Abstract: Land Acquisition for public interest in Kulon Progo Regency is a procedure that must be implemented before initializing the new airport, which will replace the function of Adisutjipto airport. It facing much rejection during the process, so that it takes long time in completion. That also causing the identification and inventory process to be inhibited so that the land valuation process can’t be done perfectly. Their compensation won’t be given directly to the land owner, but through the consignment procedure that deposited at the District Court. This research is conducted by descriptive qualitative method. The results show that the assessment of the land is done well, although there is a discretionary decision, so that re-assessment is conducted in different time. The payment mechanism of compensation through consignment also done according to procedures, although the requirement of rejection letter from the party who is not eligible can’t be fulfilled, because it can be suspended due to the large interest for the land acquisition process of the new airport. Pembangunan bandara udara baru dilaksanakan melalui prosedur Pengadaan Tanah untuk Kepentingan Umum. Penolakan terhadap pembangunan bandara udara terjadi dalam kegiatan tersebut. Penelitian ini bertujuan untuk mengetahui mekanisme penilaian dan mekanisme konsinyasi terhadap bidang tanah yang mengalami penolakan oleh pihak yang berhak pada kegiatan pengadaan tanah tersebut. Jenis penelitian yang digunakan adalah penelitian deskriptif dengan pendekatan studi kasus dan pendekatan perundang-undangan. Hasil penelitian menunjukkan bahwa dalam pelaksanaan penilaian bidang tanah secara keseluruhan sudah sesuai prosedur yang ada, akan tetapi terdapat putusan diskresi terhadap bidang tanah yang sebelumnya tidak dapat dilakukan penilaian secara keseluruhan kemudian dilakukan penilaian ulang di luar waktu yang telah ditentukan. Mekanisme pembayaran ganti kerugian melalui konsinyasi sudah sesuai dengan peraturan perundang-undangan yang berlaku, hanya dalam proses permohonan registrasi konsinyasi terdapat satu syarat terkait dengan surat penolakan dari pihak yang berhak yang tidak dapat dilampirkan, hal tersebut dapat ditangguhkan mengingat besarnya kepentingan kelancaran proses pengadaan tanah pembangunan bandara udara baru ini. Abstract: The construction of Bendung Slinga in Purbalingga Regency begins with land acquisition carried out in 2009 and 2010, but the land acquisition process has not been completed in the land rights certificate, especially the object that comes from the village cash lands of Banjaran. The purpose of this research is to explain the implementation of land acquisition for Development of Bendung Slinga in Banjaran Village, Bojongsari District, Purbalingga Regency and explain the constraints faced and the solution. This research uses qualitative method with descriptive approach. The results show that the implementation of land acquisition for the construction of Bendung Slinga until the payment of compensation has been implemented in accordance with the prevailing regulations, namely Perpres 65/2006 and Perkaban 3/2007. Problems that occur is not complete the condition of the release of cash land Banjaran village which became the object of land acquisition. Terms of release that can not be fulfilled are village regulations, permission of the bupati, and permission of the governor. In addition, replacement land for disbursed village cash lands has not been fully controlled by the Banjaran Village Government and has not yet registered its land rights on behalf of the Banjaran Village Government. Intisari: Pembangunan Bendung Slinga di Kabupaten Purbalingga diawali dengan pengadaan tanah yang dilaksanakan pada tahun 2009 dan 2010, Namun proses pengadaan tanahnya belum selesai pada tahap sertipikasi hak atas tanah, terutama objek yang berasal dari Tanah Kas Desa (TKD) Banjaran. Tujuan dari penelitian ini adalah untuk menjelaskan pelaksanaan pengadaan tanah untuk pembangunan Bendung Slinga di Desa Banjaran, Kecamatan Bojongsari, Kabupaten Purbalingga dan menjelaskan kendala yang dihadapi dan solusinya. Penelitian ini menggunakan metode kualitatif dengan pendekatan deskriptif. Hasil penelitian menunjukkan bahwa pelaksanaan pengadaan tanah untuk pembangunan Bendung Slinga sampai dengan pembayaran ganti rugi telah dilaksanakan sesuai dengan peraturan yang berlaku, yaitu Perpres 65/2006 dan Perkaban 3/2007. Permasalahan yang terjadi adalah belum lengkapnya syarat pelepasan TKD Banjaran yang menjadi obyek pengadaan tanah. Syarat pelepasan yang belum dapat dipenuhi yaitu peraturan desa, izin bupati, dan izin gubernur. Selain itu, tanah pengganti untuk tanah kas desa yang dilepaskan belum sepenuhnya dikuasai oleh Pemerintah Desa Banjaran dan belum didaftarkan hak atas tanahnya atas nama Pemerintah Desa Banjaran. Land acquisition for generic interests can be made through two systems, namely the release of authority over land and cancellation of authority over land. However, the State must provide consequences in the form of compensation (consignment). This research covers the land acquisition process for public interest according to Law Number 2 of 2012, as well as to find out the procedures for depositing compensation (consignment) for public interest in court in the context of land acquisition. The research method used is normative legal research and problem approach by examining statutory regulations. The results showed that in Law no. 2 of 2012 there is a procedure for providing land which includes the process of planning, preparation, implementation and submission of results. Then, regarding the custody of compensation in court, there are 7 procedures such as the application must be submitted in writing in Indonesian, signed by the applicant and attached with supporting documents for the collector to pay the down payment through the bank, completed with applicant registration, negotiation of repayment, termination and reserve of compensation money. as well as revocation of compensation money.

Deposit of compensation at the Court which is carried out in land acquisition for the public interest is one of the solutions to accelerate the development process. The disagreement of the parties regarding compensation has made the agency managing the project use a consignment mechanism to solve this compensation problem. Therefore, this research is focused on 3 (three) main problems. First, what is the process of assessing and determining compensation for land acquisition for the construction of the Padang-Pekanbaru toll road on Jalan Padang-Sicincin? Second, what is the process of filing an objection to the determination of the form and / or amount of compensation at the Pariaman District Court? Third, how is the implementation of deposit for compensation in land acquisition for the construction of the Padang-Pekanbaru toll road on the Padang-Sicincin road? This type of research is empirical juridical legal research and to answer the above problems, this study uses primary data and secondary data. Primary data is obtained through field research, while secondary data is obtained from tracing laws and regulations and decisions of Constitutional Court judges. The data analysis was conducted in a descriptive qualitative manner. The results showed that the process of appraising and determining compensation for land acquisition was carried out starting from the process of appointing the appraisal team, the assessment of compensation by the appraisal team, deliberation, and the process of determining the compensation. The appointment of an appraisal team is determined by the Chief Executive of Land Acquisition using the direct procurement method. The appraiser makes an appraisal using the Fair Replacement Value and refers to the SPI 306 Technical Guidelines. The results of the appraisal are used as the basis for deliberations to determine compensation. The fact is that the deliberations are carried out as it should be, but the price set by the Appraiser (Appraisal) is as if only a final price that must be agreed upon by the entitled Party, even though the price recommended by the Appraisal is a price that is the price for negotiating with the community land owner. The process for filing an objection to the determination of the form and / or amount of compensation at the Pariaman District Court is in accordance with the Supreme Court Regulation No.3 of 2016 and is a form of legal protection for land rights owners. The implementation of land’s deposit compensation at the Pariaman District Court is carried out in accordance with the Supreme Court Regulation Number 3 of 2016 and in the Compensation of the Damages awaits a court process that has permanent legal force so that the money can be given to the party entitled to receive it

Notaries as one of the legal professions are not immune from mistakes that will eventually lead to a notary profession in violating the UUJN-P and the Code of Ethics and some even have the potential for punishment. Given that the role and authority of a Notary is very important in social life, the behavior and actions of a Notary in carrying out the function of authority are vulnerable to abuse that can cause harm to the community. Notaries who act outside the authority that has been determined by law can be categorized as unlawful acts. As has been tried in the Class IA Padang District Court with Decision Number 27/Pid.Sus/TPK/2016/PN-Pdg. In this case, the Notary was accused of corruption in land acquisition for Campus III of the State Islamic Institute (IAIN) Imam Bonjol Padang (now UIN Imam Bonjol). The formulation of the problem in this study are: a). What are the legal consequences for a Notary who commits a criminal act that has permanent legal force? b). What are the implications of the Notary's dismissal on the Notary Protocol? The approach used in this research is empirical juridical. This study uses primary and secondary data. Data were analyzed qualitatively. The results of the study show that: 1) The Notary was dishonorably dismissed by the Minister because it was proven legally that he had committed a criminal act of corruption which had permanent legal force, but the implementation process took a long time because it was waiting for the Minister's decision on the dismissal of the Notary. 2). With the dismissal of a Notary who commits a criminal act that has permanent legal force, the Notary Protocol must be handed over to the Notary receiving the Protocol appointed by the Minister.

ABSTRACT  Determination of fair replacement value in land acquisition for public interest in Lhokseumawe City is carried out by the appraisal team with due regard to physical values and non-physical values in accordance with Law No. 2 of 2012 and Indonesian Assessment Standards. The purpose of this article is to study the state’s efforts to guarantee the principle of transparency and implement it into land acquisition process for the sake of public interest. With normative method, this article found that the land, despite of being an object of private ownership, has a social function. Therefore, the state has an authority to regulate the utilisation and use of land for the sake of public interests through a land acquisition. In recent years, disputes due to land acquisition between the government and the land owners has always increased, resulting in the use of violence and public distrust against the government. It is believed that such the condition was triggered by  the lack of transparency as long as the land acquisitions are concerned. In order to realize agrarian justice, which is the state’s obligation, it is necessary to guarantee the principle of transparency in the land acquisition process which are the basic rights of land owners / holders and the general public. Because the principles of openness and transparency in the Land Acquisition Law are obscure in norms, it is necessary to interpret the law. The principles of openness and transparency are carried out from the planning, preparation, implementation stages to the stage of submitting the results of land acquisition. At the empirical level, it must be implemented without causing various encapsulation resulting in land acquisition disputes. The principles of openness and transparency are needed to facilitate the flow of community participation in development

<p align="center"> </p><p><em>As happened to the Notary Eli SatriaPilo, S.H, Mkn, who was appointed as the Notary who made the Deed of Relinquishment of Land Rights in the Land Acquisition activities for the Construction of Campus III of the State Islamic Institute (IAIN) of Padang which was located in Sungai Bangek District, Padang</em><em> </em><em>in 2010. The method used was descriptive, in which describing the applicable legislation associated with legal theory in the facts and realities about the Notary’s Responsibility in Making Deed of Land Acquisition for the construction of Campus III of IAIN Padang in Sungai</em><em> </em><em>Bangek. This study used a Normative Juridical approach, in which researching by using and processing secondary data or literature related to the</em><em> </em><em>study. The data collected were in the form of primary data obtained from the District Court of Padang, secondary data obtained from secondary legal materials and primary legal materials. Based on the study, it was found that the role of Notary Eli</em><em> </em><em>Satria</em><em> </em><em>Pilo, in the land acquisition of campus III IAIN was proven to have misused the authority resulting in violation of the Notary Ethics Code and was responsible for accepting termination disrespectfully. Furthermore, he was also shown to be committing a Criminal Corruption made based on the Deed of Relinquishment of Land Rights in the land acquisition for the construction of Campus III of IAIN Padang, so that the State incurred losses of Rp. 1</em><em>.</em><em>946</em><em>.</em><em>701</em><em>.</em><em>050 (one billion nine hundred forty-six million seven hundred one thousand and fifty rupiahs). And he was responsible for receiving and carrying out the sentence that had been handed down by the District Court of Padang, a prison sentence of 4 (four) years, and paying a fine of Rp. 200</em><em>.</em><em>000</em><em>.</em><em>000 (two hundred million rupiahs)</em><em>.</em></p><p> </p>

Abstract: Based on Law Number 2 of 2012 concerning Land Acquisition for Development in the Public Interest, the Openness Principle is one of the ten principles as the basis of the implementation of development. This principle is significant because its complex role can lead to conflicts and disputes. In this paper, discussions are divided into two parts: 1) how the implementation is expected to be applied according to the acquisition procedure in theory; and 2) the reality that occurs in the field. The first discussion was conducted by reviewing the applicable regulations and the methods or concepts of development of the openness principle. Meanwhile, the second discussion about the reality on the field was conducted by elaborating case studies regarding problems in land acquisition. The results of this study indicate that there are gaps in the implementation of the openness principle between theory and reality in regards of land scarcity, economic inequality, and information asymmetry among the involved parties. In conclusion, the implementation of the openness principle is significant with the role of information in land acquisition.Intisari: Berdasarkan Undang Undang Nomor 2 Tahun 2012 tentang Pengadaan Tanah Bagi Pembangunan Untuk Kepentingan Umum, Asas Keterbukaan adalah salah satu dari sepuluh asas yang menjadi dasar pelaksanaannya. Asas ini menjadi signifikan karena perannya yang kompleks dapat menimbulkan konflik dan sengketa. Artikel ini akan membagi pembahasan menjadi dua bagian: pertama, bagaimana implementasi yang seharusnya diterapkan pada prosedur pengadaan secara harapan, dan kedua, membahas mengenai realita yang terjadi di lapangan. Secara harapan pembahasan dilakukan dengan melakukan library research atau studi terhadap peraturan yang berlaku dan metode-metode atau prinsip perkembangan dari asas keterbukaan. Realitas di lapangan akan dielaborasi dari studi kasus mengenai permasalahan dalam pengadaan tanah. Hasil dari penelitian ini menunjukkan ada gap dalam implementasi asas keterbukaan antara harapan dan realitas di lapangan yang bersumber dari kelangkaan sumber daya/tanah, ketimpangan ekonomi dan asimetri informasi di antara para pihak yang terlibat. Tulisan ini menyimpulkan bahwa implementasi asas keterbukaan signifikan dengan peran informasi dalam pengadaan tanah.

Land acquisition for public purposes, including for the construction of railroad infrastructure, is a matter that is proposed by all countries in the world. The Indonesian government or the Malaysian royal government needs land for railroad infrastructure development. To realize this, a regulation was made that became the legal umbrella for the government or royal government. The people must agree to regulations that require it. Land acquisition for public use in Malaysia can be completed quickly in Indonesia. The influencing factor is the different perceptions of the understanding of what are in the public interest, history and legal systems of the two countries as well as the people's reaction from the two countries
