Meeting the needs of victims of domestic violence with family law issues: the dangers and possibilities in restorative justice

Victims of controlling domestic violence who also have family law issues continue to have their safety compromised and to suffer the abusive use of the legal system by perpetrators. A range of conditions contribute to this systemic problem, including the fragmentation of the legal ‘system’ faced by victims, and the emphasis given to contact with fathers and to private dispute resolution. At a more abstract level, unwillingness to look at past conduct and to attribute fault in family law proceedings has led to a failure to pay attention to issues of justice in family law. The possibilities for the use of restorative justice in these cases are explored. It is argued that there are considerable dangers, particularly with a generic model of restorative justice. There is, however, some potential in restorative justice processes which are carefully designed for the domestic violence context. In particular, such processes offer the potential to extend an empowering ‘justice’ rather than a ‘dispute resolution’ frame to a wider range of cases and to overcome the current fragmentation of the legal system. It is argued that our concern should be with how to meet the needs of victims of domestic violence, rather than with the good of restorative justice in theory. In addition, we must continue to work on improvements to the formal legal system as alternatives to restorative justice.

Tax dispute resolution has a number of uniqueness. Its judiciary system takes a procedure starting from filing objections in the executive realm, appeals and filing lawsuits as well as judicial review in the judicial realm. All of these legal remedies do not delay the obligation of the tax payers to pay taxes and the task of Fiscus to collect taxes. Dispute settlement using administrative power has weaknesses as the resolver is one of the parties in the dispute (the Fiscus). Judicial branc of power come to play to settle tax disputes through the Tax Court. No cassation in the settlement of tax disputes as judicial remedies. All settlements of tax disputes are aim at otaining justice. When there is a tax dispute between Fiscus and the Taxpayers the path of mediation is advised. This normative legal research has found that mediation in the settlement of tax disputes by the Tax Court is a form of Dignified Restorative Justice in the form of Dignified Mediation as it is in line with the Pancasila values and virtues. The diversion from conventional processes through mediation is also humanistic in nature, namely the effort to humanize humans, the manifestation of the Pancasila Legal System.

Family Law passed in 1998 introduced the term domestic violence for the very first time in Croatian legal system. Article 118 of this Code contains explicit ban of if violent behavior of a spouse or other adult family member. Violation of this ban is, according to the article 362, a misdemeanor, and the sanction is up to 30 days of imprisonment. Article 118 is placed under section of parental care, subsection is Protection of rights and welfare of a child and minors. Entering article regarding family violence into this section and connecting violent behavior only to a spouse or other adult family member is dangerous, because of possibility for restrictive interpretation of this article in practice and giving protection only to children. However, in practice, although the implementation of this law started late, in June 1999, police mostly intervene and protect victims of domestic violence in all cases, no matter if it is a family with or without children. From January 1st 2001 violent behavior in a family is provided as criminal offence (article 215 of the Criminal Code). Sanction for this offence is from three months up to three years of imprisonment.

Abstract Mandatory mediation obliges parties to the dispute to firstly seek out alternative and amicable form of dispute resolution before addressing the court. This could prove suitable in family law disputes where the focus is on maintaining the relationships aft er the dispute is resolved in the best interest of children. However this presumption does not need to apply to all cases. Domestic violence is a phenomenon of family law for centuries. The impact of the abuse between partners is immense. The article focuses on conditions, upon which the mediation could be mandated, what are the key elements of successful mediation and what are the challenges of mandatory mediation in respect of these elements. The article analyzes provisions of acts that regulate mediation in various states of USA with focus on the most controversial regulation in California. At the end it debates the relation of mandatory mediation and right to fair trial.

This paper examines the role of a public prosecutor in the protection of domestic violence victims in the legal system of the Republic of Serbia. Prior to the analysis of relevant provisions of the laws referring to the authority and competences of the public prosecutor in relation to the protection of domestic violence victims, the term ?victim? in the legal system of Serbia is defined. The term ?victim? is commonly used in the legal texts, but it is not defined; thus, it is necessary to specify certain aspects of this term. In the analysis of certain legal provisions, the focus is on some of the most significant criminal, misdemeanor and family law institutes, as well as on the provisions of the Law on the Prevention of Domestic Violence, which could affect the role of the public prosecutor in prevention of domestic violence and protection of its victims. In the final part the authors propose certain solutions which should enhance implementation of existing mechanisms available to the public prosecutor in practice, which could contribute to better protection of domestic violence victims.

Majelis Tahkim sebagai proses penyelesaian sengketa (syiqāq) yang melibatkan pertemuan suami dan isteri bersama dengan Hakam untuk tujuan perdamaian atau perceraian dengan lafaz talak atau dengan khuluk. Berdasarkan fakta empiris menyatakan bahwa salah satu provinsi yang paling menonjol menggunakan metode Majelis Tahkim ini adalah Provinsi Selangor. Sebagaimana yang diketahui oleh penulis bahwa praktek Majelis Tahkim di Mahkamah Rendah Syariah Shah Alam menggunakan Kaedah-Kaedah Hakam yang diterapkan khusus di Provinsi Selangor sahaja yang berbeda dengan provinsi yang lain di Malaysia. Penelitian ini bertujuan untuk mendapatkan gambaran bagaimana praktek Enakmen Undang-Undang Keluarga Islam Nomor 2 Tahun 2003 Seksyen 48 mengenai penambahan Kaedah-Kaedah Hakam (Negeri Selangor) terhadap pelaksanaan Majelis Tahkim dalam penyelesaian sengketa rumah tangga (syiqāq) di Mahkamah Rendah Syariah Shah Alam. Penulisan skripsi ini adalah bertujuan untuk mengetahui bagaimana mekanisme Majelis Tahkim dalam penyelesaian sengketa rumah tangga dan keunggulan Kaedah-Kaedah Hakam yang digunakan. Oleh itu, penulisan ini menggunakan metode deskriptif analisis. Dari hasil penelitian penulis dapat disimpulkan bahwa mekanisme Majelis Tahkim dalam penyelesaian sengketa rumah tangga di Mahkamah Rendah Syariah Shah Alam menggunakan Kaedah-Kaedah Hakam terdapat beberapa keunggulan antaranya menjelaskan tentang Hakam dan proses Majelis Tahkim secara rinci sebagai panduan Hakam. Seterusnya, proses Majelis Tahkim ini mampu mengurangi beban Mahkamah Syariah dalam menyelesaikan kasus yang banyak di meja Mahkamah. Oleh hal yang demikian, diharapkan bagi pihak kerajaan perundangan untuk memberlakukan Kaedah-Kaedah Hakam ini bagi semua provinsi di Malaysia agar Hakam mendapatkan panduan lebih mendalam terkait Hakam dan proses Majelis Tahkim. Tahkim Assembly as a dispute resolution process (SYIQĀQ) involving a husband and wife meeting along with Hakam for peace or divorce with the pronunciation of Talak or with Khuluk. According to empirical facts, it states that one of the most prominent provinces using the method of the Tahkim assembly is Selangor province. As it is known by the authors that the practice of the Tahkim assembly in Shah Alam Sharia court used the essential methods applied in the province of Selangor only different from other provinces in Malaysia. This study aims to obtain an overview of the enactment of Islamic Family Law number 2 the year 2003 section 48 on the addition of the Hakam methods (Selangor State) on the implementation of the Tahkim assembly in the settlement of household disputes (SYIQĀQ) in the Syariah low court of Shah Alam. The writing of this thesis is aimed at knowing how the Tahkim assembly mechanisms in the settlement of household disputes and the excellence of the Hakam methods used. Thus, this writer uses a descriptive method of analysis. From the results of the author's research can be concluded that the mechanism of the Tahkim assembly in the settlement of household disputes in Shah Alam Syariah low court using the essential methods there are several advantages between explaining Hakam and the process of Tahkim assembly in detail as a guide to Hakam. Subsequently, the Tahkim assembly process was able to reduce the burden of sharia Court in resolving many cases at the Court table. Therefore, it is expected for the legal government to enforce this Hakam method for all provinces in Malaysia for Hakam to obtain a more in-depth guide to the Hakam and the process of the Tahkim assembly.
