‘True crime’ stories and psychiatrists’ ethical responsibilities

Objective: In May 2018, a small paperback book was published, which briefly described 10 cases of persons charged with murder whom an Australian psychiatrist had assessed for the court. This article considers the ethical issues raised by identifying both the persons charged with murder and their victims in newspaper articles and interviews to promote a book. Conclusions: When persons who have committed homicide are named in a ‘true crime’ book, their recovery trajectory may be prejudiced and the families of their victims may be re-traumatised. Such publications may also contribute to the stigmatisation of persons with mental illness who commit serious offences. Respect for the dignity of the person is fundamental to the ethical practice of forensic report-writing. There can never be any implied agreement or consent that a psychiatrist who writes a report for the court can also use the material in a book written for profit. The Royal Australian and New Zealand College of Psychiatrists Code of Ethics includes several principles relevant to psychiatrists who write medico-legal reports. Psychiatrists should carefully consider the ethical issues raised in publishing outside of textbooks and professional journals and engaging with the lay media.

The first ever code of ethics of the Royal Australian and New Zealand College of Psychiatrists was promulgated in 1992. In this paper two of the four members of the College's Ethics Committee (which prepared the document) describe the code's provenance and the procedure used to determine its form and content. The code, a milestone in the College's history, reflects its maturity in confronting the many ethical issues with which psychiatrists have to wrestle in contemporary clinical (and research) practice. We hope that our account will assist them to deal effectively with this pivotal aspect of their professional work.

All psychology research should strictly adhere to ethical principles outlined by the researcher's local governing body. In the UK, this is the British Psychological Society (BPS). However, in papers advising on methodology used in psychophysiology (a research area within psychology), issues linked to ethics are rarely mentioned despite the invasive nature of this type of research. Guidelines published by local governing bodies are never mentioned. In this paper, important ethical issues in psychophysiology research are discussed with respect to BPS guidelines. Recommendations are made for ensuring ethical practice when conducting psychophysiology research. This paper is intended for those new to psychophysiology research (postgraduate and undergraduate students) and should be read in conjunction with the BPS ‘Code of ethics and conduct’.

Military nurses encounter similar issues as civilian nurses in daily practice situations; however, wartime and humanitarian missions may bring unique and difficult ethical dilemmas. While nursing has the American Nurses Association code of ethics to provide a framework to guide ethical practice decisions, conflicts may arise from the unique aspects of nursing within a wartime environment. Understanding those conflicts occuring within the military wartime scenario can provide nurses with experiential examples from which to derive strategies for personal coping and professional behavior and decision making. This chapter describes the research that has focused upon the identification of these issues, the effects from uresolved issues, and those directions for future research to better prepare miltiary nurses before and during deployment.

This paper is concerned with ethical issues in the practice and administration of tests. Some broad principles related to the knowledge required for test usage are described, together with the skills necessary for competent test use. Ethical practice in relation to test users, training in testing, test administration, test interpretation and test instruments is also examined. The focus then changes to a consideration of the more general ethical principles that apply to professional practice and are equally applicable to testing. A final section examines the relevance of these issues for career guidance practitioners and also some recent professional developments that will encourage ethical practice in testing.

The first three, brief sections of the Code of Ethics of the National Association of Social Workers (1999) display striking inconsistency of content and uncertainty of purpose. The decision to incorporate those sections into a single code document along with the lengthy fourth section (Ethical Standards) appears to have contributed to their imperfection. The mission statement and the ethical principles, in particular, may develop better if they are divided into separate documents, each with its own distinct purpose. Such a development might help reduce the extent to which social workers must rely upon individualistic rather than shared wisdom in responding to common ethical issues.

Recognizing ethical issues and dilemmas that arise in professional practice is crucial for social work practitioners, educators, and students. After a discussion about the limited, although growing, literature on social work ethics, the ten main tenets form the most current NASW Code of Ethics are presented. These topics include limits to confidentiality, confidentiality and technology, confidentiality in family and group work, managed care, cultural competence, dual relationships, sexual relationships, impairment and incompetence of colleagues, application to administrators and relevance to social work educators. In addition to understanding the Code of Ethics, social workers can use the ETHIC model of decision making for resolving ethical dilemmas. This easy to use five step process includes examining personal, agency, client, and professional values, thinking about ethical standards and relevant laws, hypothesizing about consequences, identifying the most vulnerable, and consulting with supervisors and colleagues. A case example involving confidentiality, HIV/AIDS and family therapy demonstrates how social workers can use the ETHIC model.

A rising number of cases involving ethical misconduct within firms have of late received considerable attention in Malaysia. Despite the country's declaring having a strong corporate governance policy, strengthened through the Code of Ethics for Company Directors and Malaysia Code of Corporate Governance, the unethical practices and lack of integrity within firms remain an issue. PricewaterhouseCoopers (PwC) Malaysia conducted a survey in 2018, it was found that 41 percent of Malaysian registered companies were guilty of committing some forms of economic crimes, specifically business misconduct, asset misappropriation, bribery, and corruption. They added, the actual number may be higher due to many cases of ethical misconduct that typically go unreported. Furthermore, crimes of ethical misconduct in Malaysia have also increased by 28 percent in the last two years. It was revealed taht corporate culture was the most influential element in helping detect early warning signs of ethical misconduct within a firm. A KPMG 2019 report published in the subsequent year also suggested that an unhinged desire for a wealthy lifestyle acts as a prime motivation behind many of the unethical behaviors discovered. Thus, in the light of the increasingly worsening situation of ethical misconduct in Malaysian firms, the need to explore these corporate ethical issues has never become more crucial and appropriate. The ubiquitous nature of the issue has subsequently jeopardized the financial reporting quality of Malaysia's firms. The chapter provides a critical analysis of past understandings of the characteristics of professions. Many of these characteristics have lost meaning in the twenty-first century. High status has been diminished partly by professionals’ betrayal of the values they expound, but partly also by social factors such as rapid communication of information and changed understanding of the nature of knowledge, both of which have led to general scepticism about expertise. Professionals’ previous relative autonomy is challenged by government intervention and by the fact that more professionals are employed in large organizations where managers are the power centres. The chapter argues for a ‘new professionalism’ and takes two principles from the Code of Ethics of the Royal Australian and New Zealand College of Psychiatry to demonstrate how carefully deliberated codes of ethics can enunciate the particular values which the professions contribute in a well-functioning society.
