ABSTRAKSecara filosofis pemilihan kepala daerah merupakan pelaksanaan kedaulatan rakyat untuk dipilih dan memilih dalam suatu proses pemilihan yang berlangsung secara demokratis. Faktanya terjadi peningkatan jumlah daerah yang melaksanakan pemilihan kepala daerah dengan calon tunggal. Penelitian ini membahas calon tunggal dalam pemilihan kepala daerah berdasarkan pada Putusan Mahkamah Konstitusi Nomor 100/PUU-XIII/2015. Menurut peneliti putusan Mahkamah Konstitusi perlu disikapi oleh pemangku kepentingan yang terlibat untuk tetap menjaga proses pemilihan ini berlangsung secara demokratis. Penelitian ini termasuk penelitian non-doktrinal. Fakta terkini pemilihan kepala daerah dengan calon tunggal perlu dikawal sehingga pemilihan tetap berlangsung secara demokratis. Penelitian ini menyimpulkan calon tunggal dalam pemilihan kepala daerah memerlukan konstruksi hukum yang tepat (tidak dibiarkan terlepas) untuk menjamin demokrasi berjalan secara demokratis pasca Putusan Mahkamah Konstitusi Nomor 100/PUU-XIII/2015. Kerangka hukum harus menjamin pembatasan maksimal dukungan kursi calon kepala daerah yang diusung partai politik atau gabungan partai politik, sehingga dapat menghilangkan monopoli individu atau kelompok pemodal terhadap persyaratan dukungan calon kepala daerah.Kata kunci: pemilihan kepala daerah; calon tunggal; demokrasi. ABSTRACTPhilosophically, regional head elections are the implementation of people's sovereignty to be elected and vote in a democratic election process. There has been an increase in the number of regional elections with a single candidate. This research discusses the only candidate in the election of regional heads based on the Constitutional Court Decision Number 100/ PUU-XIII/2015. According to researchers, the decision of the constitutional court needs to be addressed by the stakeholders that involved keeping the election process going on democratically. This study is non-doctrinal research. The latest facts about the election of a regional head with a single candidate need to be guarded so that the polls will continue democratically. This research concludes that a single candidate in the local head election requires an appropriate legal construction (not left aside) to ensure democracy runs democratically after the Constitutional Court Decision Number 100/ PUU-XIII/2015. The legal framework must guarantee the maximum support limitation for regional head candidate seats that carried by political parties or the association to eliminate the monopoly of individuals or groups of financiers regarding the support requirements of local head candidates.Keywords: regional head election; single candidate; democracy.

The importance of the position / function of the media as an integral part of learning, it is important to get the attention of the teacher. Therefore, teachers should not only understand the concept of learning media, the type / variety, criteria and procedures as well as the election process, but also on the principle of utilization and possible problems. Media so that learning can be planned and used in an integrated and precise in learning activities, then in this paper will discuss criteria for the selection of media and the steps, use of media and the possibility of various problems to be faced. Some criteria for media selection are (1) compliance with the learning objectives to be achieved, (2) support the subject matter to be discussed, (3) practical, flexible, and easy to be used, (4) in accordance with the knowledge and skills of teachers to use it, ( 5) according to the characteristics and the number of goals that will use them (small, medium, or large), and (6) the quality or the technical quality of the type of media that will be used, (7) affordability of the financial capacity of the procurement, (8) the availability of instructional media needed in the market, and (9) is compatible with the device or the facilities available or already owned. AbstrakPentingnya kedudukan/fungsi media sebagai bagian integral dalam pembelajaran, perlu kiranya mendapatkan perhatian para guru. Oleh sebab itu, guru seyogianya tidak hanya memahami konsep tentang media pembelajaran, jenis/ragamnya, kriteria dan prosedur serta proses pemilihannya, tetapi juga mengenai prinsip pemanfaatannya dan kemungkinan permasalahan yang terjadi. Agar media pembelajaran dapat direncanakan dan dimanfaatkan secara terpadu dan tepat di dalam kegiatan pembelajaran, maka di dalam tulisan ini akan dibahas kriteria pemilihan media dan langkah-langkahnya, pemanfaatan media dan kemungkinan berbagai permasalahan yang akan dihadapi. Beberapa kriteria pemilihan media adalah: (1) kesesuaian dengan tujuan pembelajaran yang ingin dicapai, (2) mendukung materi pelajaran yang akan dibahas, (3) praktis, luwes, dan mudah dimanfaatkan, (4) sesuai dengan pengetahuan dan keterampilan guru untuk memanfaatkannya, (5) sesuai dengan karakteristik dan jumlah sasaran yang akan memanfaatkannya (kelompok kecil, sedang, atau besar), dan (6) mutu atau kualitas teknis jenis media yang akan dimanfaatkan, (7) keterjangkuan kemampuan finansial untuk pengadaannya, (8) ketersediaan media pembelajaran yang dibutuhkan di pasaran, dan (9) kompatibel dengan perangkat atau fasilitas yang tersedia atau yang telah dimiliki.

This paper aims to evaluate the simultaneous elections and view the legal politics of separating the implementation of the simultaneous national and local elections for strengthening democracy in Indonesia. This study uses a normative juridical research method with a statutory and conceptual approaches. The results of the study show that the implementation of simultaneous elections in 2019 provided problems for organizers and voters. One of the suggestions for reforming the elections is to separate local and national elections. The the legal politics objectives of separating the elections consist of two, namely the level of organizers and voters as well as aspects of the election process and the quality of election results. This separation is expected to remove voter pragmatism, and focus more on the vision and mission of the candidates. Political parties will also carry out their functions optimally, be focused, and be able to carry out political education as they should.

This paper examines the consequences of distribution of income on election results in conditions of biased pluralism and a small-scale electorate, when the results of the democratic electoral process are compromised due to electoral corruption. The paper discusses the most important concepts of political economy and political theory connected to achieving electoral victory through distribution and misuse of economic resources, focusing on identifying the conditions under which a democratic political system serves organized interest groups and not the majority; i.e., biased pluralism. Despite the formal equality of all voters, there are significant differences in their actual impact on election results. The democratic election process is put into question by the fact that the electorate is small and candidates have access to income that can be used to buy off ?privileged? voters through discretionary allocation of funds and the economic results generated by such distribution. Faced with the corrupt practice of the incumbent, the opposition candidate is driven to a similar position to gain the support of ?privileged? voters and win the election for the opposition. The economic and political result is that the free vote and political competition are compromised, resulting in a political hybrid, the semiauthoritarian regime. This paper provides a mathematical optimization model in which a hierarchically based organization is used as an approximation of society. In the model, differences in the position of members of the organization are similar to differences between voters in the electorate. The particle swarm optimization (PSO) method is used to calculate the amount of electoral bribes. The paper also uses game theory to provide an example of voting for the person who will manage the organization. The formal game between the incumbent and the opposition candidate is presented with a discussion of the various results of the game.

The article is a paper presented during the Poland-wide academic conference The U.S. Constitution – theory and practice. The basis for reflections constitutes an issue of the constitutionality of the federal legislation establishing restrictions on the money’s influence on financing election campaigns. The paper focuses on an analysis of the U.S. Supreme Court’s case law related to the range of an acceptable interference of such regulations in the freedom of speech and political expression clause of the First Amendment to the Constitution. The author discusses selected statements contained in the rulings made in cases, from which as the most crucial he regards: Buckley v. Valeo (1976), McConnell v. Federal Election Commission (2003) and Citizens United v. Federal Election Commission (2010). In the conclusion of the article an opinion is presented that the U.S. Supreme Court judicature, co-creating with the federal legislation the campaign finance law, is an unique attempt at balancing the two values fundamental to the democratic election process, which are freedom of speech and the principle of equal opportunities for political competitors.

Demokratisasi Indonesia menghasilkan sengketa politik-pemilu dalam tensi yang tinggi. Mahkamah Konstitusi mempunyai kewenangan untuk mengadili setiap perkara gugatan sengketa pemilu dan pilkada. Sejauhmana putusan Mahkamah terkait dengan sengketa pemilu dapat dinilai? Secara umum, dari berbagai putusan yang dihasilkan, Mahkamah masih menghadapi problematika terkait dengan metode interpretasi yang menjadi hal krusial dalam menghasilkan kualitas putusan yang bisa diterima dengan baik. Artikel ini bertujuan untuk mengelaborasi metode interpretasi konstitusi dan hubungannya dengan uji konstitusi antara tradisi Kelsenian dan Madisonian. Lalu menekankan pada logika inter-konektivitas antara legislasi, metode interpretasi dan hasil putusan mahkamah. Berbagai aspek yang bisa dilihat dari sengketa pemilu, diantaranya perhitungan suara, alokasi kursi, kecurangan penyelenggaraan dan manipulasi lainnya dalam proses pemilu. Tulisan ini melakukan eksplorasi terhadap satu aspek yaitu alokasi kursi dimana akan dilakukan pengujian kritis atas putusan mahkamah tentang derajat keterwakilan tinggi. Metode yang digunakan adalah uji kadar keterwakilan tinggi dengan indeks Galagher dan Pukelsheim dari putusan Mahkamah terhadap sengketa alokasi kursi. Hasilnya, kualitas putusan tersebut tidak lebih baik dari putusan Komisi Pemilihan Umum yang mereka batalkan. Dari ulasan tersebut, perlu dilakukan perbaikan terhadap metode interpretasi Mahkamah.<p>Democratization in Indonesia yield high tension of political-election dispute. Constitutional Court has authority to judge any lawsuit on both election and local government election dispute. How good The Constitutional Court verdicts on election? Refers to yielding of any verdict, The Constitutional Court itself facing problems with the method s of interpretation and became crucial point to yield good and acceptable verdict. This article aim to elaborate method of interpretation of constitution connecting to review of constitution between Kelsenian and Madisonian’s tradition. Furthermore it emphasize the logic of inter connection among legislation, method of interpretation and The Constitutional Court’s verdict. Review to election disputes in the constitutional court, many aspects such as counts of vote, seat allocation, election fraud and technical manipulation in the election process happened. This paper focus on exploring the aspect of seat allocation. It will examine with critical review those issues of degree of proportionality in The Constitutional Court verdicts. The method used is the Index Gallagher and Pukelsheim to explain the degree of proportionality in the Constitutional Court’s verdicts against the allocation of seats. As result, the quality of the Court’s verdicts is not better than the Election Commission’s verdicts that they canceled. From those evidence, The Constitutional Court’s method of interpretation should be improved.</p>
