Carl Schmitt was an anti-liberal conservative jurist during the Weimar Republic in Germany whose position on emergency powers sponsors a hardline form of ‘realism’. To restore peace and order qua the homogeneity of the people in times of crises, he sponsors the role of the sovereign in deciding on an extreme emergency even by transgressing the wordings of a written constitution. However, this article seeks to use the case of the Thai government’s response to Covid-19 through the invocation of emergency powers to expose deficiencies pertaining to the Schmittian model. Rather than calling for the politics of exclusion, the present outbreak of Covid-19 in Thailand reiterates the essence of legality and communitarian and social solidarity.

This chapter considers the role of the people in Carl Schmitt’s theorizing on democracy, and invokes the concept of constitutive boundaries as a way of understanding how communities are reproduced by way of territorial borders as well as criteria for membership and cultural markers, e.g. symbols, rituals, and holidays. The chapter suggests that the latter constitute instances of a larger logical space of constitutive exceptions, that, Schmitt implies, reproduce existing orders, but also threaten to replace them with new ones; thus, such exceptions may be surrounded by protective boundaries of the sacred, concretely as well as abstractly. Ultimately, we may visualize an entire topology of the exceptional, which is subject to fierce contestation, since it points to the possibility of new orders beyond existing ones, which may be interpreted in terms of different trajectories of highly ambiguous processes of secularization.

Social economy has assumed a role of growing importance in these last decades, being seen by several entities and political agents as one of the pillars in a new sustainable economic model. Volunteer programs are multiplying, and greater coordination between the various involved actors is essential to guarantee that society's help reaches the people who need them. In this sense, a digital donation platform based exclusively on open source technologies has been proposed and developed, which simplifies the process of donation of goods to a set of causes created by social solidarity institutions. The application permits anonymous donations and allows the monitoring of the status of each donation by the donors. Additionally, usability was considered as a key element in the design of the application

TheProblem of the origins and development of the office of Reich President in the Weimar Republic is of interest for several reasons, possibly the principal one being its relation to the general problem of Hitler's accession to power. It will be recalledthat Hitler came to power initially as Chancellor in a “Presidial” cabinet, that is, one responsible to the President rather than to the Reichstag and governing bythe use of the President's emergency powers. I propose to discuss here the role of the President of the Reich, as conceived of by the constitutional framers, in the light of the emergence of the Presidial cabinet.

Principle of democracy as governance is for the people by the people and of the people. People are not the recipient of state framed policies and programs. Citizens are not only consumers, choosers or users, but active participants for making and shaping the policies.According to Duguit, “Essence of law is to serve and secure social solidarity, where individual has to perform obligations as a member of the community”. Duguit says “everyone has to perform his duties to the society which would help to develop cooperation and social solidarity.” Law and society are interrelated and interdependent. Changes in every social component leads to change in various aspects, right from the social institutions, customs, ideologies, human behavior and human interactions.Law is meant for nonprofessionals. The welfare of the society &humanity is the sole purpose of Indian constitution. To take care of interests, social security, social solidarity are the main aim of law. Sociological school of thought says that ‘Law is social phenomenon’. According to this school, essential characteristic of law should be to represent common interaction of men in social group. Treatment towards law should be as instrument of social control and social progress. The role of law and its functioning towards society is the basic philosophy of sociological jurisprudence. Thus, social progress is very much regulated by the degree of law. Law is like the steering to lead society in particular direction. Law may be the fulcrum to control society. Balance between law and society will certainly responsible for social progress.

In this paper I wish to show a possible line of relationship between the careers of some fifteenth-century English bishops and their deathbed bequests. This attempt to correlate episcopal secularity, as revealed by the ‘careerism’ of the bishops, and episcopal sanctity, as revealed by their philanthropy, touches three major themes of historical inquiry. One of these is gift-giving. Anthropologists have taught us to see how the giving of gifts in pre-industrial societies can illuminate the role of symbolic relationships, of ties between lineages, of the bonds of social solidarity, status and hierarchy. Medieval historians know from their own work the importance of gift-giving in the economic sphere. I am also attempting to carry out a ‘group study’, one particular form of sociological history. The purpose of such endeavours is not, as Elton asserts, to reopen the quarrel as to whether history is or is not scientific. It is rather to ask questions about the past which the people of that day did not think to ask about themselves. As such I believe it to be a legitimate and proper form of historical inquiry. Lastly, I seek to shed some light on a particular aspect of medieval espiscopal activity. Anything we can learn about the ecclesiastical élite is that much more known about medieval people and medieval society.

In the volume Stasis. Civil War as a Political Paradigm, the Italian philosopher Giorgio Agamben advances the thesis that ademia – the absence of a people (a-demos) – is a constitutive element of the modern state. When confronted with the fact that modern political and juridical thought elevated the people to the role of the sole chief constituent agent and the ultimate source of the legitimacy of constituted orders, this thesis turns out to be rather problematic. In this work, I will explore Agamben’s notion of ademia, retracing the main lines of its theoretical development and reconsidering it in relation to different interpretations of the idea of the people. Most notably, I will demonstrate how Jean-Jacques Rousseau and Carl Schmitt in challenging the conundrums that the idea of the people inevitably entails ended up in revealing the ultimate absence of the people in the political space of the constituted order of the state. In doing so, I will try to show how Agamben’s notion of ademia is helpful is grasping some of the main paradoxes and conundrums underpinning the meaning and the uses of the idea of the people in legal and political thought.

A small but growing area of public administration scholarship appreciates the influence of religious values on various aspects of government. This appreciation parallels a growing interest in comparative public administration and indigenized forms of government which recognizes the role of culture in different approaches to government. This article is at the crossroads of these two trends while also considering a very salient region, the Islamic world. The Islamic world is uniquely religious, which makes this discussion even more relevant, as the nations that represent them strive towards legitimacy and stability. The history and core values of Islam need to be considered as they pertain to systems of government that are widely accepted by the people. In essence, this is being done in many countries across the Islamic world, providing fertile grounds for public administration research from a comparative perspective. This paper explores these possibilities for future research on this topic.
