<p>This paper assesses the challenges that are posed to the new mining law and other Regulations that govern the mining sector in Tanzania. The main issues discussed in this paper include the conflicts between the local people and the mining companies regarding land ownership, compensation and forced eviction, conflicts between Small Scale Mining (SSM) and Large Scale Mining (LSM).</p><p>The findings obtained by the authors, intimates that the major problems in the mining sector are due to lack of law enforcement and good governance in the sector as well as lack of awareness of the laws governing the sector by the local communities.</p>Lastly, the authors concludes and recommend that, until and unless the laws are adhered to and kept into practice, the problems in the mining sector will not be easily resolved. Hence in order for the mining sector to benefit the indigenous and the investors, there should be enhancement of sustainable development;, people should be educated on the laws and the effects of mining on the environment and the relationship between SSM and LSM be improved.

This study analyses the implementation of good governance principles for the economic revitalization program under Riau Province’s Badan Restorasi Gambut (Peatland Restoration Agency) supervision. One of the aims of this program is to support the haze-free ASEAN 2020 roadmap. Riau province is an area prone to forest fire disasters. Its peatland area,  which is twice as large as Malaysia’s peatland, have a very high potential for damage due to forest fires. To mitigate the damages, BRG initiated the 3R program: Rewetting, Revegetation, and Revitalization. What makes this topic interesting is BRG emphasizes the aspects of economic empowerment of local communities to prevent further forest and peatland damages. To assess the implementation of BRG’s program, our research team conducted several interviews with representatives from Indonesia’s Ministry of Environment and Forestry, NGOs, academics, farmers, and villages’ facilitators who assisted local communities that received the BRG’s assistance packages. Our study shows that BRG’s economic revitalization program had succeeded in creating small scale economic activities such as honey industry, pineapple farming, and catfish farming. However, the ineffective coordination and communication between BRG and the local communities had prevented them from constructing an effective method to prevent future forest fires.

AbstractLaw enforcement is an interesting issue to be studied because it deals with the implementation of applicable laws and regulations, enforcement of environmental law is closely related to all aspects of human life because the environment is a buffer of life on this earth. The formulation of the research that the researcher formulated is how to regulate the law enforcing environmental law enforcement in mining sector in kuningan Regency and Implementation of environmental law enforcement in mining sector in kuningan regency. The purpose of this study is to find out the legislation regulating the enforcement of environmental law in the mining sector in Kuningan Regency and To know? Implementation of environmental law enforcement in mining sector in Kuningan regency. The research approach method is empirical juridical. The result of the research is the Regional Regulation of Kuningan Regency Number 7 Year 2014 on the Management and Protection of the Regional Environment and Implementation of environmental law enforcement in mining sector in Kuningan Regency through the making of regulation related to environment and mining, law enforcement through repressive and persuasive Increasing the role of the community in accordance with the mandate of the law. The conclusion of this research is that law enforcement in mining sector is done through persuasive and repressive approach.Keywords: Implemetation, Enforcement, Law, Environment, Mining. Abstrak Penegakan hukum merupakan isu yang menarik untuk diteliti karena berkaitan dengan implementasi peraturan perundang-undangan yang berlaku, penegakan hukum lingkungan sangat berkaitan dengan semua aspek kehidupan manusia karena lingkungan merupakan penyangga kehidupan mahluk hidup di bumi ini. Tujuan penelitian  ini adalah untuk mengetahui pengaturan perundang-undangan yang mengatur penegakan hukum lingkungan pada sektor pertambangan di Kabupaten Kuningan dan Untuk mengetahui ? Implementasi penegakan hukum lingkungan pada sektor pertambangan di Kabupaten Kuningan. Metode pendekatan  penelitian adalah yuridis empiris. Hasil penelitian yaitu adanya Peraturan Daerah Kabupaten Kuningan Nomor 7 Tahun 2014 tentang Pengelolaan dan Perlindungan Lingkungan Hidup Daerah dan Implementasi penegakan hukum lingkungan pada sektor pertambangan di Kabupaten Kuningan yaitu  melalui pembuatan peraturan perundangan yang berkaitan dengan lingkungan hidup dan pertambangan, penegakan hukum melalui represif dan persuasif serta peningkatan peran masyarakat sesuai dengan amanat peraturan perundangan. Kesimpulan penelitain ini adalah penegakan hukum pada sektor pertambangan dilakukan melalui pendekatan persuasif dan represif.Kata kunci : Implemetasi, Penegakan, Hukum, Lingkungan, Pertambangan.

The paper analyses the roles of intermediary NGOs for linkages between government and rural communities in carrying out socio-environmental development programs as a mean of institutional development for good governance. In particular, the paper focuses on the Proambiente program that was carried out in Pará State, Amazonia, Brazil. This program was the first experience of a socio-environmental development program in Brazilian Amazonia that took into account local communities' demands to link environmental conservation and small-scale family-based rural production. Methodologically, the research was based on qualitative analysis and used semi-structured interviews for data collection. The paper shows that NGOs as intermediaries between government and rural communities is a significant mechanism to promote the strengthening of the power of local communities, to create bridges between federal government and local communities; and to stimulate participatory processes by engaging rural communities' culture and knowledge in socio-environmental development program as Proambiente.

The purpose of this paper is to report the result of a study aimed at the interrelationship between small scale indusry (SSI’s) and large scale industri (LSI’s) in Indonesia. The role of the SSI’s<br />absorbed 83,6 million workers (Bapenas, 2005) is very important but its survival could be linked with its input and its output. As Indonesia occupied by more than 300 etnics, it is very possible<br />if the SSI’s survival is linked to Indonesia cultural and art. Data were collected from around 200 companies that have linkage with almost the whole Metallurgical Industries in Indonesia both the large and the small one. System approach and multiple regression were used to analysis the relationship between the SSI’s and the LSI’s. The survival of the SSI’s and LSI’s has no different in concept, but in practice, they may not be met as the different ability to coordinate production factors. communication between them has yet to be the method for exchange information. The government’s role which previously predicted has a strong influence to this cooperation appear very weak. The study indicates that the interrelationship between the LSI’s and the SSI’s is very possible if the Indonesian economy is developed based on tourist industry. The study based on the data collected within metallurgical industry might be less representative to reflect the relationship between the LSI’s and SSI’s throughout industries. This study has contributed to develope an interrelationship between the SSI’s and the LSI’s based on sistem approach which involve the cultural environment

AbstractThe relationship between synoptic-scale atmospheric circulation and glacier mass balance in the Cordillera of south-western Canada is investigated. Objective synoptic typing techniques are applied to glaciometeorological data from Peyto Glacier, Alberta, and Sentinel Glacier, British Columbia, and to climatological data from nearby weather stations. Two scales of 500 mbar synoptic weather maps are analyzed and compared. One is smaller with high-wavenumber patterns, the other is larger with more general patterns.The results demonstrate that the mass balance of Peyto and Sentinel Glaciers are related to the 500 mbar patterns. Synoptic types with cyclonic curvature favor glacier accumulation, while anticyclonic types inhibit build-up of the regional snow-pack. Ablation is suppressed by synoptic types associated with cloudy days and/or low temperatures, and is enhanced by types associated with warm, sunny days. Furthermore, findings suggest that both the accumulation and ablation of Sentinel Glacier are controlled by small-scale, high-wavenumber synoptic patterns. Conversely, Peyto Glacier accumulation is more closely associated with large-scale patterns, suggesting that high-frequency mid-tropospheric oscillations embedded within the slow-moving baroclinic zones associated with long-wave disturbances may be dampened by the rough topography of the Canadian Cordillera. Ablation is predicted poorly by both scales at Peyto.

Penegakan hukum senantiasa berinteraksi dengan dinamika masyarakat (<em>external dynamics</em>) dan dinamika dalam hukum itu sendiri (<em>interna</em><em>l dynamics</em>). Oleh karena itu, putusan hakim hendaknya merefleksikan kedua dinamika itu dengan cara mengkonstatir hubungan antara fakta, norma, moral, dan doktrin hukum dalam pertimbangan putusan hakim –baik secara sendiri-sendiri, maupun bersama—sangat terkait atau korelatif satu sama lain.Pola putusan hakim, termasuk penegakan hukumnya yang berlangsung saat ini masih didominasi tipe rasionalitas hukum formal. Ke depan –dalam rangka <em>“good court governance”</em>—pengembanan hukum praktis hendaknya di arahkan ke tipe rasionalitas refleksif, minimal diupayakan menggeser pola hubungan tersebut dari tipe rasionalitas formal ke rasionalitas substantif dan pada saatnya ke arah tipe rasionalitas hukum refkleksif.</p><p><strong>Key Words: </strong>Putusan Hakim, Rasionalitas Hukum Refleksif, Penegakan Hukum</p><p align="center"><strong>Abstrack</strong></p><p><em>Law enforcement does not work in a social vacuum of space . Therefore, the judge’s decision should reflect both the dynamics of the relationship between facts mengkonstatir way , norms , moral , and legal doctrine in consideration of the judge’s decision - either individually , or collectively a very related or the same correlative lain.pola verdict , including the enforcement of the present day is still dominated by the type of formal legal rationality .
