AbstractAfter the amendment to the 1945 Constitution of the Republic of Indonesia, the Election of President and Vice President was not conducted by the People's Consultative Assembly but voted directly by the people. Amendment to the provision for the election of President and Vice President have invited debate, partly because they are deemed incompatible with Pancasila. This study examines the appropriateness of the presidential and vice-presidential election based on Pancasila. The research method uses normative juridical, using secondary data obtained through literature study and qualitative analysis. The result and discussion of this research are that the implementation of the election of President and Vice President based is in accordance with Pancasila, especially with the fourth principle.Keywords: Democracy, Direct Election, and Pancasila AbstrakSetelah amandemen Undang-Undang Dasar Negara Republik Indonesia Tahun 1945, Pemilihan Presiden dan Wakil Presiden tidak dilakukan oleh Majelis Permusyawaratan Rakyat tetapi dilaksanakan langsung oleh rakyat. Amandemen terhadap ketentuan untuk pemilihan Presiden dan Wakil Presiden telah mengundang perdebatan, sebagian karena mereka dianggap tidak sesuai dengan Pancasila. Studi ini mengkaji kelayakan ketentuan pemilihan presiden dan wakil presiden berdasarkan Pancasila. Metode penelitian menggunakan metode yuridis normatif, menggunakan data sekunder yang diperoleh melalui studi literatur dan dianalisis secara kualitatif. Hasil dan pembahasan penelitian ini adalah bahwa pelaksanaan pemilihan Presiden dan Wakil Presiden berdasarkan Pancasila sudah sesuai dengan Pancasila, terutama dengan prinsip keempatKata Kunci: Demokrasi, Pemilihan Langsung, Presiden dan Wakil Presiden, Pancasila. АннотацияПосле внесения поправки в Конституцию Республики Индонезия 1945 года выборы президента и вице-президента не проводились Народной Консультативной Ассамблеей, а проводились непосредственно всенародными выборами в Индонезии. Поправки к положениям о выборах президента и вице-президента вызвали дебаты, отчасти потому, что они считаются несовместимыми с Панчасилой. В этом исследовании рассматривается соответствие принятия положений о президентских и вице-президентских выборах на основе Панчасилы. Метод исследования – нормативно-юридический, используя вторичные данные, полученные в результате изучения литературы и проанализируемые качественным методом. Результаты и обсуждение этого исследования заключаются в том, что осуществление выборов президента и вице-президента на основе Панчасилы соответствует Панчасиле, особенно четвёртому принципу.Ключевые слова: Демократия, Прямые Выборы, Президент и Вице-Президент, Панчасила.

The purpose of this research is to find out whether general elections simultaneously have an influence on strengthening presidential systems. To find out the implications of simultaneous elections on elections in Indonesia. The research method in this study uses a normative juridical approach used to study or analyze secondary data in the form of legal materials, especially primary legal materials and secondary legal materials. Primary legal material is the 1945 Constitution of the Republic of Indonesia, Law Number 7 of 2017 concerning General Elections, Decision of the Constitutional Court Number 14 / PUU-XI / 2013 etc. Secondary legal materials are those that provide explanations and interpretations of sources of primary legal materials such as law books, legal journals, and others. Tertiary legal materials are legal materials that provide guidance or explanation of primary and secondary legal materials such as legal dictionaries, encyclopedias, and related documents. The results of the study were argued that the holding of elections simultaneously with the plurality system itself actually tended to produce few presidential candidates. When presidential elections the supporters of candidates in this system tend to ignore candidates who are not competitive (non-viable) so they can focus on the top two candidates. This encouraged a coalition process between parties from the start because there was only one election round. The party that should submit its own candidate but the candidate is less competitive tends to drop the candidate and endorse one of the two most competitive candidates. The plurality system, if implemented separately from the legislative elections, the parties in the legislative elections do not need to think about the influence of the presidential election. This plurality mechanism affects parties when carried out simultaneously with legislative elections. The parties tend to nominate one of the two most competitive candidates, and lead to gathering support for the legislative parties in the two candidates. When one of the candidates wins the presidential election, then support for the president in the legislature tends to be the majority or close to the majority. The combination of the presidential plurality election system carried out simultaneously with legislative elections is the most likely to help strengthen multi-party presidential systems. Thus the simultaneous implementation of elections will strengthen the presidential system in which the President and Vice-President are elected to gain strong legitimacy from the people, in order to realize the effectiveness of government and also the support base of the DPR.

Health is an important aspect and become a measure of the welfare of the people of a country. The development of national development, one of them is in the health sector, must be in accordance with and based on Pancasila and the 1945 Constitution of the Republic of Indonesia. The purpose of this research is to reveal the government's responsibility for handling Covid-19 patients and legal protection for Covid-19 patients medical services in the hospital. The research method used is normative. The assessment is carried out by means of a literature study which is specifically related to law in the health sector. The data sources used were prmiary, secondary and tertiary sources and were analyzed systematically. The result of this research indicates that the responsibility of the government for Covid-19 patients provides rights to patients regulated in related regulations. If the government and parties who violate the rights that should be received by Covid-19 patients, they can be subject to sanctions in accordance with applicable regulations. Legal protection or the issuance of legal rules regarding the rights of Covid-19 patients aims to protect the community itself.

The third time amendments of the constitution Republic of Indonesia 1945 has amended the constitutional system of the position President Republic of Indonesia fundamentally In the article 6 clause 2, The original manuscript the law of the Republic of Indonesia 1945 mention that “The President and the Vice President of Republic of Indonesia are elected by people representative assembly through the most voters. Meanwhile the result of the third amendment as mentioned previously in the Article 6A, paragraph (1) said that “The president and vice president shall be elected in one partner by people directly. The amendment above has changed the authority of People Representative Assembly (MPR) to elect the president and the vice president of the Republic of Indonesia as a representative of people. The change has been a discussion in the people, is the change election the president and vice president which is done by the representative system through People Representative Assembly (MPR) or the direct election which is elected by people. The question, Does appropriate with the value of which contained in the fourth principle of Pancasila? The method of study through the empirical normative. The normative study will use the secondary data, it connects to the legislation, library references and the other supporting data. The empirical means in the study will use primary data that is interview with the experts, academicians, practitioners, even politicians. The conclusion of the study has been analyzed which based on The basis of philosophical, theories even juridical that the changed election system of the President and the vice President from representative to direct election does not appropriate in the fourth principle of Pancasila.

This study aims to assess and analyze: 1). Notary form of responsibility for the validity of the deed under which legalized hand. 2). The strength of evidence by deed under the hand which has been legalized by the Notary in settling disputes in court. 3). The authority of the judge in dismissing deed under the hand that had to notarize a Notary.Research using normative juridical, The collection of primary and secondary data obtained by interview and literature study, then analyzed by qualitative analysis method.Based on the results of this study concluded that: 1). Notary form of responsibility for the validity of the deed under which legalized hand there is the certainty that the signature means certain that the signature was indeed the parties to the agreement and not others. It is said that because of legalizing the letter should be required to know the people who are signing an a way to see his ID such as Identity Card and others. 2). The strength of evidence by deed under the hand which has been legalized by the Notary in settling disputes in court that the evidence is perfect as an authentic deed. Deed under the hand that has obtained the legalization of Notaries has the strength of evidence was perfect, because the deed under the hand of the truth lies in the signatures of the parties. So with the recognition of such signatures, then the contents of the deed was regarded as an agreement between the parties. 3) The authority of judges to cancel the deed under the hand that had to notarize the notary is a judge can only do that if put to him a certificate as evidence. Politicians are fighting over the position of Vice President. However, after becoming Vice President, they could not be active. The Vice President's role is only as a spare tire. Usually, he would only perform ceremonial acts. The exception was different when the Vice President was Mohammad Hata and Muhammad Jusuf Kalla. Therefore, this paper will question: What is the position of the President in the constitutional system? What is the position of the Vice President of Indonesia after the amendment of the 1945 Constitution? Furthermore, how is the role sharing between the President and Vice President of Indonesia? This research uses the library research method, using secondary data. This study uses qualitative data analysis methods in a prescriptive-analytical form. From the research, the writer found that the President is assisted by the Vice President and ministers in carrying out his duties. The President and the Vice President work in a team of a presidential institution. From time to time, the Indonesian Vice President's position has always been the same to assist the President. The Vice President will replace the President if the President is permanently unavailable or temporarily absent. With the Vice President's position who is directly elected by the people in a pair with the President, he/she is a partner, not subordinate to the President. Moreover, due to his/her capacity and support from his/her team, the Vice President must be empowered to benefit the nation and state.

Abstract:The Constitutional Court's Decision is a product of the Judicial Review that was submitted to test the validity of the law against the Constitution of the Republic of Indonesia. In the implementation there are two models of the system of testing the law, namely centralized or decentralized system. Both have fundamental differences because the decentralized review system is not Erga Omnes, while the centralized system has the binding nature of Erga Omnes. The research method uses normative juridical methods, using secondary data obtained through literature study and analyzed qualitatively. The results and discussion of this research are that the Constitutional Court has provided much better direction for Indonesian legal politics, as seen from its objective decisions.Keywords: Erga Ormes, Constitutional Court, Statutory Regulations. Abstrak:Putusan Mahkamah Konstitusi merupakan produk dari Judicial Review yang diajukan untuk menguji keabsahan undang-undang terhadap Undang-Undang Dasar Negara Republik Indonesia. Dalam pelaksanaannya ada dua model sistem pengujian undang-undang yaitu centralized atau decentralized system. Keduanya memiliki perbedaan yang mendasar karena system desentralisasi review tidak bersifat Erga Omnes, sedang system centralized memiliki sifat mengikat Erga Omnes. Metode penelitian menggunakan metode yuridis normatif, dengan menggunakan data sekunder yang diperoleh melalui studi pustaka dan dianalisis secara kualitatif. Hasil dan diskusi dari penelitian ini adalah bahwa Mahkamah Konstitusi telah banyak memberikan arah politik hukum Indonesia yang lebih baik, terlihat dari putusan-putusannya yang bersifat objektif.Kata Kunci: Erga Ormes, Mahkamah Konstitusi, Peraturan Perundang-Undangan

This paper is a literature study using a historical approach that takes primary and secondary data from the writings of Mohammad Hatta, autobiography, and writing about Mohammad Hatta. Hatta was one of the important figures for the birth of the Republic of Indonesia who participated in the independence struggle. Hatta is also known as a thinker whose broad spectrum includes economics, philosophy, ideology, politics, social, culture, religion, and education. Religion became an integral part of Hatta since childhood. Islam for Hatta became the basis of personal values ​​that guide behavior. Likewise, religion has a role in developing social, political, and social life. Hatta's Islamic thought style was more substantially patterned, rather than formative. Education was also an identical part of Hatta since the struggle for Indonesian independence. The political task in the main colony is to educate the people to understand their duties, rights, and responsibilities so that new cadres of leaders can be born. After Indonesia's independence, the issue of education became one of the concerns of Hatta. Education for an independent country is an investment in the future of a country.

<p>People’s Consultative Assemly (hereinafter reffered to <em>MPR</em>) membership consisting of members of the House of Representative (hereinafter reffered to <em>DPR</em><em>)</em> and Regional Representative Council (hereinafter reffered to <em>DPD</em><em>)</em> members indicates that the <em>MPR</em> is still viewed as a representative body of the people because of its membership elected in the general election. The change of position of the People's Consultative Assembly (<em>MPR</em>), then the understanding of the form of popular sovereignty is reflected in three branches of power, namely the representative institution, the President, and the holder of the judicial power. Problem formulation discussed are: 1) How is the position of the People's Consultative Assembly as the implementer of people's sovereignty in Indonesia before the amendment of the 1945 Constitution? 2) How the position of MPR members coming from the <em>DPD</em> after the Amendment of the 1945 Constitution of the Republic of Indonesia. The research method used in this research is Normative Law research method, which uses secondary data. The discussion in this research: 1) the MPR as the executor of the sovereignty of the People in Indonesia, prior to the 1945 amendment, we see in the provisions On Article 1 paragraph (2) of the 1945 Constitution stipulates that: "Sovereignty is in the hands of the people, and carried out according to the law basic". In the above article it contains three meanings, namely: a). The sovereignty of the people is implemented by all state institutions established in the Constitution, b). The sovereignty of the people must be subject to the constitution, c) constitutional supremacy. People's sovereignty is limited by the rules of the Constitution and constitutional democracy. 2) Position of MPR members originating from DPD after the Amendment of the 1945 Constitution of the Republic of Indonesia. After the fourth amendment of the 1945 Constitution, (hereinafter referred to as the 1945 Constitution of the Republic of Indonesia), there is a fairly fundamental change in both the state administration system and the state institutions in Indonesia .</p>

This article discusses about the influence of KH. Hasyim Asy'ari regarding his efforts in building and maintaining the integrity of the nation, both in the Islamic and national fields and his role in resolving the Islamic context at the International level (Hijaz). The research method used is literature study by means of descriptive content analysis. The results of this study indicate that KH. Hasyim Asy'ari is a figure who has a great influence in regulating national and Islamic stability both in thought (aqliyah) and movement (amaliyah) so that it stands the Unitary State of the Republic of Indonesia. Besides that, the important role of KH. Hasyim Asy'ari is both as an advisor and a legitimator in an effort to preserve the purity of Islam at the international level, namely the polemic of the sovereigns in the Hijaz land. The influence in the archipelago includes: the da'wah ukhuwah Islamiyah as a form of tolerance, the value of leadership towards the people and nation, intellectual contributions as Muslim scholars, influence and commitment against the invaders while his influence at the international level is to maintain the purity and benefit of the world Islam (Hijaz).

Election of President and Vice President of the Republic of Indonesia Year 2014 (2014 presidential election) was held on July 9, 2014 to elect the President and Vice President of Indonesia for the period 2014-2019. Efforts towards the award process, the politicians do the propaganda and agitation against the people (voters) in order that the candidate from the party that wins diusungnya at a general election. This is where the strategy is needed as a vehicle for political dynamic development and as a means to the goal in question.The problems of research that is how political marketing Joko Widodo-Jusuf Kalla on winning the presidential election of 2014 in the city of Batam. The purpose of this study was to determine political marketing Joko Widodo - Jusuf Kalla on winning the presidential elections in 2014 in the city of Batam. The benefits of this research is theoretically and practically.The method used in this research is using the qualitative approach with descriptive approach. Data collection techniques used in this study is observation, interview and dokumnetasi.The results of the study describes the Winning Strategy Joko Widodo-Jusuf Kalla On Presidential Elections of 2014 in the city of Batam (Case Study Sagulung Subdistrict, District Batam City and District Bengkong). Victory Joko Widodo-Jusuf Kalla in the 2014 presidential election in Batam will be seen from the process of political marketing that product offered, promotion is done, the selling price, a prioritized and market segmentation. From the research that has been done can be concluded that the victory of Joko Widodo-Jusuf Kalla at the presidential election in 2014 in the city of Batam, influenced by products that offer is to build elektabilitas candidate in the eyes of society, promotion done is to convey the benefits of its products to the public in the form of banners, billboards , tabloids and pamphlets. Selling prices here focuses on the psychological price to image nationally be a price to pay. Place priority aims to establish communication with the voters as the campaign must touch all levels of society. Market segmentation is done is to investigate complaints of people who are not uniform. To get the victory Joko Widodo-Jusuf Kalla, the more accurate the 2014 presidential election should be held for further research in terms of other strategies. Upaya menuju proses pemenangan, para politisi melakukan propaganda dan agitasi terhadap masyarakat (pemilih) agar calon dari partai yang diusungnya menang pada saat pemilihan umum. Di sinilah strategi dibutuhkan sebagai wahana perkembangan dinamika politik dan sebagai alat menuju cita-cita yang dimaksud.Rumusan masalah dari penelitian yaitu bagaimana marketing politik Joko Widodo-Jusuf Kalla pada pemenangan pemilihan Presiden Tahun 2014 di Kota Batam. Tujuan dari penelitian ini adalah  untuk mengetahui marketing politik  Joko Widodo-Jusuf Kalla pada pemenangan pemilihan presiden tahun 2014 di Kota Batam. Manfaat dari penelitian ini yaitu secara teoritis dan secara praktis.Metode yang digunakan dalam penelitian ini adalah menggunkan pendekatan kualitatif dengan pendekatan deskriptif. Teknik pengumpulan data yang digunakan dalam penelitian ini adalah observasi, wawancara dan dokumnetasi.Kemenangan Joko Widodo-Jusuf Kalla pada Pilpres 2014 di Kota Batam akan dilihat dari proses marketing politik yaitu produk yang ditawarkan, promosi yang dilakukan, harga jual, tempat yang diprioritaskan dan segmentasi pasar. Dari penelitian yang telah dilakukan dapat disimpulkan bahwa kemenangan Joko Widodo-Jusuf Kalla pada  pilpres 2014 di Kota Batam, di pengaruhi oleh produk yang tawarkan adalah untuk membangun elektabilitas calon dimata masyarakat, Promosi yang dilakukan adalah untuk menyampaikan keunggulan produknya kepada masyarakat  baik berupa spanduk, baliho, tabloid dan pamplet. Harga Jual disini menitik beratkan pada harga secara psikologis hingga citra secara nasional menjadi harga yang harus dibayar. Tempat yang diprioritaskan bertujuan untuk membangun komunikasi dengan pemilih karena kampanye harus menyentuh semua lapisan masyarakat.  Segmentasi pasar  dilakukan adalah untuk mengetahui keluhan-keluhan masyarakat yang tidak seragam. Untuk mendapatkan proses kemenangan Joko Widodo-Jusuf Kalla yang lebih akurat pada pilpres 2014 perlu diadakan penelitian lebih lanjut yang ditinjau dari strategi lainnya. Kata Kunci : Pemilihan Umum, Marketing, Strategi, Politik, Pemilihan Presiden
