The first is the creation of the state insurance system, which either protects the states’, mainly property interests, or protects certain socially vulnerable groups of the population. The second is the creation of the mechanism for legal regulation of insurance relations as the special group of the public relations. In the legislation of any country extensive block called legislation on insurance. In the market economy, based on the private property, the main driver of insurance is the desire of the owner to protect his property. At the same time, the growth of welfare causes the individual to take care of himself, which expands the scope of personal insurance.

The social policy of a modern state should be aimed at creating conditions that ensure a decent life for a person and their free development as an individual. The most important areas of social activity of the state should be labor protection and improvement of people's health, ensuring a guaranteed minimum wage, full employment, state support for large families, students, motherhood and childhood, disabled people and pensioners. The objectives of social policy are: increasing incomes and social protection of the population; optimization of social and labor relations; improving the health of citizens; protection of motherhood and childhood and state support of the family. These factors determine the relevance ofstudying and developing methods of financing healthcare. The article pays attention to the issues of social insurance, as it is an integral part of the general insurance system. However, social insurance has a number of significant features that are determined by the requirements of social protection of citizens. Together with the state budget, significant amounts of financial resources are accumulated in social insurance funds, directed to solving problems of socio-economic development, which is reflected in this article. In the practice of healthcare financing in Kazakhstan, certain negative trends have developed, leading to inefficiency in the use of allocated budget allocations, which are emphasized in the work. Based on the results of the study, the issues of creating a stable financial base for compulsory social health insurance in the Republic of Kazakhstan are systematized.

The main provisions, essence and content of the revenue policy as a key part of the social policy of the state have been considered in the article. The author rightly notes, that the income policy is aimed at solving such important tasks as helping vulnerable groups of the population by resorting to the use of the social security system and leveling the inflationary processes that affect the income and savings of citizens. Various models of social regulation have been adduced, including the “Scandinavian” or “Swedish” model, monetarist, paternalistic, and others. The study have used various general scientific research methods: observation method, the systemic-functional method, method of synthesis and analysis, method of scientific abstraction. The main directions of improving the implementation of the state social policy, which is presented as a voluminous, multi-faceted process that has a complex structure and intersects with many other areas of state activity, have been proposed. The conclusion has been formulated, that society does not exist by itself, so the social sphere is in constant interaction with other spheres, such as production of material goods, politics, culture and the environment. It has been noted, that social policy is recognized as effective when the entire social sphere is at a high level, and the society clearly shows a positive response to the actions of the state. Thus, the broader is such a policy, the greater is the completeness of the covered areas, both explicit (the fight against poverty, social protection, etc.) and implicit (relations between social groups, motivation in society, etc.), the more effective is the overall functioning of the state as a whole.

The relevance of determining the theoretical and methodological determinants of the Robert von Moll’s concept of the social state is due to the need to determine the patterns of evolution of ideas about the state and law, as well as the need to assess the ability to use the potential of the Robert von Moll’s theoretical and legal heritage, his predecessors and contemporaries to identify the optimal model of the social state. Modern Russia attempts to build such state. The proclamation and consolidation of Russia as a social state governed by the rule of law at the constitutional level requires attention both to the experiments carried out in social and legal development, and to the practices of social reform, and also to those ideas that have not yet been embodied. The ideas of European scholars regarding the evolution of the state-legal organization of society in the early modern period, based on which Robert von Mohl (1799–1875) developed original concepts of a social state and a state governed by the rule of law are discussed in the article. An analysis of the state of European political and legal thought and identification of the factors that have a significant impact on the development of Robert von Mohl’s doctrine of a social state governed by the rule of law are the purposes of the scientific article. The methodological basis of the study was the dialectical-materialistic, general scientific (historical, systemic) and special (historical-legal, comparativelegal) methods of legal research. The method of reconstruction and interpretation of legal ideas had great importance. As a result of the study, it was concluded that in the first half of the 19th century in European political and legal thought various approaches was formed to consider the problems of social protection and how to resolve them. The development trend of European political science became the transition from ideas and principles formed in the conditions of police states and enlightened absolutism to the ideas of a state governed by the rule of law (constitutional) that protects the rights and freedoms of a citizen. At the same time, it was a question of the rights and freedoms of only a part of the population: the proletariat growing in number and significance was not always evaluated as an independent social stratum. The axiological principles of state justification have also changed. Rights and utility principle became dominant principles. In the first half of the 19th century the social issue as an independent scientific problem of the European political and legal thought was not posed and not systematically developed. Questions about the social essence of the state, the specifics of the implementation of the state social function, the features of public administration in the new stage of socio-economic development of society predetermined the emergence of the idea of a social state. This idea was comprehensively characterized in the Robert von Mohl’s works. He went down in the history of political and legal thought as founder of the concepts of social and governed by the rule of law state.

The paper starts with a brief discussion of recent developments of economic restructuring of the State Owned Enterprises in China and their related reforms in social insurance and social assistance. It then reports the findings of an attitude survey of residents in Shanghai in 1996 towards the social and economic consequences of economic reform. It reveals that, despite the fact that most people feel better off with the reforms, there is still a need for the state to play a role in social protection.

A comparative analysis of forms of social insurance and sources of financing payments in Ukraine and Germany has been carried out. The practical aspects of functioning of compulsory medical insurance in Germany are investigated, its positive features are revealed. Conclusion. It is revealed that the forms and sources of state social insurance of Ukraine and Germany are similar. The exception is the state health insurance, which in Ukraine is in the stage of implementation. The necessity to restore the payment of a single social contribution by hired workers in the conditions of a shortage of financial resources in the sphere of social insurance of Ukraine is substantiated. It is proposed to apply in the domestic practice the mechanism of functioning of the state medical insurance of Germany, which excludes the possibility of abuses by medical workers in the context of the appointment of unnecessary medical examinations and procedures.
