Resumen: El presente trabajo se centra en el análisis de las posibles colisiones existentes entre el orden público español y las principales instituciones del Derecho de familia islámico. No podrán integrarse aquellas instituciones que sean contrarias a valores esenciales de nuestro ordenamiento como la igualdad entre sexos o la monogamia. Sin embargo, a través de la aplicación del orden público atenuado, sería posible reconocer algunos “efectos colaterales” a estas instituciones cuando resultaren beneficiosos para la mujer. El objetivo último sería la protección de ésta como la parte más débil de la relación matrimonial.Palabras clave: Derecho islámico, orden público, matrimonio islámico, poligamia, repudio. Abstract: The present paper focuses on the analysis of the possible collisions between the Spanish public order and the main institutions of the Islamic Family Law. It will not be possible to integrate those institutions which are against essential values of Spanish law such as gender equality or monogamy. However, it would be possible to recognize some “collateral effects” to these institutions if they resulted beneficial for women, through the application of the attenuated public order. The main purpose would be women’s protection, as they are the weakest party of the marriage relationship.Keywords: Islamic Law, public order, Islamic marriage, polygamy, repudiation.

Abstract Muslim women have been caught in a tag-of-war between the forces of preserving Muslim family identity and advocates of its reform along the line of gender equality and International Human Rights. Given the current socio-political milieu at the global arena, the horizons for this tension to evaporate seem dim anytime soon. Reacting to Western human rights criticisms of Islamic family law, the conservative camp regard any attempt at reforming Islamic family law as a naked invasion of Western imperialism on Muslim personal domain. Reform proponents, on the other hand, indict conservative interpretation of Islamic family law as the primary cause of women oppression in Muslim societies. Accordingly, they constantly endeavour to lobby for reform of Muslim family law using either international bills of rights or gender equality as the frameworks. Consequently, Muslim women`s rights in the family has become a matter of paradoxical exegeses. To break this deadlock, this paper argues for a mediated solution (wasaÏÊyyah) by using critical content analysis of the two trends as a way forward for SharÊ‘ah-based reform in Malaysia. Abstrak Wanita-wanita Islam terperangkap diantara pemeliharaan identiti keluarga Islam dan pembaharuan kesaksamaan jantina dan Hak Asasi Manusia Antarabangsa. Melihat suasana sosio-politik semasa di arena global, ketegangan ini seolah-olah tidak akan hilang pada masa yang terdekat. Bertindak balas kepada kritikan hak asasi barat terhadap undang-undang keluarga Islam, kem konservatif menganggap sebarang percubaan untuk mereformasi undang-undang keluarga Islam sebagai pencerobohan imperialisme Barat terhadap domain peribadi Islam. Sebaliknya, penyokong reformasi mendakwa bahawa tafsiran undang-undang keluarga Islam secara konservatif sebagai punca utama penindasan wanita dalam masyarakat Islam. Oleh itu, mereka sentiasa berusaha melobi bagi pembaharuan undang-undang keluarga Islam melalui undang-undang antarabangsa atau kesaksamaan jantina sebagai framework. Akibatnya, hak-hak wanita Islam dalam keluarga telah menjadi satu masalah berparadoks. Untuk keluar dari kebuntuan ini, kajian ini berpendapat untuk penyelesaian mediasi(wasatiyyah) dengan menggunakan analisis kandungan kritikal dari dua trend sebagai satu cara pembaharuan berasaskan syariah di Malaysia. This study discusses the mainstreaming of gender equality in Islamic family law. As it is known, gender equality and Islamic law have axiological links in realizing family household that practices the universal values such as justice, literature, peace, love, compassion, etc. This research is a qualitative study with a gender perspective linked to Islamic law. The discussion showed that a number of opportunities were found as normatively affirmed in the Qur'an which has the same spirit as the mainstreaming of gender equality in Islamic family law. Likewise, legal rules such as the Compilation of Islamic Law and the development of Islamic studies caused the normative theological understanding to support gender equality. However, it cannot be denied that the understanding of theological texts has begun to erode in the context of the implementation of Islamic family law. For the challenges, there were several aspects that hinder the mainstreaming of gender equality in Islamic family law, namely marginalization of women, community stereotypes against women, subordination of women, double burden on women, and violence against women.

The Quran, the Hadith and the Shari’ah recognise the rights of women to custody of their children when they are no longer with their husband, provided they do not remarry. This right is known as hadanah. The study examines the conditions for the award of hadanah in Nigeria and Malaysia with a view to determining whether its practice is in conformity with the Islamic injunctions. The qualitative approach is used. The qualitative approach includes content, deductive, and inductive analysis as well as comparative method. The references used in this study are the primary and secondary sources. Both materials are analysed accordingly to get the information related to this study. The paper found that women in Nigeria and Malaysia are subjected to ill treatment due to misconceptions about hadanah as an Islamic practice. The study found that women are disadvantaged when securing divorce and custody of their children. The paper concludes that the practice of hadanah in both countries contravenes the constitutional provisions on gender equality. The study recommends that legislative measures be put in place in Nigeria and Malaysia to address the pitfalls of gender-bias.

There are so many problems that can be found in Islamic Family Law viewed from modernapproach especially gender equality. Starting from the rule of marriage guardian that controlled bymen, inheritance dominated by men, and also all the provisions concerning the witnesses whichweakens the existence of women. In Indonesia context it, is important to analyze the problem ofguardian and witness of marriage through the maqashid asy-syari’ah and will find the solution wherethe guardian of marriage is the primary element in order to guard of honor and about witness ofmarriage as a secondary element that has the function as the main purpose of marriage. Based onthat classification, it was found that the primary element about the guardian and the secondaryelement about witness of marriage, it led significant difference between the Arab and Indonesiacontext. Therefore, reforms are needed in the Islamic Family Law through the cultural approachso it can be responsive in Indonesia. In the Arab culture is patriarchal (patrilineal) master, while inIndonesia there are multi kinships complex such as patrilineal, matrilineal and bilateral, it impliesthe need reformations that bring the solution accordance with the local wisdom of Indonesia forthe instance the implementation of gender equality openly.

This paper aims to explain the dilemma that occurs in marital relationships. The issue of performing the external or internal maintenance obligation on the husband who has HIV / AIDS causes the wife to suffer. Thus, a qualitative study has been done to identify the dilemma that occurs in the relationship between husband and wife. Archival research methods such as the provisions of Islamic Family Law (UUKI), fiqh munakahat and case studies have been used. Interview methods were also performed to answer the objectives of the study. A total of 8 respondents, namely the wives of AIDS sufferers, were interviewed to obtain study data and the data was finally analyzed manually (QDA). The results show that there is discrimination against people living with HIV / AIDS (OHDHA) (wife) in the form of external and internal maintenance (husband and wife relationship). Even sadder, all respondents have been infected with HIV / AIDS as a result of intimate relationships with their husbands. The study finally concludes that OHDHA (wife) needs guidance and understanding of how to deal with the dilemma of performing duties as a wife and avoiding darar treatment from her partner (husband). Keywords: UUKI, Obligation, Wife, nafkah, HIV/AIDS. Makalah ini bertujuan menjelaskan dilema yang berlaku dalam hubungan suami isteri. Isu berkenaan melaksanakan kewajipan nafkah zahir atau batin terhadap suami yang menghidap HIV/AIDS menyebabkan isteri menderita. Justeru, satu kajian kualitatif telah dilakukan untuk mengenal pasti dilemma tersebut yang berlaku dalam hubungan suami isteri. Kaedah kajian arkib seperti peruntukan Undang-Undang Keluarga Islam (UUKI), fiqh munakahat dan kajian kes telah digunakan. Kaedah temubual juga telah dilakukan untuk menjawab objektif kajian. Responden seramai 8 orang iaitu isteri kepada penghidap AIDS telah ditemubual bagi mendapat data kajian dan data akhirnya dianalisis secara manual (QDA). Hasil kajian menunjukkan bahawa berlaku diskriminasi terhadap Orang Hidup Dengan HIV/AIDS (OHDHA) (isteri) iaitu dalam bentuk nafkah zahir dan batin (hubungan suami isteri). Lebih menyedihkan lagi semua responden telah dijangkiti HIV/AIDS hasil hubungan intim bersama suami. Kajian akhirnya menyimpulkan bahawa OHDHA (isteri) perlu kepada bimbingan dan pemahaman bagaimana menangani dilemma melaksanakan kewajipan sebagai isteri dan mengelakkan daripada perlakuan darar daripada pasangannya (suami).   Kata kunci: UUKI, kewajipan, isteri, nafkah, HIV/AIDS
