ABSTRAKSecara filosofis pemilihan kepala daerah merupakan pelaksanaan kedaulatan rakyat untuk dipilih dan memilih dalam suatu proses pemilihan yang berlangsung secara demokratis. Faktanya terjadi peningkatan jumlah daerah yang melaksanakan pemilihan kepala daerah dengan calon tunggal. Penelitian ini membahas calon tunggal dalam pemilihan kepala daerah berdasarkan pada Putusan Mahkamah Konstitusi Nomor 100/PUU-XIII/2015. Menurut peneliti putusan Mahkamah Konstitusi perlu disikapi oleh pemangku kepentingan yang terlibat untuk tetap menjaga proses pemilihan ini berlangsung secara demokratis. Penelitian ini termasuk penelitian non-doktrinal. Fakta terkini pemilihan kepala daerah dengan calon tunggal perlu dikawal sehingga pemilihan tetap berlangsung secara demokratis. Penelitian ini menyimpulkan calon tunggal dalam pemilihan kepala daerah memerlukan konstruksi hukum yang tepat (tidak dibiarkan terlepas) untuk menjamin demokrasi berjalan secara demokratis pasca Putusan Mahkamah Konstitusi Nomor 100/PUU-XIII/2015. Kerangka hukum harus menjamin pembatasan maksimal dukungan kursi calon kepala daerah yang diusung partai politik atau gabungan partai politik, sehingga dapat menghilangkan monopoli individu atau kelompok pemodal terhadap persyaratan dukungan calon kepala daerah.Kata kunci: pemilihan kepala daerah; calon tunggal; demokrasi. ABSTRACTPhilosophically, regional head elections are the implementation of people's sovereignty to be elected and vote in a democratic election process. There has been an increase in the number of regional elections with a single candidate. This research discusses the only candidate in the election of regional heads based on the Constitutional Court Decision Number 100/ PUU-XIII/2015. According to researchers, the decision of the constitutional court needs to be addressed by the stakeholders that involved keeping the election process going on democratically. This study is non-doctrinal research. The latest facts about the election of a regional head with a single candidate need to be guarded so that the polls will continue democratically. This research concludes that a single candidate in the local head election requires an appropriate legal construction (not left aside) to ensure democracy runs democratically after the Constitutional Court Decision Number 100/ PUU-XIII/2015. The legal framework must guarantee the maximum support limitation for regional head candidate seats that carried by political parties or the association to eliminate the monopoly of individuals or groups of financiers regarding the support requirements of local head candidates.Keywords: regional head election; single candidate; democracy.

Dalam perkembangan politik hukum kontemporer, keputusan politik dalam pembentukan regulasi sering dihadapkan pada dua persoalan sekaligus yang saling berhadapan. Konfigurasi politik dalam pembentukan Undang-Undang Nomor 7 Tahun 2017, partai politik di parlemen tidak hanya merepresentasikan kepentingan politiknya, tetapi juga dihadapkan pada keharusan mengakomodir putusan Mahkamah Konstitusi Nomor 14/PUU-XI/2013 sebagai koreksi keputusan politik yang otoriter. Penelitian ini adalah penelitian yuridis normatif dengan metode kualitatif, studi ini menitikberatkan pada pemahaman komprehensif yang meliputi interaksi politik dan hukum dalam terciptanya konfigurasi politik hukum pemilu. Hasil studi ini dapat menjelaskan kepatuhan partai politik terhadap hukum dalam menciptakan konfigurasi politik di parlemen, namun di sisi lainnya lemahnya partai politik dalam membangun koalisi dalam mewujudkan sistem pemilu demokratis justru menjadikan keputusan politik yang dipilih menjadi otoriter dalam pelaksana teknisnya. Kehadiran hukum dalam perkembangan konfigurasi politik kontemporer, dapat menjadi paradigma baru dalam terciptanya konfigurasi politik demokratis yang pada akhirnya terbentuknya hukum pemilu yang demokratis.In the development of contemporary political laws, political decisions in regulatory formation are often confronted with two issues at once facing each other. The political configuration in the Law No. 7 year 2017, political parties in parliament not only represent political interests but also face the necessity to accommodate the decision of the Constitutional Court Number 14/ PUU-XI/2013 as a correction of authoritarian political decisions. This research is normative juridical research with qualitative method. The results of this study can explain the compliance of political parties to the law in creating the political configuration in parliament. Yet on the other hand, the weakness of political parties in building coalitions in realizing the democratic election system makes the selected political decision become authoritarian in its technical execution. The presence of law in the development of contemporary political configuration can be a new paradigm in creating democratic political configuration which ultimately the formation of democratic law of elections.

This study aims to examine the Constitutional Court's Decision which carries out General Elections simultaneously from the Syiyasah Syar'iyah perspective, especially on the principle of justice. This research is a doctrinal research and uses two approaches namely the statutory approach and the concept approach. Based on Syiyasah Syar'iyah's perspective, the decision of the Constitutional Court is fair for political parties participating in elections for people who are willing to become candidates/vice presidents, and for people who want to test their electability. This decision also aims to reduce the number of non-voter groups. The Constitutional Court's decision also contains the principle of unity and alliance, because it aims to stop the practical political interests that lead to the collapse of unity.

After the issuance of the Constitutional Court Decision No.33 / PUU-Xlll / 2015 as the cancellation of the ban on dynastic politics, a number of candidates from the incumbent's relatives advanced in the direct Pilkada and mushroomed up to the 2020 regional elections. The occurrence of kinship politics is not only seen in terms of regulation, but the rise of kinship politics is also due to problems in political parties in carrying out the political recruitment function. This study seeks to analyze the findings of the online media reported in Kompas and Tempo. This study uses qualitative methods and uses Nvivo 12 Plus in processing data. In this study, it is explained that the factors for the formation of dynastic politics from online media coverage of Kompas dominantly explains the recruitment of political parties which are less democratic, while Tempo online media dominantly explains that the supporting factors for the formation of kinship politics are party recruitment, family support, and weak legal rules. In addition, the impact of kinship politics from the analysis of Kompas online media reports is the creation of corrupt behaviour and damaging the bureaucratic order. Meanwhile, the impact of kinship politics from the analysis of Tempo online media is the decline in the quality of democracy and damage to the structure of the party. This type of research used in this research is qualitative research. The analysis used in this paper is descriptive analysis. Analysis was performed using the Nvivo 12 plus software.

The purpose of this study was to analyze a single candidate pair in the regional head election of Pematang Siantar City in 2020. The purpose of this study was to explain why there was a single candidate pair in Pematang Siantar City. The legality of the Constitutional Court Decision number 100/PUU-XII/2015 is a legal force to uphold the meaning of democracy in political contestation, in this case regional head elections. Besides that, the essence of democracy which promises freedom to be elected and to vote is an additional power to bring up a single candidate pair. The failure to regenerate political parties is another trigger for the emergence of a single candidate pair in the post-conflict local election. Not only in Pematang Siantar City but also throughout Indonesia. The method used in this research is descriptive qualitative with interview instruments involving political party administrators and political observers in Pematang Siantar City in addition to references to single candidate pairs. The weak cadre of political parties with the presence of wholesale parties makes incumbents not get support in Pematang Siantar City. The legal power of the Constitutional Court's decision and the meaning of democracy to be elected and voted made the single candidate pair in Pematang Siantar City win the post-conflict local election against an empty box.

Political parties are official organizations created by people who have interests and goals to control the government, by placing their members in the government through an election mechanism. The election process is inseparable from political parties, because political parties can channel the aspirations of the people, where the people can participate in it and have a strong influence on the election. The main function of political parties is to seek power, gain power and maintain it. In the 2017 Musi Banyuasin Local Election, the pairs of Dodi Reza and Beni Hernedi were carried out by 11 (eleven) political parties namely PDIP, Golkar, Democrat, Hanura, Nasdem, and PKB. As the party supporting the pair Dodi Reza and Beni Hernedi in the 2017 Musi Banyuasin Regional Election, political parties should fight in giving victory to the candidate pair that they carry by carrying out the functions of political parties as well as possible. Issues that will be discussed in this study include how the function of political parties in winning sub-regional elections and how the functions of political parties supporting the pair Dodi Reza and Beni Hernedi are assessed from the results of votes in the 2017 Musi Banyuasin Regional Election.This type of research is field research, while the type of research is qualitative, where the research procedure produces a description, which describes and describes matters relating to the problem of the function of political parties. The rationale that the researchers used in this study is the framework of thinking from Miriam Budiardjo to explain the function of political parties. The results of this study indicate that the function of political parties carried out by the party supporting the pair Dodi Reza and Beni Hernedi has not run optimally, this is evident from the high level of abstentions in the Musi Banyuasin elections in 2017.

The main problem of this research is that there is no firmness regarding the diction of individual words in the Constitution which is useful as a condition for nominating Regional Representative Council or Dewan Perwakilan Daerah (DPD) membership. This indecisiveness has led to the composition of DPD membership being dominated by members of political parties. This journal aims to explore the meaning of the diction of words contained in the 1945 NRI Constitution, namely "Individual" which is clearly written in Article 22E paragraph (4) of the 1945 Constitution of the Republic of Indonesia after the Constitutional Court Decision No30/PUU-XVI/2018. The meaning of the term “individual” in this article will determine the conditions for nominating members of the DPD so that they are more in line with the objectives of establishing the institution. This journal uses a statutory approach and a historical approach. The results of this discussion show that the original intense definition concluded by the author regarding the word "individual" in the 1945 Constitution of the Republic of Indonesia after the Constitutional Court Decision has the following meaning: an individual who does not have a political party background or political party management and really understands his / her region.

Indonesia is a country that implements a presidential system and a multi-party system jointly. The implementation of general elections has been regulated in the 1945 Constitution of the Republic of Indonesia. The presidential threshold is a concept used in proposing candidates for President and Vice President. Proposals are made by political parties or joining political parties by general election participants. This article analyzes the application of the presidential threshold after the Constitutional Court decision Number 114 / PUU-XI / 2013. The purpose of this writing is to determine the application of the Presidensitial threshold after the Constitutional Court decision Number 14 / PUU-XI / 013, and to determine the impact of the Constitutional Court decision number 14 / PUU-XI / 2013 on political parties. The research method used is qualitative and conceptual normative research methods. Based on this article, it is known that the application of the presidential threshold in which political parties must obtain seats 20% of the number of seats in the DPR or 25% of the valid votes nationally in the previous DPR elections, so that making new or small parties will not be able to nominate the President and Vice President themselves, but parties can form a coalition.

Penodaan agama dalam konteks penafsiran konstitusi telah dijabarkan oleh Mahkamah Konstitusi (MK) dalam Putusan Nomor 140/PUU-VII/2009. UU Pencegahan Penodaan Agama tidak menentukan pembatasan kebebasan beragama, akan tetapi pembatasan untuk mengeluarkan perasaan atau melakukan perbuatan yang bersifat permusuhan, penyalahgunaan atau penodaan terhadap suatu agama serta pembatasan untuk melakukan penafsiran atau kegiatan yang menyimpang dari pokok-pokok ajaran agama yang dianut di Indonesia. Pembatasan-pembatasan tersebut hanya dapat dilakukan dengan Undang-Undang dengan maksud semata-mata untuk menjamin pengakuan serta penghormatan atas kebebasan orang lain dan untuk memenuhi tuntutan yang adil sesuai dengan pertimbangan moral, nilai-nilai agama, keamanan, dan ketertiban umum dalam masyarakat yang demokratis [vide Pasal 28J ayat (2) UUD 1945]. Tulisan ini akan menganalisis aspek-aspek konstitusionalitas penodaan agama serta pertanggungjawaban pidana dalam kasus yang dialami oleh Basuki Tjahaja Purnama. Karena pidatonya di kepulauan seribu memenuhi unsur-unsur tindak pidana dalam Pasal 156a KUHPidana berdasarkan Putusan Pengadilan Negeri Jakarta Utara Nomor 1537/Pid.B/2016/PN.JktUtr. Konsep pertanggungjawaban pidana (criminal liability /toerekeningvatsbaarheid) atau sesungguhnya tidak hanya menyangkut soal hukum semata-mata, melainkan juga menyangkut soal nilai-nilai moral atau kesusilaan umum yang dianut oleh suatu masyarakat atau kelompok-kelompok dalam masyarakat. Analisis pertanggungjawaban pidana dalam delik penodaan agama Islam dalam tulisan ini menggunakan teori pertanggungjawaban pidana, putusan MK Nomor 140/PUU-VII/2009, Putusan Pengadilan tentang Penodaan Agama dan perbandingan pertanggungjawaban pidana di Belanda dan Inggris.Blasphemy in the context of interpretation of the constitution has been elaborated by the Constitutional Court (MK) in Decision Number 140/PUU-VII/2009 The Prevention of Blasphemy Law does not specify restrictions on religious freedom, but restrictions on issuing feelings or committing acts of hostility, abuse or desecration against a religion as well as restrictions on interpretation or activities that deviate from the principles of the teachings of the religion adopted in Indonesia. These restrictions can only be done by Law with the sole purpose of guaranteeing recognition and respect for the freedom of others and to fulfill just demands in accordance with moral considerations, religious values, security and public order in a democratic society. [vide Article 28J paragraph (2) of the 1945 Constitution]. This paper will analyze aspects of constitutionality of blasphemy and criminal liability in the case experienced by Basuki Tjahaja Purnama. Because his speech in the thousand islands fulfilled the elements of criminal acts in Article 156a of the Criminal Code based on the North Jakarta District Court Decision Number 1537/Pid.B/2016/PN.JktUtr. The concept of criminal liability (criminal liability/toerekeningvatsbaarheid) or actually does not only involve legal matters, but also concerns the general moral values or morality adopted by a society or groups in society. Analysis of criminal responsibility in the Islamic blasphemy offense in this paper uses the theory of criminal responsibility, Constitutional Court decision No. 140/PUU-VII/2009, Court Decision on Blasphemy and a comparison of criminal liability in the Netherlands and England.

Abstract: The purpose of this study (1) is to explain how the level of political participation of the community in the 2018 Regional Election in Baubau City (2) to identify any efforts made by the Baubau City Election Commission and political parties in increasing public political participation. Data were collected by analyzing documents, observing, interviewing, and analyzing with qualitative and quantitative descriptive techniques. The results of this study are: (1) The level of community participation in Baubau City is relatively high because if it is accumulated at 69.87%. (2) KPUD communication to increase public political participation is to use mass media to create society following the development of the Election process. (3) Communication of Political Parties to increase political participation of the community is this political campaign is a form of political communication carried out by a person or group of people or political organizations in a certain time to obtain political support from the people.Keywords: Political Communication, Political Participation, Regional Elections Baubau CityAbstrak: Tujuan penelitian ini adalah untuk menjelaskan bagaimana tingkat partisipasi politik masyarakat dalam Pemilihan Kepala Daerah tahun 2018 di Kota Baubau, serta mengidentifikasi upaya-upaya apa saja yang dilakukan KPUD Kota Baubau dan partai politik dalam meningkatkan partisipasi politik masyarakat. Data dikumpulkan dengan analisis dokumen, pengamatan, wawancara, dan dianalisis dengan tehnik deskriptif kualitatif dan Kuantitatif. Hasil dari penelitian ini adalah tingkat partispasi masyarakat di Kota Baubau tergolong tinggi dikarenakan jika diakumulasikan sebesar 69,87% %, komunikasi Komisi Pemilihan Umum Daerah (KPUD) Kota Baubau untuk meningkatkan partisipasi politik masyarakat adalah menggunakan media massa untuk menciptakan masyarakat mengikuti perkembangan proses Pemilu, dan Komunikasi Partai Politik untuk meningkatkan partisipasi politik masyarakat adalah kampanye politik ini merupakan bentuk komunikasi politik yang dilakukan oleh seseorang atau sekelompok orang atau organisasi politik dalam waktu tertentu untuk memperoleh dukungan politik dari rakyat.Kata Kunci: Komunikasi Politik, Partisipasi Politik, Pemilukada Baubau
