Until now in Indonesia, there is no specific regulation regarding aircraft as collateral object. As a result, in practice, the aviation industry players experienced obstacles related to aircraft financing by guarantee agreements with aircraft objects. Such conditions create legal uncertainty both for credit providers (creditors) and the aircraft guarantees (debtors), because there are no references or signs that can provide direction in the guarantee agreement. If there is a default by the debtor, the creditor has no legal basis for how to execute it. To fill the legal vacuum, in practice, a guarantee agreement was found with the fiduciary deed of the aircraft. Whereas the Fiduciary Law expressly states that it does not apply to (mortgages) aircraft. While on the other hand, Law No. 20 of 2014 concerning Notary Position gives authority to the notary to make an aircraft mortgage deed. Thus the regulations in Indonesia give signals to use aircraft as collateral object. Such a situation demands the urgency for regulations on aircraft guarantee that can provide legal certainty and legal protection for the parties.

The aim of this research is to see the legal protection of Donation-based Crowdfunding zakat on financial technology due to the huge spreading of startup with zakat fund in Indonesia. Meanwhile there is still no specific regulation protecting various risks that will arise especially the risk of unobvious identity, potential disputes, dissimilarity of the zakat purpose and the implementation of zakat distribution, and the other deviations. This type of research is library legal research with conceptual and state approach. The result of the research shows that in positive law there is no legal protection regulation in Zakat based on Donationbased Crowdfunding. The regulation only crowdfunding contains investment element andgenerate profit as described in Act Number 21 Year 2011 regarding Financial Services Authority. While Zakat-based Donation-based Crowdfunding is a nonprofit-oriented type of product. This makes the absence in the elements of justice and legal certainty. The regulation on zakat only described in Law number 23 year 2011 which is not contained that system. In the protection of Islamic law, the certainty of the implementation of the contract is stipulated in the zakat based on sharia agreement that must comply with the various principles and provisions of sharia, whether the arrangement starts from the intention, the process of agreement, transparency, and all aspects relating to Amil, Muzakki and Mustahiq zakat (Who is the mustahiq and what kind and how the implementation). finally, the researcher hopes that this research will bring inputs for government to make more comprehensive regulations on zakat in its digital form.

The Fiduciary Act should provide legal protection of the parties and legal certainty, but on the other hand there are still some weaknesses of the Fiduciary Act. This paper analyzes the weaknesses of Act Number 42 Year 1999 on Fiduciary and the need for revising the Act. The type of research is a normative legal research or library which includes a study of the principles of law and the systematics of law. The research uses the statute approach and the conceptual approach. Based on the analysis it can be concludde that it requires to revise the Fiduciary Act. Legislators should produce the law not only ensuring the legal certainty but they also can provide the law presenting justice and prosperity for the people. Revision of the Fiduciary Act is expected to provide maximum protection to the people who use the fiduciary as a guarantee agency; so that the justice will be obtained by the people to create a conducive atmosphere in the economy to increase the prosperity for them.

According to the certainty on the material law, the definition of transfer of land right is the transfer of old owner to the new one. There are 2 (two) ways of the transfer of land right, which are to transfer and being transferred. To transfer means the transfer of land right without any legal action done by the owner, for example by the hereditarily. While being transferred refers to the transfer of the land through the legal action by the owner, for example by the purchase and sale. According to Paragraph 37 Article 1 Government Regulation Number 24 the Of 1997, it is stated that the Transfer of land right done by making the deed by Land Titles Registrar, so the transfer deed of land transfer will have a strong proof as a deed in the court system and a deed as the base of issuing the ownership certificate. The registration of the land as Government Regulation Number 24 the Of 1997 aims to give the legal certainty and legal protection to the right holder of the land, apartment units and other registered rights so it can easily prove that himself/herself is the right holder. On the other hand, we also acknowledge the registration of land tax, such as pipil-girik, petok, letter C, which is done by the Tax Office in Java Island. Resumen: En el Reglamento (UE) 650/2012 no existe una norma específica que regule la competencia en materia de expedición de certificados sucesorios nacionales, incluso no se utiliza nunca la expresión “certificado sucesorio nacional” como tal, sino que los denomina “documentos internos empleados en los Estados miembros para fines similares” a los de los certificados sucesorios europeos. Sin embargo, dicho instrumento internacional sí que contempla una regulación específica relativa a la competencia en materia de expedición de certificados sucesorios europeos (art. 64 Reglamento (UE) 650/2012). Pues bien, ante la “aparente laguna legal” en relación con los certificados sucesorios nacionales, se debe determinar, si dentro del concepto de “totalidad de la sucesión” -que indica el ámbito de aplicación del Reglamento-, se encuentran dichos certificados. En cuyo caso, las normas de competencia del capítulo II del Reglamento sucesorio serían de aplicación a la expedición de los certificados sucesorios nacionales y a los procedimientos relativos a ellos. En este sentido, la Sentencia del TJUE 21 junio 2018, Vincent Pierre Oberle, C-20/17 y, sobre todo, las Conclusiones del Abogado General Sr. M. Szpunar, han venido a solucionar esta “laguna legal”, así como otras cuestiones planteadas de gran importancia, en relación con el asunto concreto que se estaba dirimiendo. Se debe destacar que, con el fallo de la sentencia, se resuelve una cuestión que puede ser relevante para todos los Estados miembros en los que se contempla la posibilidad de que los órganos judiciales expidan certificados sucesorios nacionales.Palabras clave: Reglamento (UE) 650/2012, certificado sucesorio nacional, certificado sucesorio europeo, competencia internacional, tribunal, notario, resolución, totalidad de la sucesión.Abstract: In Regulation (EU) 650/2012 there is no specific provision that regulates the competence in the issue of national certificates of succession, even the term “national succession of certificate” is never used as such, but rather calls them “internal documents used for similar purposes in the Member States” to those of European Certificates of Succession. However, this international instrument contemplates a specific regulation governing the competence in the issue of European Certificate of Succession (art. 64 Regulation (EU) 650/2012). Well, given the “apparent legal loophole” in relation to national certificates of succession, it must be determined, if within the concept “succession as a whole” -which indicates the scope of the Regulation-, such certificates are found. In which case, the jurisdiction rules of Chapter II of this Regulation would apply to the issuance of national certificates of succession and the procedures related to them. In this regard, the CJEU Judgement of 21st June 2018, Vincent Pierre Oberle, C-20/17, and, above all, the Conclusions of the Advocate General Mr. M. Szpunar, have come to solve this “legal loophole”, as well as others issues raised of great importance, in relation to the specific issue that was being settled. Resumen: El presente trabajo parte de la hipótesis de que no es posible diseñar un régimen de protección internacional para las personas desplazadas por disrupciones medioambientales sin antes aclarar qué se entiende por “desplazado medioambiental” y cómo se ha llegado a tal entendimiento. Así, el artículo se estructura en dos partes. La primera de ellas pretende reconstruir el íter que ha configurado la figura del desplazado medioambiental en el pensamiento académico, tanto desde los estudios medioambientales como desde los migratorios. La segunda, por su parte, analiza la primera definición de desplazado ambiental, con vocación jurídica, que aparece en plano internacional y la influencia que en su redacción han tenido las corrientes anteriores. Abstract:  This paper is based on the hypothesis that it is not possible to design an international protection regime for people displaced by environmental disruptions without first clarifying what is meant by "environmental displaced" and how this understanding has been reached. Thus, the article is structured in two parts. The first of them aims to reconstruct how the concept of environmentally displacement has been shaped in academic thinking, both from environmental and migratory studies. The second one, on the other hand, analyzes the first definition of environmental displaced which appears, with a legal vocation, on the international scene and the influence that those previous streams have had on it.

This allows him to be relieved of some of the duties of the employer who takes over the temporary employment agency. This makes it easier for employers to hire an employee in the short term. This also creates additional jobs. On the other hand, this entails the development of a legal basis for such employment. There may also be doubts as to who is in charge of certain obligations of the employer.

Abstract               Blocking of a book of certified land begins with a legal relationship between two or more parties involving the certificate as the object of the dispute. Losses experienced by one party in the process of buying and selling led to the application of blocking the book of land certificate to the office. The significance of this writing is to know and analyze the status of the Deed of Sale and Purchase Agreement in the process of blocking the land book by the buyer in the land office and the form of legal protection provided by the land office to the injured party due to buyer blocking based on the Deed of Sale and Purchase Agreement. The result of this research is the position of the sale and purchase binding agreement in the process of blocking the land book conducted by the buyer in the land office only as evidence of actual delivery and juridical delivery between the seller and buyer on the object of sale and purchase, not as an administrative requirement blocking at the land office. The Land Affairs Office provides legal protection by implementing the provisions of Article 125 and Article 126 of the Regulation of the Minister of Agrarian Affairs / Head of the National Land Agency Number 3 of 1997 by limiting the party who wishes to file a blocking request to the land office is a party with a strong legal basis to file the request for blocking in an effort defend that right so that it will not harm the other party. AbstrakPemblokiran buku tanah sertipikat diawali oleh suatu hubungan hukum antara dua pihak atau lebih yang melibatkan sertipikat sebagai obyek sengketa.Kerugian yang dialami oleh salah satu pihak dalam proses jual beli memunculkan adanya permohonan pemblokiran buku tanah sertipikat ke kantor. Arti penting dari penulisan ini adalah untuk mengetahui dan menganalisis kedudukan Akta Perjanjian Pengikatan Jual Beli dalam proses pemblokiran buku tanah yang dilakukan pembeli pada kantor pertanahan dan  bentuk perlindungan hukum yang diberikan kantor pertanahan kepada pihak yang dirugikan karena pemblokiran oleh pembeli berdasarkan Akta Perjanjian Pengikatan Jual Beli. Hasil dari penelitian ini adalah kedudukan akta perjanjian pengikatan jual beli dalam proses pemblokiran buku tanah yang dilakukan oleh pihak pembeli pada kantor pertanahan hanya sebagai alat bukti telah terjadinya penyerahan secara nyata dan penyerahan yuridis antara penjual dan pembeli atas objek jual beli, bukan sebagai persyaratan administratif permohonan pemblokiran pada kantor pertanahan. Kantor pertanahan memberikan perlindungan hukum dengan melaksanakan ketentuan Pasal 125 dan Pasal 126 Peraturan Menteri Agraria/Kepala Badan Pertanahan Nasional Nomor 3 Tahun 1997 dengan membatasi pihak yang ingin mengajukan permohonan blokir ke kantor pertanahan adalah pihak yang memiliki dasar hukum yang kuat untuk mengajukan permohonan blokir dalam upaya mempertahankan haknya tersebut sehingga tidak akan merugikan pihak lain.

The German Law on public procurement remedies, implementing the EU Remedies Directives into national law, has to engage in a balancing act between effective legal protection of bidders and the necessary acceleration of the award procedure. The book develops solutions for conflicts between the abovementioned opposing interests, which are consistent with the pluralistic paradigm of the European legal area, and the standards of assessment of the EU primary substantive law on public procurement. The Europeanisation of the German Law on public procurement remedies is analysed in detail. The work deals with the establishment and improvement of effective legal protection of bidders on the one hand and, on the other hand, shows that the acceleration of the award procedure within the framework of the procedural system is bounded by the rule of law. The book carves out strengths and deficits of the German Law on public procurement remedies.

The length of the Indonesian coastline is based on calculations from the Work Team Standardization of the Island Name reaching 99,000 (ninety nine thousand) Kilometers which indicates that there is potential for salt production in Indonesia. But not all coastlines in Indonesia can be used as salt production centers because of several factors that influence them. However, the salt production sector in Indonesia has become a means of living for businesses in the salt sector, especially the Salt Farmers, so that the salt produced is called people's salt. At present, the people's salt production has not been able to meet industrial needs because the salt specifications and quantity cannot meet the industry's needs so the solution is to import industrial salt. The enactment of Government Regulation Number 9 of 2018 concerning Procedures for Import Control for Fisheries Commodities and Concentration as Raw Materials and Industrial Assistance provides an entry way for imported salt for industrial needs. But on the other hand, people's salt production is currently in the stage of increasing quality and quantity due to weather factors that support and the application of technology that is empowered to support industrial needs are being implemented. In this case a problem arises when people's salt is unable to compete with the presence of imported salt because the industrial needs have been met by the presence of imported salt, so that with this problem the community salt farmers need legal protection in the process of marketing their salt in Indonesia.Keywords: People’s Salt; Salt Import; Protection.

Judicial practice in Indonesia, judging from the decisions of criminal cases, generally judges give legal considerations only to prove the elements of a criminal offense. In contrast, the determination of the crime is not objectively considered, and most are merely considerations of incriminating and mitigating matters. On the other hand, the judge has absolute authority in imposing a crime; the judge's freedom is guaranteed by law. The supreme power of judges who are used freely without objective measures has the potential to produce corrupt decisions and injustices. Criminal objectives must be aligned with legal goals, namely to realize penalties that guarantee legal certainty, justice, and expediency. Ideally, good sentences reflect the three purposes of the law.
