AbstractBackground to the problem "Alternative Dispute Resolution" (APS) is a dispute resolution agency or dissent which is resolved through an agreement procedure by the parties carried out outside the court by means of consultation, negotiation, mediation, conciliation or expert judgment. The settlement is based on good faith by ignoring litigation settlement through the District Court which takes a long time and is expensive, bound to formal procedures that must be implemented. This certainly contradicts the principle of civil procedural law "examination is as simple as possible, short time and low cost." The method used to write this article is Library Research using secondary data in the form of primary legal materials, secondary legal materials and tertiary legal materials relating to Alternative Dispute Resolution (APS). The research is normative juridical. The conclusion is that dispute resolution through alternative dispute resolution carried out in a manner that is carried out outside the court is based on good faith to reach an agreement, mutually beneficial is to realize the principle of hearing a simple "short time and low cost." While the superiority of resolution through Alternative Dispute Resolution (APS) is an examination based on the agreement of the parties, good faith, mutual benefit between the two parties, no one loses and wins, prevents hostility between the parties and closed examination.Keywords: Alternative Dispute Resolution, Examination "simple, short time and low cost"  AbstrakLatar belakang masalah Alternatif Penyelesaian Sengketa (APS) adalah lembaga penyelesaian sengketa atau beda pendapat yang diselesaikan melalui prosedur kesepakatan oleh para pihak dilakukan di luar pengadilan dengan cara konsultasi, negosiasi, mediasi, konsiliasi atau penilaian ahli. Penyelesaian didasarkan itikad baik dengan mengenyampingkan penyelesaian secara litigasi melalui Pengadilan Negeri yang memakan waktu yang lama dan biaya yang mahal, terikat pada prosedur yang formal yang harus dilaksanakan. Hal ini tentu bertentangan asas hukum acara perdata “pemeriksaan sesederhana mungkin, waktu singkat dan biaya murah.” Metode yang digunakan untuk menulis artikel ini adalah Penelitian Kepustakaan dengan menggunakan data sekunder berupa bahan hukum primer, bahan hukum sekunder dan bahan hukum tertier yang berkaitan dengan Alternatif Penyelesaian Sengketa (APS). Penelitian bersifat yuridis normatif. Kesimpulannya bahwa penyelesaian sengketa melalui alternatif penyelesaian sengketa yang dilakukan dengan cara yang dilakukan di luar pengadilan didasarkan pada itikad baik untuk mencapai kesepakatan, saling menguntungkan adalah untuk mewujudkan asas pemeriksaan perkara “sederhana waktu singkat dan biaya murah.” Sedang keunggulan penyelesaian melalui Alternatif Penyelesaian Sengketa (APS) adalah pemeriksaan didasarkan kesepakatan para pihak, itikad baik, saling menguntungkan kedua belah pihak, tidak ada pihak yang kalah dan menang, mencegah permusuhan diantara para pihak dan pemeriksaan tertutup.Kata Kunci: Alternatif Penyelesaian Sengketa, Pemeriksaan “sederhana, waktu singkat dan biaya murah”

The purpose of this research is to examine the provisions of civil procedural law in settling a lawsuit, to know the form of simple, fast, and low-cost concretization in simple lawsuit settlement. The research method uses the research object of simple, fast, and low-cost concretization in the settlement of a simple claim, normative juridical approach, the type of data used in this study is secondary data, which is sourced from the literature. Secondary data consists of primary legal materials, secondary legal materials, legal material collection techniques carried out by literature and the internet, while the data analysis method is analyzed descriptively qualitatively. The results show that the provisions of civil procedural law in resolving claims in court so far have been using the basis of HIR, which do not differentiate between complicated and simple case examinations so that the time for settlement is the same. The process starting from submitting/registering a lawsuit, determining the day of trial by the head of the panel of judges, the parties being summoned appropriately, the trial, evidence to the verdict took a long time, namely 6 months (SUPREME COURT CIRCULAR No. 6 of 1992), so the Supreme Court issued SUPREME COURT CIRCULAR No. 2 of 2014 which provides a time limit for completing the case of five (5) months. The simple, fast, and low-cost principles of concretizing a small claim court can be seen in the settlement stage. Settlement of a simple lawsuit is divided into 4 (four) stages, namely: 1), preliminary stage, 2) stage of case examination, 3). The objection request stage and 4), the simple action decision stage. This simple lawsuit settlement process should take a maximum of 25 (twenty-five) days. The simple principle is embodied in the shortened settlement process mechanism, the fast principle is realized within 25 days of completion, a peace that does not use the provisions of Supreme Court rules No.1 of 2016, while the principle of low cost is realized from a simple settlement mechanism, will be affected by the cost of the case.

Consumer Dispute Settlement Board (BPSK) , as mentioned in the Rules No. 8 Years 1999 about Consumer Protection (UUPK) which is formed by the government, is the institution that responsible for holding and resolving disputes between consumers and businesses. The basic concept of the establishment of this institution is to handle the disputes between consumers and businesses. BPSK formation is intended to overcome the vagaries of litigation that tends to have long, formal and convoluted process with the alternative dispute resolution outside the court that is based on the principle of fast, simple and low cost. This research was conducted on Consumer Dispute Settlement Board (BPSK) Kota Serang by using normative juridical approach. The author conducted a review of literature regarding consumer protection law and the settlement of consumer disputes according to consumer protection codes which were collected and classified by the record in detail, systematic and focused on literature. Furthermore, the author conducted a descriptive analysis of data, in order to obtain a complete overview of the issues regarding the settlement of consumer disputes at BPSK Kota Serang.The Results of this research conducted by the author suggest a role of BPSK Serang in solving consumer disputes according to the Law No. 8 of 1999 on Consumer Protection can be resolved in three ways, which are conciliation, mediation and arbitration on the basis of selection and consent of the parties to the dispute. Verdict forms of conciliation methods and mediation are final and binding, without having to request fiat execution to the local court, while the form of the decision taken by arbitration method has to be requested fiat execution to the local Court for the arbitration award to have the executorial power. Additionally, arbitration decision of BPSK council also still has opportunities for the objection to the District Court, counted before passing 14 (fourteen) days after the arbitration decision was notified to the parties , for the party who did not accept the decision of the BPSK’s council.

Everyone is allowed to be in conflict with legal issues that exist in civil procedural law called cases that contain both disputes and those that do not contain disputes. Disputes are indeed important to mature the way of thinking, but more importantly must be agreed. Managing disputes means fi nding the best way to resolve them. The best way to resolve disputes is by means of a win-win solution in Act No. 30 of 1999 concerning Alternative Dispute Resolution (ADR). Settlement of disputes with ADR has the highest degree because it is really fi nished, not resolved the dispute, as long as each party obeys all the results of the agreement that has been made. In Article 6 paragraph (7) of Act No. 30 of 1999 concerning Alternative Dispute Resolution (ADR), the results of the agreement must be made in written form and must be registered with the District Court. This research focuses on studying the method of registration proposed in article 6 paragraph (7). Law No. 30 of 1999. The results of this study found facts regarding the payment of the results of the agreement to the District Court does not have any legal requirements for the parties related to legal certainty, justice and benefi ts for the agreement.

Abstract Compared with space parts, consumer parts are highly functional, low cost, compact and lightweight. Therefore, their increased usage in space applications is expected. Prior testing and evaluation on space applicability are necessary because consumer parts do not have quality guarantees for space application [1]. However, in the conventional reliability evaluation method, the test takes a long time, and the problem is that the robustness of the target sample can’t be evaluated in a short time. In this report, we apply to the latest TSOP PEM (Thin Small Outline Package Plastic Encapsulated Microcircuit) an evaluation method that combines preconditioning and HALT (Highly Accelerated Limit Test), which is a test method that causes failures in a short time under very severe environmental conditions. We show that this method can evaluate the robustness of TSOP PEMs including solder connections in a short time. In addition, the validity of this evaluation method for TSOP PEM is shown by comparing with the evaluation results of thermal shock test and life test, which are conventional reliability evaluation methods.

<p>Abstract<br />This article aims to find out the recognition and enforcement of international arbitration award in Indonesia, as well as the authority of the courts in annulment the international arbitration award in Indonesia. This research is a normative and prescriptive legal research. The type and source of materials used is the source of secondary legal material. The legal substances used in this study are of two kinds, namely primary legal materials and secondary legal materials. The method of collecting legal materials in this study is obtained through assessment of existing libraries, books, law journals, and court awards. Based on the result of the discussion, it can be concluded: Firstly, the international arbitration award can be recognized and enforced if the award is registered and obtain an execution from the Central Jakarta District Court. International arbitration rulings can only be recognized and enforced if they full fil the conditions in Article 66 of Arbitration and Alternative Dispute Resolution law. Second, the international arbitration award is final and binding. Metode penelitian yang digunakan adalah penelitian hukum normatif bersifat preskriptif. Pendekatan yang digunakan penulis adalah pendekatan kasus. Sumber bahan hukum yang digunakan adalah bahan hukum primer dan bahan hukum sekunder, dengan teknik analisis bahan hukum menggunakan metode silogisme dan interpretasi dengan menggunakan pola berpikir deduktif. Berdasarkan hasil pembahasan dapat disimpulkan: Pertama, agar putusan arbitrase internasional dapat diakui dan dilaksanakan, maka putusan tersebut harus terlebih dahulu didaftarkan dan memperoleh exequatur dari Pengadilan Negeri Jakarta Pusat. Putusan arbitrase internasional hanya dapat diakui dan dilaksanakan apabila memenuhi syarat-syarat yang ditentukan dalam Pasal 66 Undang-Undang Nomor. 30 Tahun 1999 tentang Arbitrase dan Alternatif Penyelesaian Sengketa. Kedua, putusan arbitrase internasional bersifat final and binding. Sehingga, putusan arbitrase internasional tidak dapat diajukan upaya pembatalan putusan arbitrase. In principle, the resolution of consumer disputes can be pursued peacefully. through an alternative mediation dispute resolution. In Law Number 8 of 1999 concerning Consumer Protection and Regulation of the Minister of Trade of the Republic of Indonesia Number 6 / M-DAG / PER / 2017 concerning the Consumer Dispute Settlement Body does not impose limits on the authority of BPSK in handling and adjudicating a consumer dispute. However, in reality many times the decisions of the Consumer Dispute Settlement Body (BPSK) are submitted to the district court and stated that BPSK is not authorized to handle such disputes. How is the authority of the Consumer Dispute Resolution Board in handling disputes between PT. Sinar Menara Deli and Sari Alamsyah are the issues discussed. The method used in this research is descriptive normative legal research, using secondary data and primary data as supporting data with the law approach. The results of the study illustrate that BPSK is not authorized to handle disputes between PT. Sinar Menara Deli with Sari Alamsyah, because the business actors in this dispute have submitted a refusal to be resolved through BPSK and not achieving the requirements for consumer disputes. It is recommended that BPSK members pay more attention to the provisions in the Consumer Protection Act and other regulations concerning the Consumer Dispute Settlement Body.

      It is estimated that the judicial system will not be able to meet the increasingly complex needs of society. This estimate is based on facts in the field. Dispute resolution through courts is considered too convoluted, takes a long time, and is inefficient for businesses that emphasize efficiency and effectiveness. Besides, the court's decision does not satisfy the parties. The principle of simple, fast, low-cost justice is still only a slogan.      Answering this problem, a study is conducted using the empirical normative legal research method with a study approach based on statutory regulations, conceptual approaches, and case approaches. Types and sources of data used in this study are primary data and secondary data with data collection techniques through document study and interviews, where the data obtained will be analyzed qualitatively deductively. Based on the results of research and discussion, it was found that mediation as a solution to the settlement of cases, both in court and outside the court, is cooperative

<p align="center"><strong><em>Abstract</em></strong></p><p><em>The purpose of this reseach is to describe the reality of peace at investigation levels,  then compared to islah according to Islamic law as the reason of criminal removing, to find / to know the relevance. Based on the relevance, it possible become material for the legislators to formulate islah as a model of law enforcement at the level of investigation. This research is the normative research supported by empirical research. The data used was primary and secondary data. Data was collected by means of study documentation and interviews. Data were analyzed quatitatively dan and presented quatitatively. The research showed that the completion of criminal case based on the agreement between perpetrator and victim, along the case have not reached the judge. If the agreement is violated, they agreed to use the formal law. Criminal case which are resolved with peace/islah personalized and value of the loss is relatively small. Islam placing islah as an alternative the completion of criminal matters, along the case have not reached the judge. In the literature and practice, settling disputes with peace  known as Alternative Dispute Resolution (ADR), which is based on Restorative Justice Theory. Al Qur’an has set peace/islah as a model the completion of criminal matters, long before these theories arises.  Peace/ islah in the completion of a criminal case at the level of investigation relevant to satisfy the principle of fast, simple, and inexpensive.</em></p><p><strong><em>Keyword : </em></strong><em>Islah, Islamic Law, Relevance and Investigation</em></p><p align="center"><strong>Abstrak</strong></p><p>Tujuan penelitian ini adalah mendeskripsikan realitas perdamaian pada tingkat penyidikan, selanjutnya akan dibandingkan dengan islah menurut hukum Islam sebagai alasan penghapus pidana, untuk diketahui/ ditemukan relevansinya. Berdasarkan relevansi tersebut, dimungkinkan menjadi bahan bagi pembentuk undang-undang  untuk menformulasikan islah sebagai model penegakan hukum pidana pada  tingkat penyidikan. Penelitian ini merupakan penelitian normatif  yang didukung dengan penelitian  empiris. Data yang digunakan mencakup data primer dan data sekunder. Teknik pengumpulan data  dilakukan dengan cara studi dokumentasi dan wawancara. Data dianalisis secara kualitatif dan disajikan secara deskriptif. Hasil penelitian menunjukan penyelesaian perkara pidana dengan perdamaian pada tingkat penyidikan mendasarkan kesepakatan pelaku dan korban. Apabila kesepakatan itu dilanggar, mereka sepakat untuk menggunakan hukum formal. Perkara pidana yang diselesaikan dengan perdamaian/ islah, bersifat personal dan nilai kerugiannya relatif kecil. Islam menempatkan perdamaian/islah sebagai alternatif penyelesaian perkara pidana, sepanjang perkara tersebut belum sampai ke tangan hakim. Dalam literatur dan praktik,  penyelesaian perkara dengan perdamaian disebut <em>Alternative Disput Resolution </em>(ADR) yang mendasarkan pada teori <em>Restorative Justice. Al-Qur’an </em>telah menetapkan Perdamaian/ Islam sebagai model penyelesaian perkara pidana, jauh sebelum teori-teori itu muncul<em>. Perdamaian/ Islah  </em>dalam penyelesaian perkara pidana ditingkat penyidikan, relevan untuk pemenuhan asas cepat, sederhana dan biaya ringan.</p><p><strong>Kata Kunci: </strong>Islah, Hukum Islam, Relevansi dan Penyidikan</p>

Consumer dispute can be resolved by litigation and non-litigation based on agreement of the parties. Presence of the Consumer Dispute Resolution Agency (BPSK) considered as a new hope for parties because thats’s give an option to resolve consumer dispute, through BPSK it is expected that dispute can be resolved in a simple, fast, and low-cost manner. However, in fact the verdict issued by BPSK has the disadvantage of not having specificity, it caused by the article 54 point 3 of Consumer Protection Law mention that the BPSK decision is final and binding but can still be submitted for objection, even cancellation, then the absence of executorial power on the BPSK decision causes this BPSK decision to have no merit.

The research is motivated by the need for eff ective, effi cient and low-cost dispute resolution in dispute arising from electronic commerce transactions. That is because the implementation of electronic commerce transaction ha the characteristic of speed and ease, then it must also be accommodated in the process of settling the dispute. This study aims to analyze, and provide a description of the form of application principle of utilities in ODR as an alternative dispute resolution of electronic commerce user. The result of this normative legal research which uses statute and conseptual approach provide an explaination that online dispute resolution as an e-commerce alternative dispute resolution system trial has been in accordance with the principle of utilities, because to fulfi ll an element that there are in principle utilities in the analysis on law and economic.
