International Juridical Forms and Legal Subjectivity: A History of the Subject in Southeast Asia from the Anglo-Dutch Treaty of 1824 to the ASEAN Charter

Abstract Using Michel Foucault's concept of modes of objectification, this paper argues that treaties, declarations, and agreements constitute international juridical forms that transform human beings into legal subjects. It retraces the objectification of “natives” in nineteenth-century colonial treaties that made human beings accessories to territories and transformed them into colonial subjects. This legal construct, the paper contends, was rendered unstable in the UN era when treaties re-objectified the “natives” into “peoples”, thereby allowing colonial subjects to re-subjectify themselves into actors and re-describe themselves with an adjective, a nationality. The paper then brings the history to the twenty-first century and posits that ASEAN is now objectifying new trans-national subjects that are ontologically connected to the regional economy. This history of legal subjectivity reveals not only the power of international juridical forms as a mode of objectification, but also the trajectory of subject formation in Southeast Asia under the ASEAN Charter.

ABSTRACT: This paper discusses some correspondence between Robert Schomburgk (1804–1865) and Adolphe Brongniart (1801–1876). Four letters survive, containing information about the history of Schomburgk's collection of fishes and plants from British Guiana, and his herbarium specimens from Dominican Republic and southeast Asia. A study of these letters has enabled us to confirm that Schomburgk supplied the collection of fishes from Guiana now in the Laboratoire d'Ichtyologie, Muséum National d'Histoire Naturelle, Paris. The letters of the German naturalist are an interesting source of information concerning the practice of sale and exchange of natural history collections in the nineteenth century in return for honours.

What is property, and why does our species happen to have it? The Property Species explores how Homo sapiens acquires, perceives, and knows the custom of property, and why it might be relevant for understanding how property works in the twenty-first century. Arguing from some hard-to-dispute facts that neither the natural sciences nor the humanities—nor the social sciences squarely in the middle—are synthesizing a full account of property, this book offers a cross-disciplinary compromise that is sure to be controversial: All human beings and only human beings have property in things, and at its core, property rests on custom, not rights. This chapter gives an overview of the history of recording and publishing epigraphic sources in Demotic language and script from the Late Period to Greco-Roman Egypt (seventh century bce to third century ce), for example, on stelae, offering tables, coffins, or votive gifts. The history of editing such texts and objects spans over two hundred years. Here, the important steps and pioneering publications on Demotic epigraphy are examined. They start from the beginning of the nineteenth century, when Napoleon’s expedition to Egypt found the Rosetta stone, until the twenty-first century.

This article focuses on the concept of randomness as the absence of goal-oriented movement in literary walks. The literature of walking displays the happenstance of adventure as one of the great antidotes to our inane, highly technologized, digitalized twenty-first-century lifestyle. In the end, however, such randomness may reveal itself as not so random after all, as the purpose of the journey, its inherent telos, discloses itself while travelling or in hindsight. This article provides brief glimpses into the history of literary walks to examine this tension between apparent randomness and the non-random. By drawing on a range of cultural theories and theorizations of travel and especially of walking, I look at literary foot travel in the nineteenth century, the Romantics and American Transcendentalists, some great adventure hikes in the twentieth and twenty-first centuries, and the urban and rural flâneur. In doing so the article does not lose sight of the question of how we can instrumentalize the literature of walking for life during the current pandemic.


While the twenty-first century has brought a wealth of new digital resources for researching late eighteenth- and early nineteenth-century serials, the subfield of Romantic periodical studies has remained largely inchoate. This collection sets out to begin tackling this problem, offering a basic groundwork for a branch of periodical studies that is distinctive to the concerns, contexts and media of Britain’s Romantic age. Featuring eleven chapters by leading experts on the subject, it showcases the range of methodological, conceptual and literary-historical insights to be drawn from just one of the era’s landmark literary periodicals, Blackwood’s Edinburgh Magazine. Drawing in particular on the trove of newly digitised content, specific essays model how careful analyses of the incisive and often inflammatory commentary, criticism and original literature from Blackwood’s first two decades (1817–37) might inform and expand many of the most vibrant contemporary discussions surrounding British Romanticism.

Modern nationalisms first arose during the later eighteenth century around the wide periphery of the ancient heartland of western culture and gnawed their way inward during the course of the nineteenth century to the core, culminating in World War I, Each new nationalism generated an original “imagined community” of human beings, part of whose ideological cohesion derived from a sense of shared historical experience. Since the actual historical record would not necessarily satisfy this hunger, it was often found expedient to amend the past through acts of imagination aptly termed the “invention of tradition.”One of the many new “imagined communities” of the long nineteenth century took shape in the northern Nile-valley Sudan between the final disintegration of the old kingdom of Sinnar (irredeemable after the death of the strongman Muhammad Abu Likaylik in 1775) and the publication of Harold MacMichael's A History of the Arabs in the Sudan in 1922. The new national community born of the collapse of Sinnar, strongly committed to Arabic speech and Islamic faith, was tested by fire through foreign conquest and revolution, by profound socio-economic transformation, and by the challenges attendant on participation in an extended sub-imperialism that earned it hegemony—first cultural, and ultimately political—over all the diverse peoples of the modern Sudan.One important response of the nascent community to the trials of this difficult age was the invention of a new national historical tradition, according to which its members were descended via comparatively recent immigrants to the Sudan from eminent Arabs of Islamic antiquity.

For a long time writers on international law took it for granted that the subject of their studies was a relatively recent product of modern civilization, and that the ancient world did not know any system of international law. If we go back to the literature of the nineteenth century, we can find a certain feeling of pride among internationalists that international law was one of the best fruits of our civilization and that it was a system which distinguished us from the ancient barbarians. Some of these writers paid special attention to this question of origins and endeavored to explain why the ancient world never could have had any international law.

This chapter summarizes the emergence and prominent features of a science of psychological development. Pioneering researchers established laboratories in Europe in the mid-nineteenth century to examine the significance of successive changes in the organism with the passage of time. American psychologists, many of whom had studied in the European laboratories, subsequently inaugurated similar efforts in the United States. Scientific theories and methods in the fledgling field were fostered by developments in experimental psychology, but also in physiology, embryology, ethology, and sociology. Moreover, organized efforts to provide information about development to parents, educators, and public policy specialists further propagated support for developmental science. The evolution of the field in its first century has provided a substantial platform for future developmental research.

Here Essig traces the history of engagements from the birth of companionate marriages in the nineteenth century to the invention of rituals like the bended knee and fetish items like the diamond ring in the early twentieth century. But the real change happened at the beginning of the twenty-first century, as engagements became “spectacular,” requiring not just highly staged events but also highly produced videos and images that could then be disseminated to the larger world.

This chapter considers how gay identities—and so gay affections—were formed in the course of the twentieth century, building on the late nineteenth-century invention of the ‘homosexual’. It also considers earlier construals of same-sex affections and the people who had them, the soft men and hard women of the first century and the sodomites of the eleventh. It thus sketches a history of continuities and discontinuities, of overlapping identities and emotional possibilities. The chapter resists the assumption that gay identity and experience can be reduced to anything less than the multitude of gay people, and that as Christians they have to give an account of themselves in a way that heterosexual Christians do not. The chapter warns against thinking gay identity undone in Christ.
