The pros and cons arguments of the possibility of granting legal education to the students on the speciality “Law” in the higher educational establishments with specific learning conditions are considered in the article. There are the following options: 1) the possibility of training on the speciality “Law Enforcement” of investigators, interrogating officers, operatives employees, forensic scientists for the needs of the national police or other public authorities exclusively; 2) the possibility of training on the speciality “Law Enforcement” of investigators, interrogating officers, operatives employees, forensic scientists for the needs of the national police or other public authorities exclusively, but at the same time training of “broad” lawyers on the speciality “Law” at the expense of individuals and legal entities; 3) the possibility of training both on the specialities “Law Enforcement” and “Law” of investigators, interrogating officers, operatives employees, forensic scientists for the needs of the national police or other public authorities and “broad” lawyers on the speciality “Law” at the expense of individuals and legal entities. It is stated that legal education of lawyers in higher educational establishments with specific learning conditions is not only possible but also appropriate. Legislative restriction of the range of educational institutions that can train lawyers leads to a lack of competition as competition is the key to improving quality of education.

The article addresses to the characteristics of the administrative and legal support of the the educational process organization in the Academy of the State Penitentiary Service. With the declaration of independence, Ukraine has paid attention to build a European state with appropriate standards in all spheres of state activity. One of the priority areas of this course is the development of a new functioning system of the structure of law enforcement agencies, including the penitentiary system. For the proper functioning of this institution, professional personnel is needed, who will be the main persons of the development of the new penitentiary system of Ukraine in compliance with the leading standards of the European community. The Academy of the State Penitentiary Service has been established and operates in accordance with the Law of Ukraine “On Higher Education”. The main purpose of the Academy is to train specialists in the field of knowledge “Law”, “Social and Behavioral Sciences” and other fields in order to meet the needs of the State Penitentiary Service of Ukraine, to provide society with qualified specialists with higher education, scientific, scientific and pedagogical staff according to the state order, contractual obligations and thus the new generations formation of national intelligentsia. The educational process in higher educational institutions with specific learning conditions, such as the Academy of the State Penitentiary Service, is carried out in accordance with the legislation on higher education, although general subordination is carried out by the relevant ministry – the Ministry of Justice of Ukraine. Having certain peculiarities in the cadets, students and associate professors’ training, the Academy also prepares students and graduate students at the expense of individuals and legal entities. The main participants in the educational process at the Academy, as well as in any higher educational institution with specific learning conditions, along with research and teaching staff, are cadets (students) (at the expense of legal entities), students (at the expense of individuals), associate professors (graduate students). All higher education obtainers, enrolled in the Academy receive higher education at the first (bachelor’s), second (master’s) and third (educational-scientific) levels. The article addresses to the need for the professional and pedagogical competence formation of future officers who obtain a master’s degree in a higher educational institution with specific learning conditions. The purpose of the article – is to substantiate the need to organize and use an additional master’s course for future officers obtaining higher education in specialties 081 “Law” and 262 “Law Enforcement” in higher educational institutions with specific learning conditions. Methodology. Foundation and analyses of objective conditions for the professional and pedagogical competence formation of future officers, whose professional activities are related to the processes of training, education of members of the rank and commanding staff of military units, law enforcement units, judicial protection, state border protection, human rights protection in bodies and penal institutions, etc. The theoretical and methodological basis of the article are didactic principles and theories of training, as well as a system of interactive methods and tools that ensure the development of pedagogical abilities of future officers. Results. The carried out analysis of publications of national scientists on the researched subject allowed to define real problems which influence reception not only theoretical knowledge, but also the main practical skills and abilities of pedagogical influence application of young officers professionals on members of the rank and commanding staff to create effective official communication, their training and education, building relationships and effective communication process during their professional and service activities. Practical implications. The introduction of the additional course “Higher School Pedagogy” in the educational and professional and educational and scientific program for the obtainers of the second (master’s) level of higher education in specialties 081 “Law” and 262 “Law Enforcement” will promote the development of future officers and provide the required level of readiness for pedagogical activities within the performance of professional and service tasks as well as the implementation of the educational process of the rank and commanding staff. The article highlights that the systematization of legislation is an essential measure on the path to European integration of our country, as well as that the systematization allows improving and streamlining legislation for ease of application and effective implementation in practice. The article reveals that the role of systematization of legislation is to create all the necessary conditions for its further development, to get rid of gaps and shortcomings in it and to ensure its internal unity. The article clarifies that the systematization of legislation creates opportunities to quickly find and correctly interpret all the necessary regulations, which provides a purposeful and effective legal education of society. Systematization of legislation becomes important in reviewing the sources of law, orientation in the system of legislation, for the adoption of new regulations by law enforcement agencies in coordination with all regulations, addressing obsolete acts and finding the most effective means of regulatory regulation of public relations. In the article, the systematization of legislation should be understood as a set of organizational and legal actions defined by the current legislation of Ukraine, which is carried out by authorized public authorities to bring existing regulations into a single internally coordinated system that improves overall efficiency. Systematization is a process of organizing individual elements, creating the right conditions for them to cooperate and interact with each other. Systematization is one of the main factors of purposeful and effective legal education (formation of legal awareness) and research in the field of student education.

We investigate the possibility of introducing criminal liability of legal entities in the Criminal Code of the Russian Federation. We analyze the provisions of regulatory enactment providing for this substantial reform. We consider initiatives and projects proposed by public authorities to amend and supplement domestic legislation. We examine the positions of reputable ex-perts, famous scientists and high-demand practitioners, who express opposite opinions on the initiated correlations and participating in the discussion. We analyze the provisions of the conventions of international organizations pro-viding for the introduction of criminal liability of legal entities in the legisla-tion of member states, due to involvement in corruption crimes, if bribery of foreign officials and corporate corruption were used. The work discusses the provisions of the bill of 2015 finalized by the Investigative Committee of Russia on the introduction of criminal liability for legal entities for the com-mission of crimes contained in the current thirty eight articles of the Criminal Code of the Russian Federation, to which Russian, as well as a number of foreign companies and international organizations represented and separate units. We draw conclusions and make suggestions for further improvement of the Criminal code of the Russian Federation.

The purpose of the study to summarize the experience of modern methods of organizing physical training of law enforcement officers and criteria for assessing physical fitness for joining the police. Results. The article considers topical issues related to the organization of physical training of cadets of higher education institutions of internal affairs bodies. Relevant areas for improving the process of psychophysical readiness are the use of priority sports, increasing the adaptation of freshmen to specific learning conditions, the use of pedagogical technologies, the introduction of new technologies for assessing the physical fitness of cadets and methods of physical training taking into account climatic and geographical conditions. Having conducted a detailed analysis of the state of organization of physical training of police cadets, the negative dynamics of physical training of cadets was established. In senior courses, the level of physical fitness decreases. The results of the scientific research confirm that the physical fitness of more than 40% of entrants is low, there is no motivation to improve their physical capabilities. Only 19.1% of respondents are satisfied with their physical shape. The experience of law enforcement shows that the underestimation of the importance of psychophysical readiness of personnel leads to injuries and wounds of law enforcement officers during the performance of official duties. The modern tendencies of improvement of physical training of police, and necessary conditions for development of professionally important physical qualities of militiamen are studied. A comparative analysis of Ukrainian and foreign experience of professional selection and evaluation criteria of physical fitness to law enforcement agencies. Conclusions. It was found that the priority issues that need to be addressed are the provision of favorable conditions for adaptation of freshmen to specific learning conditions, revision of criteria for assessing physical fitness, professional selection and the need to develop differentiated programs for psychophysical fitness of cadets.

This research aims to analyze the regulation of Civil Servant Investigator based on Regional Regulation No. 6 of 2005 and the implementation of Regional Regulation No. 6 of 2005 concerning Regional Civil Servant Investigator at Office of Kuningan District Civil Service Police Unit. This descriptive-analytical research applied a normative juridical approach. The results showed that based on Regional Regulation No. 6 of 2005, Regional Civil Servant Investigator has the duties of conducting investigation on violations of Regional Regulations in which each Regional Civil Servant Investigator must be equipped with an investigation warrant signed by the supervisor of the Regional Civil Servant Investigator in conducting the investigation. Besides, Regional Civil Servant Investigator also has the duties of providing coaching which includes general, technical, and operational coaching for Civil Servant Investigator. Further, regarding the implementation of Regional Regulation No. 6 of 2005 concerning Regional Civil Servant Investigator at Office of Kuningan District Civil Service Police Unit, the Regional Civil Servant Investigator generally has carried out its duties in conducting investigation and inspection towards illegal buildings, places of business and business activities; conducting investigation and inspection towards community, apparatus or legal entities violating regional regulations, head district regulations, and head district decisions; and preparing material to be submitted to the National Police regarding follow up actions towards community, apparatus or legal entities violating regional regulations, head district regulations, and head district decisions. Thus, it can be concluded that, in general, Regional Regulation No. 6 of 2005 concerning Regional Civil Servant Investigator at Office of Kuningan District Civil Service Police Unit has been implemented well.Tujuan penelitian ini yaitu untuk mengetahui Penyidik Pegawai Negeri Sipil berdasarkan Peraturan Daerah Nomor 6 Tahun 2005 dan implementasi Peraturan Daerah Nomor 6 Tahun 2005 tentang Penyidik Pegawai Negeri Sipil Daerah di Kantor Satpol Polisi Pamongpraja Kabupaten Kuningan. Spesifikasi penelitian yang digunakan adalah penelitian bersifat deskriptif-analitis dengan pendekatan yuridis normatif. Hasil penelitian menunjukkan bahwa pengaturan Penyidik Pegawai Negeri Sipil berdasarkan Peraturan Daerah Nomor 6 Tahun 2005 dijelaskan bahwa Penyidik Pegawai Negeri Sipil Daerah mempunyai tugas melakukan penyidikan atas pelanggaran Peraturan Daerah; setiap Penyidik Pegawai Negeri Sipil Daerah dalam menjalankan tugas penyidikan harus dilengkapi dengan surat perintah penyidikan yang ditanda tangani oleh atasan Penyidik Pegawai Negeri Sipil Daerah; serta pembinaan terhadap Penyidik Pegawai Negeri Sipil meliputi: pembinaan umum, pembinaan teknis, dan pembinaan operasional. Selanjutnya implementasi Peraturan Daerah Nomor 6 Tahun 2005 tentang Penyidik Pegawai Negeri Sipil Daerah di Kantor Satpol PP Kabupaten Kuningan secara umum Penyidik Pegawai Negeri Sipil Daerah telah melaksanakan penyelidikan, penyidikan, dan pemeriksaan terhadap bangunan, tempat-tempat usaha dan kegiatan usaha tanpa izin; melaksanakan penyelidikan, penyidikan, dan pemeriksaan terhadap masyarakat, aparatur atau badan hukum yang melakukan pelanggaran atas peraturan daerah, peraturan bupati, dan keputusan bupati; dan menyiapkan bahan koordinasi kepada Keolisian Negara mengenai tindak lanjut berita acara pemeriksaan warga masyarakat, aparatur atau badan hukum yang melakukan pelanggaran atas peraturan daerah, peraturan bupati, dan keputusan bupati. Kesimpulan penelitian yaitu implementasi Peraturan Daerah Nomor 6 Tahun 2005 tentang Penyidik Pegawai Negeri Sipil Daerah di Kantor Satpol Polisi Pamongpraja Kabupaten Kuningan secara umum sudah dilaksanakan dengan baik.

The expediency of research on the problem of optimizing the educational environment management in higher educational institutions with specific learning conditions that train officers for professional activities considering the gender aspect is due to a number of factors, the main one of which is Ukraine’s desire to integrate into the European and world space, where for the most part is the management of various spheres, including educational one, takes into account the gender principle of equality. The purpose of the article The purpose of the article is to outline the ways to optimize the educational environment management of higher educational institutions with specific learning conditions, taking into account the gender component in the educational process. Results. The article notes that in order to form a future officer as a person and as a representative of the intellectual resource of society, educational management of higher educational institutions with specific learning conditions should take into account the latest approaches, including the gender-oriented one, in order to implement the philosophy of the XXI-st century education. It is concluded that the optimization of educational environment of higher educational institutions with specific learning conditions taking into account the gender marker leads to positive results, namely: overcoming certain socio-pedagogical contradictions, significant contribution to improving the methodological principles of future officers’ training; accelerating the development of a culture of relations between male and female officers on the basis of mutual respect, tolerance, etc. Value. The introduction of a gender component in the educational institutions management with specific learning conditions will ensure the officers’ formation of the new formation, who by their professional and personal qualities will be ready to perform various difficult tasks and decisions making in difficult life situations, and their professional competence will meet the requirements of international educational standards. The necessity of the development and implementation of trainings in the framework of psychological support of personal transformations of future law enforcement officers for the optimization of their professional and personal development in the process of professional self-actuating has been substantiated. The author convinces that the essential factor of prevention of personal and professional crises of law enforcement officers is the formed professional identity, which is an integral part of their professional formation. The development of the value sphere of the personality of law enforcement officers helps to optimize their behavior and self-actuating in such spheres of life as occupation, family life, relationships, hobbies. The motivational component is one of the basic in the system of moral regulation of the activities and behavior of professionals and provides a positive attitude to the chosen kind of professional activity, the desire for self-actuating and achievements, moral and professional settings and interests. Motivation acts as a connecting link between true goals, ideals, beliefs of the personality of a cadet and actions, deeds, decisions that he takes. The psychological support is considered by the author as an integral process of diagnosis, prevention and correction of personal transformations of future law enforcement officers in the process of vocational training, which is carried out in all spheres of their activity in higher educational institutions with specific learning conditions. Trainings as a practice of psychological influence are based on active methods of group work, the use of peculiar forms of learning – knowledge, skills and techniques in the field of communication and future professional activities, diagnosis, prevention and correction. The author has studied the expediency of using training programs for the development of professional identity, the formation of value regulators of behavior and the motivational sphere of future law enforcement officers in higher educational institutions with specific learning conditions that will increase the efficiency of professional activity and self-actuating of police officers in modern conditions.
