Поправки к положениям о выборах президента и вице-президента вызвали дебаты, отчасти потому, что они считаются несовместимыми с Панчасилой. The purpose of this research is to find out whether general elections simultaneously have an influence on strengthening presidential systems. To find out the implications of simultaneous elections on elections in Indonesia. The research method in this study uses a normative juridical approach used to study or analyze secondary data in the form of legal materials, especially primary legal materials and secondary legal materials. Primary legal material is the 1945 Constitution of the Republic of Indonesia, Law Number 7 of 2017 concerning General Elections, Decision of the Constitutional Court Number 14 / PUU-XI / 2013 etc. Secondary legal materials are those that provide explanations and interpretations of sources of primary legal materials such as law books, legal journals, and others. Tertiary legal materials are legal materials that provide guidance or explanation of primary and secondary legal materials such as legal dictionaries, encyclopedias, and related documents. The results of the study were argued that the holding of elections simultaneously with the plurality system itself actually tended to produce few presidential candidates. When presidential elections the supporters of candidates in this system tend to ignore candidates who are not competitive (non-viable) so they can focus on the top two candidates. This encouraged a coalition process between parties from the start because there was only one election round. The party that should submit its own candidate but the candidate is less competitive tends to drop the candidate and endorse one of the two most competitive candidates. The plurality system, if implemented separately from the legislative elections, the parties in the legislative elections do not need to think about the influence of the presidential election. This plurality mechanism affects parties when carried out simultaneously with legislative elections. The parties tend to nominate one of the two most competitive candidates, and lead to gathering support for the legislative parties in the two candidates. When one of the candidates wins the presidential election, then support for the president in the legislature tends to be the majority or close to the majority. The combination of the presidential plurality election system carried out simultaneously with legislative elections is the most likely to help strengthen multi-party presidential systems. Thus the simultaneous implementation of elections will strengthen the presidential system in which the President and Vice-President are elected to gain strong legitimacy from the people, in order to realize the effectiveness of government and also the support base of the DPR.

According to popular parlance, we elect a President and vice-president, on the Tuesday following the first Monday of November of each fourth year, by vote of the people. It is well known however that, technically speaking, we do not choose these officers on that day or at any time by popular suffrage. Instead of that, we choose in each state a committee that is called the electoral college; and these electors meet on the second Monday of January and elect the President and vice-president by ballot. The theory of the Constitution is that these electors are not to be pledged or obligated to vote for any particular person, but that they and not the people shall really make the choice. But, practically from the start, and contrary to the expectation of those who framed the Constitution, the choice of President and vice-president was seized by state legislatures and afterwards transferred to the people, through the device of appointing electors that were virtually pledged to designated candidates. So the electoral colleges have failed of their purpose and become a useless complication. And not only are they useless, but objectionable also and dangerous in many and serious ways. This paper will endeavor to show that our present system of presidential election is bad in every step of the process, viz. in a. the appointment of the electors, b. the membership and proceedings of the electoral colleges, c. the count of the vote in congress, d. the interval between the election and the time when the President takes office, and e. the election by the house of representatives in case the electors fail to give a majority vote to any candidate.

This chapter argues that Niccolò Machiavelli considers the Roman leaders' use of pagan religion to maintain popular support as pernicious. It enabled the leaders of the people to put this religion to a very different purpose. The successive innovations of aspiring tyrants strengthened such appeals and eventuated in the destruction of the republic. Christianity transcends the methods of Caesar and the Gracchi in a critical way. Christ's followers pique the passions of the people not merely with lands that many Romans have not seen, but with domains beyond human experience. This appeal to transcendence trumped all the benefits the city of Rome could offer. When the Roman people accepted the imported doctrine, they no longer needed to devote themselves to the earthly city to receive their rewards, and thus “civil life” was utterly transcended in Rome. Therefore, only when the critical element of a promise of divine provision was added to the familiar litany of private benefits did the line of ingenious aspiring tyrants, who wished to transcend civil life, achieve its goal.

Attitudes towards a departing administration can help shape attitudes towards candidates, especially when the incumbent vice-president is one of the candidates. This succession effect was apparent in the 1988 presidential election, when Vice-President Bush benefited from the enduring popularity of retiring President Reagan. This article develops a model in which succession effects, the net candidate score and party identification affect the general election vote. Analysis shows that this effect remains when controls are instituted for retrospective voting more generally. Attitudes towards Reagan also had an indirect impact by affecting the net Bush-Dukakis candidate score; altogether the estimated impact of the Reagan effect in 1988 was to turn the vice-president's predicted loss into his observed victory. Additionally, a succession effect was detected in the 1988 nominating campaign, with Bush's popularity over Dole benefiting from reactions to the Reagan administration. There is evidence of succession effects in other presidential elections, particularly a Johnson effect in 1968.

ABSTRACTElections are a means of implementing the sovereignty of the people regulated in the 1945 Constitution. In the implementation of indirect democracy, a representative democratic system is inevitable, so that elections that uphold direct, public, free, secret, honest and fair spirit are a means of regenerating leadership politics to run the government both at central and regional levels. People as the owner of the highest sovereignty surrender their sovereignty to state institutions such as the President, DPR, DPD, and DPRD through elections. After the change in the 1945 Constitution there was a shift in the regulation of popular sovereignty such as the MPR is no longer the executor of popular sovereignty, the implementation of direct presidential elections by the people, until the emergence of the Constitutional Court that can try and decide the president and vice president to stop in his term of office. All of this is an effort to uphold the people's sovereignty and at the same time to maintain the people's sovereignty based on the 1945 Constitution. The Constitution of the Republic of Kosovo in its basic provisions has constituted the principle of separation and control of the balance between state powers as a fundamental principle of democracy, by designating representative bodies belonging to state powers such as Parliament, Government, and Judiciary. In addition, the Constitution sanctions other state bodies that have a constitutional character and together create the form of governance in the Republic of Kosovo. Among them also the President functions as a constitutional body exercising the executive duty and having ceremonial competencies. The President in Kosovo is a neutral authority because he/she is a representative of the people’s unity. The authorities in Kosovo create a "check and balance" among themselves for the normal functioning of the state. Kosovo is considered a parliamentary Republic, not sanctioned by the constitution but implied based on the decision of the Parliament of the Republic of Kosovo. In addition to electing the Government, the Parliament also elects the President of the Republic, so in this study, we will address the function of the President, the exercise of his duties, his competencies, and his relationship with other state bodies. We will also analyze the system of governance and the principle of separation and balance of powers, with special emphasis on the constitutional position of the President in the Republic of Kosovo. Among other things, we will address in particular the complexity of the procedures for the election of the President of the Republic of Kosovo. Considering the ongoing problems that have accompanied the presidential elections in the Republic of Kosovo and that continue to be so, it is necessary to clarify whether “the constitutional reform initiative for the President of the Republic of Kosovo to be voted by the people is considered the most current and best way of overcoming the present parliamentary stalemate in the election of the candidate for the President of the Republic, as well as whether the implementation of this reform is conditioned by the will of the political parties and the people”. In general, from the stated scientific elaboration of the topic, we can conclude that the intention of this paper consists in determining the constitutional regulation of the institution of the President of the Republic of Kosovo applied in the parliamentary system, empirical elaboration of problems that accompanied the election of presidents in the Republic of Kosovo as well as the immediate need to change the manner of electing the President of the Republic of Kosovo.
