More US climate court cases coming

Subject Climate change litigation in the United States. Significance Following a bench trial, on December 10, New York Supreme Court Justice Barry Ostrager ruled against the state of New York in its climate change litigation against ExxonMobil. New York’s failure to prevail on a narrow state securities law claim is not a harbinger of future climate change litigation failures. Impacts Activist investors will seek outright divestiture or pressure companies to confront, accept and mitigate climate change. Some states will try to establish state-level liability; cities and counties will also pursue lawsuits. Meaningful federal-level action will need a Democratic president, yet this is a necessary but not sufficient condition.

Abstract When do states grant social rights to noncitizens? I explore this question by examining the extension of Old Age Assistance (OAA) to noncitizens after the passage of the 1935 Social Security Act. While the act contained no alienage-based restrictions, states were permitted to bar noncitizens from means-tested programs. In 1939, 31 states had alienage restrictions for OAA. By 1971, when the Supreme Court declared state-level alienage restrictions unconstitutional, only eight states still did. States with more Mexicans and Asians were slower to repeal restriction, however. Using in-depth case studies of New York, California, and Texas, I demonstrate the importance of federal and state institutional arrangements and immigrant political power for the extension of social rights to noncitizens. I also show that to secure access to OAA, immigrant advocates adapted their strategies to match the institutional and political context.

ABSTRACT Although the New York/New Jersey (NY/NJ) area is an epicenter for carbapenem-resistant Enterobacteriaceae (CRE), there are few multicenter studies of CRE from this region. We characterized patients with CRE bacteremia in 2013 at eight NY/NJ medical centers and determined the prevalence of carbapenem resistance among Enterobacteriaceae bloodstream isolates and CRE resistance mechanisms, genetic backgrounds, capsular types (cps), and antimicrobial susceptibilities. Of 121 patients with CRE bacteremia, 50% had cancer or had undergone transplantation. The prevalences of carbapenem resistance among Klebsiella pneumoniae, Enterobacter spp., and Escherichia coli bacteremias were 9.7%, 2.2%, and 0.1%, respectively. Ninety percent of CRE were K. pneumoniae and 92% produced K. pneumoniae carbapenemase (KPC-3, 48%; KPC-2, 44%). Two CRE produced NDM-1 and OXA-48 carbapenemases. Sequence type 258 (ST258) predominated among KPC-producing K. pneumoniae (KPC-Kp). The wzi154 allele, corresponding to cps-2, was present in 93% of KPC-3-Kp, whereas KPC-2-Kp had greater cps diversity. Ninety-nine percent of CRE were ceftazidime-avibactam (CAZ-AVI)-susceptible, although 42% of KPC-3-Kp had an CAZ-AVI MIC of ≥4/4 μg/ml. There was a median of 47 h from bacteremia onset until active antimicrobial therapy, 38% of patients had septic shock, and 49% died within 30 days. KPC-3-Kp bacteremia (adjusted odds ratio [aOR], 2.58; P = 0.045), cancer (aOR, 3.61, P = 0.01), and bacteremia onset in the intensive care unit (aOR, 3.79; P = 0.03) were independently associated with mortality. Active empirical therapy and combination therapy were not associated with survival. Despite a decade of experience with CRE, patients with CRE bacteremia have protracted delays in appropriate therapies and high mortality rates, highlighting the need for rapid diagnostics and evaluation of new therapeutics.

<p>Flash droughts are the rapid intensification of drought conditions generally associated with increased temperatures and decreased precipitation on short time scales.  Consequently, flash droughts are responsible for reduced soil moisture which contributes to diminished agricultural yields and lower groundwater levels. Drought management, especially flash drought in the United States is vital to address the human and economic impact of crop loss, diminished water resources and increased wildfire risk. In previous research, climate change scenarios show increased growing season (i.e. frost-free days) and drying in soil moisture over most of the United States by 2100. Understanding projected flash drought is important to assess regional variability, frequency and intensity of flash droughts under future climate change scenarios. Data for this work was produced with the Weather Research and Forecasting (WRF) model. Initial and boundary conditions for the model were supplied by CCSM4, GFDL-ESM2G, and HadGEM2-ES and based on the 8.5 Representative Concentration Pathway (RCP8.5). The WRF model was downscaled to a 12 km spatial resolution for three climate time frames: 1995-2004 (Historical), 2045-2054 (Mid), and 2085-2094 (Late).  A key characteristic of flash drought is the rapid onset and intensification of dry conditions. For this, we identify onset with vapor pressure deficit during each time frame. Known flash drought cases during the Historical run are identified and compared to flash droughts in the Mid and Late 21<sup>st</sup> century.</p>

A pressing question for climate change adaptation is whether ongoing transformations of the agricultural sector affect its ability to cope with climatic variations. We examine this question in the United States, where major increases in productivity have fueled most of agricultural production growth over the past half-century. To quantify the evolving climate sensitivity of the sector and identify its sources, we combine state-level measures of agricultural productivity with detailed climate data for 1960–2004. We find that agriculture is growing more sensitive to climate in Midwestern states for two distinct but compounding reasons: a rising climatic sensitivity of nonirrigated cereal and oilseed crops and a growing specialization in crop production. In contrast, other regions specialize in less climate-sensitive production such as irrigated specialty crops or livestock. Results suggest that reducing vulnerability to climate change should consider the role of policies in inducing regional specialization.

Scholars and practitioners have come to understand the important role of local governments in the causes and effects of climate change. The literature has examined both the substantive and symbolic determinants of urban sustainability policies in addition to the implementation issues associated with those policies. At the heart of these policies is the idea that local governments have the desire and ability to engage in socially and environmentally responsible practices to mitigate climate change. While important, these studies are missing a key component in the investigation of local government involvement in sustainability policies: government purchasing power. This study examines the effect of administrative professionalism and interest group presence on the determinants of green procurement in the understudied context of counties in the United States.

<p>Surface ozone pollution has been proven to impose significant damages on crops. However, the quantification of the damages was extensively derived from chamber experiments, which is not representative of actual results in farm fields due to the limitations of spatial scale, time window, etc. In this work, we attempt to empirically fill this gap using county-level data in the United States from 1980 to 2015. We explore ozone impacts on corn, soybeans, spring wheat, winter wheat, barley, cotton, peanuts, rice, sorghum, and sunflower. We also incorporate a variety of climate variables to investigate potential ozone-climate interactions. More importantly, we shed light on future yield consequences of ozone and climate change individually and jointly under a moderate warming scenario. Our findings suggest significant negative impacts of ozone exposure for eight of the ten crops we examined, excepting barley and winter wheat, which contradicts experimental results. The average annual damages were estimated at $6.03 billion (in 2015 U.S. dollar) from 1980 to 2015. We also find rising temperatures tend to worsen ozone damages while water supply would mitigate that. Finally, elevated ozone driven by future climate change would cause much smaller damages than the direct effects of climate change itself.</p>

Objectives: Racial differences in mortality in the United States have narrowed and vary by time and place. The objectives of our study were to (1) examine the gap in life expectancy between white and black persons (hereinafter, racial gap in life expectancy) in 4 states (California, Georgia, Illinois, and New York) and (2) estimate trends in the contribution of major causes of death (CODs) to the racial gap in life expectancy by age group. Methods: We extracted data on the number of deaths and population sizes for 1969-2013 by state, sex, race, age group, and 6 major CODs. We used a Bayesian time-series model to smooth and impute mortality rates and decomposition methods to estimate trends in sex- and age-specific contributions of CODs to the racial gap in life expectancy. Results: The racial gap in life expectancy at birth decreased in all 4 states, especially among men in New York (from 8.8 to 1.1 years) and women in Georgia (from 8.0 to 1.7 years). Although few deaths occurred among persons aged 1-39, racial differences in mortality at these ages (mostly from injuries and infant mortality) contributed to the racial gap in life expectancy, especially among men in California (1.0 year of the 4.3-year difference in 2013) and Illinois (1.9 years of the 6.7-year difference in 2013). Cardiovascular deaths contributed most to the racial gap in life expectancy for adults aged 40-64, but contributions decreased among women aged 40-64, especially in Georgia (from 2.8 to 0.5 years). The contribution of cancer deaths to inequality increased in California and Illinois, whereas New York had the greatest reductions in inequality attributable to cancer deaths (from 0.6 to 0.2 years among men and from 0.2 to 0 years among women). Conclusions: Future research should identify policy innovations and economic changes at the state level to better understand New York’s success, which may help other states emulate its performance.

Purpose Bangladesh is one of the most flood-prone countries in the world. A number of research works have identified that the flood scenario will be aggravated with climate change context in Bangladesh. In 2014, Bangladesh had prepared municipal level master plan for 222 municipalities with a view to planned urban development. But climate change-induced flood has not been considered in master plan, which poses a question toward the sustainability of the plan. Ullapara Municipality of Sirajganj district has been selected to conduct the research. This study aims to evaluate how infrastructure in proposed master plan will be exposed to climate change-induced flood. Design/methodology/approach The methodology of this study follows geographic information system (GIS)-based flood exposure analysis of selected infrastructure. These infrastructures include transport infrastructure, educational infrastructure, health infrastructure and other urban facilities. Climate change-induced flood for the year 2040 has been used for flood exposure analysis. Findings It is evident from the flood exposure analysis that about 33.99% roads will be exposed to 1.5 m–2 m inundation level; seven primary school, six secondary school and four colleges would be highly exposed to 2.0 m–2.50 m inundation level; four health facilities would be exposed to 1.0 m–2.0 m inundation level because of future climate change. This inundation scenario for long duration will lead to dysfunction of concerned infrastructure and, in turn, undermine the stability of a socioeconomic system of Ullapara Municipality. Originality/value As the master plan is not fully implemented till now, there is scope for intervention for considering climate change-induced flood to make the plan sustainable.
