Notaries as one of the legal professions are not immune from mistakes that will eventually lead to a notary profession in violating the UUJN-P and the Code of Ethics and some even have the potential for punishment. Given that the role and authority of a Notary is very important in social life, the behavior and actions of a Notary in carrying out the function of authority are vulnerable to abuse that can cause harm to the community. Notaries who act outside the authority that has been determined by law can be categorized as unlawful acts. As has been tried in the Class IA Padang District Court with Decision Number 27/Pid.Sus/TPK/2016/PN-Pdg. In this case, the Notary was accused of corruption in land acquisition for Campus III of the State Islamic Institute (IAIN) Imam Bonjol Padang (now UIN Imam Bonjol). The formulation of the problem in this study are: a). What are the legal consequences for a Notary who commits a criminal act that has permanent legal force? b). What are the implications of the Notary's dismissal on the Notary Protocol? The approach used in this research is empirical juridical. This study uses primary and secondary data. Data were analyzed qualitatively. The results of the study show that: 1) The Notary was dishonorably dismissed by the Minister because it was proven legally that he had committed a criminal act of corruption which had permanent legal force, but the implementation process took a long time because it was waiting for the Minister's decision on the dismissal of the Notary. 2). With the dismissal of a Notary who commits a criminal act that has permanent legal force, the Notary Protocol must be handed over to the Notary receiving the Protocol appointed by the Minister.

The purpose of this study is the legal consequences arising out of the Credit Agreement with the guarantee of mortgage studies in case number 127 / Pdt.G / 2014 / PN.SMG, in the District Court of New York, How should a notary to make loan agreement with the Mortgage Guarantee ensure legal certainty.In this study, using juridical empirical method. Type and source of the data used in the primary and secondary data. Collecting data with the study of literature and the (observation, interviews and questionnaires). Analysis of data for qualitative descriptive. As a result of the law on the ratification of the creditors of the credit agreement by notary, with a guarantee of mortgage, based on the wording of Article 6 of Law No. I R 4 Year 1996 on Land  and Other Bodies related to the land, the right to sell the object of mortgage on its own power is one embodiment of the priority positions (referent). And as a result of the law of the debtor apply Article 1338 of the Civil Code, Article 1243 applies, Article 1244KUHPerdata, and Article 1237, paragraph (2) of the Civil Code. The legal consequences of Notaries that have fulfilled the provisions of Article 1320 of the Civil Code in accordance with the obligations of and is not in violation of Article 16 on the obligation of, and in compliance with the Article 38, 39, 40 andArticle 44 paragraph (1), (2), (3) and paragraph (4), Law of Republic of Indonesia No. 30 2004 Jo No. 2 Year 2014 concerning Notary and do not violate the code of ethics of the notary, so that the act is still not degraded to act under the hand. Of a credit agreement with a guarantee of mortgage that guarantees the rule of law and justice of the parties, the fulfillment of Article 1320, Article 1321 of the Civil Code, and Notary must comply with Article 15 and Article 16 ofthe Law Notary, implement the Code of conduct and other Law.

<p align="center"> </p><p><em>As happened to the Notary Eli SatriaPilo, S.H, Mkn, who was appointed as the Notary who made the Deed of Relinquishment of Land Rights in the Land Acquisition activities for the Construction of Campus III of the State Islamic Institute (IAIN) of Padang which was located in Sungai Bangek District, Padang</em><em> </em><em>in 2010. The method used was descriptive, in which describing the applicable legislation associated with legal theory in the facts and realities about the Notary’s Responsibility in Making Deed of Land Acquisition for the construction of Campus III of IAIN Padang in Sungai</em><em> </em><em>Bangek. This study used a Normative Juridical approach, in which researching by using and processing secondary data or literature related to the</em><em> </em><em>study. The data collected were in the form of primary data obtained from the District Court of Padang, secondary data obtained from secondary legal materials and primary legal materials. Based on the study, it was found that the role of Notary Eli</em><em> </em><em>Satria</em><em> </em><em>Pilo, in the land acquisition of campus III IAIN was proven to have misused the authority resulting in violation of the Notary Ethics Code and was responsible for accepting termination disrespectfully. Furthermore, he was also shown to be committing a Criminal Corruption made based on the Deed of Relinquishment of Land Rights in the land acquisition for the construction of Campus III of IAIN Padang, so that the State incurred losses of Rp. 1</em><em>.</em><em>946</em><em>.</em><em>701</em><em>.</em><em>050 (one billion nine hundred forty-six million seven hundred one thousand and fifty rupiahs). And he was responsible for receiving and carrying out the sentence that had been handed down by the District Court of Padang, a prison sentence of 4 (four) years, and paying a fine of Rp. 200</em><em>.</em><em>000</em><em>.</em><em>000 (two hundred million rupiahs)</em><em>.</em></p><p> </p>

As we know land reforms on land acquisition is directly associated with different development. It aims to improve poor people access towards mean of social welfare. In fact India and Chhattisgarh state is not an exception the above rule and policies. For land reform and acquisition in Chhattisgarh. In this research paper, an attempt has been made to cover various land displacements in Chhattisgarh. This research paper has been prepared mainly on the basis of secondary data from it. Like other places, Chhattisgarh has also seen the following effects of land displacement, such as in social life, in children, in women, in employment, the opposite effect is seen. An attempt has been made to explain the impact of land displacement in Korba, Chhattisgarh, where the common life of the displaced people has been particularly affected.

Abstract: Land Acquisition for public interest in Kulon Progo Regency is a procedure that must be implemented before initializing the new airport, which will replace the function of Adisutjipto airport. It facing much rejection during the process, so that it takes long time in completion. That also causing the identification and inventory process to be inhibited so that the land valuation process can’t be done perfectly. Their compensation won’t be given directly to the land owner, but through the consignment procedure that deposited at the District Court. This research is conducted by descriptive qualitative method. The results show that the assessment of the land is done well, although there is a discretionary decision, so that re-assessment is conducted in different time. The payment mechanism of compensation through consignment also done according to procedures, although the requirement of rejection letter from the party who is not eligible can’t be fulfilled, because it can be suspended due to the large interest for the land acquisition process of the new airport. Keywords: land assessment, consignment, land acquisition Intisari: Pembangunan bandara udara baru yang dapat menggantikan fungsi bandara udara Adisutjipto sudah tidak dapat dielakkan lagi. Pembangunan bandara udara baru dilaksanakan melalui prosedur Pengadaan Tanah untuk Kepentingan Umum. Penolakan terhadap pembangunan bandara udara terjadi dalam kegiatan tersebut. Penelitian ini bertujuan untuk mengetahui mekanisme penilaian dan mekanisme konsinyasi terhadap bidang tanah yang mengalami penolakan oleh pihak yang berhak pada kegiatan pengadaan tanah tersebut. Jenis penelitian yang digunakan adalah penelitian deskriptif dengan pendekatan studi kasus dan pendekatan perundang-undangan. Hasil penelitian menunjukkan bahwa dalam pelaksanaan penilaian bidang tanah secara keseluruhan sudah sesuai prosedur yang ada, akan tetapi terdapat putusan diskresi terhadap bidang tanah yang sebelumnya tidak dapat dilakukan penilaian secara keseluruhan kemudian dilakukan penilaian ulang di luar waktu yang telah ditentukan. Mekanisme pembayaran ganti kerugian melalui konsinyasi sudah sesuai dengan peraturan perundang-undangan yang berlaku, hanya dalam proses permohonan registrasi konsinyasi terdapat satu syarat terkait dengan surat penolakan dari pihak yang berhak yang tidak dapat dilampirkan, hal tersebut dapat ditangguhkan mengingat besarnya kepentingan kelancaran proses pengadaan tanah pembangunan bandara udara baru ini. Notary is an authorized officer to make an authentication acta and to have another authority as referred to in this law or under other laws as provided for in article 1 Figure 1 UUJNP. As a notary professional, he must perform his position by guiding the law, the Code of Ethics, the Articles of association, and the budget of the household. But the notary is also a man who does not escape the mistakes that he sometimes made that is done not because of the notary deliberate. Departing from the background of the problem above the author interested in conducting research in the form of a journal by lifting the title "The Law of typographical error in Minuta notarial deed based on this, provides a background picture of This study discussed about 1). How is the notary's responsibility for typographical error on Notara deed that is made notary? 2). What is the legal consequences of typographical errors in notarized deed? Research indicates that it can draw conclusions from the problems that can be seen in the presence of carelessness when forming the deed which is known only for a long time from typographical errors in the prefix of the deed on the identity of the Parties, and at the crucial point of a deed that is not appropriate to the will of the related party which is caused by a notary: A. The Aktanya can be cancelled if the acting is proven to have absolutely no subjective element, B. The act can be said to be void in order to The law when it proved to contain no objective requirement, C. The notary deed is degraded so that the deed under the hands of which absolutely does not have a force in terms of perfect proof. Notaris merupakan pejabat yang berwenang untuk membuat suatu akta otentik dan memiliki suatu kewenangan lainnya sebagaimana yang dimaksud pada undang-undang ini atau berdasarkan undang-undang lainnya sesuai yang telah disebutan di dalam pasal 1 angka 1 UUJNP. Sebagai seorang professional seorang notaris harus melaksanakan jabatannya dengan berpedoman pada undang-undang, kode etik, anggaran dasar, dan anggaran rumah tangga. tetapi notaris juga seorang manusia yang tidak luput dari kesalahan yang terkadang diperbuatnya yang dimana dilakukan bukan karena kesengajaan notaris itu. Berangkat dari latar belakang masalah diatas penulis tertarik melakukan penelitian dalam bentuk jurnal dengan mengangkat judul “Akibat Hukum Kesalahan Ketik Dalam Minuta Akta Notaris Berdasarkan hal tersebut, memberikan gambaran latar belakang dari penelitian ini yang membahas mengenai 1). Bagaimana tanggung jawab notaris atas kesalahan ketik pada minuta akta yang dibuat notaris? 2). Bagaimana akibat hukum terhadap kesalahan ketik pada  akta yang dibuat notaris? penelitian  menunjukan dapat menarik kesimpulan dari permasalahan yang di dapat adalah melihat dari adanya kecerobohan saat pembentukan  akta itu yang baru diketahui  setelah sekian lama dari adanya kesalahan ketik pada awalan akta tentang identitas dari para pihak, dan pada poin penting suatu akta yang tidak sesuai kehendak pihak terkait yang disebabkan karena  notaris yaitu: a. aktanya tersebut bisa dibatalkan jika aktanya itu terbukti sama sekali tidak terdapat unsur subjektif, b. aktanya dapat dikatakan batal demi hukum bilamana aktanya itu terbukti tidak mengandung syarat objektif, c. akta notaris tersebut terdegradasi jadi akta yang bersifat di bawah tangan yang sama sekali tidak mempunyai suatu kekuatan dalam hal pembuktian yang sempurna.

AbstractBackground to the problem "Alternative Dispute Resolution" (APS) is a dispute resolution agency or dissent which is resolved through an agreement procedure by the parties carried out outside the court by means of consultation, negotiation, mediation, conciliation or expert judgment. The settlement is based on good faith by ignoring litigation settlement through the District Court which takes a long time and is expensive, bound to formal procedures that must be implemented. This certainly contradicts the principle of civil procedural law "examination is as simple as possible, short time and low cost." The method used to write this article is Library Research using secondary data in the form of primary legal materials, secondary legal materials and tertiary legal materials relating to Alternative Dispute Resolution (APS). The research is normative juridical. The conclusion is that dispute resolution through alternative dispute resolution carried out in a manner that is carried out outside the court is based on good faith to reach an agreement, mutually beneficial is to realize the principle of hearing a simple "short time and low cost." Penyelesaian didasarkan itikad baik dengan mengenyampingkan penyelesaian secara litigasi melalui Pengadilan Negeri yang memakan waktu yang lama dan biaya yang mahal, terikat pada prosedur yang formal yang harus dilaksanakan. Hal ini tentu bertentangan asas hukum acara perdata “pemeriksaan sesederhana mungkin, waktu singkat dan biaya murah.” Metode yang digunakan untuk menulis artikel ini adalah Penelitian Kepustakaan dengan menggunakan data sekunder berupa bahan hukum primer, bahan hukum sekunder dan bahan hukum tertier yang berkaitan dengan Alternatif Penyelesaian Sengketa (APS). Penelitian bersifat yuridis normatif. Kesimpulannya bahwa penyelesaian sengketa melalui alternatif penyelesaian sengketa yang dilakukan dengan cara yang dilakukan di luar pengadilan didasarkan pada itikad baik untuk mencapai kesepakatan, saling menguntungkan adalah untuk mewujudkan asas pemeriksaan perkara “sederhana waktu singkat dan biaya murah.” Sedang keunggulan penyelesaian melalui Alternatif Penyelesaian Sengketa (APS) adalah pemeriksaan didasarkan kesepakatan para pihak, itikad baik, saling menguntungkan kedua belah pihak, tidak ada pihak yang kalah dan menang, mencegah permusuhan diantara para pihak dan pemeriksaan tertutup.Kata Kunci: Alternatif Penyelesaian Sengketa, Pemeriksaan “sederhana, waktu singkat dan biaya murah”

Abstract Land is the most important element for humans to be able to live, this is because  it is where natural and man-made resources grow and are also built. Indonesia regulates land ownership through this land law so that land use or management can be carried out carefully now and in the future. The land issue concerns the most basic rights of the people. The purpose of the study was to determine the consignment process in the District Court as a form of settlement of compensation for toll road land acquisition and its legal consequences. The results showed that the consignment process for compensation began with an application for consignment safekeeping, then an offer was made by the court bailiff accompanied by 2 (two) witnesses at the respondent's residence. The consignment waives the obligation as the debtor, because the consignment can be equated with making payments. All processes must be carried out in a manner that has been regulated by laws and regulations. Consignment is carried out so that government projects continue to run, through a deliberation mechanism that should be a means to find a middle way in determining the amount of compensation, often no agreement is reached. ABSTRAKDalam sistem peradilan pidana penanganan suatu kasus dimulai sejak kasus itu muncul, kemudian ditangani oleh polisi, hingga proses akhir dari penegakan hukum terletak pada putusan hakim. Putusan hakim dapat berupa menjatuhkan hukuman ataupun membebaskan seorang terdakwa. Dalam putusan hakim akan terlihat kemampuan hakim dalam mengonstruksi kasus sejak dakwaan dibacakan hingga pledoi diucapkan. Semua konstruksi hakim tersebut akan tergambar dalam pertimbangan-pertimbangan. Dalam pertimbangan tersebut akan terlihat apakah suatu putusan tersebut melanggar kode etik atau tidak. Apa yang terlihat dalam dua putusan hakim yang dikeluarkan oleh Pengadilan Negeri Tobelo, mencerminkan adanya persoalan ketika seorang terdakwa dua kali dihukum oleh majelis hakim yang sama untuk perbuatan yang sama pula. Hal inilah yang kemudian menjadi rumusan masalah, apakah putusan tersebut melanggar Kode Etik dan Pedoman Perilaku Hakim atau tidak? Dengan menggunakan metode penelitian hukum normatif yang memfokuskan kajian pada data sekunder, maka akan terlihat bagaimana sesungguhnya dua putusan tersebut. Hasil dari penelitian ini menunjukkan telah terjadi pelanggaran Kode Etik dan Pedoman Perilaku Hakim yang dilakukan oleh majelis hakim.Kata kunci: kode etik dan pedoman perilaku hakim; sistem peradilan pidana; profesionalisme.  ABSTRACT In the criminal justice system, the handling of a case starts since the claim arises, then is handled by the police, until the final process of law enforcement, which lies in the judge's decision. Judges' decisions can be in the form of sentencing or acquitting a defendant. The ability of a judge to construct a case will appear in the decision from the time the indictment is read until the plea is pronounced. In these considerations, it will be seen whether the judge's decision violates the code of ethics or not. Two judges' decisions issued by the Tobelo District Court reflect the problem in which a defendant was twice sentenced by the same panel of judges for violating the same law. This is what then becomes the formula of the problem, whether the decision violates the Code of Ethics and Code of Conduct of Judges or not. By using normative legal research method focusing on secondary data construing, it will expose the fact of these two decisions. The results of this analysis indicate that there are violations of the Code of Ethics and Code of Conduct of Judges been committed by the panel of judges examining the case. Keywords: code of ethics and code of conduct of judges; criminal justice system; professionalism.

Premarital agreements on joint property made before or during the marriage took place, the parties may determine the contents of the agreement, especially respect the innate property of each party in a premarital agreement. In Act No. 1 of 1974 About the Marriage of Article 29 paragraph (1) confirms that at the time or before the marriage took place two parties by mutual consent may submit a written agreement authorized by the employee registrar of marriage, after which it shall also apply to third parties lodged. Having made premarital agreement then the next must be registered in the district court clerk's office in legal marriages were held, the purpose of such registration in order to satisfy the principle of publicity. Background of the problem, authors conducted a study entitled "Juridical Study Of Premarital On Joint Property Which Made By Notary And Legal Consequences In The District Of Kudus". This study raises the issue of implementation of joint property on premarital agreement made by the notary in Kudus and the legal consequences of the implementation of a premarital agreement. The purpose of this study is to investigate the implementation of the agreement For Premarital of joint property made by a notary in Kudus and to know the legal consequences of a premarital agreement made by the notary. The data used in this study are primary data, secondary data and data that can support tertiary study, which was then analyzed by descriptive analysis method. Based on the results of data analysis concluded that Premarital agreements about the estate property that is made before a notary in the Kudus District by husband and wife time before or after the course of the marriage as provided for in Article 29 of Act No. 1 of 1974 About Marriage asserts that the agreement must not violate limits of the law, religion and morality. Agreement it means the contents can be related to any of any one of them the separation of joint property during the agreement was detrimental to the parties and does not conflict with the nature and purpose of marriage. The legal consequences premarital agreement made by a notary it is binding and valid as the Law for the parties.
