This paper describes the polemic of the distribution of waris for foster child in the study of Islamic law and the laws and regulations in Indonesia. The distribution of estate to foster child was regulated in article 209 in the Compilation of Islamic Law (KHI). Thus, this is a signal that the influence of customary law and Western law had entered in KHI . Therefore, by this paper, Author would like to emphasize that the distri­bu­tion of waris to the foster child by using the concept of wasiat wajibah in KHI is wrong. It is not based on the shari'ah (qath‘iy al-dilâlah), but rather based on logic of the law and humanitarian considerations, and it is zhan­niy al-dilâlah. Thus, author sure that the distribution of waris by one third (1/3) of estate to the foster child by using the concept of wasiat wajibah is an erroneous ijtihad, cotradiction with the texts, and could be detrimental to the main heirs.

Colonial law in Africa involved European moral and legal codes representing some rules of western law, as well as elements of African customary law. However, the colonial situation embodying political and economic domination necessarily negated the ideal practice of the rule of law. Nevertheless, the need arose to introduce some aspects of western law and codes of administration, including salary and benefits schemes for African employees of the colonial government, and legal entitlements such as court trials for accused government employees. These considerations were deemed necessary, if at least to propitiate metropolitan critics of the colonial establishment. Also some rule of law was required for the organization of the colonial economy, including regulation of productive systems and commercial relations. As well, the need for indigenous support necessitated dabbling in indigenous customary conventions. In Muslim polities such as Kano in northern Nigeria, customary conventions included Islamic law.On the establishment of colonial rule in Kano, judicial administration was organized on three principal institutions, involving the resident's provincial court, the judicial council (emir's court), and the chief alkali's court in Kano City with corresponding district alkali courts. The resident's provincial court had jurisdiction over colonial civil servants, including African employees such as soldiers, police constables, clerks and political agents. Also, the provincial court was responsible for enforcing the abolition of the slave trade in the region. The judicial council, classified as “Grade A” court, was composed of the emir, thewaziri(chief legal counselor), the chiefalkaliof Kano (chief judge), theimam(the religious leader of Kano mosque), thema'aji(treasurer), and general assistants including some notable scholars of Kano city. The council adopted thesha'ria(Muslim law) and local Hausa custom, and its jurisdiction extended over “matters of violence, questions of taxation and administration, and cases involving property rights, whether over land, livestock, trade goods, or slaves.” On the issue of capital sentencing, the judicial council required the approval of the resident. The council was also prohibited from authorizing punishments involving torture, mutilation, or decapitation.

The purpose of this study was to find out what sirri marriage laws according to Islamic Law and Positive Law, to find harmony and marriage requirements and to find out how the role of Religious Court of Palangka Raya in socialization confirmation marriage. The method used in this research is the method of legal normative. As for the type of research used in this study is inventory regulations that related to confirmation of marriage legalized marriage sirri according to Positive Law and Religious Law. Law wedding sirri results according to Islamic Law and Positive Law, sirri marriage according to Islamic Law illegitimate because it does not have a guardian of marriage, while marriage sirri in the view of the majority of Indonesian society is marriage not recorded but the terms and illegitimate pillars have been met in accordance with Islamic Law. Meanwhile, according to the law of the wedding positive sirri is as where according to Marriage Law in Indonesia if a legal marriage in syar'i then legitimate also according to law "marriage is not recorded" is legal according to the laws and regulations because according to Islamic Marriage Law applicable in Indonesia is based on Article 2 (1) of Law No. 1 of 1974 in conjunction with Article 4 Compilation of Islamic Law (as ius constitutun) in conjunction with Article 3 bill-HM-PA-Bperkw 2007 (as ius constituendum).

This paper explains about the application of inheritance law in Indonesia which is strongly influenced by three law systems such as Islamic law, customary law, and Western law. At the beginning of Islam in Indonesia, Islamic law is very dominant in the implementation of Islamic inheritance law which is intergrated with culture and tradition among Muslim society. In Colonial period, the government of Dutch East Hindia started to establish Western law for European and East Asian people. But for the Muslim citizens in Indonesia was implement­ting the combination of Islamic law and customary law. In the independence period, the political of law has been changed through unification and codification of Islamic law into the Indonesia rules formally, including in the application of Islamic inheritance law. As long as this policy, Islamic inheritance law in Indonesia has a characteristic of the combination between Islamic law and customary law.

This study aims to describe the marriage agreement based on legal norms, morality norms and religious norms prevailing in the Indonesian society. This normative research produces three conclusions. First, marriage agreements that do not violate the law are agreements that fulfill the legal requirements under the Civil Code and the provisions of Law Number 1 Year 1974. Second, marriage agreements that do not violate religion are agreements whose substance does not conflict with Islamic law. Third, a marriage agreement that does not violate morality is a marriage agreement that does not violate the norms of decency in general or customary law that applies to society.

ABSTRAKPenelitian dengan judul ”Hukum Waris Islam Di Indonesia (Studi Perkembangan Hukum Kewarisan Dalam Kompilasi Hukum Islam Dan Praktek Di Pengadilan Agama )”Penelitian ini menggunakan pendekatan yuridis normative, dalam pengumpulan data lebih ditekankan pada sumber bahan primer, berupa peraturan perundang-undangan, menelaah kaidah-kaidah hukum maupun teori ilmu hukum yang terkait dengan masalah yang di teliti.Berdasarkan metode tersebut penelitian menghasilkan pada pokoknya : (1) Formulasi hukum kewarisan islam dalam fiqih dan Kompilasi Hukum Islam (a) Formulasi hukum kewarisan Islam dalam fiqih pada al quran dan al hadist yaitu : Al quran, QS. An-nisa (4): 7, QS. An-nisa (4): 11, QS. An-nisa (4): 12, QS. An-nisa (4): 33, QS. An-nisa (4): 176, QS. Al-anfal (8): 75, dan Hadist Rasulullah SAW (b) Formulasi hukum kewarisan Islam dalam Kompilasi Hukum Islam di atur dalam Pasal 171 sampai dengan Pasal 193.(2) Perkembangan hukum kewarisan Islam dalam Kompilasi Hukum Islam di banding dengan kewarisan dalam fiqih yaitu banyak memasukkan unsur-unsur hukum adat dan kepentingan-kepentingan yang dibutuhkan masyarakat Indonesia masa sekarang, maka banyak bentuk-bentuk hukum kewarisan yang belum tertuang dalam fiqh konvensional (fiqh al-mawarits), namun hal itu telah termuat dan terkodifikasikan dalam hukum kewarisan Kompilasi Hukum Islam, antara lain: pasal 171 tentang harta bersama, pasal 177 tentang pembagian ayah secara `ashabah, pasal 209 yang menyatakan bahwa ayah angkat dan anak angkat menerima warisan, dan bila mereka tidak menerima wasiat, maka berhak menerima wasiat wajibah dan Kopilasi Hukum Islam pun mengakui harta gono-gini padahal fiqh tidak mengakui; (3) Perkembangan hukum kewarisan Islam dalam praktek putusan pengadilan agama di Indonesia hal ini tidak lepas dari Kompilasi Hukum Islam merupakan intruksi Presiden No. 1 Tahun 1991 tanggla 10 Juni 1991, sehingga perkawinan, kewarisan, dan wakaf bagi pemeluk-pemeluk Islam telah ditetapkan sehingga dapat dijadikan pengadilan agama sebagai “pedoman” dalam artian sebagai sesuatu petunjuk bagi para hakim Peradilan Agaman dalam memutus dan menyelesaikan perkara, maka kedudukannya adalah tergantung sepenuhnya dari para Hakim dimaksud untuk menuangkannya dalam keputusan-keputusan mereka masing-masing sehingga kompilasi ini akan terwujud dan mempunyai makna serta landasan yang kokoh dalam yurisprudensi Peradilan Agama. Dengan cara demikian, maka Peradilan Agama tidak hanya berkewajiban menerapkan ketentuan-ketentuan yang sudah digariskan dalam kompilasi, akan tetapi justru mempunya peranan yang lebih besar lagi untuk memperkembangkan dan sekaligus melengkapinya melalui yurisprudensi yang dibuatnya..Kata kunci : Hukum waris Islam, hukum Kewarisan, Kompilasi Hukum Islam ABSTRACTThe research entitled "The Law of Inheritance of Islam in Indonesia (Study of Legal Development of Inheritance in Compilation of Islamic Law and Practice in Religious Courts)" This research uses normative juridical approach, in collecting data more emphasized on primary source material, in the form of legislation, - the rule of law and the theory of jurisprudence associated with the problem in the perusal.Based on these methods, the research produces basically: (1) Formulation of Islamic inheritance law in fiqh and Compilation of Islamic Law (a) Formulation of Islamic inheritance law in fiqih on al quran and al-hadist namely: Al Quran, QS. An-nisa (4): 7, QS. An-nisa (4): 11, QS. An-nisa (4): 12, QS. An-nisa (4): 33, QS. An-nisa (4): 176, QS. Al-anfal (8): 75, and Hadith Rasulullah SAW (b) The formulation of Islamic inheritance law in the Compilation of Islamic Law is set in Articles 171 to 193. (2) The development of Islamic inheritance law in the Compilation of Islamic Law in appeal to inheritance in fiqih which includes many elements of customary law and the interests that are needed by Indonesian society today, so many forms of inheritance law that has not been contained in the conventional fiqh (fiqh al-mawarits), but it has been contained and codified in the law of inheritance The Compilation of Islamic Law, among others: article 171 on common property, article 177 on the division of fathers asabah, article 209 which states that foster and adopted sons receive inheritance, and if they do not receive a will, it is entitled to a mandatory and compulsory law Islam also recognizes the property gono-gini fiqh although do not recognize; (3) The development of Islamic inheritance law in the practice of religious court ruling in Indonesia is not separated from the Compilation of Islamic Law is the Presidential Instruction. 1 In 1991 on 10 June 1991, so that marriage, inheritance and endowments for the followers of Islam have been established so that it can be used as religious courts as a "guide" in the sense that a guide for the judges of the Religious Court in deciding and settling the case, depends entirely from the Judges intended to put it in their respective decisions so that this compilation will materialize and have a firm meaning and foundation in the jurisprudence of the Religious Courts. In this way, the Religious Judiciary is not only obliged to apply the provisions outlined in the compilation, but it has a greater role to develop and at the same time complete it through the jurisprudence it makes.Keywords: Islamic inheritance law, law of Inheritance, Compilation of Islamic Law

As social beings, social relations are fundamental and inseparable. Social interaction that has many differences requires the existence of a specific guidance or law adopted by the community. The law is for the sake of realizing a sense of security and assured in establishing community relations, as well as to realize a good social relationship, harmonious and without having to harm others. A specific form of guidance in society is the agreement. Indonesia has three sub-systems of law that are broadly divided into namely western law, customary law, and Islamic law. The procurement of agreements in order to increase security and certainty is already inevitable in the modern era, which is rapidly growing as it is today. Therefore, before entering into an agreement, it is necessary to comply with all conditions of the validity of the agreement in order for the agreement to become valid as a law so that the purpose of the agreement can be reached. One of the terms of the validity of the treaty that is "lawful cause" is an important thing to be studied deeply by the parties who make the contract because of the difference of the legal system in its environment (Indonesia) is mainly the conventional agreement system which is used as the standard of legislation in Indonesia and the system Islamic agreement or sharia that is used as the guidance of the majority of Indonesian people who are Muslims, so that there are no things that do not want inflicted in the future

Money politics is a political disease that is increasingly prevalent today. Money politics is a part of the bribery offense. In general, the criminal act of bribery is considered a violation in the world of politics, thus requiring money politics to also be considered a violation. In absolute terms, state laws and regulations explicitly prohibit this action, but this practice is rampant nonetheless. In Sharia law there is often discussion about risywah which is in the form of the millennial period which is reflected in the money political mechanism. However, Jurisprudence scholars in general still disagree over the law of certainty risywah. The editor of the Prophet's Hadith said that Rasulullah Saw. cursing the perpetrator and the recipient of the bribe. However, various interpretations of the scholars have resulted in an imbalance between positive legal regulations and Islamic law. By combining two legal decisions through the study of Ushūl Fikih with Saddu ad-Dzāriah's approach. This study will discuss legal decisions regarding risywah from a different perspective and prove that there is no imbalance between the two.

The dynamics of polygamy are not uncommon to talk about, considering that polygamy is widely practiced by the public and the actions of polygamy are not in accordance with the existing laws and regulations or laws in Indonesia. Many actions of polygamy violate the existing rules, one of which is the existence of marriage outside the KUA conducted secretly. A family will never achieve happiness in the world without the descendants born from the bond of marriage. Indonesia is one country that is able to see and interpret the actions of polygamy that occur outside the court or without the knowledge of the first wife. This is triggered by the desire of a husband who wants to polygamy or gets married for the second time. Talking about a marriage that is not always happy, can even bring a disaster, both on the part of a wife and a husband. One way is to get offspring from the marriage. In scientific studies that will be the focal point is about the reason for a husband to carry out acts of polygamy, both in Islamic provisions and in the provisions of the law. The method in scientific studies here uses qualitative methods with normative juridical research types and the nature of descriptive analysis research, as well as using an inductive thinking framework.

There are three kinds of inheritance law in Indonesia, namely Islamic inheritance, Customary inheritance and BW inheritance. The scope of this writing is limited to customary inheritance law. The parts of customary law have a big influence on customary inheritance law and vice versa. Customary inheritance law has its own characteristics and characteristics that are unique to Indonesia, which is different from Islamic law and western law (BW). Because the difference lies in the natural background of the Indonesian people who have the philosophy of Pancasila with a society that is Bhinneka Tunggal Ika. The inheritance law that exists and applies in Indonesia to date is still not in the form of legal unification. The purpose of this study is to analyze the inheritance system according to the customary inheritance law related to the kinship system in Indonesia.The type of research used in this research is normative juridical research, namely research on legal systematic is research conducted on primary and secondary legal materials, the terms of reference used are the basic definitions contained in the legal system. The approach used is a conceptual approach, a statute approach and a case approach. Types of Legal Materials are primary legal materials and secondary legal materialsThe results of this study indicate that the inheritance system according to the Adat Inheritance Law does not refer to the kinship system of the customary law community. Customary law communities whose system of collective inheritance can occur are parental kinship systems. Heritage assets related to inheritance must be distinguished from the origin of the assets, because they are related to the kinship system that exists in the local customary law community, whether parental, patrilineal or matrilineal, because not all inheritance can be divided individually.

This article aims to study the transformation of Islamic Shari’a values in the foundation of the law legislation in Indonesia. This study is legal-normative in which, in its analyzing phases, it uses both qualitative techniques of primary and secondary legal materials. The findings of this study indicate that the Islamic Shari’a values have been actualized in the laws and regulations in the elimination of domestic violence in Indonesia. Transformation of Islamic Sharia values is conducted through two approaches, namely through the principles of the content of legislation, and actualization through the material legislation.
