized and the differences between these behaviors can be identified. The main interest was to determine which package attributes of healthy foods are the most interesting according to consumers. The research shows that the most attention in terms of information is devoted to nutritional value, food composition and also country of origin. Furthermore, the attention was focused on the most suitable packaging materials for various kinds of products as well as colors used on the packaging of these foods. The results provide valuable information to create an attractive and effective packaging of healthy products.

This study aimed to adjust the predetermined theme with the theme implemented. In addition, giving interesting presentations to students, and teachers can improve the quality of human resources in the field of technology and information. This study used a qualitative approach. Data sources consisted of primary data and secondary data through procedures for collecting data with participatory observation, in-depth interviews, and documentation studies. The data analysis technique in this study used domain techniques, taxonomic techniques, compound techniques, and theme techniques. For the process of checking the validity of the data, a triangulation process was carried out to obtain accurate research results. The results of the study obtained that in thematic learning using the Lesson Plan (RPP) to achieve a basic competency set out in the Content Standards and described in the syllabus through various learning behaviors of students.

Bawean Island which is within the scope of Gresik Regency has the potential of nature, culture, and religiontourism. The natural resources that have this potential will develop if managed and promoted with an effective and efficient strategy. The purpose of this study to analyze the communication strategy used by the local government of Gresik Regency in promoting potential tourism in Bawean Island. In this qualitative descriptive study the primary data was obtained through in-depth interviews with the head of Departement of Culture Tourist Youth and Sport in Gresik. The questions in the interview related to Bawean Island tourism promotion strategic plan along with what has been done by related parties. Data analysis was performed using interactive techniques from Miles and Huberman. The results of this study show that the Department of Culture, Tourism, Youth, and Sports has not had a marketing strategy and implementation based Integrated Marketing Communications. The strategies and promotions that have been there are also still not running optimally.
