The essence of the principle of one-time administrative responsibility is considered, its concept and proposals for improving the provisions of the Code of Administrative Offenses of the Russian Federation are formulated. The conclusions are based on the provisions of the legislation on administrative offenses, the legal positions of the highest courts of the Russian Federation, the European Court of Human Rights, a comparative analysis of the current criminal and criminal procedure legislation. The operation of the principle non bis in idem in proceedings on the cases of administrative offenses is revealed by highlighting the material and procedural elements that make up its content.

One of the most acute problems nowadays is the prob-lem of reducing not only the rate of accidents, but also the number of injuries and deaths on the roads. The in-crease in the number of minors injured in road acci-dents, including those driving motor vehicles, causes particular concern. It is stated that bringing individuals to administrative responsibility is possible for transfer-ring control of a motor vehicle to a person who knowing-ly does not have the right to drive a motor vehicle under Part 3 of Article 12.7 of the Code of Administrative Of-fences of the Russian Federation, and also for not taking measures to prevent repeated driving vehicles by mi-nors who do not have such right, under Part 1 of Article 5.35 of the Code of Administrative Offences of the Rus-sian Federation. However, administrative responsibility and measures of administrative punishment do not pre-vent serious socially dangerous consequences from driving motor vehicles by minors who do not have this right. The present study substantiates the need to estab-lish criminal liability for failure by parents to fulfill their obligations to educate and teach minors to observe traf-fic rules, which is expressed in letting minors drive mo-tor vehicles without having this right, which resulted in serious consequences due to negligence.

В статье исследуются особенности привлечения организаций к административной ответственности по статьям 19.28 и 19.29 КоАП РФ, а также по ряду составов административных правонарушений, косвенно указывающих на наличие в них коррупционной направленности. Рассматривается проблема расширения административной ответственности организаций и лиц в случаях совершения коррупционного правонарушения от имени или в интересах юридического лица. The article examines the features of bringing organizations to administrative responsibility under Articles 19.28 and 19.29 of the Administrative Offenses Code of the Russian Federation, as well as for a number of administrative offenses that indirectly indicate the presence of corruption in them. The problem of expanding the administrative responsibility of organizations of persons in cases of committing a corruption offense on behalf of or in the interests of a legal entity is considered.

The present article is devoted to problem aspects of administrative responsibility for illegal remuneration on behalf of the organization in the Russian Federation. In the article on the base of law-enforcement practice are analyzed suggestions for improvement of legislative mechanisms of involvement organizations to responsibility for the corruption offenses made from a name or in interests of such organizations. Carrying out researches on the designated subject is provided by the National plan of corruption counteraction for 2014—2015. In Russian law-enforcement practice there are a lot of cases when the organization actively assists in criminal prosecution of the guilty person. However, judges make the organization responsible. Considering the big sizes of sanctions provided by this article, the situation is perceived as injustice and doesn´t promote achievement of the objectives of administrative responsibility. In this regard authors developed the special bases of releasing organization from responsibility in cases when governing bodies actively promote disclosure and investigation of the criminal offence made by interested person.

The article deals with theoretical approaches regarding the advisability of a full-fledged revival of administrative prejudice criminal law. On the basis of analyzing the legislative structures of crimes involving as a mandatory feature attraction of the person to administrative responsibility, and the provisions of Art. 14 of the Criminal Code of the Russian Federation concluded that the introduction of the institution is possible only if changes in approach to understanding the nature of the crime and the revision of the place of criminal law in the system of legal regulation.

The article reveals and justifies the need for radical processing and reform of administrative-tort legislation in the wake of the third wave of codification, which is one of the priority areas of state legal reform in the Russian Federation as a whole. The author gradually explores the main provisions of the General Part of the Draft Code of the Russian Federation on Administrative Offenses, revealing and exploring such basic categories of administrative-tort law as: subjects of jurisdiction of the Russian Federation in the field of administrative-tort law and the subjects of the Russian Federation in the field of administrative-tort law, on on the basis of which the author identifies the advantages and disadvantages of the Draft Code of the Russian Federation on administrative offenses yah in the regulatory settlement of these issues; actions of administrative-tort legislation in time, taking into account the main problems of law enforcement, especially regarding the issue of canceling administrative responsibility for a specific act with its simultaneous criminalization; actions of administrative-tort legislation in space; principles of legality, equality before the law, humanism, guilt, inadmissibility of repeated administrative punishment for the same administrative offense; the principle of justice and proportionality of punishment; categories of “administrative offense” and “administrative responsibility”. Based on the analysis, the author identifies the advantages and disadvantages of the Draft Code of the Russian Federation on Administrative Offenses, requiring refinement and clarification, makes its suggestions for its improvement.

The article considers some features of the integrative relationship between public administration and courts in two types of administrative-tort cases: 1) in cases of administrative offences (or otherwise - in cases of administrative-punishable torts, since the consideration and resolution of this category of administrative-tort cases essentially entails the appointment of administrative penalties according to the rules provided for by Code of the Russian Federation on Administrative Offences); 2) in cases of violations of mandatory requirements detected and suppressed by public administration bodies during control and supervisory proceedings (or otherwise - in cases of administrativeavoidable violations, since the consideration and resolution of this category is administrative-tort cases on the merits entail the application of such a measure of administrative enforcement and restorative influence as the introduction of an order to eliminate violations of mandatory requirements under the rules provided for by the legislation of the Russian Federation: 1) add Article 28.8 of the Code of the Russian Federation on Administrative Offences, providing that when drawing up a protocol on an administrative offense, the consideration of which is attributed to the competence of another body, a decision is made on the transfer of the case materials by authority (if the case is subject to consideration by a public administration body) or by jurisdiction (if the case is subject to consideration in a court of general jurisdiction); 2) as an alternative option for further improvement of the administrative-procedural legislation of the Russian Federation, the issue of applying a single algorithm of procedural actions of public administration bodies when sending materials of administrative-punishable cases to the court by filing an application with a requirement to bring to administrative responsibility, as already provided for in Chapter 25 of the Code of the Russian Federation on Administrative Offences, is proposed for discussion among scientists and legislators. And if it is necessary to transfer the materials of an administratively punishable case for consideration from one public administration body to another non-judicial body (public administration body), it is possible to provide for a ruling on the transfer of the case materials for consideration; 3) to regulate in the Code of the Russian Federation on Administrative Offences in the form of an independent chapter “Proceedings in administrative cases on the cancellation of a license and (or) permit” and provide for a single procedure for the review and resolution by the court of administrative cases of this category on administrative claims of public administration bodies.


The authors reflect on the prospects of reforming the administrative-tort legislation. It is emphasized that the conceptual issues of administrative-tort law should be solved before the adoption of a new Code of Administrative Offenses (Administrative Responsibility) of the Russian Federation; otherwise, the current problems of the administrative-tort legislation, in particular its great variability, will not disappear. The authors conclude that it is necessary to combat actively the prevailing practice of introducing numerous unsystematic changes to the Code of Administrative Offenses of the Russian Federation.

В статье кратко рассмотрены перспективы реформы отечественного законодательства об административной ответственности, озвученные в докладе на круглом столе «Законодательство об административной ответственности: современное состояние, перспективы развития», состоявшемся в Дальневосточном федеральном университете 9 апреля 2019 г. Кодекс Российской Федерации об административной ответственности претерпел на 2019 г. уже более 3000 изменений (правок), а нормы об административной ответственности на сегодня содержатся в большом количестве федеральных законов, сам Кодекс содержит большое количество бланкетных норм, а правоприменители отличаются слабыми знаниями законодательства, что в совокупности затрудняет правоохранительную функцию законодательства об административной ответственности. Автором на основе материалов судебной и правоприменительной практики предлагается внесение в концепцию реформы законодательства об административной ответственности инициатив по введению специального общественного квалификационного экзамена для правоприменителей законодательства об административной ответственности; установлению строгой категории вины юридического лица и вины должностного лица, учитывающей избежание наказания двух лиц за совершение одного административного проступка; либерализации административной ответственности по административным проступкам, совершённым впервые, вплоть до ограничения такой ответственности замечанием. Автор убеждён, что реформа федерального и регионального законодательства об административной ответственности в Российской Федерации должна носить комплексный характер и должна быть направлена не на карательную функцию норм, а на правоохранительную, с целью избежания злоупотребления правоприменителями своими полномочиями и создания условий для нормализации функционирования коммерческих и некоммерческих организаций в Российской Федерации, повышения уровня защищенности бизнес-климата в стране. The article reviews the prospects of reforming the legislation on administrative responsibility based on the round table report “Legislation on administrative re-sponsibility: modern state, development prospects” in the Far Eastern Federal University on April 9, 2019. As of 2019, over 3000 changes (amendments) had been introduced into the Russian Federation Code on administrative responsibility; administrative responsibility norms can nowadays be found in many federal laws; the Code contains a lot of blanket norms; law enforcers have an insufficient knowledge of the legislation thus hindering the law-enforcing function of the legislation on administrative responsibility. Based on the material of court and law-enforcement practices, it is suggested to introduce the initiatives on implementing a special public qualifying examination of the law-enforcers for the legislation of administrative responsibility, strict categories of the corporate body’s guilt and office holder’s guilt that would avoid punishing two people for committing the same administrative offence, liberalization of administrative responsibility on administrative offences committed first time including reducing this responsibility to admonition. The author of the article is sure that reforming the federal and regional legislations on administrative responsibility in the Russian Federation has to be complex and switch its function from punishment to preventing the law enforcers from misusing their authority; it also has to create the conditions for normalizing the functioning of commercial and noncommercial organizations in the Russian Federation and increase the level of business climate protection in the country.
