Consciousness, knowledge, and understanding in Islam are a fundamental prerequisite for all Muslims to allow them to affirm, think, and behave under the principles of religion. Muslim women and girls have been seen for years as potential objects of modernization and modernity. Popular belief has arisen that, for a nation to be prosperous, girls need to be educated and will raise their nation from its broad range of social issues. Women's education was indispensable to the discourses that pursued to modernize emerging and Muslim societies. Muslim women thought it was just as important to educate girls as it was to educate boys, and that they acknowledged parental and marital influence over the rights of women to be educated and to work. As Muslim women move up the educational ladder, the role of religion as a predictor of academic achievement is dwindling. This emphasis on the experiences of educated Muslim women exacerbates the prevailing narrative of modernity that portrays women's education and gender equality as an expression of individual women's choice and free will against any patriarchal structures of family, culture, and Islam. The experiences of refugees are heavily mediated by race and ethnicity, and international law plays a significant role in this mediation—in some cases offering important protections, and in others entrenching discrimination and exclusion. This Chapter makes four contributions. First, it articulates a structural and intersectional account of race, racial discrimination and xenophobic discrimination as essential starting points for international legal analysis of race and refugees. This analysis includes the overlap and distinctions between racial and xenophobic discrimination, as well as the role of religion, class and gender in shaping racial discrimination against refugees. Secondly, it reviews the doctrine on race and refugees in international refugee law and international human rights law, and maps the attendant academic literature analyzing this law. Thirdly, the Chapter canvasses legal scholarship that has examined the structure, history and development of the international refugee regime in relation to race. Finally, it concludes with reflections on a research agenda on race and refugees.

This chapter explores in considerable detail differences and similarities between the Islamic legal tradition and international law. It discusses in detail the historical interaction between these legal traditions, their co-evolution, and the academic conversations on this topic. The chapter also addresses the Islamic milieu’s contributions to international law, and sources of Islamic law including the Quran, sunna, judicial consensus, and analogical reasoning. It talks about the role of religion in international law. Mapping the specific characteristics of Islamic law and international law offers a glimpse of the contrasting and similar paradigms, spirit, and operation of law. This chapter identifies three points of convergence: law of scholars, customary law, and rule of law; as well as three points of departure: relation between law and religion, sources of law, and religious features in the courtroom (religious affiliation and gender of judges, holy oaths).

Can participation in a religious rehabilitation program benefit a released prisoner’s reentry into the community, and if so, how? Which elements of the religious worldview can be translated into tools for promoting desistance? Using a qualitative approach, we conducted 30 interviews with released prisoners from 3 months to 5 years beyond release who participated in a Jewish faith-based rehabilitation program administered by Israel’s Prisoner Rehabilitation Authority. We interviewed participants in the Torah Rehabilitation Program about the role of religion in their lives and in their desistance from crime. We map out the spiritual, behavioral, and psychological tools they feel aided them in facing the challenges of reentry.

Abstract This piece dialogues with Htun and Weldon's exceptional new book, The Logics of Gender Justice, as it relates to LGBTI rights. Beyond engaging the authors' questions of when and why governments promote women's rights, I also engage their argument that equality is not one issue but many linked issues, including issues of sexuality and gender identity. My own reflections on their work thus address the contributions the book makes to the study of political science, as well as open questions about how their logic of gender justice might apply across other issue areas less explored in the book. Htun and Weldon's own definition of gender justice also rightly includes space for LGBTQI people, which I see as an invitation to think through the typology in relation to these communities. The piece begins by reflecting on the book's theoretical and methodical innovations around the complexities of gender politics, before moving on to the multi-faceted role of religion in gender justice, and then theoretical assumptions around visibility of the marginalized.

Abstract: Based on a survey carried out with middle-class, married, practicing and non-practicing Muslim women living in Istanbul, this work is focused on female relational networks, their link to cooking and gender relations. The article argues that the disruptions, modifications and accommodations put in place by women and men in their management of everyday life are reflected through daily food practices. The study emphasises the pivotal role of older women in the changes in male/female relationships. The disruptions do not seem to be based on one’s positional relation to religion, but rather on one’s belonging to age, class, or social status.Résumé : Fondé sur une enquête réalisée avec des femmes de la classe moyenne, mariées, musulmanes pratiquantes et non-pratiquantes et résidant à Istanbul, ce travail s’est intéressé aux réseaux relationnels féminins, à leur lien au culinaire et aux relations de genre. Par le biais des pratiques alimentaires sont ainsi abordés les ruptures, les évolutions et accommodements mis en place par les femmes et les hommes dans leur gestion du quotidien. L’article insiste sur le rôle pivot des aînées dans les changements des rapports homme / femme. Les fractures ne semblent pas fondées sur le positionnement vis-à-vis de la religion, mais bien plutôt sur l’appartenance à une classe d’âge, ou à une classe sociale.

In recent years many Muslim-majority countries have undergone troubled and even tragic political transitions. A key feature of most transitions has been heightened debate over the place of women in public life, and the role of Shari‘a and Islamic ethical traditions in defining women’s roles. This chapter examines the pervasiveness of Shari‘a appeals in today’s transitions, in particular with regard to the Southeast Asian nation of Indonesia. It presents a general model for the analysis of Islamic law and ethical plurality, and then explores the model in relation to the history of Islamic law and gender politics in modern Indonesia. It ends with an analysis of the unsuccessful effort of the Islamic women’s movement in 2004 to introduce far-reaching gender reforms into the codified body of Islamic personal status law used since 1991 in Indonesia’s Islamic courts.

Through an unparalleled explosion of street art and graffiti campaigns during and after the January 25, 2011, revolution, many public spaces in Cairo, Egypt, became symbols of people’s revolt against the state. These spaces resemble open-air galleries showcasing street art on a wide range of social issues. These graffiti encourage women to resist societal pressures and daily humiliation, reclaim public spaces, and confront existing power and gender dynamics. These graffiti show Egyptian women performing agency as they create their own depiction of the role of women in post-Mubarak Cairo. In this essay, Soumia Bardhan and Karen A. Foss perform a rhetorical analysis of the female-centered graffiti displayed in Cairo’s public spaces in post-Mubarak Egypt. They analyze street art and graffiti by prominent graffiti artists, significant graffiti campaigns, and their own photographs of graffiti taken at the sites.

Ratna Kapur illustrates how the Indian judiciary, through mobilizing a politics of ‘belief,’ has endorsed the identity of the Indian state as a Hindu nation through the discourse of rights and has underscored such practice through the constructed opposition between Islam and gender equality in the advocacy of the Hindu Right. The article analyses the role of religion in the constitutional discourse of secularism in India and how this has been used as a technique to establish and reinforce Hindu majoritarianism. The article focuses on the relationship between secularism, equality, and religion in law, which is pivotal to the Hindu Right’s project of constructing the Indian Nation as Hindu. Kapur notes that the judiciary has played a central role in legitimizing the Hindutva project, and that this project has gained traction in the legal arena to reshape the meaning of equality, gender equality, and religious freedom.

PurposeNetworking is deemed important for women in careers. The purpose of this paper is to draw attention to the interaction of a specific networking practice with a religious practice and its implications on British Muslim women (BMw). The practice ‘happy hours’ is closely linked with drinking alcohol (Flores-Pereira et al., 2008), while alcohol consumption is forbidden in Islam.Design/methodology/approachA qualitative research approach was used to interview 37 participants who were in managerial or professional positions.FindingsThe findings demonstrate that the presence of alcohol in work-related socializing is a norm, making the practice of ‘happy hours’ invisible and legitimate (Acker, 2006), thereby contributing inadvertently to reinforcing inequality regimes in organizations. Furthermore, the interaction of contradictory religious beliefs/practices of individual employees and organizational practices presents challenges for Muslim women, who feel they have to participate in happy hours as a networking practice in order to progress in careers. While it involves emotional effort, as they persuade themselves to join in activities where alcohol is being served, it paradoxically results in feelings of exclusion and marginalization within the group, as they do not drink alcohol.Originality/valueThis paper focuses on the micro/individual level of analysis, singling out the Muslim female voice while positioning ‘happy hours’ as a ‘networking practice’. It also contributes to the underexplored area of the role of religion and individual behaviour in organizations (Tracey, 2012).

AbstractThis paper extends the work of Thompson, Beauvais, and Lyness (1999, Journal of Vocational Behavior, 54, 392–415) on work–family culture by considering the role co-workers play. The proposed extended measure encompasses non-work spheres beyond the family as it has been established that much of the extant research does not include a large part of the workforce – those without childcare responsibilities (Kelliher, Richardson & Boiarintseva [2019, Human Resource Management Journal, 29, 101]). The extended measure constitutes Thompson et al.'s (1999) three original dimensions plus two additional dimensions: co-worker involvement (support and consequences) and gender expectations. Two quantitative studies confirmed that the extended measure is robust for different types of workers (part- and full-time, males and females). The co-worker dimensions were significantly associated with several outcome measures; however, the gender expectation dimensions added little additional variance in relation to employee outcomes. The results support the inclusion of co-workers as an important dimension of the workplace environment that supports work and life balance.
