On the Rationale of Coercive Land Acquisitions

AbstractThis study seeks to frame the rationale of land acquisition by explicating on the market conditions necessitating the suspension of consensual exchanges in favor of the use of coercion to meet the land supply requirements of a project, and then examines the reasoning governing the use of the acquisition legislation in India. It has been argued that the law of land acquisition, by terminating the right of the seller to negotiate the conditions of the exchange and by forcibly re-allocating the land to the other party, can help in easing out land transactions only in conditions where the inordinate bargaining power of the seller, possessing the non-substitutable unit of land, is the source of the obstacles at the stage of bargaining. In Indian context, however, it is observed that the application of the land acquisition act does not fit into the economic rationale of the acquisition law as a law to correct for the specific type of land supply constraints associated with non-substitutability; rather, the concern of availing the low cost supply of land appeared to be the dominant motivation guiding the use of acquisitions.

The Indian state has used the colonial Land Acquisition Act (LAA), 1894, for acquiring land even without the consent of the people in the name of ‘public purpose’ and on payment of compensation, until it got repealed by a new act, the Right to Fair Compensation and Transparency in Land Acquisitions, Rehabilitation and Resettlement Act, 2013. The LAA, 1894 is an expression of the notion of ‘eminent domain’ and draws its sustenance from the sovereignty of the state. The understanding of sovereignty and to what extent the sovereign power of the state can use the concept of ‘eminent domain’ in the context of land acquisition remains a contentious issue. This article attempts to examine the notion of sovereignty and use of ‘eminent domain’ in the context of land acquisition in India. How does the inter-relationship between sovereignty and ‘eminent domain’ be understood according to the LAA, 1894 and the Land Act, 2013 has been discussed.

Abstract In the last years, the term “land grab” has gained international importance and has been used as a catch-all frase for (trans)national commercial land transactions mainly revolving around the production and export of food, animal feed, biofuels, timber and minerals. The main literature explains it as a consequence of the financialization process that included land as an asset. Our main proposition in this article is that for Brazil, speculative land acquisitions played an important role in the portfolio of many economical agents, but with the deregulation of financial markets and the financialization of the seventies it became more intensive. To do so, first we present the different theoretical approaches to the land grab phenomenon and add a post-keynesian view on land transactions to the debate. Second, we analyze the available data on agriculture and livestock foreign investments in Latin America with the main focus on Brazil. Third, we present the legal and institutional aspects of foreign-owned land in Brazil. In conclusion, we propose that land grabbing will always have a speculative component, but after the deregulation of financial markets, the pressure for land acquisition is larger and the efforts in regulation and control over land acquisition in Brazil have not been effective in controlling acquisitions by foreigners.

The chapter examines the fairness claim of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act (LARR), 2013. The author uses the utilitarian fairness standard proposed by one of the most influential American constitutional scholars of the twentieth and twenty-first centuries, Frank Michelman, whose study of judicial decisions from an ethical perspective by introducing the concept of “demoralization costs” has shaped the interpretational debate on takings law in the United States. Michelman’s analysis is particularly relevant for the land question in India today since there is a widespread feeling that millions of people have been unfairly deprived of their land and livelihoods. The chapter looks at the role of the Indian judiciary in interpreting the land acquisition legislation since landmark judgments affect the morale of society. It concludes that using Michelman’s standard would help in bringing about greater “fairness” than what the new legislation has achieved.

Foreign land grabbing is acknowledged as a phenomenon that generates disempowerment and dispossession of local farmers, human rights violations. Previous studies have revealed the lack of ethical benchmarks in foreign large-scale land transactions that raise moral concerns. It is evident that when resources are scarce and people depend on them, the balance between values and interests transforms itself into a dilemma. Within this context, the aims of the paper were to bring to the fore critical reflection on a more ethical perspective of large-scale land acquisitions and to extend the scant information on what factors determine landowners not to sell their land to foreigners to limit land grabbing. This context justifies the need for a critical reflection on a more ethical perspective of large-scale land acquisitions. Therefore, two objectives were set. The first one is to document the role of ethics in large-scale land transactions. Based on the land grabbing literature, authors selected a set of eight land grabbing narratives, most often interrelated and overlapping, that pose ethical considerations. The second objective is to reveal how well a set of variables can predict the “Resistance to sell” the land to foreigners even when an attractive price is offered. As ethics is a social construct, the analysis captured the stakeholders’ perspective on land grabbing. Therefore, a questionnaire was applied to a sample of 332 Romanian landowners from twelve randomly selected counties to reveal their perceptions. Partial least squares structural equation modeling (PLS-SEM) was used to observe how well a set of seven variables could predict landowners’ “Resistance to sell” their land to foreign buyers. The use of PLS-SEM was justified by the existence of single items and the need to examine many structural model relations. Results showed that the variables with the strongest contribution to the prediction of the dependent variable are the “Probability to join an association for farmers rights defense”, the “Importance of the land price offered by the potential foreign buyer”, and the “Perceived effect of agricultural land conversion to urban land”. Raising awareness on the importance of buyer attributes, increasing people’s perception of the negative effect of agricultural land conversion to urban land, or strengthening the state’s image as a necessary actor to limit land grabbing will increase landowners’ resistance to sell their land to foreigners. Finally, it can be inferred that, within this frame of discussion, ethics should be valued as a means to create economically viable and morally justifiable solutions for foreign large-scale land transactions.

With the rapid growth of wearable computing and increasing demand for mobile authentication scenarios, voiceprint-based authentication has become one of the prevalent technologies and has already presented tremendous potentials to the public. However, it is vulnerable to voice spoofing attacks (e.g., replay attacks and synthetic voice attacks). To address this threat, we propose a new biometric authentication approach, named EarPrint, which aims to extend voiceprint and build a hidden and secure user authentication scheme on earphones. EarPrint builds on the speaking-induced body sound transmission from the throat to the ear canal, i.e., different users will have different body sound conduction patterns on both sides of ears. As the first exploratory study, extensive experiments on 23 subjects show the EarPrint is robust against ambient noises and body motions. EarPrint achieves an Equal Error Rate (EER) of 3.64% with 75 seconds enrollment data. We also evaluate the resilience of EarPrint against replay attacks. A major contribution of EarPrint is that it leverages two-level uniqueness, including the body sound conduction from the throat to the ear canal and the body asymmetry between the left and the right ears, taking advantage of earphones' paring form-factor. Compared with other mobile and wearable biometric modalities, EarPrint is a low-cost, accurate, and secure authentication solution for earphone users.

Abstract Background During COVID-19 pandemic, optimization of the diagnostic resources is essential. Lung Ultrasound (LUS) is a rapid, easy-to-perform, low cost tool which allows bedside investigation of patients with COVID-19 pneumonia. We aimed to investigate the typical ultrasound patterns of COVID-19 pneumonia and their evolution at different stages of the disease. Methods We performed LUS in twenty-eight consecutive COVID-19 patients at both admission to and discharge from one of the Padua University Hospital Intensive Care Units (ICU). LUS was performed using a low frequency probe on six different areas per each hemithorax. A specific pattern for each area was assigned, depending on the prevalence of A-lines (A), non-coalescent B-lines (B1), coalescent B-lines (B2), consolidations (C). A LUS score (LUSS) was calculated after assigning to each area a defined pattern. Results Out of 28 patients, 18 survived, were stabilized and then referred to other units. The prevalence of C pattern was 58.9% on admission and 61.3% at discharge. Type B2 (19.3%) and B1 (6.5%) patterns were found in 25.8% of the videos recorded on admission and 27.1% (17.3% B2; 9.8% B1) on discharge. The A pattern was prevalent in the anterosuperior regions and was present in 15.2% of videos on admission and 11.6% at discharge. The median LUSS on admission was 27.5 [21–32.25], while on discharge was 31 [17.5–32.75] and 30.5 [27–32.75] in respectively survived and non-survived patients. On admission the median LUSS was equally distributed on the right hemithorax (13; 10.75–16) and the left hemithorax (15; 10.75–17). Conclusions LUS collected in COVID-19 patients with acute respiratory failure at ICU admission and discharge appears to be characterized by predominantly lateral and posterior non-translobar C pattern and B2 pattern. The calculated LUSS remained elevated at discharge without significant difference from admission in both groups of survived and non-survived patients.

An optical fiber solution-concentration sensor based on whispering gallery mode (WGM) is proposed in this paper. The WGM solution-concentration sensors were used to measure salt solutions, in which the concentrations ranged from 1% to 25% and the wavelength drifted from the left to the right. The experimental results showed an average sensitivity of approximately 0.372 nm/% and anR2linearity of 0.8835. The proposed WGM sensors are of low cost, feasible for mass production, and durable for solution-concentration sensing.

Abstract Measuring the motion of human hand joints is a challenging task due to the high number of DOFs. In this study, we proposed a low-cost hand tracking system built on action cameras and ArUco markers to measure finger joint rotation angles. The lens distortion of each camera was corrected first via intra-calibration and the videos of different cameras were aligned to the reference camera using a dynamic time warping based method. Two methods were proposed and implemented for extracting the rotation angles of finger joints: one is based on the 3D positions of the markers via inter-calibration between cameras, named pos-based method; the other one is based on the relative marker orientation information from individual cameras, named rot-based method. An experiment was conducted to evaluate the effectiveness of the proposed system. The right hand of a volunteer was included in this practical study, where the movement of the fingers was recorded and the finger rotation angles were calculated with the two proposed methods, respectively. The results indicated that although using the rot-based method may collect less data than using the pos-based method, it was more stable and reliable. Therefore, the rot-based method is recommended for measuring finger joint rotation in practical setups.
