AbstractCriminal law exceptionalism, or so I suggest, has turned into an ideology in German and Continental criminal law theory. It rests on interrelated claims about the (ideal or real) extraordinary qualities and properties of the criminal law and has led to exceptional doctrines in constitutional criminal law and criminal law theory. It prima facie paradoxically perpetuates and conserves the criminal law, and all too often leads to ideological thoughtlessness, which may blind us to the dark sides of criminal laws in action.

In the actual legislative processes, errors are often made: the legislator’s intentions are not always properly expressed in the legal provisions or there is insufficient clarity. The discrepancy between what the legislator said and what they meant to say poses a serious challenge to the theory and practice of legal interpretation. In this paper, the author analyses two possible reactions to a legislative error: correcting it or applying the provision in its literal meaning. The considerations are based on two decisions of the Criminal Chamber of the Polish Supreme Court, because in criminal law the protection of the prima facie understanding of the text is a very important value. In the final part of the paper, the author indicates factors which can affect the court’s attitude towards a legislative error in a specific case.

The basic idea underlying the reform of  the Criminal Code Bill has an impact on reforming the pillars of criminal law. The purpose of this research is to find out the new direction of criminal law policy regarding criminal acts, criminal responsibility and punishment. The research method uses normative legal research. The results of the research study in the discussion section are the reform of the pillars of criminal law, namely criminal acts, criminal liability, and punishment oriented to the basic idea of ??the value of balance. The reform of the pillars of criminal acts is aimed at broadening the meaning of the legality principle which provides space for living law as a source of law and also creates juridical terminology regarding criminal acts. The pillar of criminal responsibility accommodates the principle of no crime without error. The pillar of punishment is that the purpose of punishment is no longer synonymous with retaliation, but there are efforts to improve the behavior of the perpetrators of crime. The changes in the three pillars are influenced by the basic idea of ??balancing the values ??of Pancasila, namely the values ??of Divinity, Humanity, and Society. Recommendations in strengthening the direction of criminal law reform are needed in formulating criminal provisions outside the Draft Criminal Code that must be in accordance with the basic idea of ??balance which is the ideal of criminal law reform law. Ide dasar yang melandasi pembaruan RUU KUHP berdampak pada pembaruan pilar hukum pidana. Tujuan penelitian untuk mengetahui arah baru kebijakan politik hukum pidana mengenai tindak pidana, pertanggungjawaban pidana dan pemidanaan. Metode penelitian menggunakan penelitian hukum normatif. Hasil kajian penelitian dalam bagian pembahasan ialah pembaruan pilar hukum pidana yakni tindak pidana, pertanggungjawaban pidana, dan pemidanaan berorientasi pada ide dasar nilai keseimbangan. Pembaruan pilar tindak pidana tertuju pada perluasan makna asas legalitas yang memberikan ruang pada hukum yang hidup sebagai sumber hukum dan melahirkan pula terminologi yuridis mengenai tindak pidana. Pilar pertangungjawaban pidana mengakomodasi asas tiada pidana tanpa kesalahan. Pilar pemidanaan bahwa tujuan pemidanaan tidak lagi identik pembalasan akan tetapi ada upaya memperbaiki perilaku dari pelaku kejahatan. Perubahan ketiga pilar tersebut dipengaruhi oleh ide dasar keseimbangan nilai Pancasila yaitu nilai Ketuhanan, Kemanusiaan, dan Kemasyarakatan. Rekomendasi dalam memperkuat arah pembaruan hukum pidana diperlukan dalam merumuskan ketentuan pidana di luar RUU KUHP harus sesuai dengan ide dasar keseimbangan yang menjadi cita hukum pembaruan hukum pidana

Abstract, The criminal law policy in dealing with destructive fishing is currently primum remedium. However, in its development the criminal law policy in overcoming destructive fishing experiences several obstacles and is not yet in line with the concept of sustainable development. Considering that sustainable development is one of the principles in fisheries management, it is necessary to make adjustments between criminal law policies and sustainable development. Therefore this research aims to study and analyze the ideal criminal law policy in overcoming destructive fishing in the sustainable development regime. This research is a doctrinal law research using a statutory approach, analytical approach, conceptual approach, and case approach. The results showed that the ideal policy of criminal law in overcoming destructive fishing in sustainable development regimes is to make arrangements for sanctions actions that lead to social, economic improvement and repair damage to fish resources and their ecosystems due to destructive fishing practices. Sanctions for actions are more restorative, anticipatory, and educational so that they can reduce the degradation of fish resources and the environment. Thus, the balance between the use of fish resources and sustainable development can be realized. Namun dalam perkembangannya kebijakan hukum pidana dalam menanggulangi destructive fishing mengalami beberapa hambatan dan belum selaras dengan konsep pembangunan berkelanjutan. Mengingat pembangunan berkelanjutan merupakan salah satu asas dalam pengelolaan perikanan, maka perlu dilakukan penyesuaian antara kebijakan hukum pidana dengan pembangunan berkelanjutan. Oleh karena itu penelitian ini bertujuan untuk mengkaji dan menganalisis kebijakan ideal hukum pidana dalam penanggulangan destructive fishing pada rezim pembangunan berkelanjutan. Penelitian ini merupakan penelitian hukum doktrinal dengan menggunakan pendekatan perundang-undangan, pendekatan analitis, pendekatan konseptual, dan pendekatan kasus. Hasil penelitian menunjukkan bahwa kebijakan ideal hukum pidana dalam penanggulangan destructive fishing pada rezim pembangunan berkelanjutan yakni dengan melakukan pengaturan terhadap sanksi tindakan yang mengarah pada perbaikan sosial, ekonomi dan perbaikan kerusakan sumber daya ikan dan ekosistemnya akibat praktik destructive fishing. Sanksi tindakan lebih bersifat restoratif, antisipatif, dan mendidik sehingga dapat mengurangi degradasi sumber daya ikan dan lingkungan. Dengan demikian, keseimbangan antara pemanfaatan sumber daya ikan dan pembangunan berkelanjutan dapat terwujud. Kata Kunci:  Destructive Fishing, Hukum Pidana, Pembangunan Berkelanjutan

AbstractSocratic irony can be understood independently of the immortal heroics of Plato’s Socrates. We need a systematic account and criticism of it both as a debate-winning strategy of argumentation and teaching method. The Speaker introduces an issue pretending to be at a lower intellectual level than her co-debaters, or Participants. An Audience looks over and evaluates the results. How is it possible that the Speaker like Socrates is, consistently, in the winning position? The situation is ironic because the Participants fight from a losing position but realize it too late. Socratic irony compares with divine irony: divine irony is a subtype of Socratic irony since you lose when you challenge gods. Socratic irony is also, prima facie, a subtype of dramatic irony when the Audience knows more than the Participants on the stage. We must distinguish between the ideal and realistic elements of Socratic Irony. The very idea of Socratic irony looks idealized, or it is an ideal case, which explains the Speaker’s consistently winning position. In real life, the debate must be rigged, or the Dutch Book argument applies to the Participants, if the Speaker is so successful.

Indonesian Criminal Code that comes from Dutch heritage has to be reconstructed, because it is not in accordance with the state of Indonesia which is now already independent. One of the important principles in the Criminal Code that needs to be reconstructed is the retroactive principle contained in Article 1 paragraph (2) of the Criminal Code. The law can be retroactive as long as it benefits the defendant, not until the convicted person. The purpose of this research is to evaluate retroactive principle in Criminal Code seen from perspective value of religious wisdom, and ideal reconstruction of retroactive principle in next Criminal Code in accordance with perspective value of religious wisdom. Approach method in this research was done with normative juridical, the data used were secondary data by doing the extracting data bibliography, and data analysis were done by using qualitative descriptive method. Based on the values of religious wisdom, especially from the perspective of Islamic law in the case of any change of laws and regulations, in principle, non-retroactive principle (non-retroactive) is applied, but in certain cases the principle can be disregarded in accordance with the principles of "dlarar" and " maslahat ". The ideal reconstruction of the retroactive principle in the case of a change of laws and regulations after an act has occurred, new laws and regulations shall be applied in accordance with prevailing laws and regulations in favor of the producer and to the benefit of the public for certain offenses determined by Constitution.

 Penelitian ini bertujuan untuk mengetahui kebijakan hukum pidana yang menghambat penerapan status darurat kesehatan masyarakat pada saat diselenggarakan kekarantinaan kesehatan dan menganalisis sistem pemidanaan yang ideal untuk diterapkan bagi pelaku tindak pidana kekarantinaan kesehatan. Metode penelitian yang digunakan adalah penelitian hukum normatif melalui pendekatan perundang-undangan (statute approach). Hasil penelitian menunjukkan bahwa secara teoretis kebijakan hukum pidana dalam darurat kesehatan masyarakat sulit untuk diterapkan. Substansi Pasal 93 UU Kekarantinaan Kesehatan memuat 2 (dua) jenis delik, yaitu delik formil dan delik materiel. Namun, terdapat penggunaan kata yang masih abstrak di antaranya: perbuatan “menghalang-halangi” serta menempatkan “kedaruratan kesehatan” sebagai “sebab” dalam peraturan tersebut merupakan sebuah kerancuan. Seharusnya rumusan kausalitas pidana dalam sebuah produk hukum pidana dirumuskan sesuai dengan konsepsi awalnya. Oleh karena itu, rumusan delik yang abstrak atau luas akan menghasilkan ketidakpastian hukum, berpotensi tidak dapat diterapkan, dan bertentangan dengan penafsiran yang menyatakan bahwa hukum pidana harus ditafsirkan secara sempit. Merujuk pada keadaan tersebut, maka sistem pemidanaan yang ideal diterapkan ketika terjadi pelanggaran penyelenggaraan kekarantinaan kesehatan, yaitu sistem pemidanaan yang bersifat restoratif dan integratif.Kata kunci: Pandemi Covid-19, Kekarantinaan Kesehatan, Kebijakan Hukum Pidana AbstractThis study aims to determine the legal policy policies that apply Law Number 6 of 2018 concerning Health Quarantine and analyze the ideal punishment system to be applied to health quarantine crimes. The research method used, namely normative research through an invited approach (statute approach). The results show that legal policies in public health emergencies are difficult to implement. The substance of Article 93 of the Health Quarantine Law contains 2 types of offenses, namely formal offenses and material offenses. However, there is a use of the word which is still abstract beside: the act of "obstructing" and placing "health emergency" as "cause" in the regulation is a confusion. The formulation of criminal causality in a criminal law product should be formulated in accordance with its initial conception. Therefore, the abstract or broad formulation of offenses will provide legal uncertainty, which cannot be applied, and contradicts the interpretation which states that criminal law must be interpreted narrowly. Referring to this situation, the ideal punishment system is applied when implementing health quarantine, namely a restorative and integrative system of punishment.Keywords: Covid-19 Pandemic, Health Quarantine Act, Penal Policy

The criminal law relating to sex work was last modified in the Sexual Offences Act 2003. Three years later in January 2006 the UK government published a ‘prostitution strategy’ that set out four core aims: challenge the view that street prostitution is inevitable and here to stay; achieve an overall reduction in street prostitution; improve the safety and quality of life of communities affected by prostitution, including those directly involved in street sex markets, and finally, to reduce all forms of commercial sexual exploitation. This framework prima facie failed to take into account both the issue of male sex work and also the Internet effect upon sex work. This article seeks to examine the intersection of technology and male for male sex work and reviews both the criminal law and UK policy framework in that context.
