Abstract This article considers the issue of whether Singapore should amend its trust laws to allow for non-charitable purpose trusts (NCPTs) for the specific purpose of holding company shares in perpetuity. The authors argue that such trusts should be allowed for two reasons. First, NCPTs in general should not be regarded as repugnant to the trust concept. Secondly, the practical advantages of allowing non-charitable trusts in a limited fashion outweigh the disadvantages. The article concludes by proposing possible reforms to the Singapore trust legislation.

Zarathushtra, better known to the Classical and modern world in the Greek form of his name ‘Zoroaster’, revealed his vision of truth, wisdom and justice in the verse texts known as the Gāthās (c.1200–1000 bc) and is revered by Zoroastrians as their holy prophet. The religion is correctly described as mazdāyasna, ‘the worship of Ahura (‘Lord’) Mazdā, creator of the world and source of all goodness. Since the Avestan word mazdā means ‘wise, wisdom’, Zoroastrians see their prophet as the original philosophos, ‘lover of wisdom’. Zarathushtra’s message is primarily ethical and rationalistic. Zoroastrianism teaches a life based on (1) the avoidance of evil, through rigorous discrimination between good and evil, and (2) the service of wisdom through the cherishing of seven ideals. These latter are personified as seven immortal, beneficent spirits: Ahura Mazdāhimself, conceived as the creative ‘holy’ spirit; Sublime Truth; Virtuous Power; Good Purpose/Mind; Beneficent Piety; Wholeness/Health and, finally, Immortality. Evil originates neither from God nor from his creatures, but from a wholly other source, personified as Angra Mainyu, the ‘Hostile Spirit’, whose existence is ritually and doctrinally rejected as being pretended and parasitic. Real existence is solely the domain of Ahura Mazdāand his creation; Angra Mainyu and his demons are actually states of negativity, denial or, as the religion puts it, ‘the Lie’. Thus the charge that the religion is ontologically dualistic is no more true than it is of other systems which conceive of good and evil as being in fundamental opposition. Equally, the allegation that its theology is ditheistic or polytheistic is a misunderstanding of the Zoroastrian theological and ritual tradition. The influence which this religion has exerted on classical philosophy and the thought and practice of Judaism, Christianity and Islam is being reappraised by scholars in modern times.

---------- Can we lie for a good purpose? Is it better to tell the whole truth immediately, or to leak it progressively, taking into account the interlocutor’s capacity to suffer? These ethical dilemmas are often raised in the most varied professional fields and first of all in our daily life. Do the different traditions that gave rise to western culture share similar attitudes towards truth and lies? What about Greek culture? What about Judeo-Christian culture? What about Modernity? How has philosophical reflection developed these topics? What did Plato, Augustine, Machiavelli, Grotius, Kant, Constant, Feyerabend, MacIntyre and Sandel think about these issues? After dealing with these difficult questions, this short essay tries to look for an answer in the Aristotelian concept of phronesis and in the Kantian notion of reflective judgement, testing these conceptual tools through bioethical and clinical medical cases.

The subject of the paper is theoretical justification of legal nature of positive constitutionalresponsibility legal institute. The evolution of views on the institution of positive constitutionalresponsibility from the first works on it (S.A. Avak`yan, Yu.P. Eremenko, F.M. Rudinsky, N.A. Bobrova) to the present time is analyzed. The purpose is to clarify its role in establishment and maintaining the regime of constitutionallegality. The results, scope of application. Doubts about the legal nature of positive constitutionalresponsibility up to its complete denial are identical with doubts about the legal nature ofmany constitutional norms, the denial of their direct action. These disputes will last forever.Direct service of constitutional and legal responsibility to the quality of governance is a featureof this type of legal responsibility along with its pronounced political character, as wellas the specific guilt of the subject of constitutional tort (liability not only for their acts butfor the acts of their subordinates). The emphasis on positive moral aspect to the detriment of "sanction" (retrospective) aspectof the constitutional responsibility does not meet the challenges of the new time.Proponents of affirmative responsibility had good purpose to build its high creative andeducational role from the positive side of the legal liability. However, this good purpose inpractice has not led to optimistic results. The authors come to the conclusion the legal regulation of mechanisms of responsibilityenforcement in Russia is necessary.

A basic introductory account of Plato’s metaphysics that wished to steer as clear of controversy as possible might claim that Plato, at some point in his career, came to hold the following views. Whenever a plurality of sensible things are so-and-so (e.g., beautiful), they are so-and-so in virtue of bearing the appropriate relation (which can be variously described as “possession,” “participation,” or “imitation”) to an abstract object that explains or grounds their being so-and-so. If we adopt the convention of using “F” as an abbreviation for “so-and-so,” then this object can be referred to by such expressions as “the F itself” or “F-ness itself” (e.g., “the beautiful itself,” “beauty itself”), as distinct from ordinary, sensible F things (e.g., particular beautiful items). It can also be referred to as “the form of F” or “the form of F-ness” (e.g., “the form of beautiful,” “the form of beauty”). Forms are immaterial, changeless, and eternal; they constitute the realm of perfect Being; they are the primary referents of general terms (“beautiful”) and the proper objects of definition and knowledge. By contrast, sensible particulars are always subject to all sorts of change, can at most be the objects of belief or opinion, and are ontologically inferior to forms. The sensible universe as a whole has a rational, teleological order, in which everything contributes to an ultimately good purpose, and is arranged according to a mathematical structure. Now, this basic, generic account leaves room for plenty of questions and controversies. Does Plato conceive of forms as universals, that is, as properties or kinds which sensible particulars instantiate, or rather as perfect nonsensible particulars? What exactly is the relation between forms and sensible particulars? Did Plato’s views on these matters evolve through time or is it possible to identify at least a stable doctrinal core? What is the significance of the fact that the literary genre chosen by Plato to present these views is the fictional dialogue rather than, for example, the systematic treatise? To what extent was Plato influenced by Socrates and other contemporary philosophers? When Plato describes the universe’s order as having been brought about by a benevolent god, does he mean what he says? And so on. This article is meant as a guide to the various competing answers offered to such questions by Platonic scholarship.
