<p>Penanggulangan perkara pidana yang terjadi di tengah masyarakat dapat diselesaikan dengan dua metode, yaitu penal dan non penal. Penyelesaian secara non penal salah satunya merupakan Mediasi Penal. Mediasi penal sendiri lahir dari budaya yang ada di dalam masyarakat sehingga kandungan nilai-nilainya sesuai dengan karakteristik Bangsa Indonesia. Namun penerapan mediasi penal ini belum memiliki landasan yuridis yang kuat sehingga perlu diteliti lebih lanjut apa model mediasi yang digunakan serta bagaimana peran aparat penegak hukum. Dalam artikel ini akan dipaparkan proses penyelesaian perkara pidana melalui mediasi penal di tingkat penyidikan dan peran aparat penegak hukum dalam proses mediasi penal. Data pendukung artikel ini menggunakan hasil penelitian dengan jenis kualitatif dan metode pendekatan yuridis sosiologis yang mendasarkan pada data primer dan data sekunder. Pada dasarnya, mediasi penal telah familiar dilaksanakan ditingkat kepolisian didasarkan pada Surat Kapolri No Pol: B/3022/XII/2009/SDEOPS tanggal 14 Desember 2009 tentang Penanganan Kasus Melalui <em>Alternatif Dispute Resolution</em> dengan bentuk mediasi penal yang digunakan adalah <em>victim offender mediation</em>. Model VOM ini dianggap paling layak untuk diterapkan karena mempertemukan antara kedua belah pihak sehingga mengakomodir kepentingan para pihak demi terwujudnya keadilan restoratif.</p><p>Overcoming criminal cases that occur in the middle of society can be solved by two methods, namely reasoning and non-punishment. Non-reasoning settlement is one of them is Penal Mediation. The reasoning mediation itself is born from the culture that exists in society so that the content of its values is in accordance with the characteristics of the Indonesian Nation. However, the application of this reasoning mediation does not yet have a strong juridical basis so it needs to be investigated further what the mediation model is used and how the role of law enforcement officers is. In this article will be presented the process of solving criminal cases through reasoning mediation at the level of investigation and the role of law enforcement officers in the process of judicial mediation. Supporting data for this article uses the results of research with qualitative types and sociological juridical approaches that base on primary data and secondary data. Basically, the reasoning mediation is familiar is carried out at the police level based on National Police Chief No Pol: B / 3022 / XII / 2009 / SDEOPS dated December 14, 2009 concerning Case Handling through Dispute Resolution Alternatives with the form of reasoning mediation that is victim offender mediation. This VOM model is considered the most feasible to implement because it brings together the two parties so that it accommodates the interests of the parties in order to realize restorative justice.</p>

Efforts to overcome crime through peace based on Restorative Justice, namely justice for all parties are greatly missed by everyone. In carrying out law enforcement duties, the State Police Investigator of the Republic of Indonesia has the duties, functions, and authorities in the field of investigating criminal acts in accordance with the applicable laws and regulations. Based on the Regulation of the National Police Chief Number .6 of 2019 concerning Criminal Investigation, it has a role to carry out prevention efforts without having to use the Criminal Justice System (SPP), namely by resolving cases through the peace process. This process is due to the desire of the community who wants the case to be completed immediately and no longer be complicated. The resolution can be supported by the police's discretionary authority so that the type of research is descriptive empirical juridical, using primary data by means of interviews and secondary data by means of documentation studies. Then all data were processed using qualitative data analysis. Based on the research results, the Pemayung Police Sector policy is to settle criminal cases peacefully (penal police), or through the settlement of criminal cases involving the perpetrator, victim and/or their family and related parties, with the aim of achieving justice for all parties/restorative justice can be carried out, if it does not cause public unrest or there is no community rejection, it will not have an impact on social conflict and the case is still in the process of investigation and investigation. So that it can be directed to a settlement by conducting mediation to the parties, both the victim and the suspect. From the results of the mediation, it was agreed by the parties, both from the reporting party and the reported party as a suspect, admitting all his actions. And from the results of the mediation there was an agreement with the parties (victim and suspect) and a letter of peace was made and the revocation of the Police Report by the victim but after that, the victim came and asked again for the case to be continued, the investigator explained that the agreement had become an agreement of both parties and was binding and the investigation has been discontinued.

This research aims to identify and analyze the existence of the application of criminal penalties in the handling of criminal cases Child Protection in Indonesia and analyze the effectiveness of criminal fines when viewed from the perspective of children as victims of crime.Method used is socio-juridical using primary and secondary data. Primary data collection technique is done with the interview, and secondary data by reading, reviewing and analyzing primary legal materials, secondary legal materials, tertiary legal materials with qualitative analysis techniques, interpreted logically and systematically and drawn conclusions.Based on the survey results revealed that the existence of the application of criminal penalties in the handling of criminal cases Child Protection in Indonesia criminal fines in criminal prospects are just as an alternative or substitute for imprisonment or confinement. And effectiveness this penalty has not run optimally because the defendant would prefer to replace the criminal penalties to imprisonment.The conclusion of this thesis is that the implementation or execution of criminal penalties in Indonesia have not been effective or not maximized because law enforcement or judges tend to prefer the imprisonment of the criminal finesKeywords: Criminal Fines; Criminal Prison; Children.

AbstractThe author conducted this research with the background of the implementation of Mediation in Kuningan Religious Court in Kuningan. The purposes of writing this paper are to know how the Implementation on Divorce Settlement in Kuningan Religious Court and to know the factors that affect the success of mediation in the Kuningan Religious Court. The method used in this research is with empirical juridical approach using primary data and secondary data and data collection techniques are interviews, observation and literature study. The results of this research are the mediation arrangements set out in the Supreme Court Regulation (PERMA ) Number 1 Year 2016 about Mediation Procedures in Courts and more specifically stipulated in the Decree of the Chief Justice Number 108 / KMA / AK / VI / 2016 on Mediation Governance at the Court. Mediation is the means of dispute resolution through the negotiation process to obtain agreement of the Parties with the assistance of the Mediator. Mediator is a Judge or any other party who has a Mediator Certificate as a neutral party assisting Parties in the negotiation process to see possible dispute resolution without resorting to the disconnection or enforcement of a settlement. Its implementation has been regulated in Law Number 1 Year 1974 about concerning Marriage, Compilation of Islamic Law, and Supreme Court RegulationNumber 1 of 2016 concerning Mediation Procedure in Court. The conclusion of this thesis writing is Mediation which should be one of the alternative process of dispute settlement which can give greater access to justice to the parties in finding satisfactory dispute settlement and to fulfill the sense of justice, and become one of the effective instrument to overcome the problem of case buildup especially for the case Divorce, in the end has not been effectively implemented.Keywords: Mediation, Divorce, Marriage.�AbstrakPenulis melakukan penelitian ini dengan latar belakang yaitu bagaimana pelaksanaan Mediasi pada Pengadilan Agama Kuningan. Tujuan penulisan ini untuk mengetahui bagaimana Pelaksanaan pada Penyelesaian Perceraian di Pengadilan Agama Kuningan dan untuk mengetahui bagaimana faktor-faktor yang memepengaruhi keberhasilan mediasi di Pengadilan Agama Kuningan. Metode yang digunakan dalam penelitian ini adalah dengan pendekatan yuridis empiris dengan menggunakan data primer dan data sekunder serta alat pengumpulan data yang digunakan melalui wawancara, observasi dan studi pustaka. Hasil penelitian ini adalah pengaturan mediasi diatur dalam Peraturan Mahkamah Agung (PERMA) Nomor 1 Tahun 2016 tentang Prosedur Mediasi di Pengadilan dan lebih spesifik diatur dalam Keputusan Ketua Mahkamah Agung Nomor : 108/KMA/AK/VI/2016 tentang Tata Kelola Mediasi di Pengadilan. Mediasi adalah cara penyelesaian sengketa melalui proses perundingan untuk memperoleh kesepakatan Para Pihak dengan dibantu oleh Mediator. Mediator adalah Hakim atau pihak lain yang memiliki Sertifikat Mediator sebagai pihak netral yang membantu Para Pihak dalam proses perundingan guna mencari berbagai kemungkinan penyelesaian sengketa tanpa menggunakan cara memutus atau memaksakan sebuah penyelesaian. Pelaksanaannya telah di atur dalam Undang-Undang Nomor 1 Tahun 1974 tentang Perkwinan, Kompilasi Hukum Islam, dan Peraturan Mahkamah Agung Nomor 1 Tahun 2016 tentang Prosedur Mediasi di Pengadilan. Kesimpulan dari penulisan skripsi ini adalah Mediasi yang seharusnya menjadi salah satu alternatif proses penyelesaian sengketa yang dapat memberikan akses keadilan yang lebbesar kepada para pihak dalam menemukan penyelesaian sengketa yang memuaskan dan mmemenuhi rasa keadilan, serta menjadi salah satu instrumen efektif mengatasi masalah penumpukan perkara khususnya untuk perkara perceraian, pada akhirnya belum efektif dilaksanakan.Kata Kunci : Mediasi, Perceraian, Perdata

Abstract<br />This article aims to determine the factors that hinder the effectiveness of the application of the Indonesian <br />National Standard (SNI) on children’s toys. The research methodology used is empirical research, which<br />is researching secondary data at first, then continuing research on primary data in the field or the<br />community. Legal research materials used are primary and secondary legal materials, the technique<br />used in gathering legal materials is depth interviews and document studies or library materials. The<br />results showed that there were factors that hindered the effectiveness of the implementation of the <br />Indonesian National Standard (SNI), which was due to the community being indifferent or not paying <br />attention to the importance of standardization in children’s toys besidesthe lack of merchant knowledge<br />to the importance of SNI in children’s toys.In the application of SNI, there are inhibiting factors, namely<br />the Law factor indicated by the absence of regional regulations governing mandatory SNI on children’s<br />toys, law enforcement factors namely the lack of work ethic in law enforcement, facility and infrastructure<br />factorsare indicated by communication tools that do not yet support the role of law enforcers to maximize<br />their performance, community factors many people who do not know the importance of SNI in children’s<br />toys due to the lack of socialization they get, cultural factors are shown by the legal culture or immature<br />legal habits of society so that the effectiveness of the mandatory forefront of SNI is not running optimally.<br />Keywords: SNI; Children Toys; Effectiveness.<br />Abstrak<br />Artikel ini bertujuan untuk mengetahui faktor-faktor yang menjadi penghambat efektivitas penerapan <br />Standar Nasional Indonesia (SNI) pada mainan anak. Metodologi penelitian yang digunakan adalah<br />penelitian empiris, yaitu meneliti data sekunder pada awalnya, untuk kemudian dilanjutkan penelitian<br />terhadap data primer di lapangan atau terhadap masyarakat. Bahan penelitian hukum yang digunakan<br />adalah bahan hukum primer dan sekunder, teknik yang digunakan dalam pengumpulan bahan hukum<br />adalah depth interview dan studi dokumen atau bahan pustaka. Hasil penelitian menunjukkan terdapat<br />faktor yang menghambat efektivitas penerapan Standar Nasional Indonesia (SNI) yaitu dikarenakan<br />masyarakat acuh atau tidak memperhatikan betul pentingnya standardisasi pada mainan anak selain<br />itu  kurangnya pengetahuan pedagang terkait pentingnya SNI pada mainan anak. Dalam penerapan<br />SNI terdapat faktor-faktor yang menghambat yaitu faktor Undang-Undang ditunjukkan dengan belum<br />adanya peraturan daerah yang mengatur tentang wajib SNI pada mainan anak, faktor penegak hukum<br />yaitu masih kurangnya etos kerja pada penegak hukum, faktor sarana dan prasarana ditunjukkan<br />dengan alat komunikasi yang belum menunjang peranan penegak hukum untuk memaksimalkan<br />kinerjanya, faktor masyarakat yaitu banyak masyarakat yang belum mengetahui pentingnya SNI pada<br />mainan anak dikarenakan kurangnya sosialisasi yang mereka dapatkan, faktor kebudayaan ditunjukkan<br />dengan budaya hukum atau kebiasaan hukum masyarakat yang belum matang sehingga efektivitas <br />penerapan wajib SNI tidak berjalan dengan maksimal. <br />Kata Kunci: SNI; Mainan Anak; Efektivitas.

The problems of this study were 1) the process of resolving the crime of traffic accident committed by a child which causing death in Jurisdiction Police Cirebon, 2) the difference between the completion of the crime of traffic accident by a child which causing death by perpetrators of adults in Police Cirebon City? 3) consideration of the law by the police in the Cirebon City Police enforcement of laws against the crime of traffic accident causing death committed by a child.The method used is research that combines Juridical and Empirical. The source of research data derived from primary data and secondary data obtained by collecting documents and interviewing criminal cases with informants.Based on research findings conducted by researchers regarding law enforcement in case of a traffic accident causing death committed by minors resolved with the criminal justice process method to process outside the criminal justice and restorative justice approach that is Diversion. Based on Act No. 11 of 2012 on the Criminal Justice System Child involvement of multiple stakeholders in the settlement became a mandatory provision. Constraints law enforcement officials in the execution of diversion itself is the factor of legal, officials law enforcement factors, community factors and factors of facilities and infrastructure.Keywords: Law Enforcement; Police; Accident; Traffic; Child.

In the process of investigating criminal cases of persecution relating to the body, health, and human lives, it requires the assistance of a medical expert. The assistance of a doctor with his medical science of justice as stated in the Visum et repertum which he made is absolutely necessary. The formulation of the problem that was formed in this study is how the role of visum et repertum as evidence in the implementation of court cases of persecution in the Blora State Court, and what obstacles and solutions that occur in the form of evidence visum et repertum in cases of criminal abuse. Juridical sociology as an approach method used in this study with research specifications with descriptive methods. The data used consisted of primary data and secondary data using interview and literature study methods. Based on the research it was concluded (1) The role of Visum et repertum in the case of mistreatment in case decision number 184 / Pid.B / 2018 / PN Bla, the judge weighed on the elements in Article 351 paragraph 1 of the Criminal Code in which the result was a feeling of discomfort, pain or injury, which is based on evidence in the form of Visum et repertum on the victim's body. (2)Obstacles in proving in the form of visum et repertum in cases of torture include the qualification of wounds based on the legal needs confusing a doctor, standardization of the determination of the degree of injury to be poured on the Visum et repertum, Provisions for the signing of the post visum et repertum letter by the doctor, Request for visum et repertum which is lacking / incomplete, Visum Request Letter arrives late.�Keywords: Visum Et Repertum; Evidence; Criminal Acts Of Persecution.

Sexual violence happened to children are often occurred, after the emergence of sexual cases in Jakarta International School (JIS). It began to arise attention to child victims of sexual violence. This paper aims to provide a review of the protection on child victims of sexual violence at this time. With the sociological juridical method, the primary data were obtained from direct interviews with law enforcement officers, while secondary data were obtained from literature references. The result shows that the legal protection does not pay attention on children as victim. The legal protection for children as victim sexual violence is expected to give punishment to the criminals in the form of payment of compensation to the victim whose amount is determined in the court, or fulfillment of the obligation of the Local custom or legal obligations that live in society or social and mental rehabilitation. If the convicted person tries to avoid giving the compensation, the convicted person is not entitled to a reduction in the criminal term and does not get conditional released.

Animal cruelty is an immoral crime that usurps animal rights, while exploitation of endangered animals is an act that has the potential to kill biodiversity in its country. The purpose of this article is to evaluate law enforcement against animal cruelty in Indonesia and its obstacles. The methodology used in this research is normative legal research which focused on secondary data approach. Although laws that regulate these criminal acts exist, such as Article 302 Criminal Code which explains the prohibition of actions that are detrimental to animal health, Law 5/1990 concerning conservation of the living natural resources and its ecosystem, added with Law18/2009 concerning husbandry and animal health, criminal cases regarding maltreatment and exploitation of circus animals, also abuse to killing pets and hunting of protected wildlife are still rampant. This could happen because of weak law enforcement that prevents deterrence. Criminal sanctions given to the perpetrators of animal cruelty are considered very light and justice for animal welfare is almost non existent. Factors that cause weak law enforcement are unsupportive constitutions, law enforcers, law facilities, its country community, and the legal culture factor. In order to overcome this matter, formulation of appropriate law to ensure legal certainty, a supportive constitution, education about biodiversity to the community, a proper surveillance system, assertiveness in law enforcement officers, and availability of adequate facilities are needed. Penganiayaan terhadap hewan merupakan suatu tindak kejahatan asusila yang merampas hak hewan. Sementara eksploitasi satwa langka adalah suatu tindakan yang berpotensi mematikan keanekaragaman hayati dalam negara. Penulisan ini bertujuan untuk mengetahui bagaimana penegakan hukum terhadap pelaku penganiayaan hewan dan eksploitasi satwa langka di Indonesia, serta faktor penghambatnya. Metode penelitian yang digunakan untuk menyusun artikel ini adalah metode penelitian hukum normatif yang berfokus pengumpulan data sekunder. Walau sudah ada peraturan perundang-undangan yang mengatur tindak pidana tersebut, seperti pada Pasal 302 KUHP yang membahas mengenai larangan perbuatan yang merugikan kesehatan hewan, UU 5/1990 tentang Konservasi Sumber Daya Alam Hayati dan Ekosistemnya, ditambah dengan UU 18/2009 tentang Peternakan dan Kesehatan Hewan, kasus-kasus seperti penganiayaan dan eksploitasi hewan sirkus, juga penganiayaan hingga pembunuhan terhadap hewan peliharaan dan perburuan satwa liar yang dilindungi masih saja marak terjadi. Hal ini diakibatkan oleh penegakan hukum yang lemah sehingga efek jera gagal dimunculkan. Sanksi pidana yang diberikan kepada pelaku tindak pidana dinilai sangat ringan dan eksistensi keadilan bagi kesejahteraan hewan hampir tidak ada. Penegakan hukum yang lemah disebabkan oleh faktor Undang-Undang, penegak hukum, sarana dan fasilitas, faktor masyarakat, dan faktor budaya hukum. Dibutuhkan perumusan suatu aturan yang menjamin kepastian hukum untuk mendongkrak efektivitas hukum, penyuluhan masyarakat, sistem pengawasan yang memadai, ketegasan dari para aparat penegak hukum, dan ketersediaan fasilitas dan sarana yang memadai.

The success in recovering asset stolen from corrupt practices was one of the key success indicators in an attempt to eradicate corruption in Indonesia. The transnational corruption trend which involved many actors has made the asset recovery efforts to be more difficult. This article aimed to investigate the asset recovery efforts, the role of state institutions and the law enforcement officers in the assets recovery effort. The research method used was normative legal research, which was done by examining the secondary data in which the data were analyzed qualitatively. The conclusion derived in this article was that the Non Conviction Based (NCB) Asset Forfeiture is a critical tool for recovering the proceeds of corruption and also to combat corruption, especially in case where the proceeds have been transferred abroad. However, to ensure that such measure would be a strategic policy, it would be necessary to enter into international treaties with other countries related to the corruption case. In addition, the harmonization of Indonesian Anti-Corruption Law regarding the Eradication of Criminal Acts of Corruption should be conducted in order to support the Non Conviction Based (NCB) Asset Forfeiture. The NCB asset forfeiture system should encompass the 36 Key Concepts introduced in StAR so that the NCB system could be more effective in recovering the stolen assets.
