The right to education at the international and domestic levels has become the interest of several parties who are responsible and obliged to achieve and respect this right, by recruiting all relevant parties and the means available for this. Like other countries, Algeria has recognized this right since the date of independence and is enshrined in all successive constitutions. Where the constitutional founder recognizes the principle of free education, the principle of compulsory basic education, and the state is responsible for regulating the educational system and ensuring equal access to education, but these constitutional principles can only be effective if supported by the legal provisions governing and specifying the applicable provisions in order to achieve the exercise of this right, which has long been considered a fundamental requirement at the international and domestic level. Through this presentation, we have tried to ask how the legal text of the right to education is addressed and whether it was sufficient to meet the basic demands of the educational system in the light of globalization, technological development and digitization. In this context, it was necessary to address the various legal texts and various conventions that addressed the dedication and strengthening of the right to education at the international level and its results at the internal level, which is what we will address through this intervention, by addressing the analysis of the various Algerian legal texts related to the subject through the division of work into two main axes. The descriptive and analytical approaches have been relied upon to reach different results and solutions for improving the curriculum and the educational system in general.

This study examines the issue of norm construction in al-Ghazālī’s thought focusing on the grounds advanced to support his radical infallibilist position. To fulfill such end, al-Ghazālī, I explain, relies on two types of arguments, the first one relates to the presumptive nature of legal texts in order to highlight their fundamental indeterminacy and the second links to the interpreter to show the impossibility to fall into error. To buttress these arguments, al-Ghazālī both draws on epistemological principles and metaethical ones. As it will be shown in the study, al-Ghazālī ultimately explains the divergence in interpretation of norms using the concept of ṭabʿ (nature, disposition or appetitive self) drawing on his well-known relativist ethical theory concerning norm evaluation and therefore brings in a unique way this typical feature of Ashʿarism within his own radical infallibilist theory of norm construction. The concept of ṭabʿ allows to bridge the gap between the ambiguity in the revealed text and the mujtahid’s interpretation in the norm construction process, and ultimately serves to justify ex post the choices made by the mujtahid. In doing so, al-Ghazālī assigns to theology a critical role in revealing the origin of the illusion of the jurists who naively think that licit and illicit are qualities of things themselves.

The issue of compensating the legal person for the moral damage it causes to it has raised a great argument of controversy in Jordan, especially in light of the refusal to recognize the rights attached to the natural person of the legal person. This research came to identify the legal nature of the legal personality and the moral damage and the position of the Jordanian law on it, and to determine the feasibility, adequacy and appropriateness of the legal texts contained in the Jordanian civil law in knowing the extent to which the legal person may be compensated for moral damage. Using the opinions of jurists and judicial and explanatory decisions, the researcher has found that moral damage has multiple forms, a research that arises from the act and assault carried out by the aggressor. As a result, it is not appropriate to limit moral damage to rigid legal texts based on what is stated in the legislation and decisions of the esteemed Court of Cassation, as the researcher recommends. The Jordanian legislator should include general provisions clarifying the civil liability of the legal person, and the researcher recommends a separate chapter in the civil law to talk about the moral damage and its multiple meanings and aspects and how to rule for compensation and claim it.

The present paper is focused on Lyuben Georgiev’s innovative ideas concerning Bulgarian language teaching. The author’s new ideas presented in his work The Mother Tongue in Our Junior High Schools and High Schools (a Language Teaching Endeavour) (1933) have not been the subject of scientific research so far. L. Georgiev’s set of didactic ideas is important evidence for the overcoming of the Herbartian model and the orientation of language teaching towards the formation of communicative competencies. Emphasizing the creative nature of pedagogical interaction, Lyuben Georgiev offers a comprehensive system of ideas – a system that is in line with modern trends in language learning.
